作為一項復雜的系(xi)統工(gong)(gong)(gong)程(cheng),房(fang)屋建筑工(gong)(gong)(gong)程(cheng)施(shi)工(gong)(gong)(gong)會受到(dao)諸(zhu)多因(yin)素(su)影響(xiang),因(yin)此要想提高工(gong)(gong)(gong)程(cheng)的施(shi)工(gong)(gong)(gong)質(zhi)量與投入(ru)使用后的性能,首要任(ren)務是(shi)強(qiang)化施(shi)工(gong)(gong)(gong)管理工(gong)(gong)(gong)作,從而對各種影響(xiang)因(yin)素(su)進(jin)行綜合分析,制(zhi)定并落實(shi)有效(xiao)應對策略,并提高對施(shi)工(gong)(gong)(gong)要素(su)的管理,實(shi)現資源的最優(you)化配置,為房(fang)屋建筑工(gong)(gong)(gong)程(cheng)整(zheng)體性建設水平的提高打下(xia)堅實(shi)的基(ji)礎(chu)。

一、現狀和問題
因歷史欠賬(zhang)多與(yu)“重地上、輕地下”現象并存(cun),我區(qu)地下管線(xian)建設管理工(gong)作與(yu)保障城市(shi)安全運行、改善城區(qu)人居環境要(yao)求存(cun)在(zai)(zai)一定差距。主(zhu)要(yao)表(biao)現在(zai)(zai):
——統(tong)籌不(bu)夠,規(gui)(gui)(gui)劃管(guan)(guan)理凸顯滯(zhi)(zhi)后。隨(sui)著城(cheng)(cheng)市建(jian)(jian)成(cheng)(cheng)區(qu)面(mian)積越(yue)(yue)來越(yue)(yue)大,管(guan)(guan)線(xian)(xian)骨架越(yue)(yue)拉越(yue)(yue)長(chang)(chang),管(guan)(guan)線(xian)(xian)詳細(xi)規(gui)(gui)(gui)劃就越(yue)(yue)顯滯(zhi)(zhi)后。一是(shi)(shi)管(guan)(guan)線(xian)(xian)單(dan)位在(zai)建(jian)(jian)設(she)(she)過程(cheng)中未(wei)慮及(ji)自身管(guan)(guan)理外的管(guan)(guan)線(xian)(xian),顧(gu)及(ji)當前卻(que)未(wei)顧(gu)長(chang)(chang)遠,導致(zhi)時間一長(chang)(chang),各種管(guan)(guan)線(xian)(xian)交叉纏繞、錯綜復雜。二是(shi)(shi)我區(qu)預留廊道不(bu)足且規(gui)(gui)(gui)劃建(jian)(jian)設(she)(she)相對滯(zhi)(zhi)后,管(guan)(guan)線(xian)(xian)大多埋在(zai)人行道下,成(cheng)(cheng)為城(cheng)(cheng)市管(guan)(guan)線(xian)(xian)建(jian)(jian)設(she)(she)維護(hu)時經常對道路“開腸破肚(du)”的根(gen)源。三是(shi)(shi)各單(dan)位之間聯動(dong)不(bu)夠,沒有從(cong)整體(ti)系統(tong)考慮地下空間資源的有效持續利用,重復交叉建(jian)(jian)設(she)(she)造成(cheng)(cheng)路面(mian)頻繁開挖(wa),城(cheng)(cheng)市道路經常“千瘡百(bai)孔”。
——多頭(tou)管(guan)(guan)(guan)理(li)(li)(li),體制(zhi)機制(zhi)運(yun)行(xing)(xing)(xing)不(bu)順。由(you)于(yu)監督管(guan)(guan)(guan)理(li)(li)(li)與行(xing)(xing)(xing)業管(guan)(guan)(guan)理(li)(li)(li)職能不(bu)分(fen),各(ge)部(bu)(bu)門(men)(men)按職責監管(guan)(guan)(guan)經常(chang)出(chu)現(xian)多頭(tou)監管(guan)(guan)(guan)或監管(guan)(guan)(guan)缺位(wei)現(xian)象(xiang),管(guan)(guan)(guan)理(li)(li)(li)體制(zhi)機制(zhi)不(bu)順。