加快建立法治政府
《國務(wu)院關于*年深化(hua)經(jing)濟體制改革的(de)(de)(de)(de)意見》要(yao)(yao)(yao)求(qiu),全(quan)(quan)(quan)面推行(xing)(xing)依(yi)法行(xing)(xing)政(zheng)(zheng)(zheng)(zheng),認真貫(guan)徹(che)執行(xing)(xing)《行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)許可(ke)法》和(he)(he)《全(quan)(quan)(quan)面推進(jin)依(yi)法行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)實(shi)施(shi)(shi)綱(gang)(gang)要(yao)(yao)(yao)》,加快建立(li)法治(zhi)政(zheng)(zheng)(zheng)(zheng)府(fu)。國務(wu)院《全(quan)(quan)(quan)面推進(jin)依(yi)法行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)實(shi)施(shi)(shi)綱(gang)(gang)要(yao)(yao)(yao)》(以下(xia)簡稱《綱(gang)(gang)要(yao)(yao)(yao)》)頒布一(yi)年來,貫(guan)徹(che)落實(shi)工作取得了(le)(le)顯(xian)著成效:法治(zhi)政(zheng)(zheng)(zheng)(zheng)府(fu)的(de)(de)(de)(de)目標全(quan)(quan)(quan)面確(que)立(li);各(ge)地(di)方(fang)、各(ge)部(bu)門(men)全(quan)(quan)(quan)面推進(jin)依(yi)法行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)的(de)(de)(de)(de)辦法和(he)(he)措施(shi)(shi)紛紛出臺(tai);以實(shi)施(shi)(shi)《行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)許可(ke)法》、改革行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)審(shen)批制度以及加強監(jian)察、審(shen)計(ji)監(jian)督為突(tu)破(po)口,進(jin)一(yi)步健全(quan)(quan)(quan)了(le)(le)事(shi)(shi)前、事(shi)(shi)中(zhong)和(he)(he)事(shi)(shi)后對行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)權力進(jin)行(xing)(xing)全(quan)(quan)(quan)方(fang)位、全(quan)(quan)(quan)過(guo)程制約與監(jian)督的(de)(de)(de)(de)機(ji)制;各(ge)級政(zheng)(zheng)(zheng)(zheng)府(fu)和(he)(he)廣大公(gong)務(wu)員(yuan)依(yi)法行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)的(de)(de)(de)(de)意識明顯(xian)提高;依(yi)法行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)在(zai)(zai)構建社(she)會(hui)主(zhu)義和(he)(he)諧社(she)會(hui)中(zhong)的(de)(de)(de)(de)基(ji)礎性(xing)作用更加凸(tu)顯(xian)。但我們也必須(xu)清醒地(di)看到,如何將《綱(gang)(gang)要(yao)(yao)(yao)》從綱(gang)(gang)領(ling)性(xing)的(de)(de)(de)(de)文(wen)件轉(zhuan)(zhuan)化(hua)為制度性(xing)的(de)(de)(de)(de)實(shi)踐,從書面上的(de)(de)(de)(de)條文(wen)轉(zhuan)(zhuan)化(hua)為法治(zhi)化(hua)的(de)(de)(de)(de)行(xing)(xing)為,從對政(zheng)(zheng)(zheng)(zheng)府(fu)的(de)(de)(de)(de)外在(zai)(zai)規(gui)范要(yao)(yao)(yao)求(qiu)轉(zhuan)(zhuan)化(hua)為公(gong)務(wu)員(yuan)的(de)(de)(de)(de)內(nei)在(zai)(zai)價值追求(qiu),仍然(ran)任(ren)重而道遠(yuan)。建設法治(zhi)政(zheng)(zheng)(zheng)(zheng)府(fu),需要(yao)(yao)(yao)我們根(gen)據各(ge)地(di)區(qu)、各(ge)部(bu)門(men)依(yi)法行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)的(de)(de)(de)(de)發(fa)展現(xian)狀、突(tu)出矛盾和(he)(he)主(zhu)要(yao)(yao)(yao)問題,有(you)計(ji)劃、有(you)步驟地(di)整體推進(jin)和(he)(he)重點突(tu)破(po)。要(yao)(yao)(yao)從我做(zuo)起(qi),從現(xian)在(zai)(zai)做(zuo)起(qi),花(hua)大力氣,下(xia)真功夫(fu),真正把(ba)《綱(gang)(gang)要(yao)(yao)(yao)》貫(guan)徹(che)到位、實(shi)施(shi)(shi)到底。
以轉變政府職能和深化行政管(guan)理體制改(gai)革為(wei)動力(li),不斷完善依法行政的體制
科學的(de)(de)(de)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)職(zhi)(zhi)(zhi)能(neng)(neng)配置(zhi)(zhi)和(he)(he)完善的(de)(de)(de)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)管(guan)(guan)(guan)理(li)(li)(li)(li)體(ti)(ti)制(zhi)(zhi)是(shi)推進(jin)依(yi)法(fa)(fa)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)的(de)(de)(de)基礎(chu)和(he)(he)前提。改(gai)革(ge)開(kai)放20多年來,我(wo)國雖然在轉變政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)職(zhi)(zhi)(zhi)能(neng)(neng)和(he)(he)改(gai)革(ge)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)管(guan)(guan)(guan)理(li)(li)(li)(li)體(ti)(ti)制(zhi)(zhi)上取得(de)了重大(da)成(cheng)效,但(dan)目前政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)職(zhi)(zhi)(zhi)能(neng)(neng)配置(zhi)(zhi)和(he)(he)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)管(guan)(guan)(guan)理(li)(li)(li)(li)體(ti)(ti)制(zhi)(zhi)與依(yi)法(fa)(fa)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)的(de)(de)(de)要(yao)(yao)求(qiu)還不完全適應(ying),從(cong)(cong)全能(neng)(neng)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)向有(you)限(xian)(xian)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)、從(cong)(cong)管(guan)(guan)(guan)制(zhi)(zhi)型政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)向服(fu)務型政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)、從(cong)(cong)權力(li)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)向責任政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)的(de)(de)(de)轉變還沒(mei)有(you)全面(mian)完成(cheng)。