工作制度
XXX街道貫徹落實黨的十八屆四中全會精神,貫徹落實省委十屆六次全會、市委十屆六次全會及區委相關會議的精神,深入開展法治宣(xuan)傳教(jiao)育,加快推進全(quan)民守法進程(cheng),經街(jie)道黨(dang)工委辦事處研究決定成立了XXX街(jie)道普法依法治理辦公室,為使該辦公室工作順利開展,特制訂本制度(du)以(yi)供執行。
一、主要職責
(一)傳達、貫徹和(he)落(luo)實(shi)中(zhong)央、省、市、區(qu)關于普法和(he)依法治理工(gong)作的安排部署。
(二)制定普法教育、法治文化建設、法治創建的階段性工(gong)作計劃及年度工(gong)作要點。
(三)貫徹普(pu)法規劃,研究(jiu)安排(pai)全(quan)街道普(pu)法工(gong)作,推動解決(jue)普(pu)法工(gong)作中的突出問(wen)題。
(四)推進社會主義法(fa)治(zhi)(zhi)文(wen)(wen)化(hua)建設(she),協調、指導法(fa)治(zhi)(zhi)文(wen)(wen)化(hua)陣(zhen)地建設(she)、法(fa)治(zhi)(zhi)文(wen)(wen)化(hua)作品創作和法(fa)治(zhi)(zhi)文(wen)(wen)化(hua)公共服(fu)務等相關工作。
(五)安排部(bu)署法治(zhi)創建(jian)工作,研究、落實推進各(ge)層次、各(ge)領域依法治(zhi)理的方法和措施(shi)。
(六)推進法制新(xin)聞宣傳(chuan)工作,加強普法依法治(zhi)理工作的社會宣傳(chuan)。
(七)安排部(bu)署(shu)普法(fa)教育、法(fa)治文化建設、法(fa)治創建工作(zuo)的階(jie)段性或年終督導檢(jian)查工作(zuo)。
(八(ba))通報普法教育、法治(zhi)文化建(jian)設、法治(zhi)創建(jian)工作評議考核情(qing)況。
(九)負責培(pei)養、總(zong)結和推廣(guang)各社區和各部(bu)門在普法宣傳、依法治(zhi)理、法治(zhi)創建(jian)中的先進典型和經驗(yan)做法。
(十)其(qi)它需要辦公室研究推(tui)進的(de)事項。
二、工作程序
(一)普法依法治理辦公室實行主任會議制度,每半年召開一次,也可根據工作需要隨時召開。主任會議由辦公室主任召集,各位副主任參加,各社區、各部門負責人列席。會議聽取各社區、各部門的工作匯報,研究解決工作中存在的突出問題,并形成會議紀要,下發(fa)各(ge)社區、部各(ge)門(men)。
(二)各(ge)社區、各(ge)部門要貫徹落實辦公室(shi)主任(ren)會議議定事項的進展情況,要及時反饋辦公室(shi)。

2、突出重點工作,注重溝通協(xie)調服務(wu)

為強化依(yi)法治局,落(luo)實執(zhi)行用制(zhi)度(du)管(guan)班子、管(guan)隊伍、管(guan)財(cai)務、管(guan)行政的(de)(de)要求,我們參與制(zhi)定(ding)了(le)(le)一系列規(gui)(gui)章制(zhi)度(du)。同時,以落(luo)實、執(zhi)行制(zhi)度(du),遵守規(gui)(gui)定(ding)為前提,結合辦(ban)公室實際,制(zhi)定(ding)和(he)(he)(he)細化了(le)(le)工(gong)作(zuo)(zuo)規(gui)(gui)范(fan)和(he)(he)(he)工(gong)作(zuo)(zuo)流程。制(zhi)定(ding)和(he)(he)(he)完善了(le)(le)文(wen)(wen)件、文(wen)(wen)稿處理(li)(li),印鑒使用規(gui)(gui)定(ding),車輛調(diao)度(du)、油料追加、路橋費(fei)等審批手(shou)續(xu)和(he)(he)(he)定(ding)期(qi)檢查制(zhi)度(du);進(jin)一步完善了(le)(le)文(wen)(wen)件收發、處理(li)(li)、督查、歸(gui)案“四位一位”的(de)(de)工(gong)作(zuo)(zuo)機制(zhi);加大了(le)(le)辦(ban)文(wen)(wen)責任、落(luo)實、督查和(he)(he)(he)考評(ping)的(de)(de)工(gong)作(zuo)(zuo)力度(du),提高了(le)(le)辦(ban)公自動化程度(du);明確了(le)(le)車輛管(guan)理(li)(li)運轉(zhuan)、機關保衛(wei)、消(xiao)防安全和(he)(he)(he)環境建設的(de)(de)要求和(he)(he)(he)責任。
4、積極(ji)轉變作(zuo)風,強化(hua)隊(dui)伍和支部建設
在(zai)新一(yi)輪思(si)想(xiang)解放學教活(huo)動中,我(wo)們深刻的(de)(de)體會到,對(dui)于(yu)既是(shi)(shi)(shi)全局(ju)中樞,又是(shi)(shi)(shi)窗口部門的(de)(de)辦(ban)公室(shi)(shi),必須在(zai)這(zhe)方面花大力(li)(li)氣,作(zuo)全局(ju)的(de)(de)表率(lv)。根據市局(ju)的(de)(de)總(zong)體要(yao)求和(he)部署,結合(he)辦(ban)公室(shi)(shi)人(ren)(ren)員(yuan)多、分布廣、工作(zuo)責(ze)任大等特點(dian),一(yi)是(shi)(shi)(shi)多次召(zhao)開(kai)了(le)(le)各個層面的(de)(de)會議,研(yan)究(jiu)工作(zuo),制定(ding)(ding)措施(shi)。除(chu)召(zhao)開(kai)支(zhi)部大會和(he)全體人(ren)(ren)員(yuan)會議外,以科為單位(wei),查(cha)找(zhao)思(si)想(xiang)、作(zuo)風(feng)(feng)和(he)工作(zuo)上存在(zai)的(de)(de)差距和(he)不(bu)足,逐項制定(ding)(ding)整改(gai)(gai)措施(shi)。如在(zai)辦(ban)公室(shi)(shi)內部實行了(le)(le)“舉牌制”,一(yi)次失職黃牌;第二(er)次,年末不(bu)能評優。通過近一(yi)時(shi)期的(de)(de)努(nu)力(li)(li),取(qu)得了(le)(le)較好(hao)效(xiao)果(guo),一(yi)些(xie)問題(ti)得到了(le)(le)切實解決。二(er)是(shi)(shi)(shi)加大了(le)(le)學習力(li)(li)度。學教活(huo)動開(kai)展(zhan)以來,在(zai)綜合(he)、秘書、督查(cha)、檔案(an)科開(kai)展(zhan)了(le)(le)每周一(yi)次的(de)(de)政(zheng)治、業(ye)務(wu)學習活(huo)動,在(zai)機關車隊、總(zong)值(zhi)班室(shi)(shi)開(kai)展(zhan)了(le)(le)定(ding)(ding)期或不(bu)定(ding)(ding)期業(ye)務(wu)會議。這(zhe)一(yi)做法(fa)我(wo)們將(jiang)堅持(chi)開(kai)展(zhan)下去。三是(shi)(shi)(shi)加強了(le)(le)形(xing)(xing)象(xiang)建設。要(yao)求每一(yi)位(wei)同志,特別是(shi)(shi)(shi)處于(yu)窗口位(wei)置的(de)(de)同志,必須注重自己的(de)(de)工作(zuo)態(tai)(tai)度和(he)言(yan)行,確保(bao)在(zai)這(zhe)方面不(bu)出現任何問題(ti)。前9個月發(fa)(fa)展(zhan)黨(dang)員(yuan)2名,培(pei)養5名。同時(shi),注重發(fa)(fa)揮(hui)黨(dang)員(yuan)和(he)骨干(gan)的(de)(de)模范(fan)帶頭作(zuo)用。目前,辦(ban)公室(shi)(shi)的(de)(de)工作(zuo)質量和(he)效(xiao)率(lv)、整體和(he)形(xing)(xing)象(xiang)、紀律和(he)作(zuo)風(feng)(feng)得到了(le)(le)明顯改(gai)(gai)善,形(xing)(xing)成了(le)(le)良(liang)好(hao)的(de)(de)發(fa)(fa)展(zhan)態(tai)(tai)勢。
二、存在(zai)的主要(yao)問題小陳老師工(gong)作室原創
一是(shi)(shi)工(gong)作效率(lv)低,辦事拖拉(la);二是(shi)(shi)工(gong)作質量不(bu)(bu)均衡,超前(qian)不(bu)(bu)夠;三是(shi)(shi)程(cheng)序不(bu)(bu)規范(fan),有(you)時(shi)(shi)忙亂;四是(shi)(shi)解決個別時(shi)(shi)候服(fu)務不(bu)(bu)到(dao)位(wei),質量不(bu)(bu)高的問題。
三、第四季度主要工作
1、加強和(he)改進(jin)局域網(wang)建設。一是要(yao)確保網(wang)絡(luo)全線暢通;二是加強信息(xi)錄入工作,本月底將主要(yao)信息(xi)全部(bu)錄入完畢;三是修改和(he)完善(shan)版面,使其更加美觀、科學。
2、加強檔案(an)救護管理(li)工(gong)(gong)作(zuo)。一是(shi)盡早完成(cheng)檔案(an)室的搬遷(qian)工(gong)(gong)作(zuo);二(er)是(shi)加強對檔案(an)的編(bian)輯(ji)、整理(li)、救護工(gong)(gong)作(zuo);三是(shi)強化檔案(an)管理(li),使之達到規范化、科學化。

