一、堅持中國共產黨的領導

四、加強隊伍建設,有效夯實依法治企基礎
建設(she)社會(hui)(hui)(hui)(hui)主(zhu)(zhu)義法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)國家對(dui)公民(min)(min)(min)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)觀念(nian)(nian)(nian)的(de)(de)(de)普遍養成和提(ti)升提(ti)出了更高的(de)(de)(de)要(yao)(yao)(yao)求。全(quan)民(min)(min)(min)遵法(fa)(fa)(fa)(fa)守法(fa)(fa)(fa)(fa)是(shi)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)社會(hui)(hui)(hui)(hui)建設(she)的(de)(de)(de)基礎工(gong)(gong)程。提(ti)高員(yuan)(yuan)工(gong)(gong)隊伍的(de)(de)(de)法(fa)(fa)(fa)(fa)律(lv)素養是(shi)國有(you)企(qi)(qi)(qi)業(ye)(ye)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建設(she)的(de)(de)(de)一項重要(yao)(yao)(yao)任務。目前,國有(you)企(qi)(qi)(qi)業(ye)(ye)干部(bu)隊伍存在(zai)(zai)的(de)(de)(de)主(zhu)(zhu)要(yao)(yao)(yao)問題:一是(shi)部(bu)分黨(dang)員(yuan)(yuan)和領(ling)導干部(bu)對(dui)監(jian)督制(zhi)度(du)存在(zai)(zai)抵制(zhi)情(qing)緒(xu);二(er)是(shi)制(zhi)度(du)執行力(li)(li)不(bu)夠(gou)。深層次的(de)(de)(de)原(yuan)因(yin)還(huan)是(shi)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)觀念(nian)(nian)(nian)淡(dan)薄。增(zeng)強(qiang)員(yuan)(yuan)工(gong)(gong)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)觀念(nian)(nian)(nian),一要(yao)(yao)(yao)注重發(fa)(fa)揮領(ling)導干部(bu)的(de)(de)(de)表(biao)率和示范(fan)作用。通過集(ji)中培訓和專項培訓,掛職鍛煉等(deng)方式,全(quan)方位(wei)提(ti)升全(quan)系(xi)(xi)(xi)統(tong)(tong)領(ling)導干部(bu)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)思維和依法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)企(qi)(qi)(qi)能力(li)(li)。二(er)要(yao)(yao)(yao)重視提(ti)升系(xi)(xi)(xi)統(tong)(tong)法(fa)(fa)(fa)(fa)律(lv)人(ren)員(yuan)(yuan)的(de)(de)(de)專業(ye)(ye)技能。在(zai)(zai)全(quan)系(xi)(xi)(xi)統(tong)(tong)廣泛開展法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)思想的(de)(de)(de)宣講活動,使系(xi)(xi)(xi)統(tong)(tong)的(de)(de)(de)專業(ye)(ye)技術(shu)人(ren)員(yuan)(yuan)堅定(ding)政(zheng)治(zhi)(zhi)(zhi)立(li)場(chang)、把握正(zheng)確(que)政(zheng)治(zhi)(zhi)(zhi)方向(xiang),樹(shu)立(li)社會(hui)(hui)(hui)(hui)主(zhu)(zhu)義法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)觀念(nian)(nian)(nian),以扎實(shi)(shi)專業(ye)(ye)理論(lun)知識推(tui)進企(qi)(qi)(qi)業(ye)(ye)經濟發(fa)(fa)展,同時也自覺抵御外來風(feng)險(xian)(xian)侵蝕。三要(yao)(yao)(yao)落實(shi)(shi)總法(fa)(fa)(fa)(fa)律(lv)顧(gu)問列席黨(dang)委(wei)會(hui)(hui)(hui)(hui)、董事會(hui)(hui)(hui)(hui)參(can)與(yu)研究討論(lun)或審議涉及法(fa)(fa)(fa)(fa)律(lv)合規相關議題,參(can)加總經理辦公會(hui)(hui)(hui)(hui)等(deng)重要(yao)(yao)(yao)決策會(hui)(hui)(hui)(hui)議制(zhi)度(du),將合法(fa)(fa)(fa)(fa)合規性審查和重大風(feng)險(xian)(xian)評估作為重大決策事項必經前置程序。