學生自殺高校民事責任分析

摘要:對于學生自殺,所在高校應當根據(ju)其過(guo)錯(cuo)程度承擔相應的(de)法(fa)(fa)律責(ze)任。如果高校已(yi)經(jing)履行(xing)相應的(de)職(zhi)責(ze),且行(xing)為并無不當,則(ze)不應承擔法(fa)(fa)律責(ze)任。現(xian)行(xing)的(de)相關(guan)立法(fa)(fa)與調(diao)解(jie)機(ji)制(zhi)存在一定(ding)的(de)不足。完善《中華人民共和國高等教育法(fa)(fa)》,明確(que)高校對學生人身保障的(de)法(fa)(fa)律責(ze)任和免責(ze)事(shi)由,增設強制(zhi)調(diao)解(jie)機(ji)制(zhi),利于快(kuai)速有效地解(jie)決因學生自殺(sha)等傷害(hai)事(shi)故引發的(de)紛爭(zheng)。

對于學(xue)生(sheng)自殺,高校(xiao)是否(fou)應當(dang)承擔法(fa)(fa)律責(ze)任(ren)?如何承擔法(fa)(fa)律責(ze)任(ren)?隨著《中華人民共(gong)和國民法(fa)(fa)典(dian)》的(de)生(sheng)效,梳理相(xiang)關法(fa)(fa)律法(fa)(fa)規、厘清高校(xiao)在學(xue)生(sheng)自殺事故中的(de)民事責(ze)任(ren),對于避免紛爭、維(wei)護高校(xiao)的(de)正(zheng)常教學(xue)秩(zhi)序有著重要的(de)現實(shi)意義。

一、現行相關法律規定之梳理

(一)《學生傷害事(shi)故(gu)處理辦法》的相關規(gui)定(ding)

迄今為止,對學(xue)生(sheng)傷(shang)害(hai)事(shi)(shi)故的(de)(de)處(chu)理(li),最明確的(de)(de)規定(ding)是于2002年9月1日(ri)起施(shi)行(xing)的(de)(de)《學(xue)生(sheng)傷(shang)害(hai)事(shi)(shi)故處(chu)理(li)辦法》。《學(xue)生(sheng)傷(shang)害(hai)事(shi)(shi)故處(chu)理(li)辦法》規定(ding),對于學(xue)生(sheng)自(zi)殺、自(zi)傷(shang),高校(xiao)(xiao)如(ru)果已經履行(xing)相(xiang)應職(zhi)責,且行(xing)為并無(wu)不(bu)(bu)當,不(bu)(bu)應承(cheng)擔(dan)法律責任(ren)。如(ru)果學(xue)校(xiao)(xiao)存在(zai)過(guo)錯或(huo)(huo)故意對學(xue)生(sheng)造成傷(shang)害(hai),則應當依法承(cheng)擔(dan)相(xiang)應的(de)(de)法律責任(ren)。另外,根據《學(xue)生(sheng)傷(shang)害(hai)事(shi)(shi)故處(chu)理(li)辦法》,學(xue)生(sheng)在(zai)自(zi)行(xing)上學(xue)、放學(xue)、返校(xiao)(xiao)、離(li)校(xiao)(xiao)途中,或(huo)(huo)在(zai)自(zi)行(xing)外出、擅自(zi)離(li)校(xiao)(xiao)期間,或(huo)(huo)在(zai)放學(xue)后、節假日(ri)等學(xue)校(xiao)(xiao)工作時間以外,以及在(zai)學(xue)校(xiao)(xiao)管理(li)職(zhi)責范圍外發生(sheng)的(de)(de)事(shi)(shi)故,如(ru)果學(xue)校(xiao)(xiao)行(xing)為并無(wu)不(bu)(bu)當,不(bu)(bu)應承(cheng)擔(dan)事(shi)(shi)故責任(ren)。

(二)《中(zhong)華人民(min)共(gong)和國(guo)教育法(fa)》和《中(zhong)華人民(min)共(gong)和國(guo)高等教育法(fa)》的相關規(gui)定

