一、機(ji)動車(che)自動駕駛技術(shu)
自(zi)(zi)動(dong)駕(jia)駛技(ji)(ji)術(shu)(shu)是(shi)實(shi)(shi)用(yong)前(qian)景(jing)最為廣闊、同時(shi)對公共安(an)全影響(xiang)最大的(de)人工智能技(ji)(ji)術(shu)(shu)之一(yi)。隨著5G通信的(de)廣泛覆蓋,依(yi)賴大量高靈(ling)敏度傳感器與高速(su)信號(hao)傳輸(shu)的(de)自(zi)(zi)動(dong)駕(jia)駛技(ji)(ji)術(shu)(shu),必將加快其走向實(shi)(shi)用(yong)化(hua)的(de)腳步。當自(zi)(zi)動(dong)駕(jia)駛汽車大量走上道路,一(yi)旦因(yin)為自(zi)(zi)動(dong)駕(jia)駛汽車的(de)原因(yin)發生重大交通事(shi)故(gu),可否追究(jiu)有關主體的(de)刑(xing)事(shi)責(ze)任?筆者認為,以下幾點應當重點予以考慮:
(一(yi))必須(xu)(xu)堅持責(ze)任主(zhu)義原則[2]。責(ze)任主(zhu)義原則是(shi)刑(xing)(xing)(xing)(xing)(xing)法(fa)(fa)不(bu)可(ke)(ke)突破(po)的(de)(de)重(zhong)要(yao)(yao)(yao)(yao)原則之一(yi),“無(wu)罪(zui)(zui)過(guo)則無(wu)責(ze)任”作(zuo)為(wei)(wei)(wei)責(ze)任主(zhu)義的(de)(de)重(zhong)要(yao)(yao)(yao)(yao)體現(xian)(xian)(xian),不(bu)允許存在例外(wai)。自(zi)動駕駛技術的(de)(de)發展及大量(liang)運用,必將(jiang)(jiang)(jiang)更(geng)加(jia)突出地(di)展現(xian)(xian)(xian)當(dang)(dang)代“風(feng)險社會”的(de)(de)特點。可(ke)(ke)以(yi)(yi)預(yu)(yu)見(jian),有關“風(feng)險刑(xing)(xing)(xing)(xing)(xing)法(fa)(fa)”的(de)(de)觀點將(jiang)(jiang)(jiang)被更(geng)廣泛提及。筆者(zhe)以(yi)(yi)為(wei)(wei)(wei),在這樣的(de)(de)背景(jing)之下,堅持責(ze)任主(zhu)義原則尤為(wei)(wei)(wei)重(zhong)要(yao)(yao)(yao)(yao)。刑(xing)(xing)(xing)(xing)(xing)法(fa)(fa)需(xu)(xu)要(yao)(yao)(yao)(yao)對風(feng)險社會有所回應,需(xu)(xu)要(yao)(yao)(yao)(yao)承擔起防(fang)范(fan)風(feng)險的(de)(de)重(zhong)要(yao)(yao)(yao)(yao)責(ze)任,甚(shen)至需(xu)(xu)要(yao)(yao)(yao)(yao)將(jiang)(jiang)(jiang)行為(wei)(wei)(wei)的(de)(de)范(fan)疇進行擴展,將(jiang)(jiang)(jiang)犯罪(zui)(zui)標準適當(dang)(dang)前移,這些都無(wu)可(ke)(ke)非議;但(dan)是(shi)如果以(yi)(yi)“風(feng)險社會”需(xu)(xu)要(yao)(yao)(yao)(yao)“風(feng)險刑(xing)(xing)(xing)(xing)(xing)法(fa)(fa)”為(wei)(wei)(wei)理由,主(zhu)張(zhang)“嚴(yan)格責(ze)任”“無(wu)罪(zui)(zui)過(guo)責(ze)任”,去突破(po)責(ze)任主(zhu)義原則的(de)(de)底線,則既有違(wei)刑(xing)(xing)(xing)(xing)(xing)法(fa)(fa)的(de)(de)謙(qian)抑性,也無(wu)助于刑(xing)(xing)(xing)(xing)(xing)罰(fa)目的(de)(de)的(de)(de)實現(xian)(xian)(xian)。