實(shi)(shi)施法(fa)(fa)(fa)(fa)律(lv)顧(gu)問制(zhi)度(du)是(shi)國有(you)企(qi)(qi)(qi)業(ye)(ye)扎實(shi)(shi)推(tui)進法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建設(she)的(de)(de)(de)具體(ti)舉措,將降低法(fa)(fa)(fa)(fa)律(lv)風(feng)險(xian)(xian),有(you)效保(bao)障國有(you)企(qi)(qi)(qi)業(ye)(ye)各部(bu)門(men)協調有(you)序高效運轉。四要(yao)(yao)(yao)加強(qiang)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)文(wen)(wen)(wen)(wen)化陣地建設(she)。在(zai)(zai)具備條件的(de)(de)(de)龍(long)(long)(long)江森(sen)工(gong)(gong)集(ji)團所屬(shu)的(de)(de)(de)林業(ye)(ye)局建設(she)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)文(wen)(wen)(wen)(wen)化主(zhu)(zhu)題公園,在(zai)(zai)龍(long)(long)(long)江森(sen)工(gong)(gong)集(ji)團所屬(shu)的(de)(de)(de)林業(ye)(ye)局和直屬(shu)單(dan)位(wei),設(she)置法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)文(wen)(wen)(wen)(wen)化宣傳(chuan)欄(墻)。不(bu)僅要(yao)(yao)(yao)大力(li)(li)弘揚(yang)森(sen)工(gong)(gong)精(jing)神(shen),更要(yao)(yao)(yao)在(zai)(zai)企(qi)(qi)(qi)業(ye)(ye)文(wen)(wen)(wen)(wen)化中融(rong)入法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)教育內(nei)容(rong),弘揚(yang)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)精(jing)神(shen),傳(chuan)播法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)理念(nian)(nian)(nian),解讀民(min)(min)(min)法(fa)(fa)(fa)(fa)典(dian),在(zai)(zai)龍(long)(long)(long)江森(sen)工(gong)(gong)系(xi)(xi)(xi)統(tong)(tong)營造良好的(de)(de)(de)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)教育環(huan)境(jing)和社會(hui)(hui)(hui)(hui)氛圍(wei)。鼓勵(li)支(zhi)持(chi)龍(long)(long)(long)江森(sen)工(gong)(gong)系(xi)(xi)(xi)統(tong)(tong)普法(fa)(fa)(fa)(fa)志愿(yuan)者積極參(can)與(yu)各項公益(yi)普法(fa)(fa)(fa)(fa)活動,鼓勵(li)支(zhi)持(chi)龍(long)(long)(long)江森(sen)工(gong)(gong)系(xi)(xi)(xi)統(tong)(tong)法(fa)(fa)(fa)(fa)律(lv)專業(ye)(ye)人(ren)士為社會(hui)(hui)(hui)(hui)各類弱勢(shi)群(qun)體(ti)提(ti)供(gong)法(fa)(fa)(fa)(fa)律(lv)援(yuan)助(zhu),彰顯龍(long)(long)(long)江森(sen)工(gong)(gong)人(ren)的(de)(de)(de)社會(hui)(hui)(hui)(hui)責任擔當。
五、充分發揮法律機制在實現“碳達峰”“碳中和”中的作用