《中華(hua)人民(min)共(gong)和(he)國教育法(fa)(fa)(fa)》和(he)《中華(hua)人民(min)共(gong)和(he)國高等(deng)教育法(fa)(fa)(fa)》都明確規定學(xue)校(xiao)在民(min)事活動中依法(fa)(fa)(fa)享有民(min)事權(quan)利(li),承(cheng)擔(dan)民(min)事責任;學(xue)生的(de)合法(fa)(fa)(fa)權(quan)益受法(fa)(fa)(fa)律保(bao)護(hu)。但(dan)是,這兩(liang)部(bu)法(fa)(fa)(fa)律都沒有就學(xue)生自殺等(deng)傷(shang)害事故進行(xing)明確規定。

(三)《中華人民(min)共和(he)國民(min)法典(dian)》的(de)相關規定(ding)

二、高校義務之定位及其過錯程度之判斷

在學生自殺事故中,高校是否存在過錯,是確定其是否應當承擔民事責任的重要因素。而判斷高校是否存在過錯,必須明確高校與學生之間的權利和義務關系。在我國,關于高校與學生之間的法律關系,學界有“行政法律關系”“民事法律關系”“行政與民事雙重法律關系”等觀點。目前,多數學者認同“行政與民事雙重法律關系”,即高校與學生之間既存在管理與被管理的行政法律關系,也存在平等民事主體之間的民事法律關系。基于此種法律關系,可以清晰地界定高校對學生應當履行的法定義務。1.教育和安保義務根據《學生傷害事故處理辦法》,學校應當對在校學生開展必要的安全教育,向學生介紹自護自救的有效方法。在學生情緒低落時,教師或相應的管理人員應當提醒學生采取適當的方式進行自我調節和宣泄,并為學生提供相應的情緒疏導途徑。根據《中華人民共和國教育法》和《學生傷害事故處理辦法》,安全保護是高校的重要義務。高校如果因為沒有很好地履行安保義務而造成學生自殺,應當承擔法律責任。高校還應盡力為學生營造安全的學習和生活環境。這要求學校建立科學的、完善的安保制度,采取有效的安全保障和管理措施,盡可能消除教育教學環境中存在的安全隱患,保障學生的安全。2.管理義務根據《學生傷害事故處理辦法》,學校的教師或其他工作人員在負有組織、管理學生的職責期間,如果發現學生的行為具有危險性,應當進行必要的管理。自殺屬于對自己生命造成危險的行為。高校教師或管理人員如果發現學生具有自殺傾向,應當盡到管理義務。具體而言,管理義務包括注意、提醒和處理義務,三者分別對應學生自殺事前、事中、事后三個階段。其中,注意義務主要集中在自殺事故之前。高校應對具有明顯自殺傾向的學生盡到注意義務。學生在自殺前,一般會在日常生活中表現出厭世等消極情緒,在與他人交流時會發表消極言論,高校教師或管理人員應關注學生的信息,及時了解學生的心理狀態及異常行為。提醒義務是指在發現學生具有自殺傾向時,高校應當及時告知、提醒學生的家長或近親屬,并組織專業的心理咨詢人員對學生進行評估,判斷該學生是否需要接受治療或休學。如果學生繼續留校學習,高校則應當安排專人對該學生的行蹤和狀態進行跟蹤,定期匯報。提醒義務雖然未明確寫入我國法律,但作為預防學生自殺行為的有效方式,以及高校證明自身已履行安全保障義務的有力證據,多數高校實際上都履行了這項義務。高校在履行提醒義務時,要注意保留相關證據,如請家長或近親屬在書面告知書上簽字并留存,否則只能承擔無法舉證的不利后果。處理義務是指在學生自殺事故發生之后,高校應立即采取行動,動用一切資源積極搶救學生,并及時告知家屬,報告警方,積極處理相關救助和善后事宜。當然,這些義務的履行應當有一個適當的限度,既不影響高校開展正常的日常教學工作,也不能超過一般人可以預測的合理范圍。否則,對高校要求過高,則可能使高校疲于應付、陷入困境,無暇顧及教育教學、學科建設等重要工作或矯枉過正,迫使高校過分增加經費支出或過分限制學生自由,得不償失。3.高校對學生自殺行為賠償責任之承擔高等教育服務具有一定的獨特性。高校對學生自殺的賠償責任與其是否有過錯以及過錯大小密切相關。筆者試圖根據不同情況,分析學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)(sheng)(sheng)自(zi)(zi)(zi)(zi)(zi)殺(sha)(sha)(sha)(sha)(sha)事(shi)故(gu)(gu)(gu)中高(gao)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)的(de)(de)(de)(de)(de)(de)過錯程(cheng)度(如(ru)(ru)圖(tu)1),以(yi)(yi)便更好地確定(ding)(ding)高(gao)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)應(ying)當(dang)承(cheng)擔(dan)(dan)的(de)(de)(de)(de)(de)(de)賠償(chang)責(ze)(ze)任(ren)(ren)(ren)(ren)。發(fa)生(sheng)(sheng)(sheng)(sheng)(sheng)(sheng)在(zai)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)外(wai)(wai)(wai)的(de)(de)(de)(de)(de)(de)學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)(sheng)(sheng)自(zi)(zi)(zi)(zi)(zi)殺(sha)(sha)(sha)(sha)(sha)事(shi)故(gu)(gu)(gu)。