過(guo)分地(di)擴張(zhang)犯罪(zui)(zui)圈,只(zhi)能(neng)混淆刑(xing)(xing)(xing)(xing)(xing)法(fa)(fa)與侵(qin)權法(fa)(fa)的(de)(de)界限。因而(er),對于自(zi)動駕駛車(che)(che)輛導致(zhi)的(de)(de)重(zhong)大交通(tong)事(shi)故(gu)追究刑(xing)(xing)(xing)(xing)(xing)事(shi)責(ze)任,也必須(xu)(xu)以(yi)(yi)有關主(zhu)體存在罪(zui)(zui)過(guo)(主(zhu)要(yao)(yao)(yao)(yao)是(shi)過(guo)失(shi))為(wei)(wei)(wei)要(yao)(yao)(yao)(yao)件。這一(yi)過(guo)失(shi),將(jiang)(jiang)(jiang)主(zhu)要(yao)(yao)(yao)(yao)體現(xian)(xian)(xian)在車(che)(che)輛的(de)(de)制造者(zhe)、管理者(zhe)、交通(tong)設施的(de)(de)運營者(zhe)、管理者(zhe)身上,表現(xian)(xian)(xian)為(wei)(wei)(wei):車(che)(che)輛的(de)(de)制造者(zhe)應當(dang)(dang)預(yu)(yu)見(jian)到其生產的(de)(de)車(che)(che)輛尚不(bu)足以(yi)(yi)保(bao)證安全、可(ke)(ke)靠地(di)上路(lu)行駛,一(yi)旦(dan)大量(liang)上路(lu)運行,將(jiang)(jiang)(jiang)可(ke)(ke)能(neng)發生重(zhong)大交通(tong)事(shi)故(gu),但(dan)因疏忽大意未能(neng)預(yu)(yu)見(jian),或者(zhe)雖然已經預(yu)(yu)見(jian)但(dan)輕(qing)信能(neng)夠避免,因而(er)導致(zhi)重(zhong)大事(shi)故(gu)的(de)(de)發生。車(che)(che)輛的(de)(de)管理者(zhe),交通(tong)設施的(de)(de)維護者(zhe)、管理者(zhe)的(de)(de)過(guo)失(shi)也基本(ben)類似。

突(tu)發(fa)(fa)的(de)(de)疫(yi)(yi)情(qing)(qing)使社會各行業遭受(shou)(shou)重創,作(zuo)為教育期刊(kan),短期內受(shou)(shou)疫(yi)(yi)情(qing)(qing)影(ying)響看(kan)似有限,但(dan)是,我們(men)應該(gai)清楚地(di)認識到(dao),疫(yi)(yi)情(qing)(qing)持續(xu)過程(cheng)中(zhong),在(zai)線教育、人工智能(neng)已在(zai)重塑和影(ying)響著全世界數以億計人的(de)(de)學習方(fang)式、閱讀方(fang)式。后(hou)(hou)疫(yi)(yi)情(qing)(qing)時(shi)(shi)代到(dao)來,傳(chuan)統教育期刊(kan)出版單位不僅(jin)面(mian)臨著媒體發(fa)(fa)展(zhan)環境、發(fa)(fa)展(zhan)趨勢、發(fa)(fa)展(zhan)方(fang)式的(de)(de)變化,更(geng)面(mian)臨著疫(yi)(yi)情(qing)(qing)后(hou)(hou)教育信(xin)息化的(de)(de)快速發(fa)(fa)展(zhan),尤其(qi)人工智能(neng)技術對(dui)于師生在(zai)閱讀方(fang)式、教育教學方(fang)式方(fang)面(mian)產生的(de)(de)深刻改(gai)變和影(ying)響。我們(men)不但(dan)要看(kan)到(dao)短期內傳(chuan)統期刊(kan)出版經營受(shou)(shou)到(dao)的(de)(de)直接影(ying)響,更(geng)要研究(jiu)后(hou)(hou)疫(yi)(yi)情(qing)(qing)時(shi)(shi)代決定(ding)教育期刊(kan)未來發(fa)(fa)展(zhan)的(de)(de)顛覆性力量。