一(yi)是由(you)于(yu)管(guan)(guan)(guan)線(xian)大都埋于(yu)地(di)下,分(fen)布(bu)走向(xiang)不(bu)明(ming)(ming)顯(xian),且各(ge)級管(guan)(guan)(guan)網具有連(lian)貫性等(deng)特殊(shu)性,導致各(ge)單(dan)位(wei)之間(jian)管(guan)(guan)(guan)理(li)(li)(li)界線(xian)不(bu)明(ming)(ming)確,經常(chang)引(yin)起挖(wa)斷(duan)地(di)下管(guan)(guan)(guan)線(xian)現(xian)象(xiang),既影響施(shi)工進度拖延工期,又給市民(min)出(chu)行(xing)(xing)(xing)帶來諸多不(bu)便。二是有部(bu)(bu)分(fen)新建和改(gai)造管(guan)(guan)(guan)線(xian)未(wei)及時(shi)按程序進行(xing)(xing)(xing)管(guan)(guan)(guan)理(li)(li)(li)移交,導致該部(bu)(bu)分(fen)管(guan)(guan)(guan)網無(wu)明(ming)(ming)確管(guan)(guan)(guan)理(li)(li)(li)單(dan)位(wei),管(guan)(guan)(guan)網的(de)相關(guan)管(guan)(guan)(guan)理(li)(li)(li)部(bu)(bu)門(men)(men)職責不(bu)清或有責無(wu)權。三是各(ge)管(guan)(guan)(guan)線(xian)單(dan)位(wei)在(zai)建設時(shi)“一(yi)挖(wa)了之”,對(dui)建設后期的(de)維護投入推諉扯皮,最后只能由(you)區政府兜底(di)“買單(dan)”。
——檔(dang)(dang)案(an)分散,信息(xi)不(bu)(bu)(bu)能及時(shi)共(gong)(gong)享。未(wei)建立(li)全區統一的(de)信息(xi)共(gong)(gong)享平臺和共(gong)(gong)享機制。一是(shi)管(guan)(guan)(guan)(guan)(guan)線(xian)(xian)(xian)(xian)檔(dang)(dang)案(an)分散在(zai)各(ge)職能部門或管(guan)(guan)(guan)(guan)(guan)線(xian)(xian)(xian)(xian)單位,未(wei)能統一歸檔(dang)(dang)管(guan)(guan)(guan)(guan)(guan)理。二(er)是(shi)現(xian)有(you)地下管(guan)(guan)(guan)(guan)(guan)線(xian)(xian)(xian)(xian)普查成(cheng)果(guo)覆蓋不(bu)(bu)(bu)足,無法全面準確掌握(wo)城市管(guan)(guan)(guan)(guan)(guan)線(xian)(xian)(xian)(xian)基本情況(kuang),造成(cheng)保管(guan)(guan)(guan)(guan)(guan)的(de)地下管(guan)(guan)(guan)(guan)(guan)線(xian)(xian)(xian)(xian)檔(dang)(dang)案(an)不(bu)(bu)(bu)真(zhen)實(shi)(shi)、不(bu)(bu)(bu)準確、不(bu)(bu)(bu)完(wan)整,不(bu)(bu)(bu)利于(yu)建立(li)地下管(guan)(guan)(guan)(guan)(guan)線(xian)(xian)(xian)(xian)管(guan)(guan)(guan)(guan)(guan)理信息(xi)系統。