學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)(sheng)(sheng)在(zai)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)外(wai)(wai)(wai)自(zi)(zi)(zi)(zi)(zi)殺(sha)(sha)(sha)(sha)(sha)一(yi)(yi)般包括兩種(zhong)(zhong)情形。一(yi)(yi)種(zhong)(zhong)是(shi)(shi)學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)(sheng)(sheng)在(zai)學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)組(zu)織校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)外(wai)(wai)(wai)活動期間(jian)(jian)(jian)自(zi)(zi)(zi)(zi)(zi)殺(sha)(sha)(sha)(sha)(sha)。根(gen)據相關(guan)規定(ding)(ding),學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)在(zai)教學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)區(qu)域外(wai)(wai)(wai)組(zu)織活動,帶隊人(ren)(ren)員應(ying)該對(dui)(dui)學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)(sheng)(sheng)的(de)(de)(de)(de)(de)(de)人(ren)(ren)身(shen)安全負責(ze)(ze),高(gao)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)應(ying)當(dang)對(dui)(dui)在(zai)此期間(jian)(jian)(jian)的(de)(de)(de)(de)(de)(de)學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)(sheng)(sheng)自(zi)(zi)(zi)(zi)(zi)殺(sha)(sha)(sha)(sha)(sha)承(cheng)擔(dan)(dan)一(yi)(yi)定(ding)(ding)的(de)(de)(de)(de)(de)(de)賠償(chang)責(ze)(ze)任(ren)(ren)(ren)(ren)。另一(yi)(yi)種(zhong)(zhong)是(shi)(shi)學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)(sheng)(sheng)在(zai)自(zi)(zi)(zi)(zi)(zi)行(xing)(xing)(xing)外(wai)(wai)(wai)出(chu)期間(jian)(jian)(jian)自(zi)(zi)(zi)(zi)(zi)殺(sha)(sha)(sha)(sha)(sha)。此處(chu)(chu)的(de)(de)(de)(de)(de)(de)自(zi)(zi)(zi)(zi)(zi)行(xing)(xing)(xing)外(wai)(wai)(wai)出(chu)又分為(wei)(wei)非教學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)時(shi)(shi)間(jian)(jian)(jian)內(nei)(nei)(nei)(nei)的(de)(de)(de)(de)(de)(de)自(zi)(zi)(zi)(zi)(zi)行(xing)(xing)(xing)外(wai)(wai)(wai)出(chu)和教學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)時(shi)(shi)間(jian)(jian)(jian)內(nei)(nei)(nei)(nei)的(de)(de)(de)(de)(de)(de)自(zi)(zi)(zi)(zi)(zi)行(xing)(xing)(xing)外(wai)(wai)(wai)出(chu)。根(gen)據《學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)(sheng)(sheng)傷害事(shi)故(gu)(gu)(gu)處(chu)(chu)理(li)(li)辦(ban)法(fa)》,對(dui)(dui)于(yu)(yu)學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)(sheng)(sheng)在(zai)自(zi)(zi)(zi)(zi)(zi)行(xing)(xing)(xing)上學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)、放學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)、返(fan)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