《綱要(yao)(yao)》把轉變政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)職(zhi)(zhi)(zhi)能(neng)(neng)和(he)(he)深化行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)管(guan)(guan)(guan)理(li)(li)(li)(li)體(ti)(ti)制(zhi)(zhi)改(gai)革(ge)作(zuo)為推進(jin)依(yi)法(fa)(fa)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)的(de)(de)(de)切(qie)入點和(he)(he)第一個環節(jie)(jie),充分(fen)體(ti)(ti)現了它在建(jian)設(she)法(fa)(fa)治政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)中(zhong)的(de)(de)(de)先(xian)導(dao)性地位(wei)。當前,推進(jin)法(fa)(fa)治政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)建(jian)設(she),首(shou)先(xian)要(yao)(yao)求(qiu)我(wo)們以進(jin)一步轉變政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)職(zhi)(zhi)(zhi)能(neng)(neng)和(he)(he)深化行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)管(guan)(guan)(guan)理(li)(li)(li)(li)體(ti)(ti)制(zhi)(zhi)改(gai)革(ge)為動力(li),不斷改(gai)革(ge)和(he)(he)完善依(yi)法(fa)(fa)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)的(de)(de)(de)體(ti)(ti)制(zhi)(zhi)。體(ti)(ti)制(zhi)(zhi)不完善,法(fa)(fa)治政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)的(de)(de)(de)建(jian)設(she)就沒(mei)有(you)健全的(de)(de)(de)框架,依(yi)法(fa)(fa)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)的(de)(de)(de)推進(jin)就沒(mei)有(you)堅實的(de)(de)(de)基礎(chu)。因此,一方(fang)面(mian),應(ying)依(yi)法(fa)(fa)界定和(he)(he)規范(fan)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)的(de)(de)(de)經濟調節(jie)(jie)、市(shi)場(chang)(chang)監管(guan)(guan)(guan)、社會(hui)(hui)管(guan)(guan)(guan)理(li)(li)(li)(li)和(he)(he)公共服(fu)務四(si)項基本職(zhi)(zhi)(zhi)能(neng)(neng),明確劃分(fen)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)與市(shi)場(chang)(chang)、政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)與社會(hui)(hui)的(de)(de)(de)界限(xian)(xian),堅持(chi)凡是(shi)老百(bai)姓能(neng)(neng)夠(gou)自(zi)己解決的(de)(de)(de)、市(shi)場(chang)(chang)競爭機制(zhi)(zhi)能(neng)(neng)夠(gou)自(zi)行(xing)(xing)調節(jie)(jie)的(de)(de)(de)和(he)(he)社會(hui)(hui)組織(zhi)能(neng)(neng)夠(gou)自(zi)我(wo)管(guan)(guan)(guan)理(li)(li)(li)(li)的(de)(de)(de),政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)就不必(bi)也(ye)不應(ying)當干預;另一方(fang)面(mian),應(ying)合理(li)(li)(li)(li)劃分(fen)和(he)(he)依(yi)法(fa)(fa)規范(fan)各(ge)(ge)級、各(ge)(ge)類(lei)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)機關的(de)(de)(de)職(zhi)(zhi)(zhi)能(neng)(neng)和(he)(he)權限(xian)(xian),合理(li)(li)(li)(li)設(she)置(zhi)(zhi)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)機構(gou),嚴(yan)格(ge)控制(zhi)(zhi)人(ren)員編制(zhi)(zhi),大(da)力(li)改(gai)革(ge)管(guan)(guan)(guan)理(li)(li)(li)(li)方(fang)式,全面(mian)推進(jin)信(xin)息公開(kai),努力(li)形(xing)成(cheng)行(xing)(xing)為規范(fan)、運轉協調、公正(zheng)透明、廉潔高效的(de)(de)(de)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)管(guan)(guan)(guan)理(li)(li)(li)(li)體(ti)(ti)制(zhi)(zhi)。

法治政府形成體制
全面推進依法(fa)(fa)行(xing)(xing)政(zheng),加快建設法(fa)(fa)治政(zheng)府,是落實黨的(de)(de)(de)(de)十(shi)七大(da)“加快建設社會(hui)主義法(fa)(fa)治國家”的(de)(de)(de)(de)重(zhong)中之(zhi)重(zhong)。國務院《全面推進依法(fa)(fa)行(xing)(xing)政(zheng)實施綱要》(以下簡(jian)稱《綱要》)實施7年來,我(wo)國依法(fa)(fa)行(xing)(xing)政(zheng)工(gong)(gong)作已經站在一個新(xin)(xin)的(de)(de)(de)(de)歷史起點上,如(ru)何深入(ru)推進依法(fa)(fa)行(xing)(xing)政(zheng),加快建設法(fa)(fa)治政(zheng)府,如(ru)何從(cong)體制機制上找準抓手和平臺,是新(xin)(xin)時期(qi)依法(fa)(fa)行(xing)(xing)政(zheng)工(gong)(gong)作面臨和必須解決的(de)(de)(de)(de)重(zhong)大(da)課(ke)題。
一、我國建設法(fa)治(zhi)政府的成就與困(kun)境
1.建設成就