三是(shi)由(you)于(yu)管(guan)(guan)(guan)(guan)(guan)線(xian)(xian)(xian)(xian)資料(liao)(liao)殘缺(que)不(bu)(bu)(bu)詳盡、移(yi)交(jiao)不(bu)(bu)(bu)完(wan)善(shan)等原因,地下管(guan)(guan)(guan)(guan)(guan)線(xian)(xian)(xian)(xian)工(gong)程(cheng)未(wei)按有(you)關規范要求(qiu)進行報建、施(shi)工(gong)和竣工(gong)測量(liang),沒有(you)形成(cheng)準確的(de)竣工(gong)測量(liang)成(cheng)果(guo),竣工(gong)圖(tu)不(bu)(bu)(bu)能真(zhen)實(shi)(shi)反映(ying)管(guan)(guan)(guan)(guan)(guan)線(xian)(xian)(xian)(xian)情況(kuang),造成(cheng)地下管(guan)(guan)(guan)(guan)(guan)線(xian)(xian)(xian)(xian)的(de)實(shi)(shi)際布置和圖(tu)紙資料(liao)(liao)出現(xian)差別。
二、思考和建議
今年,區委編委會第一(yi)次會議(yi)明確區住房城(cheng)鄉(xiang)建(jian)委為城(cheng)市(shi)地(di)下管(guan)線(xian)(xian)(xian)綜合(he)統(tong)籌管(guan)理(li)部門,負責建(jian)立綜合(he)管(guan)理(li)協調機制(zhi),擬(ni)定(ding)管(guan)線(xian)(xian)(xian)建(jian)設(she)項目年度計劃,負責管(guan)線(xian)(xian)(xian)建(jian)設(she)過程(cheng)中(zhong)的施工監管(guan)、竣(jun)工環節的資料歸(gui)總等工作(zuo);區城(cheng)市(shi)管(guan)理(li)局(ju)等相關部門各司(si)其職、協同配合(he)。在(zai)此基礎(chu)上,為切實做好城(cheng)市(shi)地(di)下管(guan)線(xian)(xian)(xian)管(guan)理(li)工作(zuo),筆者(zhe)建(jian)議(yi):
——統(tong)籌(chou)規(gui)(gui)劃(hua)建(jian)(jian)(jian)設,規(gui)(gui)范(fan)統(tong)一(yi)流程(cheng)。由(you)區住房城鄉建(jian)(jian)(jian)委嚴格落(luo)實區委編委會(hui)精神,牽(qian)頭(tou)抓總,建(jian)(jian)(jian)立綜(zong)合(he)管(guan)理協調機制(zhi),統(tong)籌(chou)城市管(guan)線(xian)建(jian)(jian)(jian)設管(guan)理。一(yi)是(shi)統(tong)一(yi)審(shen)批。由(you)區住房城鄉建(jian)(jian)(jian)委負責統(tong)籌(chou),管(guan)線(xian)行(xing)業(ye)主(zhu)管(guan)部門根據管(guan)線(xian)專(zhuan)項規(gui)(gui)劃(hua)、行(xing)業(ye)規(gui)(gui)劃(hua),組織管(guan)線(xian)權屬、管(guan)理單位編制(zhi)管(guan)線(xian)專(zhuan)業(ye)規(gui)(gui)劃(hua),會(hui)同(tong)區規(gui)(gui)劃(hua)和自然資源局綜(zong)合(he)平衡后報區政府審(shen)批。二是(shi)統(tong)一(yi)程(cheng)序(xu)。管(guan)線(xian)工(gong)程(cheng)應(ying)當(dang)履(lv)行(xing)基本建(jian)(jian)(jian)設程(cheng)序(xu),依法辦理初步設計審(shen)批、施(shi)(shi)工(gong)圖(tu)設計文件審(shen)查(cha)、施(shi)(shi)工(gong)許可(ke)、工(gong)程(cheng)質量(liang)(liang)安全監督、竣工(gong)測量(liang)(liang)以及檔(dang)案移(yi)交等建(jian)(jian)(jian)設手續。三是(shi)統(tong)一(yi)驗收。管(guan)線(xian)工(gong)程(cheng)竣工(gong)驗收前(qian),管(guan)線(xian)建(jian)(jian)(jian)設單位應(ying)當(dang)向城鄉建(jian)(jian)(jian)設主(zhu)管(guan)部門申(shen)請建(jian)(jian)(jian)設工(gong)程(cheng)檔(dang)案專(zhuan)項驗收。