1、項目概況
二(er)廣高(gao)(gao)速(su)(su)(su)公(gong)路(lu)懷集至三水段工程全(quan)長116.947公(gong)里,起于懷集橫洞,向東南沿(yan)線經懷集縣(xian)、廣寧縣(xian)、四會(hui)市(shi),止于佛山市(shi)三水區,并與廣三高(gao)(gao)速(su)(su)(su)相連,全(quan)線按六車道時速(su)(su)(su)80-100公(gong)里設(she)計,項目總(zong)(zong)投(tou)(tou)資84.585億元(yuan)。本項目由肇(zhao)慶市(shi)公(gong)路(lu)發展(zhan)總(zong)(zong)公(gong)司(si)、廣東省路(lu)橋建(jian)設(she)發展(zhan)有限(xian)公(gong)司(si)和廣東華銳投(tou)(tou)資有限(xian)公(gong)司(si)三方共同投(tou)(tou)資建(jian)設(she),2005年11月(yue)(yue)成(cheng)立項目法人肇(zhao)慶市(shi)廣賀(he)高(gao)(gao)速(su)(su)(su)公(gong)路(lu)有限(xian)公(gong)司(si)。先(xian)行工程于2005年12月(yue)(yue)開工,2010年12月(yue)(yue)建(jian)成(cheng)通車。
2、含義
工程(cheng)變更(geng)是指(zhi)因(yin)(yin)施(shi)工條件改變、業主要求、監(jian)理工程(cheng)師指(zhi)令或設計原因(yin)(yin)使工程(cheng)或其(qi)任何部分的形式(shi)、質量(liang)或數量(liang)發生變更(geng)。
工(gong)程(cheng)索賠是指在(zai)工(gong)程(cheng)承包合同履約中,當事人(ren)一方(fang)由于另一方(fang)未履行(xing)合同所規定的(de)義務或(huo)者出(chu)現了應(ying)當由對方(fang)承擔的(de)風險而遭(zao)受損失(shi)時(shi),向另一方(fang)提出(chu)賠償要求的(de)行(xing)為。
3、分類
二廣高(gao)速公路懷集至三水(shui)段項目工程(cheng)變更分A、B、C、D、E五類。
A類(lei)變更(geng)(geng):重大(da)變更(geng)(geng),超過(guo)初步設計(ji)批準(zhun)概算的,報交通部審批;
B類變(bian)更:較大(da)變(bian)更,超(chao)過施工圖設計(ji)批準預算(suan)或單項工程費用變(bian)化超(chao)過500萬元(yuan)的,報交通廳(ting)審批;
C類變更(geng):一般變更(geng),變更(geng)增(zeng)減金額在100-500萬元(含100萬元)的,報肇慶市(shi)交(jiao)通局審批;
D類變更:一般變更,變更增減金額(e)在10-100萬元(含10萬元)的,由項目公司審批;
E類變(bian)(bian)更:一般變(bian)(bian)更,變(bian)(bian)更增減(jian)金額在10萬元以內的,由項目公司聯席(xi)會審批。
根據索賠(pei)的目標或要(yao)求,工(gong)程(cheng)索賠(pei)主要(yao)分工(gong)期索賠(pei)和費用索賠(pei)。
工(gong)(gong)期(qi)索賠(pei)主要是由于非(fei)承包人(ren)(ren)的(de)(de)原(yuan)因(yin)而導(dao)致施工(gong)(gong)進程的(de)(de)延誤,承包人(ren)(ren)要求批準延長(chang)施工(gong)(gong)合同工(gong)(gong)期(qi)。

5、處理方法
5.1變更(geng)處理方法
業主(zhu)發(fa)出正規的(de)變更(geng)指令(ling)時較易處理,當業主(zhu)通過口(kou)頭或暗(an)示方(fang)式下達變更(geng)指令(ling)時,承包商應在(zai)規定的(de)時間內發(fa)出書面信(xin)函要(yao)求業主(zhu)對(dui)其口(kou)頭或暗(an)示指令(ling)予以確認。
工程(cheng)變更導(dao)致工期(qi)延(yan)長(chang)或費用(yong)增加時,應及時提出索(suo)賠要(yao)求,并在(zai)規定的時間內(nei)計算工期(qi)延(yan)長(chang)或費用(yong)增加的數量,保證各個環節均符合(he)(he)合(he)(he)同要(yao)求。在(zai)出現合(he)(he)同爭議(yi)時,能做(zuo)到“依據充(chong)分、過程(cheng)清晰、手續完善(shan)、資料齊全、造價(jia)合(he)(he)理”。
5.2索賠處理方法
費用增(zeng)加和(he)工(gong)期(qi)延(yan)長索賠(pei)是由建設項目中的(de)(de)各種事件(jian)(jian)(jian)引起的(de)(de),業主、總(zong)包商(shang)或(huo)項目的(de)(de)任何(he)分包商(shang)、供貨商(shang)都可索賠(pei)。為了增(zeng)加索賠(pei)成功的(de)(de)機會,索賠(pei)方必須有足夠(gou)的(de)(de)證據、相應的(de)(de)文件(jian)(jian)(jian)、確定增(zeng)加費用和(he)延(yan)長工(gong)期(qi)的(de)(de)數量(liang)及原(yuan)因(yin)。因(yin)此,合同各方必須以事件(jian)(jian)(jian)和(he)文件(jian)(jian)(jian)為依(yi)據,辨別、記錄可能發生或(huo)已經發生的(de)(de)事件(jian)(jian)(jian)對(dui)施工(gong)工(gong)期(qi)、費用的(de)(de)影響。
合同中規定了提出(chu)索(suo)(suo)賠(pei)的程序及時間要求,發生索(suo)(suo)賠(pei)事件時,一定要及時地提交有關報告,如(ru)果沒有按合同要求及時出(chu)示書面(mian)索(suo)(suo)賠(pei)通知,可能(neng)會(hui)導致索(suo)(suo)賠(pei)失敗。因此,必須深刻意識到及時準(zhun)確的通知和合理的文(wen)件證明對索(suo)(suo)賠(pei)成功的重要性(xing)。
6、處理原則
6.1預(yu)防為(wei)主的原則(ze)
任何索(suo)賠(pei)事(shi)件的出現,都會造成工(gong)(gong)程拖(tuo)期(qi)或成本加大,增(zeng)加履行合同的困(kun)難,對于業主和承(cheng)包商(shang)雙方(fang)來說都是不(bu)利的,因此(ci),應(ying)努力從(cong)預防索(suo)賠(pei)發生著手,洞察(cha)工(gong)(gong)程實(shi)施中可能導(dao)致(zhi)索(suo)賠(pei)的起因,防止或減少索(suo)賠(pei)事(shi)件的出現。
6.2必須以合同為依(yi)據
遇(yu)到索賠事件(jian)時(shi),處理索賠事件(jian)各方均應站在客(ke)觀公正(zheng)的立場,審查索賠要求的正(zheng)當性。必須(xu)對(dui)合同條(tiao)件(jian)、協議條(tiao)款(kuan)等有詳細的了解(jie),以合同為依(yi)據來公平處理合同雙(shuang)方的利益糾紛。
6.3公(gong)平合理原則

7.1 當索賠事件(jian)發生時,有些施工(gong)單(dan)位考慮與(yu)業主(zhu)、監理單(dan)位的(de)下(xia)一(yi)步(bu)合作(zuo),而(er)不(bu)敢提出。
7.2 項目經理和技術負責(ze)人對(dui)索賠工作意識不(bu)到位,對(dui)可提可不(bu)提的索賠往往不(bu)提出。
7.3 主管人員對(dui)技(ji)術規范文件及業(ye)主、監理、施(shi)工單位(wei)往來文件理解(jie)不深刻(ke),對(dui)實際存在的(de)索賠項目無(wu)充分理由。
7.4 只(zhi)注重索(suo)賠(pei)意向的提(ti)出(chu),不重視索(suo)賠(pei)過程(cheng)中的證據收集和及時作最終索(suo)賠(pei)報(bao)告。

對城建檔(dang)案信息資源(yuan)在(zai)(zai)企業發展過(guo)程中(zhong)的作(zuo)用或潛在(zai)(zai)作(zuo)用認識不足,只一(yi)味追求(qiu)眼前的經濟利益,沒(mei)有(you)在(zai)(zai)城建檔(dang)案管理工作(zuo)方面(mian)投入充(chong)足的經費和配(pei)備合適的人手(shou)。
2.城建檔案管理工作人員檔案知識匱(kui)乏。

4.檔案室(shi)或資料室(shi)條件差,投入經費嚴重不足,空間小

二、城建檔案管理工作的發展(zhan)對策
1.加大宣傳(chuan)力度,提(ti)高(gao)建設單位建檔工作(zuo)的積極性。

(二)機構人(ren)(ren)員(yuan)要(yao)到位。私營企業(ye)(ye)具有“多、小(xiao)、散”的(de)(de)特點(dian)。在私營企業(ye)(ye)中都要(yao)像國有企業(ye)(ye)那樣(yang)建立(li)經(jing)審(shen)(shen)會(hui)形成完整的(de)(de)一套(tao)班(ban)子(zi)是難(nan)以做到的(de)(de),應根據私營企業(ye)(ye)實際(ji)需要(yao)和職(zhi)工的(de)(de)人(ren)(ren)數,來(lai)確定(ding)(ding)設(she)置經(jing)審(shen)(shen)會(hui)或(huo)經(jing)審(shen)(shen)小(xiao)組(zu)(zu)。在一般情況(kuang)下,企業(ye)(ye)規模較(jiao)大,經(jing)營穩定(ding)(ding)、人(ren)(ren)數較(jiao)多的(de)(de)可以考慮(lv)建立(li)經(jing)審(shen)(shen)會(hui),委(wei)員(yuan)會(hui)組(zu)(zu)成人(ren)(ren)員(yuan)3-7人(ren)(ren),經(jing)審(shen)(shen)主(zhu)任(ren)由工會(hui)副主(zhu)席(xi)或(huo)專業(ye)(ye)財會(hui)人(ren)(ren)員(yuan)擔任(ren);企業(ye)(ye)規模較(jiao)小(xiao),人(ren)(ren)數偏少不(bu)足10人(ren)(ren)的(de)(de)可以設(she)置經(jing)審(shen)(shen)小(xiao)組(zu)(zu)并配備一名工會(hui)經(jing)審(shen)(shen)委(wei)員(yuan)負責經(jing)審(shen)(shen)工作。
(三(san))基(ji)礎工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)要(yao)(yao)(yao)到位。工(gong)會(hui)(hui)(hui)經(jing)(jing)(jing)(jing)審(shen)(shen)工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)是一項政策性、專業性很強的工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)。各私營(ying)企(qi)業工(gong)會(hui)(hui)(hui)經(jing)(jing)(jing)(jing)審(shen)(shen)組(zu)織必須建立健全(quan)經(jing)(jing)(jing)(jing)審(shen)(shen)工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)臺帳,通過工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)臺帳的形式進行(xing)具體量(liang)化。為(wei)此我們必須從組(zu)建工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)開始(shi),就(jiu)要(yao)(yao)(yao)抓(zhua)好經(jing)(jing)(jing)(jing)審(shen)(shen)規范化工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo),就(jiu)應當把基(ji)礎工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)打好,這是做好經(jing)(jing)(jing)(jing)審(shen)(shen)工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)的前(qian)提。具體規范要(yao)(yao)(yao)求(qiu)主要(yao)(yao)(yao)包(bao)括以下(xia)十個方面的內容(rong):1、工(gong)會(hui)(hui)(hui)經(jing)(jing)(jing)(jing)審(shen)(shen)組(zu)成(cheng)情(qing)況;2、工(gong)會(hui)(hui)(hui)經(jing)(jing)(jing)(jing)審(shen)(shen)會(hui)(hui)(hui)規章制度(du)文件會(hui)(hui)(hui)議(yi)紀(ji)要(yao)(yao)(yao);3、工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)計(ji)(ji)劃、總結(jie);4、工(gong)會(hui)(hui)(hui)經(jing)(jing)(jing)(jing)費(fei)計(ji)(ji)撥上解審(shen)(shen)查;5、會(hui)(hui)(hui)費(fei)收(shou)入審(shen)(shen)查;6、工(gong)會(hui)(hui)(hui)經(jing)(jing)(jing)(jing)費(fei)收(shou)支(zhi)決算審(shen)(shen)計(ji)(ji);7、工(gong)會(hui)(hui)(hui)經(jing)(jing)(jing)(jing)費(fei)收(shou)支(zhi)預算審(shen)(shen)查;8、經(jing)(jing)(jing)(jing)審(shen)(shen)會(hui)(hui)(hui)委員會(hui)(hui)(hui)活動紀(ji)錄;9、參加上級工(gong)會(hui)(hui)(hui)經(jing)(jing)(jing)(jing)審(shen)(shen)會(hui)(hui)(hui)會(hui)(hui)(hui)議(yi)、培訓情(qing)況;10、經(jing)(jing)(jing)(jing)審(shen)(shen)論文、信息情(qing)況等。上述這些內容(rong)應隨時跟蹤,詳(xiang)實記錄并進行(xing)資料整理、分類、裝訂成(cheng)冊,以便作(zuo)(zuo)(zuo)(zuo)(zuo)為(wei)將來工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)參考或考核的重(zhong)要(yao)(yao)(yao)依據。
(四)執行制(zhi)(zhi)度(du)(du)(du)(du)要(yao)(yao)到位。私(si)營(ying)企業工(gong)(gong)會經審(shen)(shen)(shen)組織應根(gen)據(ju)工(gong)(gong)會經審(shen)(shen)(shen)組織的職責和(he)任務(wu),建立和(he)完善各項工(gong)(gong)作(zuo)制(zhi)(zhi)度(du)(du)(du)(du)包括學(xue)習(xi)制(zhi)(zhi)度(du)(du)(du)(du)、會議(yi)制(zhi)(zhi)度(du)(du)(du)(du)、審(shen)(shen)(shen)查(審(shen)(shen)(shen)計)制(zhi)(zhi)度(du)(du)(du)(du)、財務(wu)內控(kong)制(zhi)(zhi)度(du)(du)(du)(du)、培訓制(zhi)(zhi)度(du)(du)(du)(du)、調研制(zhi)(zhi)度(du)(du)(du)(du)、檔案(an)管理制(zhi)(zhi)度(du)(du)(du)(du)和(he)獎勵制(zhi)(zhi)度(du)(du)(du)(du)等(deng)。有計劃(hua)、有步驟地結(jie)(jie)合企業實際依照制(zhi)(zhi)度(du)(du)(du)(du)規(gui)定和(he)要(yao)(yao)求,因地制(zhi)(zhi)宜地開展工(gong)(gong)作(zuo)。如學(xue)習(xi)制(zhi)(zhi)度(du)(du)(du)(du):一年安排(pai)兩次政(zheng)治、業務(wu)學(xue)習(xi),學(xue)習(xi)上級(ji)指示、財經政(zheng)策、經審(shen)(shen)(shen)業務(wu)和(he)有關財務(wu)知識。會議(yi)制(zhi)(zhi)度(du)(du)(du)(du):年初、年中召開經審(shen)(shen)(shen)會全委會議(yi)研究布(bu)置(zhi)、總結(jie)(jie)、分析工(gong)(gong)作(zuo)中存在的問題和(he)經驗(yan)教訓等(deng),把各項制(zhi)(zhi)度(du)(du)(du)(du)貫穿于經審(shen)(shen)(shen)工(gong)(gong)作(zuo)的全過(guo)程。