生(sheng)態(tai)建(jian)(jian)設是龍(long)江(jiang)(jiang)(jiang)(jiang)森(sen)(sen)(sen)(sen)(sen)工(gong)(gong)(gong)人的(de)(de)(de)根,幾代(dai)龍(long)江(jiang)(jiang)(jiang)(jiang)森(sen)(sen)(sen)(sen)(sen)工(gong)(gong)(gong)人為(wei)(wei)了(le)(le)支持(chi)“天保工(gong)(gong)(gong)程(cheng)”付出了(le)(le)艱辛努力(li)(li)和(he)(he)巨大(da)代(dai)價,實(shi)(shi)(shi)(shi)現(xian)(xian)碳(tan)(tan)(tan)達峰、碳(tan)(tan)(tan)中(zhong)和(he)(he),多植樹造林(lin)(lin)(lin),這(zhe)是持(chi)續發(fa)(fa)(fa)(fa)展的(de)(de)(de)基礎(chu)。過去我(wo)們存(cun)在(zai)的(de)(de)(de)認識誤區(qu),認為(wei)(wei)保護生(sheng)態(tai)和(he)(he)發(fa)(fa)(fa)(fa)展經(jing)濟相矛(mao)盾(dun),單靠生(sheng)態(tai)資源(yuan)無法(fa)獲得經(jing)濟效益(yi),沒有產(chan)(chan)出的(de)(de)(de),只能探討林(lin)(lin)(lin)下(xia)經(jing)濟。今后正確(que)(que)的(de)(de)(de)方(fang)向就是,要通過生(sheng)態(tai)資源(yuan)可(ke)持(chi)續發(fa)(fa)(fa)(fa)展獲得孳(zi)息(xi)效益(yi)。我(wo)國(guo)自2011年(nian)(nian)啟動(dong)了(le)(le)碳(tan)(tan)(tan)排(pai)放(fang)(fang)權(quan)(quan)(quan)交(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)易(yi)試點,2021年(nian)(nian)全(quan)國(guo)碳(tan)(tan)(tan)排(pai)放(fang)(fang)權(quan)(quan)(quan)交(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)易(yi)市(shi)場上(shang)線。龍(long)江(jiang)(jiang)(jiang)(jiang)森(sen)(sen)(sen)(sen)(sen)工(gong)(gong)(gong)系(xi)(xi)統(tong)(tong)(tong)雖(sui)然(ran)(ran)起步(bu)晚,但轉(zhuan)變(bian)理念(nian),開(kai)(kai)局(ju)(ju)良(liang)好。2021年(nian)(nian)5月,黑龍(long)江(jiang)(jiang)(jiang)(jiang)森(sen)(sen)(sen)(sen)(sen)工(gong)(gong)(gong)碳(tan)(tan)(tan)資產(chan)(chan)投(tou)資開(kai)(kai)發(fa)(fa)(fa)(fa)有限公(gong)(gong)(gong)司與(yu)(yu)集團所轄(xia)23個(ge)林(lin)(lin)(lin)業(ye)(ye)(ye)(ye)(ye)(ye)局(ju)(ju)有限公(gong)(gong)(gong)司和(he)(he)7個(ge)直(zhi)屬(shu)林(lin)(lin)(lin)場簽訂(ding)了(le)(le)林(lin)(lin)(lin)業(ye)(ye)(ye)(ye)(ye)(ye)碳(tan)(tan)(tan)匯開(kai)(kai)發(fa)(fa)(fa)(fa)授權(quan)(quan)(quan)書。此(ci)舉無疑將推(tui)(tui)進(jin)龍(long)江(jiang)(jiang)(jiang)(jiang)森(sen)(sen)(sen)(sen)(sen)工(gong)(gong)(gong)碳(tan)(tan)(tan)匯產(chan)(chan)業(ye)(ye)(ye)(ye)(ye)(ye)加(jia)快發(fa)(fa)(fa)(fa)展。此(ci)次簽約標(biao)志著森(sen)(sen)(sen)(sen)(sen)工(gong)(gong)(gong)林(lin)(lin)(lin)業(ye)(ye)(ye)(ye)(ye)(ye)碳(tan)(tan)(tan)匯發(fa)(fa)(fa)(fa)展進(jin)入了(le)(le)統(tong)(tong)(tong)籌規(gui)劃、統(tong)(tong)(tong)一管理、統(tong)(tong)(tong)籌開(kai)(kai)發(fa)(fa)(fa)(fa)的(de)(de)(de)新(xin)發(fa)(fa)(fa)(fa)展階段,森(sen)(sen)(sen)(sen)(sen)工(gong)(gong)(gong)林(lin)(lin)(lin)業(ye)(ye)(ye)(ye)(ye)(ye)碳(tan)(tan)(tan)匯產(chan)(chan)業(ye)(ye)(ye)(ye)(ye)(ye)發(fa)(fa)(fa)(fa)展形成(cheng)(cheng)了(le)(le)橫(heng)向協同、戰(zhan)略縱深的(de)(de)(de)新(xin)發(fa)(fa)(fa)(fa)展格局(ju)(ju)。