一(yi)、疫情影響下的傳統(tong)教育出版發(fa)展狀(zhuang)況
(一)傳統教育出版(ban)遭受(shou)重創
教(jiao)育(yu)(yu)(yu)出版(ban)(ban)業(ye)在疫情發(fa)生(sheng)之后,從內(nei)容創(chuang)作到生(sheng)產(chan)印(yin)制,到線下(xia)(xia)(xia)發(fa)行(xing)銷(xiao)(xiao)售,各(ge)個環節都受到不同程度的(de)沖擊,疫情對(dui)實(shi)體書(shu)店(dian)、書(shu)展(zhan)沖擊巨大,出版(ban)(ban)社整體圖書(shu)銷(xiao)(xiao)售降(jiang)幅達到二(er)至五成。疫情期(qi)(qi)間全(quan)國(guo)有90.7%的(de)實(shi)體書(shu)店(dian)被(bei)迫停業(ye),全(quan)國(guo)實(shi)體書(shu)店(dian)的(de)收入比去年(nian)同期(qi)(qi)下(xia)(xia)(xia)降(jiang)85%-95%。[1]各(ge)家出版(ban)(ban)單位聚(ju)焦抗疫主題(ti)出版(ban)(ban)的(de)公益性(xing)出版(ban)(ban)物,社會效益為先,經濟(ji)效益基本忽略不計。面向教(jiao)育(yu)(yu)(yu)系(xi)統出版(ban)(ban)發(fa)行(xing)的(de)教(jiao)育(yu)(yu)(yu)類期(qi)(qi)刊,因疫情防(fang)控和去年(nian)上半年(nian)延(yan)遲(chi)開學等(deng)因素影(ying)響,征訂發(fa)行(xing)普(pu)遍出現下(xia)(xia)(xia)滑,以(yi)江蘇教(jiao)育(yu)(yu)(yu)報刊總社出版(ban)(ban)的(de)教(jiao)育(yu)(yu)(yu)教(jiao)學類期(qi)(qi)刊為例,2020年(nian)同期(qi)(qi)發(fa)行(xing)量下(xia)(xia)(xia)降(jiang)近(jin)20%。
(二)教育出(chu)版數字化轉型“被加速(su)”

1引言
近(jin)年來,伴隨(sui)著(zhu)信息技(ji)術(shu)的發(fa)展,人(ren)工(gong)智(zhi)(zhi)能的應用(yong)(yong)無處不在(zai),包含金融、影像(xiang)、自(zi)動(dong)駕駛、醫療等各(ge)個領域,使得諸(zhu)多行業能夠簡(jian)化工(gong)作(zuo)流程、降(jiang)低投入、加快工(gong)作(zuo)效率(lv),為(wei)行業的健康發(fa)展帶來深遠的影響。隨(sui)著(zhu)相關技(ji)術(shu)的不斷(duan)成熟,人(ren)工(gong)智(zhi)(zhi)能也開始應用(yong)(yong)于建(jian)筑設計、場地(di)設計之中(zhong),“小(xiao)庫(ku)(ku)xkool”就是將人(ren)工(gong)智(zhi)(zhi)能技(ji)術(shu)運用(yong)(yong)到建(jian)筑設計中(zhong)的開始[1]。本文以“小(xiao)庫(ku)(ku)xkool”人(ren)工(gong)智(zhi)(zhi)能建(jian)筑師為(wei)例,探討人(ren)工(gong)智(zhi)(zhi)能技(ji)術(shu)在(zai)建(jian)筑設計中(zhong)的應用(yong)(yong)。