一(yi)、加強學(xue)習,切實提(ti)高思想認(ren)識
教(jiao)育是一(yi)個地區(qu)經濟社(she)會發(fa)展水平的(de)(de)(de)主要(yao)(yao)標志,是市域(yu)軟(ruan)實力、軟(ruan)環境(jing)建(jian)(jian)設(she)的(de)(de)(de)重要(yao)(yao)組(zu)成部分(fen),在(zai)招商引資(zi)和社(she)會發(fa)展環境(jing)建(jian)(jian)設(she)中具有不(bu)(bu)可替代的(de)(de)(de)作(zuo)用。近幾年來,我(wo)們以師(shi)德(de)師(shi)風(feng)建(jian)(jian)設(she)和機關(guan)效能建(jian)(jian)設(she)為主線,狠抓了(le)教(jiao)育系(xi)統政風(feng)行(xing)風(feng)建(jian)(jian)設(she),教(jiao)育發(fa)展環境(jing)得到了(le)一(yi)定程(cheng)度的(de)(de)(de)改善。但總體上看,仍然存(cun)在(zai)不(bu)(bu)少問題。加(jia)班加(jia)點、有償補課、亂印濫發(fa)資(zi)料、體罰和變相體罰學(xue)生(sheng)等(deng)不(bu)(bu)良(liang)現象還在(zai)部分(fen)學(xue)校和少數教(jiao)師(shi)中間存(cun)在(zai)。這些既損害了(le)師(shi)生(sheng)合法權益,影響了(le)教(jiao)育形象,也不(bu)(bu)利于我(wo)市優化發(fa)展環境(jing)建(jian)(jian)設(she)工作(zuo),應引起我(wo)們的(de)(de)(de)高度重視。
各(ge)學校(xiao)、各(ge)單(dan)(dan)位要結合(he)日常(chang)政(zheng)治學習和(he)師德(de)師風教(jiao)(jiao)(jiao)(jiao)育(yu),進(jin)(jin)一步加強(qiang)宣(xuan)傳教(jiao)(jiao)(jiao)(jiao)育(yu)工(gong)作。通過(guo)宣(xuan)傳教(jiao)(jiao)(jiao)(jiao)育(yu),使廣(guang)大教(jiao)(jiao)(jiao)(jiao)職工(gong)充分認識(shi)到,開(kai)展(zhan)優(you)化(hua)(hua)發(fa)展(zhan)環(huan)境(jing)考核評價(jia),既是優(you)化(hua)(hua)我(wo)市(shi)經濟社會發(fa)展(zhan)環(huan)境(jing)的需(xu)(xu)要,是市(shi)委、市(shi)政(zheng)府的統一部署;也是辦好(hao)人(ren)(ren)(ren)民(min)滿(man)意(yi)教(jiao)(jiao)(jiao)(jiao)育(yu),促進(jin)(jin)我(wo)市(shi)教(jiao)(jiao)(jiao)(jiao)育(yu)事業健康發(fa)展(zhan)的內在(zai)需(xu)(xu)要,是人(ren)(ren)(ren)民(min)群眾和(he)社會各(ge)界對教(jiao)(jiao)(jiao)(jiao)育(yu)的期盼和(he)希望(wang)。各(ge)學校(xiao)、各(ge)單(dan)(dan)位必須將此作為當(dang)前工(gong)作重(zhong)點,擺(bai)在(zai)重(zhong)要議事日程,切實抓(zhua)緊抓(zhua)好(hao)。要通過(guo)宣(xuan)傳教(jiao)(jiao)(jiao)(jiao)育(yu),在(zai)教(jiao)(jiao)(jiao)(jiao)職工(gong)中牢固樹立“辦人(ren)(ren)(ren)民(min)滿(man)意(yi)教(jiao)(jiao)(jiao)(jiao)育(yu)人(ren)(ren)(ren)人(ren)(ren)(ren)有責(ze)”、“優(you)化(hua)(hua)教(jiao)(jiao)(jiao)(jiao)育(yu)發(fa)展(zhan)環(huan)境(jing)人(ren)(ren)(ren)人(ren)(ren)(ren)有責(ze)”的從教(jiao)(jiao)(jiao)(jiao)理念,并采取有效措施,廣(guang)泛動員(yuan)、鼓勵、支持廣(guang)大教(jiao)(jiao)(jiao)(jiao)職員(yuan)工(gong)不斷加強(qiang)個人(ren)(ren)(ren)修養、提高業務(wu)技(ji)能、規范(fan)從教(jiao)(jiao)(jiao)(jiao)行為,爭(zheng)做(zuo)人(ren)(ren)(ren)民(min)滿(man)意(yi)教(jiao)(jiao)(jiao)(jiao)師,自覺為優(you)化(hua)(hua)教(jiao)(jiao)(jiao)(jiao)育(yu)發(fa)展(zhan)環(huan)境(jing)做(zuo)出積(ji)極貢獻。
二、明確(que)重點,抓好自查(cha)整(zheng)改工(gong)作
根據市(shi)委、市(shi)政(zheng)府相關文(wen)件(jian)精(jing)神,目(mu)前市(shi)優化發(fa)展環境(jing)考核主要考核內容如(ru)下:(1)市(shi)委、市(shi)政(zheng)府重大決策、部(bu)署的貫徹落(luo)實情(qing)況(kuang);(2)各級領導批示(shi)件(jian)(含書記及(ji)市(shi)長信箱(xiang)、市(shi)長熱(re)線),市(shi)委、市(shi)政(zheng)府各類會議紀要,人大建議及(ji)政(zheng)協(xie)委員提(ti)案(an)等辦理落(luo)實情(qing)況(kuang);(3)企(qi)業、群眾反應的各類問題(包(bao)括(kuo)各類舉(ju)報、投訴(su))以及(ji)各類件(jian)、行風熱(re)線的辦理與回(hui)復(fu)情(qing)況(kuang);(4)招商引資(zi)完成情(qing)況(kuang);(5)市(shi)委“五辦”作(zuo)風和(he)“八個(ge)嚴(yan)禁”紀律執行情(qing)況(kuang)(具體要求參見附(fu)件(jian));(6)上級部(bu)門、領導及(ji)市(shi)優化發(fa)展環境(jing)領導小組交辦的其他工(gong)作(zuo)。
凡(fan)涉及上述范(fan)疇的(de)(de)具體事項,各(ge)(ge)單(dan)位(wei)(wei)主要(yao)(yao)(yao)(yao)負責人(ren)要(yao)(yao)(yao)(yao)親(qin)自抓(zhua)(zhua)、親(qin)自督辦。常規性(xing)工作(zuo)(zuo)(zuo)如學(xue)籍管理、接待、群(qun)眾(zhong)咨詢答(da)疑、學(xue)校對(dui)外電(dian)話的(de)(de)接傳等,要(yao)(yao)(yao)(yao)明(ming)確專人(ren)負責,并進(jin)行(xing)必(bi)要(yao)(yao)(yao)(yao)的(de)(de)培訓,以(yi)確保(bao)各(ge)(ge)項工作(zuo)(zuo)(zuo)都(dou)能在規定(ding)時間(jian)內按(an)(an)要(yao)(yao)(yao)(yao)求(qiu)(qiu)、保(bao)質保(bao)量辦結,不(bu)出任何紕(pi)漏(lou)。“五辦”作(zuo)(zuo)(zuo)風建設和(he)“八(ba)(ba)個嚴禁”紀(ji)(ji)律(lv)要(yao)(yao)(yao)(yao)求(qiu)(qiu)是(shi)考(kao)核的(de)(de)重(zhong)點,各(ge)(ge)學(xue)校、各(ge)(ge)單(dan)位(wei)(wei)要(yao)(yao)(yao)(yao)認真對(dui)照要(yao)(yao)(yao)(yao)求(qiu)(qiu),抓(zhua)(zhua)好(hao)自查(cha)工作(zuo)(zuo)(zuo)。特別(bie)是(shi)單(dan)位(wei)(wei)內部直接涉及為家長(chang)服務、為基層群(qun)眾(zhong)服務的(de)(de)相關管理部門和(he)工作(zuo)(zuo)(zuo)環節,各(ge)(ge)單(dan)位(wei)(wei)要(yao)(yao)(yao)(yao)組織精兵強將自查(cha)整(zheng)改,做到既不(bu)遺漏(lou)崗位(wei)(wei),也不(bu)漏(lou)查(cha)環節。良好(hao)的(de)(de)師(shi)(shi)(shi)德(de)(de)師(shi)(shi)(shi)風是(shi)教(jiao)(jiao)育(yu)系(xi)統落實(shi)“五辦”作(zuo)(zuo)(zuo)風和(he)“八(ba)(ba)個嚴禁”紀(ji)(ji)律(lv)要(yao)(yao)(yao)(yao)求(qiu)(qiu)的(de)(de)重(zhong)要(yao)(yao)(yao)(yao)體現,是(shi)當前影響教(jiao)(jiao)育(yu)形象和(he)教(jiao)(jiao)育(yu)系(xi)統優化發展環境工作(zuo)(zuo)(zuo)的(de)(de)關鍵因素,各(ge)(ge)學(xue)校、各(ge)(ge)單(dan)位(wei)(wei)要(yao)(yao)(yao)(yao)認真按(an)(an)照局統一部署,以(yi)師(shi)(shi)(shi)德(de)(de)師(shi)(shi)(shi)風教(jiao)(jiao)育(yu)月(yue)活動為契機,仔細查(cha)找本校、本單(dan)位(wei)(wei)所存在的(de)(de)實(shi)際問題,切實(shi)把師(shi)(shi)(shi)德(de)(de)師(shi)(shi)(shi)風教(jiao)(jiao)育(yu)抓(zhua)(zhua)緊抓(zhua)(zhua)落實(shi)。
各學(xue)校、各單位(wei)要高(gao)度重視長效機制建設(she)。要以本次自查(cha)整(zheng)改為契機,進一步完善各類工作規范和管理制度,為學(xue)校、教育持(chi)續穩定發展提供保障和支持(chi)。
三(san)、強化職責(ze),建立責(ze)任(ren)追究制度
根據市委、市政府(fu)安(an)排部署,市優化(hua)發展環境考(kao)(kao)核(he)目前主要考(kao)(kao)核(he)對(dui)象為(wei)(wei)各鎮(zhen)(街道)政府(fu)、開發區(qu)以(yi)及市直各部門等黨政機關。各學校、各二級單(dan)位(wei)的(de)表(biao)現將直接帶入對(dui)市教育局(ju)的(de)考(kao)(kao)核(he)。為(wei)(wei)抓(zhua)好(hao)考(kao)(kao)核(he)工作,目前,市教育局(ju)成立了以(yi)局(ju)黨組書記、局(ju)長同志任(ren)組長,其(qi)他班(ban)子成員為(wei)(wei)成員的(de)領導小(xiao)組,并設立了優化(hua)發展環境管理辦公室(shi)。各學校、各單(dan)位(wei)應(ying)相應(ying)明確責(ze)(ze)任(ren)領導和責(ze)(ze)任(ren)人(ren)。主要負責(ze)(ze)人(ren)要親自掛帥,率先垂范,切實履行第一責(ze)(ze)任(ren)人(ren)的(de)責(ze)(ze)任(ren)。
凡(fan)因工作失誤導(dao)致教育系(xi)統(tong)被市優化發展環境領導(dao)小組扣分的,單位當年(nian)度不(bu)得評(ping)先表優;學校主要負責人、直接責任人,除當年(nian)度不(bu)得評(ping)先表優外(wai),也不(bu)得晉(jin)職(zhi)晉(jin)級(ji),不(bu)得提(ti)拔重(zhong)用。同時按照(zhao)以下標準實施(shi)處罰:
(一)經濟處罰
(1)凡(fan)因個人工(gong)作失誤(wu)導致局優化發展環境考核(he)扣分達到1分(含1分)的,其直(zhi)接責(ze)任人,當年度校內績效工(gong)資減三(san)個月發放。在此基礎上,按照(zhao)每增加0.5分則增扣兩個月績效工(gong)資的標準逐層遞加,直(zhi)至(zhi)扣完為止。不足0.5分的按0.5分計算(suan)。
(2)凡(fan)單位導致局優化發(fa)展環境考核(he)扣分(fen)(fen)達到1.5分(fen)(fen)(含1.5分(fen)(fen))的,單位主要負(fu)責人(ren)、分(fen)(fen)管(guan)負(fu)責人(ren)當(dang)年度校(xiao)內績效工資減三個(ge)月發(fa)放(fang)。在(zai)此(ci)基礎上,按照每增(zeng)加(jia)0.5分(fen)(fen)則增(zeng)扣兩個(ge)月績效工資的標準(zhun)逐層遞加(jia),直至扣完為止;不足0.5分(fen)(fen)的按0.5分(fen)(fen)計算。