我國(guo)在(zai)推(tui)進依法(fa)(fa)(fa)行(xing)政(zheng)(zheng)(zheng)的征程(cheng)上,不(bu)斷(duan)探索與創新,政(zheng)(zheng)(zheng)府法(fa)(fa)(fa)制(zhi)(zhi)(zhi)工(gong)作從無到有,不(bu)斷(duan)規(gui)范與完善,尤其是(shi)在(zai)《綱要(yao)》頒布實(shi)施以(yi)后,法(fa)(fa)(fa)治政(zheng)(zheng)(zheng)府建(jian)設邁(mai)出了堅實(shi)步(bu)(bu)伐,依法(fa)(fa)(fa)行(xing)政(zheng)(zheng)(zheng)工(gong)作取得了明(ming)顯成(cheng)效:依法(fa)(fa)(fa)行(xing)政(zheng)(zheng)(zheng)意識和水平不(bu)斷(duan)提(ti)高;行(xing)政(zheng)(zheng)(zheng)決策機制(zhi)(zhi)(zhi)日漸(jian)完善;政(zheng)(zheng)(zheng)府立法(fa)(fa)(fa)工(gong)作從粗到細,逐(zhu)(zhu)(zhu)步(bu)(bu)覆蓋(gai)政(zheng)(zheng)(zheng)府工(gong)作的方方面面;行(xing)政(zheng)(zheng)(zheng)執法(fa)(fa)(fa)行(xing)為逐(zhu)(zhu)(zhu)步(bu)(bu)規(gui)范;有效防范和化解社(she)會矛盾機制(zhi)(zhi)(zhi)逐(zhu)(zhu)(zhu)漸(jian)形成(cheng);政(zheng)(zheng)(zheng)府法(fa)(fa)(fa)制(zhi)(zhi)(zhi)監督工(gong)作由(you)弱(ruo)到強,有力地保(bao)證了憲法(fa)(fa)(fa)、法(fa)(fa)(fa)律、法(fa)(fa)(fa)規(gui)在(zai)本行(xing)政(zheng)(zheng)(zheng)區域內的有效實(shi)施。應該(gai)說,我國(guo)依法(fa)(fa)(fa)行(xing)政(zheng)(zheng)(zheng)、建(jian)設法(fa)(fa)(fa)治政(zheng)(zheng)(zheng)府工(gong)作目前(qian)已經躍上了一(yi)個新的臺階,也(ye)是(shi)到了一(yi)個非(fei)常關鍵(jian)的時(shi)期(qi)。
2.現實困境
雖然我國(guo)在(zai)建(jian)(jian)設(she)法(fa)(fa)治(zhi)政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)的(de)(de)(de)征程上(shang)已經取得了巨大成就(jiu),但仍然存在(zai)一些突(tu)(tu)出問題(ti),具體表現在(zai):推進(jin)(jin)依(yi)(yi)法(fa)(fa)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng),建(jian)(jian)設(she)法(fa)(fa)治(zhi)政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)的(de)(de)(de)體制(zhi)(zhi)(zhi)機(ji)(ji)制(zhi)(zhi)(zhi)不(bu)成熟、不(bu)健全,推進(jin)(jin)力(li)度不(bu)穩定。實際工(gong)作(zuo)中(zhong)“概念法(fa)(fa)治(zhi)”、“形式法(fa)(fa)治(zhi)”和“兩張皮(pi)”現象比(bi)(bi)較(jiao)突(tu)(tu)出;建(jian)(jian)設(she)法(fa)(fa)治(zhi)政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)的(de)(de)(de)推進(jin)(jin)動(dong)力(li)單一,主(zhu)要依(yi)(yi)賴于“人”的(de)(de)(de)自(zi)覺性,存在(zai)以(yi)“人治(zhi)”推動(dong)“法(fa)(fa)治(zhi)”的(de)(de)(de)特殊現象;法(fa)(fa)律制(zhi)(zhi)(zhi)度在(zai)保(bao)障全面(mian)(mian)協調可持續發(fa)展(zhan)上(shang)相對(dui)滯后,立(li)法(fa)(fa)與改革的(de)(de)(de)關系不(bu)夠銜(xian)接;以(yi)人為(wei)本和保(bao)障民生(sheng)方面(mian)(mian)的(de)(de)(de)制(zhi)(zhi)(zhi)度建(jian)(jian)設(she)跟不(bu)上(shang)形勢發(fa)展(zhan)的(de)(de)(de)要求,部(bu)門利益的(de)(de)(de)傾向仍然比(bi)(bi)較(jiao)突(tu)(tu)出;行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)管(guan)理體制(zhi)(zhi)(zhi)改革和政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)職能轉變(bian)不(bu)到(dao)(dao)位,職能缺位、越位和不(bu)到(dao)(dao)位的(de)(de)(de)情況仍然突(tu)(tu)出;行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)自(zi)由裁量權過(guo)大,執(zhi)法(fa)(fa)行(xing)(xing)(xing)(xing)為(wei)不(bu)規范的(de)(de)(de)情況仍然突(tu)(tu)出,行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)執(zhi)法(fa)(fa)責任制(zhi)(zhi)(zhi)的(de)(de)(de)落實不(bu)理想。有(you)的(de)(de)(de)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)機(ji)(ji)關對(dui)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)執(zhi)法(fa)(fa)有(you)畏難(nan)情緒,對(dui)依(yi)(yi)法(fa)(fa)履職底氣不(bu)足,被(bei)動(dong)作(zuo)為(wei)的(de)(de)(de)情況比(bi)(bi)較(jiao)突(tu)(tu)出;政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)法(fa)(fa)制(zhi)(zhi)(zhi)工(gong)作(zuo)還(huan)比(bi)(bi)較(jiao)被(bei)動(dong),服務(wu)大局的(de)(de)(de)思路和辦法(fa)(fa)還(huan)不(bu)多,能力(li)還(huan)不(bu)強(qiang)。機(ji)(ji)構建(jian)(jian)設(she)欠賬(zhang)太多,與日(ri)益繁重(zhong)的(de)(de)(de)工(gong)作(zuo)任務(wu)很不(bu)適應,嚴重(zhong)制(zhi)(zhi)(zhi)約了政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)法(fa)(fa)制(zhi)(zhi)(zhi)工(gong)作(zuo)的(de)(de)(de)正常開展(zhan)。這樣的(de)(de)(de)狀(zhuang)況,很難(nan)擔當起繁重(zhong)的(de)(de)(de)依(yi)(yi)法(fa)(fa)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)的(de)(de)(de)工(gong)作(zuo)任務(wu)。
建設法治政府思考
依法行政(zheng)(zheng),建(jian)設法治政(zheng)(zheng)府(fu),是發(fa)展社會主義市場(chang)經濟的必(bi)然要求,市場(chang)實(shi)質上就是法治經濟體(ti)制,必(bi)須實(shi)行依法行政(zheng)(zheng),建(jian)設法治政(zheng)(zheng)府(fu),尤其要全面(mian)實(shi)施(shi)《行政(zheng)(zheng)許可法》,大力推進(jin)依法行政(zheng)(zheng)。
一(yi)、發展(zhan)社會主義(yi)市場經濟必須推進依法(fa)行政
根據現(xian)代經濟(ji)(ji)理論對市(shi)場(chang)經濟(ji)(ji)的主要(yao)概括,從國內外市(shi)場(chang)經濟(ji)(ji)發展的歷史和現(xian)實考察市(shi)場(chang),市(shi)場(chang)經濟(ji)(ji)應具有以下幾個(ge)共(gong)性標(biao)準:
1、政府行為是否規范(fan)化(hua)。主要看資料由政府配(pei)(pei)置還(huan)是市(shi)場配(pei)(pei)置?資源的使用和定(ding)價是市(shi)場決(jue)定(ding)還(huan)是政府決(jue)定(ding)?政府是否尊重和保護經濟(ji)主體(ti)在(zai)經濟(ji)方面的自主權利,是否對企業有不(bu)公(gong)平的對待?這些問題即是政府作(zuo)(zuo)用問題,更確(que)切地講(jiang),是市(shi)場經濟(ji)中的政府作(zuo)(zuo)用與企業、公(gong)民(min)、社會(hui)組(zu)織(zhi)的關系問題。