)、離校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)途中的(de)(de)(de)(de)(de)(de)自(zi)(zi)(zi)(zi)(zi)殺(sha)(sha)(sha)(sha)(sha),或(huo)者在(zai)自(zi)(zi)(zi)(zi)(zi)行(xing)(xing)(xing)外(wai)(wai)(wai)出(chu)或(huo)擅自(zi)(zi)(zi)(zi)(zi)離校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)期間(jian)(jian)(jian)的(de)(de)(de)(de)(de)(de)自(zi)(zi)(zi)(zi)(zi)殺(sha)(sha)(sha)(sha)(sha),抑或(huo)是(shi)(shi)在(zai)放學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)后、節假日等學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)(x )(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)沒有任(ren)(ren)(ren)(ren)何途徑可以(yi)(yi)了(le)解該學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)(sheng)(sheng)的(de)(de)(de)(de)(de)(de)自(zi)(zi)(zi)(zi)(zi)殺(sha)(sha)(sha)(sha)(sha)傾向,無(wu)(wu)(wu)法(fa)發(fa)現(xian)其(qi)異(yi)(yi)常(chang)情況(kuang),不(bu)(bu)(bu)存在(zai)管(guan)理(li)(li)和教育(yu)失(shi)(shi)當(dang)之(zhi)處(chu)(chu),因此駁回(hui)了(le)原(yuan)告的(de)(de)(de)(de)(de)(de)訴訟請(qing)求。可見,即使學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)(sheng)(sheng)是(shi)(shi)在(zai)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)內(nei)(nei)(nei)(nei)自(zi)(zi)(zi)(zi)(zi)殺(sha)(sha)(sha)(sha)(sha),但(dan)如(ru)(ru)果(guo)(guo)高(gao)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)全面履行(xing)(xing)(xing)了(le)注(zhu)意、提(ti)醒(xing)、處(chu)(chu)理(li)(li)等相關(guan)義務,對(dui)(dui)于(yu)(yu)無(wu)(wu)(wu)法(fa)預見或(huo)無(wu)(wu)(wu)法(fa)了(le)解的(de)(de)(de)(de)(de)(de)學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)(sheng)(sheng)自(zi)(zi)(zi)(zi)(zi)殺(sha)(sha)(sha)(sha)(sha)行(xing)(xing)(xing)為(wei)(wei)不(bu)(bu)(bu)承(cheng)擔(dan)(dan)法(fa)律責(ze)(ze)任(ren)(ren)(ren)(ren)。相反,如(ru)(ru)果(guo)(guo)學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)已經(jing)預見學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)(sheng)(sheng)的(de)(de)(de)(de)(de)(de)自(zi)(zi)(zi)(zi)(zi)殺(sha)(sha)(sha)(sha)(sha)可能(neng)性(xing)或(huo)者學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)生(sheng)(sheng)(sheng)(sheng)(sheng)(sheng)有明顯(xian)的(de)(de)(de)(de)(de)(de)自(zi)(zi)(zi)(zi)(zi)殺(sha)(sha)(sha)(sha)(sha)傾向,學(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)因疏忽(hu)或(huo)者行(xing)(xing)(xing)動遲滯導致自(zi)(zi)(zi)(zi)(zi)殺(sha)(sha)(sha)(sha)(sha)結(jie)果(guo)(guo)的(de)(de)(de)(de)(de)(de),則(ze)(ze)應(ying)當(dang)根(gen)據過失(shi)(shi)大(da)小(xiao)承(cheng)擔(dan)(dan)相應(ying)的(de)(de)(de)(de)(de)(de)法(fa)律責(ze)(ze)任(ren)(ren)(ren)(ren)。