二、城(cheng)市規(gui)劃管理(li)機制(zhi)創(chuang)新的思路

三、城市規劃管理機制(zhi)創(chuang)新的操作性
1、規劃委員(yuan)會(hui)議事規則
(1)、依法行政的(de)原則。先期研究全(quan)縣發展與規(gui)(gui)(gui)劃(hua)建設的(de)重大經(jing)濟(ji)、規(gui)(gui)(gui)劃(hua)方針(zhen)政策(ce),為規(gui)(gui)(gui)劃(hua)布(bu)局決(jue)策(ce)提供(gong)重要(yao)依據;對重大規(gui)(gui)(gui)劃(hua)決(jue)策(ce)實施建設的(de)后評(ping)估(gu)。報送規(gui)(gui)(gui)劃(hua)委員(yuan)會討(tao)論(lun)重大決(jue)策(ce)性議題(ti),一般先交規(gui)(gui)(gui)劃(hua)專家咨(zi)詢委員(yuan)會討(tao)論(lun),提出意(yi)見(jian)或(huo)建議,同(tong)時對規(gui)(gui)(gui)劃(hua)管理實施中需要(yao)重視的(de)問(wen)題(ti)形成咨(zi)詢意(yi)見(jian)。咨(zi)詢成果(guo)作(zuo)為縣規(gui)(gui)(gui)劃(hua)委員(yuan)會審(shen)批重要(yao)規(gui)(gui)(gui)劃(hua)或(huo)協調決(jue)策(ce)重要(yao)規(gui)(gui)(gui)劃(hua)依據。
(2)、集體(ti)決策的(de)(de)(de)原(yuan)(yuan)則(ze)。規(gui)劃委員(yuan)會在(zai)主任的(de)(de)(de)領導下開(kai)展(zhan)工作,涉及(ji)區(qu)域規(gui)劃管理的(de)(de)(de)重大問題、全局性問題,建立集體(ti)決策制(zhi)度;定(ding)期和不定(ding)期召(zhao)開(kai)由主任主持(chi)的(de)(de)(de)工作例會。規(gui)劃項(xiang)目(mu)(mu)集體(ti)審核后,按(an)照“公(gong)開(kai)、公(gong)平、公(gong)正”的(de)(de)(de)原(yuan)(yuan)則(ze),由主任簽署會議紀(ji)要,各成員(yuan)單位按(an)照各自分工落實具(ju)體(ti)措施(shi)。規(gui)劃委員(yuan)會會議必須(xu)堅持(chi)回避的(de)(de)(de)原(yuan)(yuan)則(ze)。凡所審議的(de)(de)(de)項(xiang)目(mu)(mu)與委員(yuan)本人或(huo)其所在(zai)組織有(you)直接(jie)或(huo)間接(jie)的(de)(de)(de)利(li)益關系(xi)時,有(you)關人員(yuan)應在(zai)會議召(zhao)開(kai)前向會議召(zhao)集人申請回避。
(3)、促(cu)進發(fa)展的(de)原則。規(gui)劃(hua)(hua)委員會通過強化政府對規(gui)劃(hua)(hua)建(jian)設的(de)控制,確保(bao)規(gui)劃(hua)(hua)的(de)科學性、前(qian)瞻性和可操作性;按照(zhao)“布(bu)局合(he)理、層次分(fen)明(ming)、功能完善、有序(xu)發(fa)展”的(de)原則,實(shi)現“工業向園區集(ji)中、居住向城鎮(zhen)集(ji)中、土地向規(gui)模經營(ying)集(ji)中”的(de)目標(biao),優化配(pei)置資(zi)源的(de)同時,實(shi)行規(gui)劃(hua)(hua)的(de)全覆蓋,使各專業規(gui)劃(hua)(hua)寬到邊、深到底,形成合(he)力。
2、規(gui)劃專家(jia)咨(zi)詢委員會議事(shi)規(gui)則
(1)、科學(xue)合理(li)(li)的(de)原(yuan)則。本著科學(xue)探索、合理(li)(li)布(bu)局的(de)原(yuan)則,加(jia)強區域(yu)經濟、社會(hui)、文(wen)化(hua)、環境(jing)的(de)研(yan)究,加(jia)強可持(chi)續發展(zhan)的(de)力度,探索區域(yu)規劃的(de)發展(zhan)戰略。
(2)、集體(ti)探(tan)討(tao)的原則。集體(ti)討(tao)論,從各個(ge)不同領域、不同角度(du)探(tan)討(tao)發(fa)展思路(lu),為規(gui)劃委員會對區域重大規(gui)劃做出決策提供咨詢和依(yi)據。
(3)、促(cu)(cu)進發展(zhan)的原則。集思(si)廣(guang)益,發揮專(zhuan)家咨詢成果的有(you)效作(zuo)用,促(cu)(cu)進區域的經濟、文化、社會和(he)生態環境發展(zhan),提升區域的整體品(pin)質。

關鍵詞:戰略意識
華為(wei),這個(ge)名字在人們心目(mu)中總是和“狼(lang)”聯系在一起(qi),大家一提“華為(wei)”,就會認為(wei)它是“狼(lang)性”文化(hua)的(de)代名詞。
不過(guo),通過(guo)《華為基本法》的學習(xi),我們(men)(men)認為,這匹“狼”真的不簡單(dan),最大的體(ti)現就在于:它會在奔跑中思考。我們(men)(men)稱之為“戰略意識”。
通信設備這(zhe)個行業(ye),競爭是非常殘酷(ku)的,一不留神就會被客戶淘汰,企業(ye)會面臨“餓死(si)”的命(ming)運。因此,在(zai)這(zhe)個行業(ye)里(li),無論你是誰,必須時刻處于“奔跑(pao)”的狀態(tai)。
然而,華(hua)為與其它企業不同的(de)是,能夠(gou)在“奔(ben)跑(pao)”中思考“我(wo)們是誰,我(wo)們何(he)(he)去何(he)(he)從,我(wo)們如何(he)(he)實現夢想”。
1、明確的取舍。
“為(wei)(wei)了使(shi)(shi)華為(wei)(wei)成為(wei)(wei)世界一(yi)流的(de)設(she)備供應商,我們(men)將永不進入信息(xi)服務業。通(tong)過(guo)無依賴的(de)市場壓力傳遞(di),使(shi)(shi)內部機(ji)制永遠處(chu)于激活狀態。” 這(zhe)句話雖然很簡短,卻闡明了華為(wei)(wei)“做什么”和“不做什么”。中國(guo)民營(ying)企(qi)(qi)業為(wei)(wei)什么學不會華為(wei)(wei)?問題就在這(zhe)里,歸結于一(yi)個字:貪(tan)。過(guo)度的(de)貪(tan)婪和擴張,導致無數(shu)個企(qi)(qi)業半(ban)途而廢。
在企業家(jia)面(mian)(mian)前(qian),常常會(hui)出現諸(zhu)多(duo)“誘惑”。而恰恰在這(zhe)些誘惑面(mian)(mian)前(qian),很(hen)多(duo)企業家(jia)把(ba)持不住,以“試(shi)試(shi)看”的僥幸心理進入市場,最后,連(lian)本帶(dai)息付諸(zhu)東流(liu)。