2、經濟主(zhu)體(ti)是否自由(you)化。主(zhu)要看企業在產銷活動中(zhong),行為是市場化的還(huan)是行政化的?本質上講(jiang),這一條要害是講(jiang)企業權(quan)利和行為。
3、生產(chan)要素(su)是(shi)(shi)否市場(chang)化。即企業投入方面的(de)(de)生產(chan)要素(su)如原(yuan)材(cai)料價格(ge)、勞動力工資等是(shi)(shi)否是(shi)(shi)市場(chang)價格(ge),其(qi)成(cheng)(cheng)本的(de)(de)真實性和其(qi)價格(ge)形(xing)成(cheng)(cheng)的(de)(de)規則。
法治政府建設意見
為認真(zhen)落(luo)實(shi)省委(wei)、市委(wei)關于(yu)加(jia)強法治(zhi)(zhi)(zhi)建(jian)設(she)的決(jue)定,切(qie)實(shi)貫(guan)徹執行省人民(min)政府(fu)《關于(yu)推進法治(zhi)(zhi)(zhi)政府(fu)建(jian)設(she)的意見》(浙政發〔2006〕34號),經市人民(min)政府(fu)研究決(jue)定,現就全面推進依法行政、加(jia)快(kuai)法治(zhi)(zhi)(zhi)政府(fu)建(jian)設(she)提出如下(xia)實(shi)施意見:
一、建設(she)法治(zhi)政府(fu)的(de)總體要求和(he)目標任務
(一)總體(ti)要(yao)求。以鄧小平理(li)論和(he)(he)(he)“三個(ge)代表”重要(yao)思想為指(zhi)導,堅(jian)(jian)持黨的(de)(de)(de)領導,堅(jian)(jian)持執政為民,全面貫徹國務(wu)院《全面推進(jin)(jin)依法(fa)行(xing)政實施(shi)綱要(yao)》,忠實履行(xing)憲法(fa)和(he)(he)(he)法(fa)律(lv)賦予的(de)(de)(de)職(zhi)責(ze),維護(hu)憲法(fa)權威(wei)、法(fa)制統一和(he)(he)(he)政令(ling)暢通(tong),切實保護(hu)公民、法(fa)人和(he)(he)(he)其他組(zu)織(zhi)的(de)(de)(de)合(he)法(fa)權益,著力推進(jin)(jin)行(xing)政管理(li)體(ti)制改革,加快轉變政府職(zhi)能,創新行(xing)政管理(li)方(fang)式,提高行(xing)政管理(li)效能,為扎(zha)實推進(jin)(jin)“平安**”、文化大市和(he)(he)(he)法(fa)治政府建(jian)(jian)設,構(gou)建(jian)(jian)社(she)(she)會主義和(he)(he)(he)諧(xie)社(she)(she)會,順利(li)完成(cheng)“十一五”規劃確定的(de)(de)(de)目標任(ren)務(wu),實現我市在杭湖(hu)寧發展(zhan)帶中間(jian)率(lv)先崛起,提供良好的(de)(de)(de)體(ti)制環(huan)境和(he)(he)(he)有效的(de)(de)(de)制度保障。
(二)工作目標。“十(shi)一五”期間(jian)經過各(ge)級政府和部門的共同努力,基本實現職權法定、依法行政、有效監(jian)督、運轉高效的法治政府目標:
——政(zheng)(zheng)府(fu)職(zhi)能基本到位,行為規范、運(yun)轉協調(diao)、公正(zheng)透明、廉(lian)潔高效的(de)行政(zheng)(zheng)管理(li)體制(zhi)基本形(xing)成,政(zheng)(zheng)企分(fen)開、政(zheng)(zheng)資分(fen)開、政(zheng)(zheng)事分(fen)開、政(zheng)(zheng)府(fu)與中介(jie)組織(zhi)分(fen)開,政(zheng)(zheng)府(fu)機構設(she)置(zhi)規范化(hua),依法、合理(li)界定各級政(zheng)(zheng)府(fu)管理(li)權(quan)限(xian)。
——法(fa)(fa)律、法(fa)(fa)規、規章得(de)到全面、正(zheng)(zheng)確(que)實施,行政決(jue)策科學、民主,公民、法(fa)(fa)人(ren)和其他組織的(de)合(he)法(fa)(fa)權益得(de)到切實保護,違法(fa)(fa)行為得(de)到及時糾正(zheng)(zheng)、制裁,經濟(ji)社會秩序得(de)到有效維護,政府(fu)應對突(tu)發事件和風險(xian)的(de)能(neng)力明顯增(zeng)強。
加快建設法治政府
*年(nian)是(shi)貫徹(che)落實(shi)科學發展觀、保持經濟社會(hui)良好健康發展態勢的(de)(de)關鍵一年(nian),也是(shi)國務院(yuan)全面推進依法(fa)行政,加快建設法(fa)治政府的(de)(de)重要一年(nian)。回(hui)顧這一年(nian),國務院(yuan)的(de)(de)法(fa)制工作同其他工作一樣,取得了可喜的(de)(de)成績(ji)。
一、全面貫徹科學發展觀和構建和諧社會的要(yao)求(qiu),認(ren)真做(zuo)好政(zheng)府立法工作
*年,國(guo)務(wu)院(yuan)的(de)(de)(de)立(li)法(fa)(fa)(fa)(fa)工作(zuo)緊緊圍繞全(quan)(quan)面(mian)建設小康(kang)社(she)會的(de)(de)(de)奮斗目標,按照科學發展觀和(he)構(gou)建社(she)會主義和(he)諧社(she)會的(de)(de)(de)要(yao)求,在(zai)繼續加強(qiang)經濟(ji)(ji)調(diao)節、市場監(jian)管(guan)方(fang)面(mian)的(de)(de)(de)立(li)法(fa)(fa)(fa)(fa)的(de)(de)(de)同時,高度重視(shi)社(she)會管(guan)理、公(gong)(gong)共服務(wu)方(fang)面(mian)的(de)(de)(de)立(li)法(fa)(fa)(fa)(fa),特(te)別是(shi)維護公(gong)(gong)眾身體健(jian)康(kang)和(he)生命財產安全(quan)(quan)、完善勞動法(fa)(fa)(fa)(fa)律(lv)制(zhi)度、促進經濟(ji)(ji)社(she)會全(quan)(quan)面(mian)協調(diao)可(ke)持續發展等方(fang)面(mian)的(de)(de)(de)立(li)法(fa)(fa)(fa)(fa)。同時,按照《全(quan)(quan)面(mian)推進依法(fa)(fa)(fa)(fa)行政實施綱要(yao)》提出的(de)(de)(de)制(zhi)度建設的(de)(de)(de)基(ji)本要(yao)求,在(zai)政府立(li)法(fa)(fa)(fa)(fa)工作(zuo)中遵(zun)循并反映經濟(ji)(ji)社(she)會發展規律(lv),建立(li)健(jian)全(quan)(quan)專家咨詢(xun)論證(zheng)制(zhi)度,拓寬公(gong)(gong)眾有序參與政府立(li)法(fa)(fa)(fa)(fa)的(de)(de)(de)渠道,不(bu)斷提高政府立(li)法(fa)(fa)(fa)(fa)工作(zuo)質量。國(guo)務(wu)院(yuan)全(quan)(quan)年共向全(quan)(quan)國(guo)人大常委會提交法(fa)(fa)(fa)(fa)律(lv)議案(an)7件,制(zhi)定行政法(fa)(fa)(fa)(fa)規22件。

高度重視(shi)依(yi)(yi)法(fa)防控高致病性禽流(liu)感(gan)工作。今(jin)年11月16日,總(zong)理主持召開(kai)了(le)國務院第113次常(chang)務會議(yi),審議(yi)并原(yuan)則通過了(le)《重大動物疫(yi)情應急條例(li)》。兩(liang)天(tian)后,該條例(li)公布(bu)施(shi)行。條例(li)對(dui)重大動物疫(yi)情的(de)(de)應急準備,疫(yi)情監測(ce)、報告和(he)公布(bu),應急處理等作出(chu)明確規定。條例(li)的(de)(de)公布(bu)施(shi)行,對(dui)于建立信息暢通、反應快捷(jie)、指揮有(you)力、控制有(you)效的(de)(de)疫(yi)情快速反應機制,依(yi)(yi)法(fa)保障養殖業生(sheng)產安(an)全(quan),保護公眾(zhong)身(shen)體健康與生(sheng)命安(an)全(quan),維護正常(chang)的(de)(de)社會秩序具有(you)十分(fen)重要的(de)(de)意義。