中(zhong)國(guo)雖(sui)然(ran)(ran)在(zai)2019年(nian)(nian)構建(jian)(jian)完成(cheng)(cheng)了(le)(le)全(quan)國(guo)性的(de)(de)(de)碳(tan)(tan)(tan)交(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)易(yi)體(ti)系(xi)(xi),但是只涉及電力(li)(li)行(xing)業(ye)(ye)(ye)(ye)(ye)(ye),林(lin)(lin)(lin)業(ye)(ye)(ye)(ye)(ye)(ye)碳(tan)(tan)(tan)匯還(huan)沒有標(biao)準(zhun)統(tong)(tong)(tong)一的(de)(de)(de)全(quan)國(guo)性交(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)易(yi)平(ping)(ping)臺(tai)(tai)。現(xian)(xian)階段,林(lin)(lin)(lin)業(ye)(ye)(ye)(ye)(ye)(ye)碳(tan)(tan)(tan)匯交(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)易(yi)主(zhu)(zhu)要在(zai)試點的(de)(de)(de)碳(tan)(tan)(tan)交(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)易(yi)市(shi)場進(jin)行(xing),并且這(zhe)些(xie)區(qu)域性的(de)(de)(de)交(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)易(yi)市(shi)場對碳(tan)(tan)(tan)匯項目(mu)標(biao)準(zhun)、碳(tan)(tan)(tan)信(xin)用核(he)準(zhun)規(gui)則(ze)、交(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)易(yi)流程(cheng)等方(fang)面(mian)存(cun)在(zai)較大(da)差異。作為(wei)(wei)黑龍(long)江(jiang)(jiang)(jiang)(jiang)省(sheng)保障生(sheng)態(tai)安全(quan)的(de)(de)(de)主(zhu)(zhu)力(li)(li)軍(jun),龍(long)江(jiang)(jiang)(jiang)(jiang)森(sen)(sen)(sen)(sen)(sen)工(gong)(gong)(gong)集團現(xian)(xian)有森(sen)(sen)(sen)(sen)(sen)林(lin)(lin)(lin)濕(shi)地(di)總碳(tan)(tan)(tan)儲量7.99億(yi)(yi)噸,森(sen)(sen)(sen)(sen)(sen)林(lin)(lin)(lin)蓄積6.74億(yi)(yi)立方(fang)米(mi)(mi)(mi),具備(bei)供(gong)給優勢和(he)(he)碳(tan)(tan)(tan)匯產(chan)(chan)業(ye)(ye)(ye)(ye)(ye)(ye)發(fa)(fa)(fa)(fa)展潛力(li)(li)。到2025年(nian)(nian),森(sen)(sen)(sen)(sen)(sen)林(lin)(lin)(lin)面(mian)積增(zeng)加(jia)0.33萬公(gong)(gong)(gong)頃(qing)(qing),達到558.06萬公(gong)(gong)(gong)頃(qing)(qing);森(sen)(sen)(sen)(sen)(sen)林(lin)(lin)(lin)總蓄積提(ti)高(gao)0.67億(yi)(yi)立方(fang)米(mi)(mi)(mi),達到7.17億(yi)(yi)立方(fang)米(mi)(mi)(mi);森(sen)(sen)(sen)(sen)(sen)林(lin)(lin)(lin)覆被率提(ti)升(sheng)0.06個(ge)百分(fen)點,達到84.74%;公(gong)(gong)(gong)頃(qing)(qing)蓄積提(ti)升(sheng)12.13立方(fang)米(mi)(mi)(mi),達到128.63立方(fang)米(mi)(mi)(mi)/公(gong)(gong)(gong)頃(qing)(qing)。黑龍(long)江(jiang)(jiang)(jiang)(jiang)聯(lian)合產(chan)(chan)權(quan)(quan)(quan)交(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)易(yi)所擁有省(sheng)政府批準(zhun)成(cheng)(cheng)立的(de)(de)(de)黑龍(long)江(jiang)(jiang)(jiang)(jiang)省(sheng)唯一的(de)(de)(de)碳(tan)(tan)(tan)市(shi)場相關業(ye)(ye)(ye)(ye)(ye)(ye)務(wu)(wu)交(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)易(yi)