三、基于學生自殺的高校民事責任立法與司法之弊端與完善

(一(yi))基于學生自(zi)殺的高校民事責任(ren)立法與司法之弊端

1.與(yu)高(gao)(gao)校學(xue)(xue)生(sheng)自(zi)(zi)殺(sha)相關的立法(fa)(fa)(fa)缺(que)陷高(gao)(gao)校與(yu)學(xue)(xue)生(sheng)之(zhi)間(jian)既有(you)(you)行(xing)政法(fa)(fa)(fa)律(lv)關系(xi),又(you)存在(zai)(zai)民(min)(min)事(shi)(shi)(shi)(shi)(shi)(shi)法(fa)(fa)(fa)律(lv)關系(xi),故(gu)(gu)受多(duo)部(bu)部(bu)門(men)(men)(men)(men)法(fa)(fa)(fa)調(diao)整(zheng)。我國(guo)的刑法(fa)(fa)(fa)、民(min)(min)法(fa)(fa)(fa)、教育法(fa)(fa)(fa)等(deng)(deng)均有(you)(you)保(bao)障學(xue)(xue)生(sheng)人(ren)身(shen)安全(quan)的規(gui)定(ding),但(dan)相關規(gui)定(ding)雜(za)亂(luan)、籠(long)統(tong),責任劃分(fen)不(bu)(bu)明(ming)確(que),也未(wei)對(dui)學(xue)(xue)生(sheng)自(zi)(zi)殺(sha)等(deng)(deng)人(ren)身(shen)傷(shang)害(hai)(hai)事(shi)(shi)(shi)(shi)(shi)(shi)故(gu)(gu)進(jin)行(xing)歸(gui)納(na)。如:《中(zhong)華人(ren)民(min)(min)共和(he)國(guo)民(min)(min)法(fa)(fa)(fa)典》只對(dui)侵權行(xing)為(wei)做了原(yuan)則性規(gui)定(ding),并未(wei)特別涉(she)及學(xue)(xue)生(sheng)自(zi)(zi)殺(sha)等(deng)(deng)傷(shang)害(hai)(hai)行(xing)為(wei)。《學(xue)(xue)生(sheng)傷(shang)害(hai)(hai)事(shi)(shi)(shi)(shi)(shi)(shi)故(gu)(gu)處理辦(ban)法(fa)(fa)(fa)》雖然對(dui)學(xue)(xue)生(sheng)自(zi)(zi)殺(sha)行(xing)為(wei)有(you)(you)專門(men)(men)(men)(men)、具體的規(gui)定(ding),但(dan)這只是部(bu)門(men)(men)(men)(men)規(gui)章,立法(fa)(fa)(fa)層(ceng)級低,法(fa)(fa)(fa)院(yuan)在(zai)(zai)判決中(zhong)往(wang)(wang)往(wang)(wang)不(bu)(bu)予采納(na),且其(qi)制定(ding)者教育部(bu)是高(gao)(gao)校的主管(guan)部(bu)門(men)(men)(men)(men),公眾(zhong)會(hui)(hui)對(dui)其(qi)公正性存在(zai)(zai)質疑。2.