為(wei)了(le)(le)加強對疫(yi)苗(miao)流通(tong)和(he)預防(fang)(fang)接種的(de)管(guan)(guan)理(li),預防(fang)(fang)、控制(zhi)傳染病的(de)發生、流行,保(bao)障人體(ti)健康和(he)公共衛(wei)生,今年3月(yue)24日(ri),國(guo)務院(yuan)制(zhi)定了(le)(le)《疫(yi)苗(miao)流通(tong)和(he)預防(fang)(fang)接種管(guan)(guan)理(li)條例》。8月(yue)3日(ri),國(guo)務院(yuan)制(zhi)定了(le)(le)《麻醉藥(yao)(yao)品(pin)和(he)精神藥(yao)(yao)品(pin)管(guan)(guan)理(li)條例》,依(yi)法加強對麻醉藥(yao)(yao)品(pin)和(he)精神藥(yao)(yao)品(pin)的(de)管(guan)(guan)理(li),保(bao)證麻醉藥(yao)(yao)品(pin)和(he)精神藥(yao)(yao)品(pin)的(de)合法、安全、合理(li)使用(yong),防(fang)(fang)止(zhi)流入非法渠道。

《中華人(ren)民(min)(min)共和(he)國(guo)行(xing)(xing)政(zheng)許可法(fa)》已于2003年(nian)8月(yue)27日經十屆全國(guo)人(ren)大常委會第四次會議(yi)通過,從2004年(nian)7月(yue)1日起施行(xing)(xing)。它的(de)頒行(xing)(xing),對(dui)進一(yi)步規范和(he)限制政(zheng)府(fu)行(xing)(xing)為,保護(hu)公民(min)(min)、法(fa)人(ren)和(he)其他(ta)組織的(de)合法(fa)權益(yi),從源(yuan)頭預防和(he)治(zhi)理(li)腐敗,建設有(you)限、統一(yi)、透(tou)明(ming)和(he)便民(min)(min)的(de)現代法(fa)治(zhi)政(zheng)府(fu),都(dou)將(jiang)產生積極的(de)作用。
一、限制政府(fu)規制范圍,有(you)利于建設有(you)限政府(fu)
法(fa)治(zhi)政府(fu)的第一要義是保(bao)障人(ren)民的自(zi)由,而要保(bao)障人(ren)民的自(zi)由,就必須限(xian)制政府(fu)的權(quan)力,限(xian)制政府(fu)規(gui)制的范圍。長期以(yi)來,尤(you)其是計劃(hua)經(jing)濟向市場經(jing)濟轉型時期,公(gong)權(quan)力過寬過大,私權(quan)利(li)過小(xiao)過少,事(shi)事(shi)要審批,樣樣要許(xu)可,極大地限(xian)制了(le)行政相(xiang)對人(ren)的創造(zao)性和(he)智(zhi)慧(hui)。

去(qu)實(shi)施(shi)的(de)(de)(de)(de)(de)(de)(de)大量不(bu)(bu)必(bi)要的(de)(de)(de)(de)(de)(de)(de)規(gui)制(zhi)(zhi),還市場主(zhu)體和(he)(he)公(gong)(gong)(gong)(gong)民(min)(min)個(ge)人以(yi)自(zi)(zi)由另(ling)一(yi)方面將某些必(bi)要的(de)(de)(de)(de)(de)(de)(de)規(gui)制(zhi)(zhi)轉移給行(xing)(xing)(xing)(xing)業(ye)組(zu)(zu)(zu)織(zhi)和(he)(he)中介機構(gou)實(shi)施(shi)。只(zhi)(zhi)保留真(zhen)正屬于“公(gong)(gong)(gong)(gong)共(gong)物品(pin)”范疇的(de)(de)(de)(de)(de)(de)(de)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)許(xu)(xu)(xu)(xu)(xu)可(ke)(ke)(ke)(ke)(ke)(ke)(ke),表明(ming)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)從(cong)(cong)“全能政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)”向(xiang)“有(you)限(xian)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)”邁(mai)進一(yi)大步。《行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)許(xu)(xu)(xu)(xu)(xu)可(ke)(ke)(ke)(ke)(ke)(ke)(ke)法(fa)》確立(li)了(le)有(you)限(xian)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)的(de)(de)(de)(de)(de)(de)(de)理(li)念,妥(tuo)善(shan)處(chu)理(li)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)與(yu)(yu)(yu)市場、政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)與(yu)(yu)(yu)社會、公(gong)(gong)(gong)(gong)權(quan)(quan)(quan)力(li)與(yu)(yu)(yu)私(si)權(quan)(quan)(quan)利的(de)(de)(de)(de)(de)(de)(de)關(guan)系,大大縮小了(le)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)審批的(de)(de)(de)(de)(de)(de)(de)范圍(wei),從(cong)(cong)根本上(shang)實(shi)現(xian)(xian)了(le)還權(quan)(quan)(quan)于民(min)(min)。
二、取消(xiao)部門(men)規(gui)(gui)章(zhang)和限制地(di)方規(gui)(gui)章(zhang)許(xu)可設定權,有利于建設法制統一政府
法(fa)(fa)治(zhi)政(zheng)(zheng)府(fu)必須是(shi)法(fa)(fa)制統一(yi)的(de)政(zheng)(zheng)府(fu)。而(er)過去我國(guo)的(de)法(fa)(fa)律沒(mei)有對(dui)部(bu)(bu)(bu)門(men)和(he)地(di)方的(de)規(gui)制權(quan)加(jia)以限制,一(yi)些中央政(zheng)(zheng)府(fu)部(bu)(bu)(bu)門(men)和(he)地(di)方政(zheng)(zheng)府(fu)通過規(gui)章為本部(bu)(bu)(bu)門(men)爭權(quan),為本地(di)方謀利(li),通過許可搞部(bu)(bu)(bu)門(men)分割和(he)地(di)方封鎖(suo),造成了“權(quan)力部(bu)(bu)(bu)門(men)化(hua)(hua)、部(bu)(bu)(bu)門(men)利(li)益化(hua)(hua)、利(li)益法(fa)(fa)制化(hua)(hua)”的(de)局(ju)面,政(zheng)(zheng)府(fu)的(de)自(zi)利(li)性得到進一(yi)步強化(hua)(hua)。