2、均衡發展觀。
很多民(min)營企業(ye)(ye)都(dou)會(hui)出現這樣的(de)現象(xiang):業(ye)(ye)績(ji)好的(de)時候,顧不(bu)上管(guan)(guan)理;業(ye)(ye)績(ji)不(bu)好的(de)時候,心思也(ye)不(bu)在于(yu)管(guan)(guan)理。因此,“管(guan)(guan)理”二字對于(yu)民(min)營企業(ye)(ye)而言(yan),是(shi)永恒的(de)“缺(que)憾”。

看到這些(xie)數(shu)據,我們(men)不得(de)不為(wei)華(hua)(hua)為(wei)豎一個大拇(mu)指,不得(de)不承認他們(men)在客戶服務方面所做的(de)(de)努力(li)和(he)投入。中國民營企(qi)業(ye)為(wei)什么出(chu)不來“第二個華(hua)(hua)為(wei)”?理由就在這里。多數(shu)民營企(qi)業(ye),都是以(yi)“投機”為(wei)目的(de)(de),沒(mei)有把客戶的(de)(de)需求真正(zheng)放在“心”上(shang),更沒(mei)有持之以(yi)恒(heng)對“品質”的(de)(de)堅持,更沒(mei)有給(gei)客戶提(ti)供“終身服務”承諾。所以(yi)才會出(chu)現那么多質量案件(jian)。因此,在這里,我們(men)借用華(hua)(hua)為(wei)的(de)(de)一句(ju)話告誡大家:
質量(liang)是(shi)我(wo)們的自尊心(xin)。
團結(jie)一切可以(yi)團結(jie)的人
關鍵詞:團隊意識
在自然界,可能“狼”比“人”還要有團隊精神。它(ta)們捕(bu)獵時,不會(hui)輕(qing)易(yi)地(di)(di)單獨行動,有嚴(yan)密的組織(zhi)行為,而且,根據(ju)地(di)(di)形和氣候條件,合理(li)安排(pai)行動計劃。
被業界譽為(wei)“狼(lang)性十足(zu)”的(de)華為(wei)也不(bu)例外,時刻(ke)強調團隊精神,時刻(ke)強調華為(wei)的(de)整體性。在《華為(wei)基本法》中,有這樣一段描述(shu):“華為(wei)始終(zhong)是一個整體,傾(qing)聽不(bu)同意(yi)見,團結(jie)一切可以(yi)團結(jie)的(de)人。
這句(ju)話有三個要點:第一(yi)、強調(diao)“整體”的概念,第二、允許“”,第三、跨越“小團隊(dui)(dui)”營造“大團隊(dui)(dui)”。這似乎(hu)對(dui)“團隊(dui)(dui)精神”做(zuo)了(le)一(yi)個新(xin)的定義。
在“整體”的(de)概念上,華(hua)為有詳(xiang)細的(de)規定。比(bi)如:強調“集體奮斗”,而“不(bu)(bu)遷就有功的(de)員(yuan)工”等。尤其,“不(bu)(bu)遷就有功的(de)員(yuan)工”這(zhe)一條出乎我們的(de)預料,不(bu)(bu)得不(bu)(bu)讓我們刮目相(xiang)看(kan)。
在“”方面(mian),華為(wei)也有(you)進一步的(de)描述。比如(ru),提(ti)(ti)到“首(shou)長(chang)辦(ban)(ban)公會(hui)(hui)”時提(ti)(ti)出(chu):“各級(ji)(ji)首(shou)長(chang)辦(ban)(ban)公會(hui)(hui)的(de)討論(lun)結果,以(yi)會(hui)(hui)議紀(ji)要(yao)的(de)方式向上級(ji)(ji)呈報。報告(gao)上必須有(you)三分之二以(yi)上的(de)正式成(cheng)員(yuan)簽名,報告(gao)中(zhong)要(yao)特(te)別注明討論(lun)過程(cheng)中(zhong)的(de)不同意見。”
在(zai)“大團隊”建設(she)方面,華(hua)為更是(shi)(shi)思(si)維(wei)超(chao)前。在(zai)《華(hua)為基本法》中(zhong)這樣寫道:“華(hua)為主張在(zai)顧客、員工與合作(zuo)者之(zhi)間結(jie)成利(li)(li)益共同(tong)體。”這樣的(de)理念(nian)在(zai)中(zhong)國的(de)民(min)營(ying)企(qi)業里(li)是(shi)(shi)很(hen)少(shao)見的(de),多(duo)數企(qi)業可(ke)以(yi)在(zai)“員工之(zhi)間”或“與合作(zuo)者之(zhi)間”是(shi)(shi)可(ke)以(yi)講“利(li)(li)益共同(tong)體”概(gai)念(nian),但是(shi)(shi)在(zai)“顧客和企(qi)業之(zhi)間”很(hen)少(shao)提(ti)這個概(gai)念(nian)。
更令人驚嘆的(de)(de)是,華為(wei)沒有(you)僅(jin)僅(jin)停留在(zai)理(li)念層面,在(zai)實際工(gong)作(zuo)中確確實實按照這樣的(de)(de)理(li)念開展工(gong)作(zuo),團(tuan)(tuan)結一(yi)切可以團(tuan)(tuan)結的(de)(de)力量,打造了一(yi)個前(qian)所(suo)未(wei)有(you)的(de)(de)強(qiang)(qiang)大(da)(da)的(de)(de)商業生物鏈。超過2000億的(de)(de)營業額就(jiu)是強(qiang)(qiang)大(da)(da)的(de)(de)證明。
蛻變,為了美麗(li)飛翔
關鍵詞:創新意識
創新,這個詞幾乎在所有企(qi)(qi)業里成為口頭禪(chan)。然而(er),遺(yi)憾的是,沒有幾個企(qi)(qi)業依靠(kao)“創新”真正(zheng)成功(gong)過。因為,多數企(qi)(qi)業把“創新”當成“新奇(qi)特”,當成“藝術”,當成“一股新鮮勁(jing)兒(er)”,沒有形成科學的機制和(he)體系(xi),沒有把創新融入到實際的工作當中。
不過,華為改變了這一局面。
他們把“創新(xin)”確確實(shi)(shi)實(shi)(shi)落到了(le)實(shi)(shi)處。在(zai)《華為基本法(fa)》中有這(zhe)樣(yang)一句話:“創新(xin)要體(ti)現在(zai)行動,而不僅僅停留(liu)在(zai)建(jian)議”。這(zhe)就是華為與其它企業(ye)的區(qu)別(bie)之處。
圍(wei)繞這(zhe)個區別(bie),任正非(fei)有句經典的(de)觀(guan)點:“小改進,大獎勵;大建議,只鼓(gu)勵”。他(ta)在(zai)《華為(wei)的(de)冬天(tian)》里這(zhe)樣寫道(dao):“我們(men)有些員(yuan)工(gong),交給他(ta)一件事,他(ta)能(neng)干出十件事來,這(zhe)種創新就不需要,是無能(neng)的(de)表現。這(zhe)是制(zhi)造(zao)垃(la)圾,這(zhe)類員(yuan)工(gong)要降低(di)使用。”
創新(xin)(xin)(xin)(xin)是什么?我們認為,創新(xin)(xin)(xin)(xin)是一種科學,用(yong)科學的(de)(de)(de)流程和(he)方(fang)法,創造企業(ye)戰略所(suo)需要的(de)(de)(de)新(xin)(xin)(xin)(xin)產品、新(xin)(xin)(xin)(xin)服務(wu)以及一切可執(zhi)行的(de)(de)(de)新(xin)(xin)(xin)(xin)思路和(he)新(xin)(xin)(xin)(xin)舉(ju)(ju)動。比如:華(hua)為所(suo)開發的(de)(de)(de)“云手機(ji)”就是一種創新(xin)(xin)(xin)(xin)舉(ju)(ju)動,它敢于叫板蘋果,敢于叫板三星(xing),雖然在銷(xiao)量(liang)上打不過它們,但(dan)是這種創新(xin)(xin)(xin)(xin)精神是值(zhi)得鼓勵的(de)(de)(de)。
不過,我們認為(wei),華為(wei)最具創新(xin)的(de)舉動不是“云手機”,也不是其(qi)它產品,而是《華為(wei)基(ji)本法(fa)》。
華(hua)為制(zhi)定(ding)這個法(fa)律敢于(yu)(yu)用三年(nian)的(de)時(shi)間,組織大量的(de)人(ren)力,投入大量的(de)精力,不(bu)斷抽(chou)絲、織繭,最終大膽(dan)地破繭而(er)出,華(hua)麗重生。就像(xiang)在《華(hua)為基(ji)本法(fa)》中(zhong)所提到的(de)“敢于(yu)(yu)打破常規,走別人(ren)沒有(you)走過的(de)路;我們要善于(yu)(yu)利用有(you)節(jie)制(zhi)的(de)混(hun)沌狀(zhuang)態(tai),尋求(qiu)對未知領域研(yan)究(jiu)的(de)突破;要完善競爭(zheng)性(xing)的(de)理(li)性(xing)選擇程(cheng)序,確(que)保開發過程(cheng)的(de)成(cheng)功。”
一經形成決議,就要(yao)權威(wei)管理
關鍵詞:法治意識
企業發展需要三個階段的發展:人治、法(fa)治和心(xin)治,而且,這三個階段很難逾越。為什么多數中(zhong)(zhong)國(guo)民營企業發展不(bu)暢(chang)?主要原因(yin)就(jiu)在于從(cong)“人治”轉向“法(fa)治”的過程(cheng)中(zhong)(zhong)都夭折了。這也是為什么在中(zhong)(zhong)國(guo)迄今沒有(you)出現“第二個華為”的原因(yin)所在。
民營企業(ye)要想蛻(tui)變,就必(bi)須(xu)過(guo)這(zhe)一關,從“人治(zhi)”轉(zhuan)向“法治(zhi)”。用(yong)科(ke)學的流程和制度來(lai)管理(li)企業(ye)。在這(zhe)一點,華為是典范。
在《華為(wei)基本法》中明確提出:“決策的原則是,從賢不(bu)從眾。真理往往掌握在少數人(ren)手里,要(yao)造(zao)成(cheng)一種(zhong)環境,讓不(bu)同意見存(cun)在和(he)發表。一經形成(cheng)決議,就(jiu)要(yao)實行權威管理。”
在華為,觸犯制(zhi)(zhi)度的(de)代價是(shi)昂貴(gui)的(de),它通過《基本法》確保在制(zhi)(zhi)度面前人(ren)(ren)(ren)人(ren)(ren)(ren)平等(deng),制(zhi)(zhi)定了嚴厲的(de)獎懲(cheng)制(zhi)(zhi)度,有人(ren)(ren)(ren)一旦觸犯,絕不(bu)手軟,每年因觸犯相關制(zhi)(zhi)度被開(kai)除(chu)、處罰和降(jiang)級的(de)員(yuan)工(gong)可謂(wei)數(shu)不(bu)勝數(shu)。
說到這里,讓我們想起了在“人(ren)治(zhi)”和(he)“法治(zhi)”的(de)過(guo)渡(du)期付出過(guo)沉重代價的(de)企業:新(xin)東(dong)方。早(zao)期的(de)新(xin)東(dong)方也(ye)(ye)面臨這個問(wen)題(ti),從(cong)“人(ren)治(zhi)”怎么也(ye)(ye)轉不到“法治(zhi)”上來(lai),企業管理一度陷入混亂。在此過(guo)程中,俞敏(min)洪也(ye)(ye)曾經離開過(guo)新(xin)東(dong)方。然而(er),最后還(huan)是艱難地走(zou)出這一步,影(ying)響(xiang)“法治(zhi)”建(jian)設(she)中的(de)所有人(ren)全部被(bei)調整出來(lai)(包括(kuo)他老婆(po)),還(huan)給企業一個可(ke)進行(xing)“法治(zhi)化(hua)建(jian)設(she)”的(de)空間(jian)。
我們(men)認為(wei),民(min)營企業(ye)要想真正做大(da)(da),就必(bi)須(xu)過這(zhe)一關,遲(chi)早(zao)有(you)一天必(bi)須(xu)破釜沉舟地進行“法制化”建(jian)設。因(yin)為(wei),林子大(da)(da)了什(shen)么鳥都有(you),企業(ye)大(da)(da)了什(shen)么人(ren)都有(you),光(guang)靠“人(ren)治”是(shi)不可能管(guan)理好一個超大(da)(da)規模的企業(ye)。這(zhe)是(shi)自然規律。
在“權威管理(li)”上,華為是強硬的。曾經有一員(yuan)工(gong)給任正(zheng)非(fei)寫了一封(feng)信,信里提(ti)出對《華為基本法》以(yi)及(ji)相關理(li)念(nian)的改正(zheng)建議。然而,任正(zheng)非(fei)的答復是,讓人力資源對這位員(yuan)工(gong)進行神經科(ke)檢查。這說明什么?只要(yao)用組織智商論(lun)證(zheng)通過的東西,就不再討論(lun),要(yao)強制執行。
人力資本(ben)優先于財務資本(ben)