事(shi)(shi)(shi)(shi)(shi)(shi)故(gu)(gu)調(diao)解(jie)機制未(wei)發揮應有(you)(you)功(gong)效高(gao)(gao)校學(xue)(xue)生(sheng)自(zi)(zi)殺(sha)事(shi)(shi)(shi)(shi)(shi)(shi)故(gu)(gu)發生(sheng)后(hou),常用的處理方(fang)(fang)式(shi)包括訴訟(song)、仲裁、第三方(fang)(fang)調(diao)解(jie)、自(zi)(zi)行(xing)和(he)解(jie)等(deng)(deng)。《學(xue)(xue)生(sheng)傷(shang)害(hai)(hai)事(shi)(shi)(shi)(shi)(shi)(shi)故(gu)(gu)處理辦(ban)法(fa)(fa)(fa)》雖然規(gui)定(ding)學(xue)(xue)生(sheng)傷(shang)亡(wang)事(shi)(shi)(shi)(shi)(shi)(shi)故(gu)(gu)發生(sheng)后(hou),如果雙方(fang)(fang)自(zi)(zi)愿,可以書面請(qing)求教育主管(guan)部(bu)門(men)(men)(men)(men)進(jin)行(xing)調(diao)解(jie),但(dan)實際上高(gao)(gao)校往(wang)(wang)往(wang)(wang)不(bu)(bu)敢也不(bu)(bu)愿意(yi)申(shen)請(qing)教育主管(guan)部(bu)門(men)(men)(men)(men)調(diao)解(jie),而家(jia)長對(dui)教育主管(guan)部(bu)門(men)(men)(men)(men)缺(que)乏信任感(gan),擔心其(qi)偏(pian)袒高(gao)(gao)校。因此(ci),《學(xue)(xue)生(sheng)傷(shang)害(hai)(hai)事(shi)(shi)(shi)(shi)(shi)(shi)故(gu)(gu)處理辦(ban)法(fa)(fa)(fa)》規(gui)定(ding)的自(zi)(zi)愿調(diao)解(jie)實際上沒有(you)(you)發揮應有(you)(you)的功(gong)效。一般情況(kuang)下,學(xue)(xue)生(sheng)自(zi)(zi)殺(sha)事(shi)(shi)(shi)(shi)(shi)(shi)故(gu)(gu)發生(sheng)后(hou),涉(she)事(shi)(shi)(shi)(shi)(shi)(shi)高(gao)(gao)校立即成為(wei)社會(hui)(hui)輿(yu)論關注的焦點。面對(dui)來(lai)自(zi)(zi)家(jia)長、社會(hui)(hui)、政府(fu)等(deng)(deng)方(fang)(fang)面的壓力(li),高(gao)(gao)校往(wang)(wang)往(wang)(wang)會(hui)(hui)為(wei)自(zi)(zi)己的聲(sheng)譽(yu)著想,希望大事(shi)(shi)(shi)(shi)(shi)(shi)化小,不(bu)(bu)愿意(yi)運用法(fa)(fa)(fa)律(lv)武(wu)器。有(you)(you)的家(jia)長無視學(xue)(xue)校是否有(you)(you)過錯,漫天要價,有(you)(you)的甚至還在(zai)(zai)學(xue)(xue)校門(men)(men)(men)(men)口聚眾(zhong)哭鬧,擺(bai)設(she)靈堂,燒紙錢,拉橫幅,高(gao)(gao)校無力(li)阻止,也無有(you)(you)效處理機制,導致(zhi)雙方(fang)(fang)身(shen)心俱疲,嚴重影響校園環(huan)境和(he)正常教學(xue)(xue)秩序(xu)。