《中華人民共(gong)和(he)國行(xing)政(zheng)(zheng)許(xu)可(ke)法(fa)(fa)(fa)(fa)(fa)》從去年(nian)8月(yue)27日(ri)頒布,到今年(nian)7月(yue)1日(ri)正式實施(shi),歷時十個月(yue)。這是一(yi)部(bu)非常值得(de)學(xue)習(xi)和(he)研究(jiu)的(de)法(fa)(fa)(fa)(fa)(fa)律。無(wu)論用歷史(shi)的(de)、還是現代(dai)(dai)的(de)眼光,來(lai)審視這部(bu)法(fa)(fa)(fa)(fa)(fa)律,它(ta)都堪稱是出類(lei)拔萃的(de)。在世界行(xing)政(zheng)(zheng)法(fa)(fa)(fa)(fa)(fa)治(zhi)史(shi)上,也是絕無(wu)僅有(you)的(de),世界上沒有(you)一(yi)個國家象我們這樣制定專(zhuan)門(men)的(de)行(xing)政(zheng)(zheng)許(xu)可(ke)法(fa)(fa)(fa)(fa)(fa)。這主要是針對我們國家長期的(de)計劃(hua)經濟傳統、和(he)行(xing)政(zheng)(zheng)管(guan)理習(xi)慣所(suo)暴(bao)露出來(lai)的(de)問題過(guo)于突出才(cai)制定的(de)。《行(xing)政(zheng)(zheng)許(xu)可(ke)法(fa)(fa)(fa)(fa)(fa)》凝聚了(le)幾乎所(suo)有(you)現代(dai)(dai)行(xing)政(zheng)(zheng)法(fa)(fa)(fa)(fa)(fa)治(zhi)的(de)全新理念,勾劃(hua)了(le)法(fa)(fa)(fa)(fa)(fa)治(zhi)政(zheng)(zheng)府的(de)基本輪廓,代(dai)(dai)表著未來(lai)法(fa)(fa)(fa)(fa)(fa)治(zhi)政(zheng)(zheng)府的(de)發展方(fang)向。這是《行(xing)政(zheng)(zheng)許(xu)可(ke)法(fa)(fa)(fa)(fa)(fa)》的(de)最大亮點(dian)。
一、《行政許(xu)可法》所凝聚的現代行政法治理(li)念
2001年(nian)第(di)8期的《新(xin)華文摘》刊登過一篇文章,題目(mu)叫《經(jing)(jing)濟全球化(hua)(hua)背景下的政府(fu)改革:中國的經(jing)(jing)驗、問題與(yu)(yu)前景》,它把政治(zhi)民(min)主(zhu)化(hua)(hua)與(yu)(yu)經(jing)(jing)濟全球化(hua)(hua)、信息化(hua)(hua)、市場化(hua)(hua)并(bing)稱為當(dang)今世界的四大潮流。伴隨(sui)著(zhu)經(jing)(jing)濟全球化(hua)(hua)、市場化(hua)(hua)和政治(zhi)民(min)主(zhu)化(hua)(hua)的進程,現(xian)代行政法(fa)治(zhi)的理(li)念,已經(jing)(jing)和正(zheng)在(zai)發(fa)生(sheng)著(zhu)深刻(ke)而(er)又巨(ju)大的變化(hua)(hua):
(1)行(xing)政法的調整范(fan)圍在縮小,從“行(xing)政國家”走向“有限政府(fu)”。
最初,政(zheng)府(fu)的(de)行政(zheng)職(zhi)能是很有限的(de)。法(fa)國著名法(fa)學家(jia)和思想家(jia)孟德思鳩,在《論法(fa)的(de)精神》中說,“行政(zheng),就是國家(jia)宣戰(zhan)或(huo)媾和、派遣和接受使節、維護公(gong)共安全(quan)、防(fang)御(yu)侵略的(de)活動。”
在(zai)19世紀,西(xi)方(fang)國家大多實行(xing)自由放任政策,信奉“管(guan)事最少的(de)(de)(de)政府(fu)(fu)是(shi)最好的(de)(de)(de)政府(fu)(fu)”的(de)(de)(de)理念(nian)。當(dang)時,在(zai)英(ying)國有一(yi)句話(hua)非常流行(xing):“除了郵局和警察,一(yi)名具(ju)有守法意識的(de)(de)(de)英(ying)國人幾乎可能意識不到政府(fu)(fu)的(de)(de)(de)存在(zai)而度(du)過他的(de)(de)(de)一(yi)生”。

這次全縣(xian)(xian)政法(fa)(fa)、信(xin)訪(fang)、依(yi)法(fa)(fa)治縣(xian)(xian)工(gong)作會(hui)(hui)(hui)(hui)議的(de)(de)(de)(de)主要任務是:認真貫徹落實(shi)黨的(de)(de)(de)(de)十(shi)七大,十(shi)七屆三中全會(hui)(hui)(hui)(hui),全國、省(sheng)、市政法(fa)(fa)信(xin)訪(fang)工(gong)作會(hui)(hui)(hui)(hui)議和全縣(xian)(xian)工(gong)作會(hui)(hui)(hui)(hui)議精神(shen)(shen),總結20*年(nian)全縣(xian)(xian)政法(fa)(fa)、信(xin)訪(fang)、依(yi)法(fa)(fa)治縣(xian)(xian)工(gong)作,分析當前社會(hui)(hui)(hui)(hui)治安和信(xin)訪(fang)穩(wen)定形(xing)勢,安排部署(shu)2009年(nian)和今后一個(ge)時期的(de)(de)(de)(de)工(gong)作,迎(ying)接(jie)挑戰(zhan),統一思想,堅定信(xin)心,為(wei)推(tui)動全縣(xian)(xian)政治經濟社會(hui)(hui)(hui)(hui)的(de)(de)(de)(de)平穩(wen)、快速發展(zhan)提供堅強(qiang)保(bao)障。參加這次會(hui)(hui)(hui)(hui)議的(de)(de)(de)(de)有各鄉(xiang)鎮(zhen)黨委(wei)(wei)書記、主抓副(fu)職(zhi)、綜治辦主任、信(xin)訪(fang)辦主任,縣(xian)(xian)直單位一把手、分管副(fu)職(zhi),政法(fa)(fa)各單位班子成員(yuan)、中層(ceng)干部。縣(xian)(xian)委(wei)(wei)對這次會(hui)(hui)(hui)(hui)議非常(chang)(chang)重視(shi),會(hui)(hui)(hui)(hui)前,縣(xian)(xian)委(wei)(wei)常(chang)(chang)委(wei)(wei)會(hui)(hui)(hui)(hui)兩次聽取了(le)會(hui)(hui)(hui)(hui)議準(zhun)備情況(kuang)的(de)(de)(de)(de)匯報(bao),并進行了(le)認真研究(jiu),提出了(le)明確要求,楊縣(xian)(xian)長(chang)和其他在(zai)家的(de)(de)(de)(de)縣(xian)(xian)委(wei)(wei)常(chang)(chang)委(wei)(wei)、縣(xian)(xian)“四大家”領導都出席了(le)今天的(de)(de)(de)(de)會(hui)(hui)(hui)(hui)議,充分體(ti)現了(le)縣(xian)(xian)委(wei)(wei)、政府對政法(fa)(fa)、信(xin)訪(fang)、依(yi)法(fa)(fa)治縣(xian)(xian)工(gong)作的(de)(de)(de)(de)重視(shi),隨后,楊縣(xian)(xian)長(chang)還要做重要指示,希望(wang)大家認真學習領會(hui)(hui)(hui)(hui),抓好各項措施的(de)(de)(de)(de)落實(shi)。下面,根據上級精神(shen)(shen)和縣(xian)(xian)委(wei)(wei)常(chang)(chang)委(wei)(wei)會(hui)(hui)(hui)(hui)研究(jiu)的(de)(de)(de)(de)意(yi)見,我講四個(ge)方面的(de)(de)(de)(de)問題。
一、20*年全縣政法(fa)信(xin)訪依法(fa)治縣工(gong)作的簡(jian)要回顧