在一個“狼性(xing)十(shi)足”的企(qi)業里(li)還有“人(ren)性(xing)”嗎?華為能夠把(ba)人(ren)當成(cheng)人(ren)來看(kan)待嗎?
估計不少人也會提(ti)出(chu)這樣(yang)的(de)疑問。我們(men)也帶著(zhu)這樣(yang)的(de)疑問認真閱讀了《華為基本(ben)法》,結(jie)果卻(que)得到了讓(rang)我們(men)欣(xin)慰的(de)答案。
通過《華(hua)為基本(ben)法》的(de)閱讀我們(men)看(kan)到,其(qi)實“狼性”并(bing)不等于“沒有人性”。華(hua)為對人才的(de)尊重和(he)愛護還是相(xiang)當高的(de)。
在《華為基本法》中有(you)這樣(yang)一段描述:“認真負責和(he)管理(li)有(you)效的(de)員工是華為最大的(de)財富。我(wo)們強調人(ren)力資本不斷增值的(de)目標(biao)優先于財務(wu)資本增值的(de)目標(biao)。”這段話,足以(yi)說明華為“人(ren)性”的(de)一面(mian)。
不(bu)過,此刻(ke)有人(ren)會反駁(bo)“文字(zi)上的描述只是(shi)一面之詞(ci),并不(bu)代表(biao)實(shi)(shi)際”。說得對,那(nei)我(wo)們再看華為在實(shi)(shi)際當中都做了哪(na)些事情。
華(hua)(hua)為(wei),為(wei)了讓(rang)員工(gong)在華(hua)(hua)為(wei)落地生根,在全國(guo)范圍優先實施(shi)了“全員持股計劃”。也(ye)就是說,讓(rang)每(mei)個在華(hua)(hua)為(wei)工(gong)作(zuo)的(de)人都可(ke)以成為(wei)華(hua)(hua)為(wei)的(de)股東。為(wei)此,任正非是這么(me)說的(de):“一方面,普惠認同華(hua)(hua)為(wei)的(de)模范員工(gong),結成公(gong)司與員工(gong)的(de)利益與命運共同體;另一方面,將不斷地使最有責(ze)任心與才能的(de)人進入公(gong)司的(de)中堅層。”
為(wei)了實施這個計劃,任(ren)正非的股(gu)(gu)份(fen)一路(lu)被(bei)稀釋和轉讓(rang)(rang)出來,今(jin)天的任(ren)正非在華為(wei)的股(gu)(gu)份(fen)只有1%左右(you),其余的股(gu)(gu)份(fen)全部分給(gei)了員(yuan)工(gong),從而讓(rang)(rang)員(yuan)工(gong)變成企業真正的主人。
這一(yi)舉動和數字,足(zu)以讓我們感嘆,給(gei)華為(wei)(wei)的(de)人才建設(she)給(gei)予(yu)一(yi)個肯(ken)定(ding)(ding)。看來在《華為(wei)(wei)基本法》中所說的(de)“我們不(bu)(bu)搞終(zhong)身雇(gu)傭制,但(dan)這不(bu)(bu)等于不(bu)(bu)能終(zhong)身在華為(wei)(wei)工作,我們決不(bu)(bu)讓雷鋒吃(chi)虧,奉(feng)獻(xian)者定(ding)(ding)當得到合理的(de)回(hui)報”不(bu)(bu)是一(yi)句空(kong)話(hua)。
春天(tian)里(li),時刻準(zhun)備(bei)著過冬

現在,恰好是春暖花(hua)(hua)(hua)開(kai)的(de)(de)(de)(de)季節,院子里(li)的(de)(de)(de)(de)迎春花(hua)(hua)(hua)開(kai)了,馬(ma)路邊的(de)(de)(de)(de)梅花(hua)(hua)(hua)開(kai)了,公園(yuan)里(li)的(de)(de)(de)(de)桃(tao)花(hua)(hua)(hua)也(ye)已(yi)經含苞待放,一股暖流抑制不(bu)住春天的(de)(de)(de)(de)喜悅向我們涌動。此刻,在所(suo)有(you)人的(de)(de)(de)(de)腦(nao)海里(li)回(hui)蕩著更(geng)加(jia)美好的(de)(de)(de)(de)氣息(xi)、更(geng)加(jia)絢爛的(de)(de)(de)(de)景色,沒有(you)人此刻會惦記來(lai)年的(de)(de)(de)(de)冬天。
然而,華(hua)為不是。華(hua)為在它最為輝(hui)煌的時候,業(ye)績(ji)最好的時候,總是想著“萬(wan)一(yi)哪一(yi)天(tian)冬天(tian)來(lai)了怎么辦”。這種危機(ji)意識,也讓我們肅然起敬。
任正(zheng)非在《華為的(de)(de)冬天》一(yi)文中(zhong)這(zhe)樣(yang)寫道:“公司所有員工(gong)是否(fou)考慮過,如(ru)果有一(yi)天,公司銷(xiao)售(shou)額下(xia)滑、利潤下(xia)滑甚至會(hui)破產,我(wo)們(men)怎(zen)么辦?我(wo)們(men)公司的(de)(de)太平(ping)時間太長了(le),在和平(ping)時期升(sheng)的(de)(de)官太多(duo)了(le),這(zhe)也(ye)許就是我(wo)們(men)的(de)(de)災難。泰(tai)坦尼克號(hao)也(ye)是在一(yi)片歡呼聲中(zhong)出的(de)(de)海。而且(qie)我(wo)相信,這(zhe)一(yi)天一(yi)定會(hui)到來(lai)(lai)。面對這(zhe)樣(yang)的(de)(de)未來(lai)(lai),我(wo)們(men)怎(zen)樣(yang)來(lai)(lai)處理,我(wo)們(men)是不是思(si)考過。我(wo)們(men)好多(duo)員工(gong)盲目自豪,盲目樂觀,如(ru)果想過的(de)(de)人太少,也(ye)許就快來(lai)(lai)臨了(le)。居安思(si)危(wei),不是危(wei)言聳聽。”
讀到這篇文(wen)章的時候,我們對中國民(min)營(ying)(ying)企業的未來,捏了(le)一(yi)把汗。因(yin)為(wei),讓我們看(kan)看(kan)其它民(min)營(ying)(ying)企業老板成功之后是怎(zen)么做的。這樣一(yi)句(ju)順口溜(liu)足以說明問題:
“自恃才高(gao)八(ba)斗,實(shi)同弱智一(yi)(yi)般(ban)。表(biao)面干練果敢,實(shi)則優柔寡(gua)斷。大權獨霸獨攬(lan),堪稱一(yi)(yi)手遮天(tian)。一(yi)(yi)生孤(gu)苦伶(ling)仃,疑心(xin)勝過(guo)曹瞞。訓(xun)人(ren)頭(tou)(tou)頭(tou)(tou)是道,可謂大言(yan)不(bu)(bu)慚(can)。深交(jiao)酒肉之(zhi)朋,冷落(luo)能忠(zhong)(zhong)智賢。家里紅旗(qi)(qi)不(bu)(bu)倒,外(wai)邊彩旗(qi)(qi)飄揚。不(bu)(bu)思檢(jian)點(dian)己過(guo),秘(mi)書輪番(fan)更(geng)換(huan)。日(ri)漸昏庸透(tou)頂(ding),阻塞(sai)忠(zhong)(zhong)諫之(zhi)言(yan)。導(dao)致公司上下(xia),亂作散(san)沙(sha)一(yi)(yi)盤(pan)。眼看末日(ri)臨近,滅(mie)亡就在目(mu)前。如此英明老板,堪稱絕(jue)頂(ding)混蛋。“
大家(jia)看看,這樣的老(lao)板還(huan)有什么可發展的空間呢?一個企業在(zai)這樣的環境(jing)里,還(huan)有什么未來呢?這就是我們中國(guo)不少民營(ying)“短命”的根源(yuan):小富即安,小富即亂,毫無危機意識。
我們曾經總結過中國民營(ying)企(qi)業存在的(de)(de)問(wen)題,即(ji):粗放(fang)的(de)(de)戰略,脆(cui)弱的(de)(de)品牌(pai),殘缺的(de)(de)制度,盲目(mu)的(de)(de)擴張(zhang),權術而非管理,投機而非堅(jian)持,口號而非文化,選(xuan)人而非用人。
我們認為,如果中國民營企(qi)業(ye)不能解決好(hao)這問題,“持(chi)續發展”、“百(bai)年基(ji)業(ye)”等(deng)所有(you)的(de)豪言壯(zhuang)語只是(shi)一句空話,中國的(de)民營企(qi)業(ye)不可(ke)能逃脫“短(duan)命”的(de)怪圈。
因此,我們在這里強烈推(tui)薦《華(hua)(hua)(hua)為基本法(fa)》,強烈推(tui)薦我們所總結的(de)(de)“華(hua)(hua)(hua)為七(qi)大意識”,希望我們的(de)(de)民營企業要認認真真向華(hua)(hua)(hua)為學習,學習它(ta)的(de)(de)理念,學習它(ta)的(de)(de)方法(fa),更要學習它(ta)的(de)(de)行動,為我們民族工業的(de)(de)振興做出貢(gong)獻(xian)。