(二(er))基于學生自殺的高校民(min)事責任立法(fa)與司法(fa)之完善(shan)

1.修(xiu)訂(ding)法(fa)(fa)(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)(fa)(fa)規(gui)(gui),明確(que)(que)各(ge)方(fang)責任(ren)要(yao)(yao)加快推進《中(zhong)華人(ren)(ren)(ren)民共(gong)(gong)和(he)(he)國高(gao)(gao)(gao)等(deng)教(jiao)育(yu)法(fa)(fa)(fa)(fa)(fa)》的(de)(de)立法(fa)(fa)(fa)(fa)(fa)修(xiu)訂(ding)工作(zuo)(zuo),在(zai)其中(zhong)增加有(you)關(guan)校(xiao)(xiao)(xiao)(xiao)園安(an)全(quan)(quan)保障方(fang)面(mian)的(de)(de)內容。要(yao)(yao)建立健全(quan)(quan)科學、合理且有(you)針對性、操(cao)作(zuo)(zuo)性強的(de)(de)專項(xiang)校(xiao)(xiao)(xiao)(xiao)園安(an)全(quan)(quan)制度(du),切實保障學生在(zai)校(xiao)(xiao)(xiao)(xiao)期間的(de)(de)人(ren)(ren)(ren)身(shen)安(an)全(quan)(quan)和(he)(he)高(gao)(gao)(gao)校(xiao)(xiao)(xiao)(xiao)的(de)(de)合法(fa)(fa)(fa)(fa)(fa)權(quan)益(yi),明確(que)(que)社(she)會、學校(xiao)(xiao)(xiao)(xiao)和(he)(he)家庭各(ge)方(fang)的(de)(de)責任(ren)。應(ying)將《學生傷害事(shi)(shi)(shi)故處理辦(ban)法(fa)(fa)(fa)(fa)(fa)》中(zhong)的(de)(de)有(you)關(guan)內容移植到《中(zhong)華人(ren)(ren)(ren)民共(gong)(gong)和(he)(he)國高(gao)(gao)(gao)等(deng)教(jiao)育(yu)法(fa)(fa)(fa)(fa)(fa)》中(zhong),使之具(ju)有(you)更高(gao)(gao)(gao)的(de)(de)法(fa)(fa)(fa)(fa)(fa)律(lv)效力(li),成(cheng)為(wei)(wei)各(ge)級人(ren)(ren)(ren)民法(fa)(fa)(fa)(fa)(fa)院的(de)(de)判決依(yi)據。2.完善事(shi)(shi)(shi)故調(diao)(diao)解(jie)(jie)機(ji)制考慮到事(shi)(shi)(shi)故發生后涉事(shi)(shi)(shi)雙方(fang)多數不愿訴(su)訟解(jie)(jie)決,自(zi)行和(he)(he)解(jie)(jie)又困難重(zhong)重(zhong),建議(yi)在(zai)《中(zhong)華人(ren)(ren)(ren)民共(gong)(gong)和(he)(he)國高(gao)(gao)(gao)等(deng)教(jiao)育(yu)法(fa)(fa)(fa)(fa)(fa)》中(zhong)明確(que)(que)規(gui)(gui)定調(diao)(diao)解(jie)(jie)機(ji)制,并將目(mu)前的(de)(de)自(zi)愿調(diao)(diao)解(jie)(jie)修(xiu)改為(wei)(wei)強制調(diao)(diao)解(jie)(jie),規(gui)(gui)定調(diao)(diao)解(jie)(jie)為(wei)(wei)訴(su)訟的(de)(de)前置程(cheng)序。強制調(diao)(diao)解(jie)(jie)既可(ke)以及時化解(jie)(jie)糾紛,避(bi)免訴(su)累,也可(ke)以在(zai)一定程(cheng)度(du)上避(bi)免學生家長在(zai)校(xiao)(xiao)(xiao)(xiao)園反復(fu)糾纏,影響正常教(jiao)學秩序。另(ling)外,為(wei)(wei)了提高(gao)(gao)(gao)調(diao)(diao)解(jie)(jie)的(de)(de)公信力(li),應(ying)將調(diao)(diao)解(jie)(jie)人(ren)(ren)(ren)由高(gao)(gao)(gao)校(xiao)(xiao)(xiao)(xiao)主管(guan)部門改為(wei)(wei)高(gao)(gao)(gao)校(xiao)(xiao)(xiao)(xiao)所(suo)在(zai)地的(de)(de)人(ren)(ren)(ren)民法(fa)(fa)(fa)(fa)(fa)院。人(ren)(ren)(ren)民法(fa)(fa)(fa)(fa)(fa)院在(zai)調(diao)(diao)解(jie)(jie)失敗后,可(ke)以引導當(dang)事(shi)(shi)(shi)人(ren)(ren)(ren)采(cai)取訴(su)訟方(fang)式(shi)解(jie)(jie)決糾紛。