20*年(nian)(nian),全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)縣(xian)(xian)(xian)(xian)(xian)政法(fa)(fa)、信訪(fang)、依法(fa)(fa)治(zhi)縣(xian)(xian)(xian)(xian)(xian)工(gong)(gong)作(zuo)在(zai)縣(xian)(xian)(xian)(xian)(xian)委(wei)、縣(xian)(xian)(xian)(xian)(xian)政府(fu)的(de)(de)正確領導(dao)下(xia),緊(jin)(jin)緊(jin)(jin)圍(wei)繞建(jian)設(she)富強和諧*和實現(xian)率(lv)(lv)先(xian)(xian)崛(jue)起的(de)(de)奮(fen)斗(dou)目標,以(yi)打(da)(da)擊(ji)“兩搶一(yi)(yi)盜”專項斗(dou)爭(zheng)為(wei)(wei)(wei)重(zhong)點(dian),以(yi)化(hua)解各類社(she)會矛盾(dun)為(wei)(wei)(wei)主(zhu)線,充分發揮(hui)職能(neng)作(zuo)用,有(you)(you)力(li)地維(wei)護了(le)全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)縣(xian)(xian)(xian)(xian)(xian)大局(ju)穩定。一(yi)(yi)年(nian)(nian)來(lai),全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)縣(xian)(xian)(xian)(xian)(xian)沒(mei)有(you)(you)發生(sheng)在(zai)全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)省(sheng)全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)市有(you)(you)較(jiao)大影響的(de)(de)治(zhi)安(an)案(an)事件、安(an)全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)事故和群體(ti)(ti)性信訪(fang)事件,社(she)會治(zhi)安(an)秩序良好,廣大群眾的(de)(de)安(an)全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)感進(jin)(jin)一(yi)(yi)步(bu)提高,信訪(fang)案(an)件逐漸減少;20*年(nian)(nian),我縣(xian)(xian)(xian)(xian)(xian)的(de)(de)社(she)會治(zhi)安(an)綜合治(zhi)理(li)、維(wei)護社(she)會穩定、反邪教等工(gong)(gong)作(zuo)均居全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)市前(qian)列,被市委(wei)、市政府(fu)命(ming)(ming)名(ming)為(wei)(wei)(wei)全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)市平(ping)安(an)建(jian)設(she)先(xian)(xian)進(jin)(jin)縣(xian)(xian)(xian)(xian)(xian)。在(zai)全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)體(ti)(ti)政法(fa)(fa)干警的(de)(de)共同努力(li)下(xia),政法(fa)(fa)各部(bu)門的(de)(de)工(gong)(gong)作(zuo)也取(qu)得(de)了(le)突出成績。縣(xian)(xian)(xian)(xian)(xian)法(fa)(fa)院榮立集(ji)(ji)體(ti)(ti)一(yi)(yi)等功,獲得(de)全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)省(sheng)優秀基層法(fa)(fa)院榮譽稱號,案(an)件執結率(lv)(lv)居全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)市第一(yi)(yi);縣(xian)(xian)(xian)(xian)(xian)檢(jian)察(cha)院被評為(wei)(wei)(wei)省(sheng)級先(xian)(xian)進(jin)(jin)基層檢(jian)察(cha)院、全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)市先(xian)(xian)進(jin)(jin)檢(jian)察(cha)院,整體(ti)(ti)工(gong)(gong)作(zuo)繼續(xu)在(zai)全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)市檢(jian)察(cha)系(xi)統(tong)位(wei)居前(qian)列;縣(xian)(xian)(xian)(xian)(xian)公(gong)安(an)局(ju)以(yi)命(ming)(ming)案(an)攻(gong)堅(jian)為(wei)(wei)(wei)重(zhong)點(dian),現(xian)行命(ming)(ming)案(an)全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)部(bu)偵破(po),命(ming)(ming)案(an)偵破(po)率(lv)(lv)達到歷史最高水(shui)平(ping),受(shou)(shou)到上(shang)級多次(ci)表(biao)彰(zhang)(zhang);縣(xian)(xian)(xian)(xian)(xian)司法(fa)(fa)局(ju)被評為(wei)(wei)(wei)全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)市平(ping)安(an)建(jian)設(she)重(zhong)點(dian)工(gong)(gong)作(zuo)、律師(shi)管(guan)(guan)理(li)工(gong)(gong)作(zuo)、公(gong)證管(guan)(guan)理(li)工(gong)(gong)作(zuo)和司法(fa)(fa)鑒定管(guan)(guan)理(li)工(gong)(gong)作(zuo)先(xian)(xian)進(jin)(jin)單位(wei);據初步(bu)統(tong)計,20*年(nian)(nian),全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)縣(xian)(xian)(xian)(xian)(xian)政法(fa)(fa)系(xi)統(tong)獲省(sheng)級以(yi)上(shang)表(biao)彰(zhang)(zhang)獎(jiang)勵的(de)(de)先(xian)(xian)進(jin)(jin)集(ji)(ji)體(ti)(ti)15個(ge)(ge),先(xian)(xian)進(jin)(jin)個(ge)(ge)人(ren)26人(ren)次(ci);獲市表(biao)彰(zhang)(zhang)獎(jiang)勵的(de)(de)先(xian)(xian)進(jin)(jin)集(ji)(ji)體(ti)(ti)14個(ge)(ge),先(xian)(xian)進(jin)(jin)個(ge)(ge)人(ren)32人(ren)次(ci);信訪(fang)工(gong)(gong)作(zuo)也取(qu)得(de)了(le)突出成績。全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)年(nian)(nian)立案(an)查(cha)(cha)處(chu)信訪(fang)案(an)件1236件,群眾滿(man)意率(lv)(lv)達85%;排查(cha)(cha)矛盾(dun)糾紛(fen)648起,化(hua)解穩定95%以(yi)上(shang);信訪(fang)整體(ti)(ti)工(gong)(gong)作(zuo)居全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)市先(xian)(xian)進(jin)(jin)行列,受(shou)(shou)到省(sheng)、市委(wei)的(de)(de)表(biao)彰(zhang)(zhang);依法(fa)(fa)治(zhi)縣(xian)(xian)(xian)(xian)(xian)工(gong)(gong)作(zuo)通過(guo)大力(li)開展(zhan)(zhan)法(fa)(fa)制宣傳教育(yu)和推進(jin)(jin)依法(fa)(fa)治(zhi)理(li)又邁上(shang)一(yi)(yi)個(ge)(ge)新臺階。實事求是講,一(yi)(yi)年(nian)(nian)來(lai),全(quan)(quan)(quan)(quan)(quan)(quan)(quan)(quan)縣(xian)(xian)(xian)(xian)(xian)政法(fa)(fa)信訪(fang)等部(bu)門辛(xin)勤(qin)努力(li),攻(gong)堅(jian)克難,較(jiao)好地發揮(hui)了(le)保(bao)護人(ren)民、打(da)(da)擊(ji)犯罪、維(wei)護穩定、保(bao)障(zhang)發展(zhan)(zhan)的(de)(de)主(zhu)力(li)軍作(zuo)用。主(zhu)要做了(le)以(yi)下(xia)六個(ge)(ge)方面的(de)(de)工(gong)(gong)作(zuo):