近(jin)年隨著國(guo)有企業改(gai)革(ge)步(bu)伐的(de)加緊(jin)加快(kuai),在(zai)(zai)依法(fa)(fa)處(chu)置(zhi)(zhi)無行業發(fa)(fa)展前景且效益極差的(de)國(guo)有企業資(zi)(zi)產(chan)及妥善(shan)安置(zhi)(zhi)這些國(guo)企職(zhi)(zhi)工的(de)工作(zuo)中(zhong)與當地(di)政(zheng)府政(zheng)策性支持是分(fen)(fen)不開的(de)。但是在(zai)(zai)筆者處(chu)理國(guo)企改(gai)制的(de)有關糾紛中(zhong)發(fa)(fa)現這樣(yang)的(de)一個現象(xiang),即有些因經營發(fa)(fa)生(sheng)嚴重困(kun)難的(de)國(guo)有企業,因受到(dao)破(po)產(chan)法(fa)(fa)的(de)限制無法(fa)(fa)正常進入破(po)產(chan)程序而(er)是按“關門(men)走(zou)人”的(de)方(fang)式對(dui)國(guo)有企業資(zi)(zi)產(chan)進行清盤或者清產(chan)核資(zi)(zi)后實(shi)施轉讓,對(dui)國(guo)有企業職(zhi)(zhi)工實(shi)施給(gei)錢走(zou)人的(de)方(fang)法(fa)(fa)分(fen)(fen)流(liu)(liu)安置(zhi)(zhi),而(er)在(zai)(zai)這一過(guo)程中(zhong)為(wei)(wei)達到(dao)分(fen)(fen)流(liu)(liu)安置(zhi)(zhi)職(zhi)(zhi)工的(de)目的(de),卻采(cai)取名為(wei)(wei)自(zi)愿實(shi)為(wei)(wei)強制的(de)方(fang)式要求企業職(zhi)(zhi)工自(zi)愿申請與企業訂立解(jie)(jie)除(chu)勞(lao)動關系協議,并以當地(di)政(zheng)府決定的(de) “職(zhi)(zhi)工分(fen)(fen)流(liu)(liu)安置(zhi)(zhi)基準日”作(zuo)為(wei)(wei)解(jie)(jie)除(chu)勞(lao)動關系的(de)時點及作(zuo)為(wei)(wei)解(jie)(jie)除(chu)勞(lao)動關系的(de)計付經濟(ji)補償(chang)金終止日的(de)依據。對(dui)此,筆者認為(wei)(wei),由政(zheng)府來確(que)定企業職(zhi)(zhi)工分(fen)(fen)流(liu)(liu)安置(zhi)(zhi)基準日的(de)作(zuo)法(fa)(fa)與我國(guo)現在(zai)(zai)法(fa)(fa)律(lv)規定不符,且易發(fa)(fa)生(sheng)勞(lao)動爭(zheng)議及可能引發(fa)(fa)行政(zheng)糾紛。
首先,就(jiu)(jiu)企(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)(fa)人(ren)(ren)經(jing)(jing)(jing)(jing)營(ying)自(zi)主(zhu)權(quan)(quan)(quan)而(er)言(yan),對(dui)無發(fa)(fa)展(zhan)前(qian)景(jing)及(ji)(ji)經(jing)(jing)(jing)(jing)營(ying)發(fa)(fa)生嚴重困難的(de)(de)(de)(de)(de)(de)企(qi)(qi)(qi)業(ye),根據國(guo)有資產管理(li)程序及(ji)(ji)企(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)(fa)規定(ding)(ding)企(qi)(qi)(qi)業(ye)依(yi)法(fa)(fa)(fa)(fa)享(xiang)有申請(qing)注銷權(quan)(quan)(quan)或(huo)停止經(jing)(jing)(jing)(jing)營(ying)權(quan)(quan)(quan)。而(er)企(qi)(qi)(qi)業(ye)作(zuo)為(wei)市場(chang)(chang)主(zhu)體其(qi)(qi)生存或(huo)發(fa)(fa)展(zhan)應(ying)當(dang)(dang)由經(jing)(jing)(jing)(jing)濟(ji)市場(chang)(chang)運作(zuo)規律來(lai)決定(ding)(ding),這(zhe)是(shi)不(bu)以(yi)任何(he)人(ren)(ren)或(huo)哪個政(zheng)(zheng)(zheng)府的(de)(de)(de)(de)(de)(de)意(yi)志所支配(pei)的(de)(de)(de)(de)(de)(de)。其(qi)(qi)次(ci),就(jiu)(jiu)企(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)(fa)人(ren)(ren)的(de)(de)(de)(de)(de)(de)用(yong)人(ren)(ren)自(zi)主(zhu)權(quan)(quan)(quan)而(er)言(yan),根據《勞(lao)(lao)動(dong)(dong)(dong)(dong)法(fa)(fa)(fa)(fa)》及(ji)(ji)勞(lao)(lao)動(dong)(dong)(dong)(dong)法(fa)(fa)(fa)(fa)相關(guan)配(pei)套法(fa)(fa)(fa)(fa)規,企(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)(fa)人(ren)(ren)依(yi)法(fa)(fa)(fa)(fa)享(xiang)有人(ren)(ren)員(yuan)(yuan)的(de)(de)(de)(de)(de)(de)裁(cai)(cai)減權(quan)(quan)(quan)。勞(lao)(lao)動(dong)(dong)(dong)(dong)法(fa)(fa)(fa)(fa)第(di)二十七條第(di)一款規定(ding)(ding) “用(yong)人(ren)(ren)單(dan)位瀕臨破產進行法(fa)(fa)(fa)(fa)定(ding)(ding)整頓期間或(huo)者生產經(jing)(jing)(jing)(jing)營(ying)狀況(kuang)發(fa)(fa)生嚴重困難,確需(xu)裁(cai)(cai)減人(ren)(ren)員(yuan)(yuan)的(de)(de)(de)(de)(de)(de),應(ying)當(dang)(dang)提前(qian)三(san)十日向(xiang)工(gong)會(hui)或(huo)者全體職(zhi)(zhi)工(gong)說明情況(kuang),聽取工(gong)會(hui)或(huo)者職(zhi)(zhi)工(gong)的(de)(de)(de)(de)(de)(de)意(yi)見,經(jing)(jing)(jing)(jing)向(xiang)勞(lao)(lao)動(dong)(dong)(dong)(dong)行政(zheng)(zheng)(zheng)部(bu)門報告(gao)后,可以(yi)裁(cai)(cai)減人(ren)(ren)員(yuan)(yuan)。”由此可證,依(yi)法(fa)(fa)(fa)(fa)裁(cai)(cai)員(yuan)(yuan)是(shi)企(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)(fa)人(ren)(ren)的(de)(de)(de)(de)(de)(de)法(fa)(fa)(fa)(fa)定(ding)(ding)權(quan)(quan)(quan)力,這(zhe)種權(quan)(quan)(quan)力的(de)(de)(de)(de)(de)(de)行使無需(xu)借(jie)助于國(guo)家行政(zheng)(zheng)(zheng)權(quan)(quan)(quan)的(de)(de)(de)(de)(de)(de)支持及(ji)(ji)批準。再次(ci),就(jiu)(jiu)勞(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)系(xi)的(de)(de)(de)(de)(de)(de)當(dang)(dang)事(shi)(shi)人(ren)(ren)而(er)言(yan),企(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)(fa)人(ren)(ren)與(yu)企(qi)(qi)(qi)業(ye)職(zhi)(zhi)工(gong)是(shi)勞(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)系(xi)的(de)(de)(de)(de)(de)(de)當(dang)(dang)事(shi)(shi)人(ren)(ren),而(er)在(zai)企(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)(fa)人(ren)(ren)處于法(fa)(fa)(fa)(fa)定(ding)(ding)的(de)(de)(de)(de)(de)(de)裁(cai)(cai)員(yuan)(yuan)情形下,企(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)(fa)人(ren)(ren)對(dui)企(qi)(qi)(qi)業(ye)職(zhi)(zhi)工(gong)依(yi)法(fa)(fa)(fa)(fa)享(xiang)有行使解(jie)除(chu)勞(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)系(xi)的(de)(de)(de)(de)(de)(de)解(jie)除(chu)權(quan)(quan)(quan),這(zhe)應(ying)當(dang)(dang)是(shi)企(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)(fa)人(ren)(ren)的(de)(de)(de)(de)(de)(de)自(zi)主(zhu)行為(wei),而(er)不(bu)應(ying)當(dang)(dang)由政(zheng)(zheng)(zheng)府行政(zheng)(zheng)(zheng)命令(ling)來(lai)替代,也無需(xu)政(zheng)(zheng)(zheng)府的(de)(de)(de)(de)(de)(de)文件來(lai)批準確定(ding)(ding)。再其(qi)(qi)次(ci),就(jiu)(jiu)勞(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)系(xi)內容設定(ding)(ding)原則而(er)言(yan),有關(guan)勞(lao)(lao)動(dong)(dong)(dong)(dong)權(quan)(quan)(quan)益與(yu)勞(lao)(lao)動(dong)(dong)(dong)(dong)義(yi)務(wu)的(de)(de)(de)(de)(de)(de)內容約定(ding)(ding)是(shi)由勞(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)系(xi)當(dang)(dang)事(shi)(shi)人(ren)(ren)依(yi)法(fa)(fa)(fa)(fa)設定(ding)(ding)的(de)(de)(de)(de)(de)(de),勞(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)系(xi)的(de)(de)(de)(de)(de)(de)建立與(yu)解(jie)除(chu)也基于勞(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)系(xi)當(dang)(dang)事(shi)(shi)人(ren)(ren)依(yi)法(fa)(fa)(fa)(fa)定(ding)(ding)情形而(er)發(fa)(fa)生的(de)(de)(de)(de)(de)(de),同樣不(bu)得由其(qi)(qi)他主(zhu)體的(de)(de)(de)(de)(de)(de)替代。
本文中(zhong)所稱(cheng)(cheng)“企(qi)(qi)業(ye)(ye)(ye)職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)分流(liu)安置基(ji)準(zhun)(zhun)(zhun)日(ri)”實質上(shang)就(jiu)是(shi)(shi)(shi)由(you)(you)政(zheng)府(fu)來(lai)確(que)定(ding)(ding)(ding)(ding)職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)與(yu)企(qi)(qi)業(ye)(ye)(ye)解(jie)(jie)(jie)除(chu)(chu)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)系(xi)的(de)(de)(de)(de)(de)(de)時(shi)間(jian),而該(gai)“基(ji)準(zhun)(zhun)(zhun)日(ri)”一(yi)(yi)旦確(que)定(ding)(ding)(ding)(ding)就(jiu)終(zhong)(zhong)止(zhi)了(le)(le)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)系(xi),這明(ming)顯不(bu)符勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)基(ji)本原(yuan)則(ze)(ze)與(yu)企(qi)(qi)業(ye)(ye)(ye)法(fa)(fa)(fa)人(ren)(ren)人(ren)(ren)格(ge)獨立性(xing)原(yuan)則(ze)(ze),而現實中(zhong)由(you)(you)政(zheng)府(fu)來(lai)確(que)定(ding)(ding)(ding)(ding)的(de)(de)(de)(de)(de)(de)這種(zhong)“基(ji)準(zhun)(zhun)(zhun)日(ri)”的(de)(de)(de)(de)(de)(de)做(zuo)法(fa)(fa)(fa),實質上(shang)是(shi)(shi)(shi)政(zheng)府(fu)超權行為(wei),政(zheng)府(fu)的(de)(de)(de)(de)(de)(de)這種(zhong)“關(guan)(guan)心”與(yu)“愛心”,在(zai)(zai)(zai)(zai)某(mou)(mou)種(zhong)情況下(xia)還(huan)成了(le)(le)引(yin)發(fa)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)爭議(yi)(yi)(yi)(yi)的(de)(de)(de)(de)(de)(de)因(yin)(yin)(yin)素(su)之(zhi)一(yi)(yi)。筆者有(you)例為(wei)證(zheng):二(er)(er)(er)OO三(san)年(nian)十(shi)二(er)(er)(er)月(yue),某(mou)(mou)國(guo)企(qi)(qi)數十(shi)名職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)向(xiang)當地勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)爭議(yi)(yi)(yi)(yi)仲裁(cai)(cai)(cai)(cai)委會(hui)申(shen)(shen)(shen)請勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)爭議(yi)(yi)(yi)(yi)仲裁(cai)(cai)(cai)(cai),申(shen)(shen)(shen)訴(su)(su)請求是(shi)(shi)(shi)補(bu)(bu)發(fa)二(er)(er)(er)OO一(yi)(yi)年(nian)至(zhi)今的(de)(de)(de)(de)(de)(de)生(sheng)活費(fei)及(ji)(ji)補(bu)(bu)繳社保金(jin)(jin)。事(shi)因(yin)(yin)(yin)是(shi)(shi)(shi)由(you)(you)該(gai)國(guo)企(qi)(qi)于(yu)(yu)(yu)二(er)(er)(er)OO三(san)年(nian)十(shi)一(yi)(yi)月(yue)張(zhang)貼的(de)(de)(de)(de)(de)(de)一(yi)(yi)張(zhang)公(gong)告(gao)通(tong)知(zhi)(zhi)(zhi)書引(yin)起(qi)的(de)(de)(de)(de)(de)(de)。該(gai)公(gong)告(gao)通(tong)知(zhi)(zhi)(zhi)書上(shang)稱(cheng)(cheng):根(gen)據(ju)(ju)某(mou)(mou)屆某(mou)(mou)政(zheng)府(fu)某(mou)(mou)次會(hui)議(yi)(yi)(yi)(yi)紀(ji)要精神,經(jing)研究,決(jue)(jue)定(ding)(ding)(ding)(ding)于(yu)(yu)(yu)二(er)(er)(er)OO三(san)年(nian)十(shi)一(yi)(yi)月(yue)十(shi)八日(ri)之(zhi)前(qian),我廠將近兩年(nian)來(lai)陸(lu)續申(shen)(shen)(shen)請簽訂(ding)(ding)解(jie)(jie)(jie)除(chu)(chu)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)系(xi)的(de)(de)(de)(de)(de)(de)職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)名單(dan),向(xiang)某(mou)(mou)政(zheng)府(fu)有(you)關(guan)(guan)部(bu)門呈報(bao)(bao),并申(shen)(shen)(shen)請領取(qu)(qu)一(yi)(yi)次性(xing)安置費(fei)。為(wei)了(le)(le)對職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)負責,我廠再一(yi)(yi)次通(tong)告(gao),尚未簽訂(ding)(ding)解(jie)(jie)(jie)除(chu)(chu)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)系(xi)的(de)(de)(de)(de)(de)(de)職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong),若愿(yuan)(yuan)(yuan)(yuan)意解(jie)(jie)(jie)除(chu)(chu)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)系(xi),請于(yu)(yu)(yu)二(er)(er)(er)OO三(san)年(nian)十(shi)一(yi)(yi)月(yue)十(shi)八日(ri)之(zhi)前(qian)到廠勞(lao)(lao)(lao)(lao)(lao)(lao)工(gong)(gong)(gong)(gong)(gong)(gong)科辦(ban)(ban)理(li)(li)相關(guan)(guan)手(shou)續,以(yi)便統一(yi)(yi)上(shang)報(bao)(bao)。隨后并提供一(yi)(yi)份打印好(hao)(hao)的(de)(de)(de)(de)(de)(de)解(jie)(jie)(jie)除(chu)(chu)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)系(xi)基(ji)準(zhun)(zhun)(zhun)日(ri)定(ding)(ding)(ding)(ding)為(wei)二(er)(er)(er)OO一(yi)(yi)年(nian)三(san)月(yue)份的(de)(de)(de)(de)(de)(de)《職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)解(jie)(jie)(jie)除(chu)(chu)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)系(xi)協議(yi)(yi)(yi)(yi)書》。而職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)認(ren)(ren)為(wei)盡管(guan)此前(qian)企(qi)(qi)業(ye)(ye)(ye)曾(ceng)要求職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)訂(ding)(ding)立解(jie)(jie)(jie)除(chu)(chu)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)系(xi)協議(yi)(yi)(yi)(yi)書,但(dan)(dan)與(yu)此次公(gong)告(gao)通(tong)知(zhi)(zhi)(zhi)書一(yi)(yi)樣是(shi)(shi)(shi)以(yi)“若愿(yuan)(yuan)(yuan)(yuan)意解(jie)(jie)(jie)除(chu)(chu)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)系(xi)”為(wei)前(qian)提的(de)(de)(de)(de)(de)(de),而當年(nian)職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)就(jiu)已經(jing)以(yi)自己的(de)(de)(de)(de)(de)(de)實際(ji)行為(wei)證(zheng)明(ming)了(le)(le)不(bu)“愿(yuan)(yuan)(yuan)(yuan)意”,因(yin)(yin)(yin)此,職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)利用此次公(gong)告(gao)通(tong)知(zhi)(zhi)(zhi)機會(hui)將企(qi)(qi)業(ye)(ye)(ye)告(gao)上(shang)了(le)(le)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)仲裁(cai)(cai)(cai)(cai)庭(ting)。勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)爭議(yi)(yi)(yi)(yi)仲裁(c 建筑工程(cheng)施(shi)工合(he)同又(you)稱(cheng)建筑安裝工程(cheng)承包合(he)同,簡稱(cheng)施(shi)工合(he)同,是由具有法人資格的發包方(建設(she)單位(wei)或總(zong)包單位(wei))和承包方(施(shi)工單位(wei))為完(wan)成商定的建筑安裝工程(cheng),所簽訂的用(yong)以(yi)明(ming)確雙(shuang)方權利、義務的法律文書。