平(ping)(ping)臺(tai)(tai),能夠為(wei)(wei)龍(long)江(jiang)(jiang)(jiang)(jiang)森(sen)(sen)(sen)(sen)(sen)工(gong)(gong)(gong)碳(tan)(tan)(tan)匯項目(mu)提(ti)供(gong)精準(zhun)服(fu)務(wu)(wu),實(shi)(shi)(shi)(shi)現(xian)(xian)林(lin)(lin)(lin)業(ye)(ye)(ye)(ye)(ye)(ye)碳(tan)(tan)(tan)匯基礎(chu)信(xin)息(xi)收集、審核(he)管理、交(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)易(yi)、綜合信(xin)息(xi)發(fa)(fa)(fa)(fa)布與(yu)(yu)共享的(de)(de)(de)集約化管理,可(ke)以(yi)有效提(ti)高(gao)龍(long)江(jiang)(jiang)(jiang)(jiang)森(sen)(sen)(sen)(sen)(sen)工(gong)(gong)(gong)集團碳(tan)(tan)(tan)匯項目(mu)管理、交(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)易(yi)監管能力(li)(li)和(he)(he)公(gong)(gong)(gong)共服(fu)務(wu)(wu)水平(ping)(ping)。目(mu)前,我(wo)國(guo)法(fa)律(lv)(lv)(lv)(lv)(lv)制(zhi)度體(ti)系(xi)(xi)中(zhong),缺乏(fa)對碳(tan)(tan)(tan)達峰和(he)(he)碳(tan)(tan)(tan)中(zhong)和(he)(he)目(mu)標(biao)的(de)(de)(de)統(tong)(tong)(tong)籌考慮,對碳(tan)(tan)(tan)排(pai)放(fang)(fang)管理還(huan)處于(yu)法(fa)律(lv)(lv)(lv)(lv)(lv)空白,雖(sui)有頂(ding)層設計,各部門各行(xing)業(ye)(ye)(ye)(ye)(ye)(ye)的(de)(de)(de)行(xing)動(dong)方(fang)案也在(zai)制(zhi)定,但這(zhe)些(xie)不(bu)具有法(fa)律(lv)(lv)(lv)(lv)(lv)的(de)(de)(de)穩定性、明(ming)確(que)(que)性和(he)(he)強制(zhi)性,迫切(qie)需要以(yi)法(fa)律(lv)(lv)(lv)(lv)(lv)形式將實(shi)(shi)(shi)(shi)現(xian)(xian)“雙(shuang)碳(tan)(tan)(tan)”轉(zhuan)型確(que)(que)立為(wei)(wei)國(guo)家戰(zhan)略,從國(guo)家層面(mian)整(zheng)體(ti)推(tui)(tui)動(dong)實(shi)(shi)(shi)(shi)現(xian)(xian)碳(tan)(tan)(tan)達峰、碳(tan)(tan)(tan)中(zhong)和(he)(he),為(wei)(wei)堅定不(bu)移(yi)、科學有序推(tui)(tui)進(jin)“雙(shuang)碳(tan)(tan)(tan)”目(mu)標(biao)提(ti)供(gong)權(quan)(quan)(quan)威、全(quan)面(mian)、系(xi)(xi)統(tong)(tong)(tong)的(de)(de)(de)法(fa)治保障。同時,要注重法(fa)律(lv)(lv)(lv)(lv)(lv)制(zhi)度的(de)(de)(de)體(ti)系(xi)(xi)化。整(zheng)合運(yun)用行(xing)政法(fa)、民法(fa)、刑法(fa)等法(fa)律(lv)(lv)(lv)(lv)(lv)制(zhi)度,形成(cheng)(cheng)促(cu)進(jin)碳(tan)(tan)(tan)中(zhong)和(he)(he)目(mu)標(biao)實(shi)(shi)(shi)(shi)現(xian)(xian)的(de)(de)(de)體(ti)系(xi)(xi)化法(fa)律(lv)(lv)(lv)(lv)(lv)制(zhi)度,碳(tan)(tan)(tan)中(zhong)和(he)(he)目(mu)標(biao)的(de)(de)(de)實(shi)(shi)(shi)(shi)現(xian)(xian)涉及不(bu)同主(zhu)(zhu)體(ti)的(de)(de)(de)經(jing)濟利益(yi),這(zhe)種錯綜復雜的(de)(de)(de)關系(xi)(xi)必須由法(fa)律(lv)(lv)(lv)(lv)(lv)調整(zheng),構建(jian)(jian)碳(tan)(tan)(tan)中(zhong)和(he)(he)目(mu)標(biao)實(shi)(shi)(shi)(shi)現(xian)(xian)的(de)(de)(de)法(fa)律(lv)(lv)(lv)(lv)(lv)制(zhi)度是刻不(bu)容緩的(de)(de)(de)課題(ti)。