(一)堅(jian)持“打防并舉”,推(tui)進(jin)平(ping)安建設不斷深化
全力開展打擊(ji)“兩搶(qiang)一盜(dao)(dao)”專(zhuan)項(xiang)斗爭,群眾的安(an)(an)(an)全感和對政法(fa)機(ji)關(guan)的滿(man)意度不斷提高(gao)。根據省(sheng)、市安(an)(an)(an)排部署,我縣自去年3月19日開展打擊(ji)“兩搶(qiang)一盜(dao)(dao)”專(zhuan)項(xiang)斗爭,在縣委(wei)(wei)、縣政府的高(gao)度重(zhong)視和正確領導下,我們(men)組織公檢(jian)法(fa)司(si)干警(jing)和綜(zong)治(zhi)委(wei)(wei)成員(yuan)單位骨干300余人,分片包(bao)鄉,在全縣掀起(qi)(qi)(qi)了斗爭高(gao)潮,取(qu)得(de)了明(ming)顯成效。至去年底,共破(po)各類刑(xing)事案(an)(an)(an)(an)件1970起(qi)(qi)(qi),抓(zhua)獲(huo)各類犯罪嫌疑(yi)人1340人,其中破(po)獲(huo)“兩搶(qiang)一盜(dao)(dao)”案(an)(an)(an)(an)件1350起(qi)(qi)(qi),抓(zhua)獲(huo)犯罪嫌疑(yi)人843人。打掉“兩搶(qiang)一盜(dao)(dao)”團伙21個(ge),抓(zhua)獲(huo)成員(yuan)79人;抓(zhua)獲(huo)省(sheng)廳(ting)督捕(bu)逃犯15人,破(po)獲(huo)省(sheng)廳(ting)督破(po)案(an)(an)(an)(an)件14起(qi)(qi)(qi);查(cha)處治(zhi)安(an)(an)(an)案(an)(an)(an)(an)件5033起(qi)(qi)(qi),處理(li)違反治(zhi)安(an)(an)(an)管(guan)理(li)人員(yuan)33*人。縣檢(jian)察院共受理(li)“兩搶(qiang)一盜(dao)(dao)”案(an)(an)(an)(an)件114案(an)(an)(an)(an)235人,批捕(bu)85案(an)(an)(an)(an)149人,提起(qi)(qi)(qi)公訴106案(an)(an)(an)(an)203人;縣法(fa)院共受理(li)“兩搶(qiang)一盜(dao)(dao)”案(an)(an)(an)(an)件98案(an)(an)(an)(an)197人,已全部審結。通(tong)過強有(you)力的打擊(ji),全縣突出治(zhi)安(an)(an)(an)問題和治(zhi)安(an)(an)(an)亂(luan)點得(de)到有(you)效整治(zhi),確保了全縣社(she)會治(zhi)安(an)(an)(an)大局的持續(xu)穩定(ding)。
市法制辦法治政府建設意見
各區、市人民政(zheng)府,市政(zheng)府各部門,市直各單位:
為貫徹實施《國務院關(guan)于加強(qiang)法治(zhi)政府建(jian)設的意見》,進一步(bu)推進我市依(yi)法行(xing)政,加強(qiang)法治(zhi)政府建(jian)設,為建(jian)設宜(yi)居、打造幸(xing)福(fu)城市提(ti)供有力法治(zhi)保障和良好法治(zhi)環境,結合我市實際,提(ti)出以下意見:
一、提(ti)高(gao)依法行政的(de)意識和(he)能(neng)力
1.堅持領(ling)導干(gan)部(bu)學法(fa)(fa)(fa)。落實領(ling)導干(gan)部(bu)各項(xiang)學法(fa)(fa)(fa)制(zhi)度,每年(nian)政府常務會(hui)議(yi)學法(fa)(fa)(fa)、部(bu)門辦(ban)公會(hui)議(yi)學法(fa)(fa)(fa)、專題法(fa)(fa)(fa)制(zhi)講(jiang)座、依(yi)法(fa)(fa)(fa)行政專題研討(tao)等形式的(de)(de)集(ji)體(ti)學習不少于(yu)4次。建立領(ling)導干(gan)部(bu)學法(fa)(fa)(fa)情況登(deng)記制(zhi)度和監督檢查制(zhi)度,確保學法(fa)(fa)(fa)的(de)(de)計劃、內容、時間、人員、效果“五落實”。

2.加強依(yi)法行(xing)政(zheng)培訓(xun)。制定(ding)依(yi)法行(xing)政(zheng)培訓(xun)規(gui)劃并(bing)認真組織(zhi)(zhi)(zhi)實施,確(que)保(bao)每年(nian)依(yi)法行(xing)政(zheng)知(zhi)識學習累計(ji)不少于20學時。對培訓(xun)情(qing)況不定(ding)期檢查,必(bi)要時進行(xing)測(ce)試。公(gong)共(gong)法律知(zhi)識由(you)法制部門和人力資源(yuan)社(she)會(hui)保(bao)障(zhang)部門共(gong)同組織(zhi)(zhi)(zhi)統一測(ce)試;專門法律知(zhi)識由(you)各部門自行(xing)組織(zhi)(zhi)(zhi)測(ce)試。測(ce)試成(cheng)績(ji)登(deng)記在公(gong)務員培訓(xun)證書上,作為考核(he)內容和任職晉(jin)升的依(yi)據之一。

法治政(zheng)府是怎么樣(yang)的(de)(de)一(yi)個(ge)(ge)(ge)框架(jia),什么樣(yang)的(de)(de)一(yi)個(ge)(ge)(ge)要求。在(zai)2004年(nian)國務院的(de)(de)一(yi)個(ge)(ge)(ge)全面實施依法行政(zheng)的(de)(de)綱要中對這(zhe)個(ge)(ge)(ge)問題做了比較完整的(de)(de)敘述,也就是說要爭取(qu)在(zai)2010年(nian)左右(you)要把我們(men)的(de)(de)政(zheng)府建設(she)(she)成法治政(zheng)府。所以(yi)從國家的(de)(de)時間(jian)表上來講是希(xi)望在(zai)十(shi)年(nian)左右(you),就是2010年(nian)左右(you)把我們(men)的(de)(de)政(zheng)府能夠建設(she)(she)成為法治政(zheng)府,我們(men)當然也期待這(zhe)樣(yang)做,也期待有這(zhe)樣(yang)一(yi)個(ge)(ge)(ge)結果。
主持人:這個總理在(zai)2004年提出這個目標的是(shi)吧?十(shi)年左右的時(shi)間(jian)打造成法治政(zheng)(zheng)府,您對溫總理的時(shi)間(jian)表(biao)有多(duo)大的信心呢(ni)?就(jiu)是(shi)中(zhong)國在(zai)推進政(zheng)(zheng)府法治方面有哪些(xie)困難需要(yao)克服呢(ni)?還有哪些(xie)工作需要(yao)加強?
楊海坤:建設社會主(zhu)義(yi)法治(zhi)國(guo)家(jia)(jia)本(ben)身是(shi)(shi)一(yi)個(ge)比較遠大(da)的(de)目標,而且(qie)它從(cong)整個(ge)實(shi)施來講(jiang)是(shi)(shi)法治(zhi)的(de)系統(tong)工(gong)程,這(zhe)個(ge)系統(tong)工(gong)程設計到立法、行政(zheng)(zheng)、司法以及廣大(da)人民的(de)守(shou)法和法律監督等(deng)等(deng)方(fang)面,建設法治(zhi)政(zheng)(zheng)府(fu)應該是(shi)(shi)建設法治(zhi)國(guo)家(jia)(jia)里面的(de)重要(yao)組成部分(fen),只有這(zhe)樣(yang)的(de)理解才是(shi)(shi)正確的(de),實(shi)際上(shang)從(cong)九(jiu)十(shi)(shi)年(nian)代以來,特別是(shi)(shi)包括上(shang)一(yi)屆政(zheng)(zheng)府(fu),朱總理每年(nian)政(zheng)(zheng)府(fu)工(gong)作(zuo)(zuo)報告都談到了從(cong)嚴執政(zheng)(zheng),對政(zheng)(zheng)府(fu)的(de)工(gong)作(zuo)(zuo)作(zuo)(zuo)風、工(gong)作(zuo)(zuo)方(fang)法、職能轉變都提出很多要(yao)求(qiu),所(suo)以這(zhe)個(ge)工(gong)作(zuo)(zuo)的(de)提出也不(bu)是(shi)(shi)一(yi)朝一(yi)夕忽然心(xin)血來潮提出來的(de),從(cong)九(jiu)十(shi)(shi)年(nian)代到醞釀到現(xian)在也有一(yi)段時間(jian)。