二、加強合同管理(li)及風險(xian)防范的措施

2、建立(li)健全建筑工程(cheng)合同(tong)(tong)管理(li)制(zhi)度(du)并善加利用(yong)。合同(tong)(tong)管理(li)環節繁多,包括合同(tong)(tong)的洽談、草擬、評審、簽訂、下達、交底、學習、責任分解(jie)、履(lv)行跟蹤、變更、中止(zhi)、解(jie)除、終(zhong)止(zhi)等(deng),建筑單位要規范(fan)本單位的合同(tong)(tong)管理(li),就應該(gai)首先就合同(tong)(tong)管理(li)全過程(cheng)的每一(yi)個環節建立(li)和健全一(yi)系列可操作(zuo)的合同(tong)(tong)管理(li)制(zhi)度(du),使其合同(tong)(tong)管理(li)有章可循(xun)。

(1) 建立索(suo)(suo)(suo)(suo)(suo)賠(pei)制度。施(shi)工(gong)(gong)索(suo)(suo)(suo)(suo)(suo)賠(pei)是法律(lv)和合(he)同(tong)賦予損失者的權利,對(dui)建筑企業來(lai)說是一種保(bao)護自(zi)己,維護自(zi)己正(zheng)當權益,避免損失,增加利潤的手段;施(shi)工(gong)(gong)索(suo)(suo)(suo)(suo)(suo)賠(pei)可以化解工(gong)(gong)程項目的各(ge)類風(feng)險,是建筑企業生存和發展的必然(ran)選擇(ze);施(shi)工(gong)(gong)索(suo)(suo)(suo)(suo)(suo)賠(pei)是建筑企業在對(dui)業主索(suo)(suo)(suo)(suo)(suo)賠(pei)的過(guo)程中(zhong),把協(xie)商、解決(jue)經濟損失作為上策(ce),避免合(he)同(tong)糾(jiu)紛的發生;施(shi)工(gong)(gong)索(suo)(suo)(suo)(suo)(suo)賠(pei)要以合(he)同(tong)為基礎,要以事實證據說話(hua),索(suo)(suo)(suo)(suo)(suo)賠(pei)的證據包括投標文件(jian)、會議紀要、來(lai)往信函、通知(zhi)、施(shi)工(gong)(gong)組織設計(ji)、施(shi)工(gong)(gong)記錄、工(gong)(gong)程照片、氣象資料、各(ge)種驗收報告、有關原始憑證及(ji)國家的相關規定(ding)和有效(xiao)信息等。
(2) 重視現場(chang)簽(qian)(qian)(qian)(qian)證(zheng)(zheng)。在按(an)照合同條(tiao)款支(zhi)付時(shi)應(ying)該防(fang)止(zhi)過早、過量(liang)簽(qian)(qian)(qian)(qian)證(zheng)(zheng),特(te)別是合同變(bian)(bian)(bian)更(geng)(geng)(geng)補充協(xie)議的(de)簽(qian)(qian)(qian)(qian)訂須格(ge)外謹慎(shen),簽(qian)(qian)(qian)(qian)證(zheng)(zheng)必(bi)須依據相(xiang)關合同條(tiao)款衡量(liang),起到(dao)相(xiang)互制約(yue)的(de)作用。尤其要重視設計變(bian)(bian)(bian)更(geng)(geng)(geng)與施工圖錯誤,此類簽(qian)(qian)(qian)(qian)證(zheng)(zheng)只(zhi)需簽(qian)(qian)(qian)(qian)變(bian)(bian)(bian)更(geng)(geng)(geng)或(huo)修正(zheng)的(de)項(xiang)目(mu),原(yuan)圖紙不變(bian)(bian)(bian)的(de)勿重復(fu)簽(qian)(qian)(qian)(qian)證(zheng)(zheng),已(yi)經下料(liao)和(he)購料(liao)的(de),務必(bi)簽(qian)(qian)(qian)(qian)寫清楚材料(liao)名稱、規(gui)格(ge)、型號、數量(liang)、變(bian)(bian)(bian)更(geng)(geng)(geng)日期、運輸(shu)情況(kuang)、到(dao)場(chang)情況(kuang)、成(cheng)品情況(kuang)、有無回收(shou)或(huo)代用等詳細情況(kuang)。
(3) 及時記錄、收集和整理(li)工程所涉及的各種(zhong)文件(如圖紙(zhi)、計劃(hua)、技術說明、規范、變(bian)更指令等(deng)),對合(he)同(tong)(tong)變(bian)更部分進(jin)行審核(he)與分析(xi)。在實際工作中(zhong),合(he)同(tong)(tong)變(bian)更應該與提出索賠同(tong)(tong)步進(jin)行,須(xu)業主與承(cheng)包(bao)商雙方達(da)成一致后再進(jin)行合(he)同(tong)(tong)變(bian)更。
(4) 及時(shi)處理停工(gong)損失(包括由非(fei)承包商(shang)責(ze)任造成的(de)(de)停工(gong)損失),雙方(fang)按(an)合(he)同約(yue)定的(de)(de)時(shi)間以書面形(xing)式,按(an)合(he)法程序簽認停工(gong)的(de)(de)相(xiang)關具體內容。
(5) 嚴格執行工(gong)程量清單(dan)規(gui)范(fan)及(ji)定(ding)(ding)額(e)規(gui)定(ding)(ding),對于定(ding)(ding)額(e)未規(gui)定(ding)(ding)的(de)情況,應根據工(gong)程實際情況或者參考相同類定(ding)(ding)額(e)及(ji)有關的(de)規(gui)定(ding)(ding)做出補償。