——統攬建(jian)(jian)設(she)(she)計(ji)(ji)劃(hua)(hua)(hua)(hua)(hua),分批推進實(shi)施(shi)。地下管(guan)(guan)線(xian)不得隨(sui)意建(jian)(jian)設(she)(she),任何部(bu)門開挖道(dao)路(lu)(lu)必(bi)須符合城(cheng)(cheng)(cheng)市(shi)(shi)總體規劃(hua)(hua)(hua)(hua)(hua)和管(guan)(guan)線(xian)年度(du)(du)(du)建(jian)(jian)設(she)(she)計(ji)(ji)劃(hua)(hua)(hua)(hua)(hua)。一(yi)是統分結(jie)合。區(qu)住房城(cheng)(cheng)(cheng)鄉建(jian)(jian)委(wei)根據(ju)城(cheng)(cheng)(cheng)市(shi)(shi)總體規劃(hua)(hua)(hua)(hua)(hua)和城(cheng)(cheng)(cheng)市(shi)(shi)經濟社會(hui)發展(zhan)需要(yao),組織編(bian)制城(cheng)(cheng)(cheng)市(shi)(shi)道(dao)路(lu)(lu)年度(du)(du)(du)建(jian)(jian)設(she)(she)計(ji)(ji)劃(hua)(hua)(hua)(hua)(hua),并(bing)及時(shi)(shi)書面告知管(guan)(guan)線(xian)行業(ye)主管(guan)(guan)部(bu)門。管(guan)(guan)線(xian)行業(ye)主管(guan)(guan)部(bu)門負責編(bian)制本行業(ye)管(guan)(guan)線(xian)年度(du)(du)(du)建(jian)(jian)設(she)(she)計(ji)(ji)劃(hua)(hua)(hua)(hua)(hua),并(bing)報區(qu)住房城(cheng)(cheng)(cheng)鄉建(jian)(jian)委(wei)。二是統籌(chou)時(shi)(shi)序。區(qu)住房城(cheng)(cheng)(cheng)鄉建(jian)(jian)委(wei)根據(ju)道(dao)路(lu)(lu)年度(du)(du)(du)建(jian)(jian)設(she)(she)計(ji)(ji)劃(hua)(hua)(hua)(hua)(hua)、道(dao)路(lu)(lu)年度(du)(du)(du)挖掘計(ji)(ji)劃(hua)(hua)(hua)(hua)(hua),統籌(chou)各管(guan)(guan)線(xian)行業(ye)年度(du)(du)(du)建(jian)(jian)設(she)(she)計(ji)(ji)劃(hua)(hua)(hua)(hua)(hua),合理安排管(guan)(guan)線(xian)工程建(jian)(jian)設(she)(she)時(shi)(shi)序,提出城(cheng)(cheng)(cheng)市(shi)(shi)管(guan)(guan)線(xian)年度(du)(du)(du)建(jian)(jian)設(she)(she)總計(ji)(ji)劃(hua)(hua)(hua)(hua)(hua),并(bing)報區(qu)政府(fu)批準后實(shi)施(shi)。三(san)是儲備項目。區(qu)住房城(cheng)(cheng)(cheng)鄉建(jian)(jian)委(wei)負責統籌(chou)建(jian)(jian)立項目儲備制度(du)(du)(du),編(bian)制城(cheng)(cheng)(cheng)市(shi)(shi)綜合管(guan)(guan)廊中(zhong)長期建(jian)(jian)設(she)(she)規劃(hua)(hua)(hua)(hua)(hua)和年度(du)(du)(du)建(jian)(jian)設(she)(she)計(ji)(ji)劃(hua)(hua)(hua)(hua)(hua),協調城(cheng)(cheng)(cheng)市(shi)(shi)道(dao)路(lu)(lu)建(jian)(jian)設(she)(she)與(yu)城(cheng)(cheng)(cheng)市(shi)(shi)管(guan)(guan)線(xian)建(jian)(jian)設(she)(she)時(shi)(shi)序。

一(yi)、韶山市實行社區(qu)網(wang)格化管(guan)理的必要性
實現韶山社(she)會(hui)(hui)管理(li)(li)(li)的全覆蓋(gai)。面對(dui)新時期利(li)益主體(ti)的多(duo)元性(xing)、利(li)益訴求多(duo)樣性(xing)、利(li)益問(wen)題(ti)多(duo)發性(xing),傳統的社(she)會(hui)(hui)管理(li)(li)(li)涉及的范圍愈(yu)(yu)來愈(yu)(yu)廣,管理(li)(li)(li)上(shang)愈(yu)(yu)加復(fu)雜(za),出現的問(wen)題(ti)也越多(duo)。社(she)區網格(ge)化管理(li)(li)(li)是(shi)韶山市傳統社(she)區管理(li)(li)(li)體(ti)制的延伸發展,是(shi)城市管理(li)(li)(li)科學的新實踐。在推進(jin)社(she)會(hui)(hui)管理(li)(li)(li)創新的工作中,做好(hao)了(le)維護(hu)社(she)會(hui)(hui)治安和(he)社(she)會(hui)(hui)穩定(ding)工作,抓好(hao)了(le)民生改善和(he)權益保障工作,加強了(le)服務群眾和(he)創新管理(li)(li)(li)等工作,2011年取得了(le)群眾滿意度排名全省縣(xian)市區第一的成績。
實現創新以及(ji)服(fu)務政府建設。對于傳統自(zi)上而下的社(she)(she)區(qu)管理和社(she)(she)區(qu)服(fu)務行(xing)政模(mo)式(shi)來(lai)說,網格化社(she)(she)區(qu)管理是一種創新的城市(shi)社(she)(she)區(qu)管理模(mo)式(shi),從體(ti)制上能(neng)(neng)夠保(bao)證(zheng)組織平(ping)等、有(you)序參與、合(he)作共(gong)治(zhi),使行(xing)政職能(neng)(neng)與行(xing)政現代化有(you)機(ji)結(jie)合(he)起(qi)來(lai),有(you)助于加大行(xing)政透(tou)明度,推動法治(zhi)政府、服(fu)務政府、責(ze)任政府的建設。
推進基(ji)層民(min)主(zhu)建(jian)設,實現(xian)人的(de)全面發展。發展基(ji)層民(min)主(zhu)是推動社(she)(she)網格(ge)化(hua)區(qu)管理(li)的(de)動力(li),社(she)(she)區(qu)網格(ge)化(hua)管理(li)積極探索政(zheng)務公(gong)(gong)開等(deng)工作(zuo),管理(li)主(zhu)體趨于多元化(hua),提(ti)高了社(she)(she)區(qu)管理(li)工作(zuo)的(de)透明度、精細(xi)化(hua)、規范化(hua)。針對群(qun)眾精神(shen)文(wen)(wen)化(hua)需求多樣化(hua)的(de)特點,各社(she)(she)區(qu)積極引(yin)導群(qun)眾性(xing)文(wen)(wen)體團隊(dui)的(de)發展,通過(guo)社(she)(she)區(qu)文(wen)(wen)化(hua)和社(she)(she)區(qu)民(min)主(zhu)建(jian)設,滿足社(she)(she)區(qu)居民(min)提(ti)高自身(shen)素(su)質的(de)需要,增強社(she)(she)區(qu)居民(min)的(de)社(she)(she)會認同感和公(gong)(gong)共意識(shi),為群(qun)眾的(de)廣(guang)泛自主(zhu)參與開辟空間,促進人與環境(jing)的(de)協調發展。
二、韶山市社區網格(ge)化管理基本(ben)情況
2010年湖南省出臺了《關于加強和創(chuang)新社會(hui)管(guan)理(li)(li)的意(yi)見》(湘發[2010]18號),省綜治委于2011年3月確定(ding)韶山市為全省社會(hui)管(guan)理(li)(li)創(chuang)新綜合試點市,韶山市社會(hui)管(guan)理(li)(li)創(chuang)新工(gong)作(zuo)全面
展開。
(一)韶(shao)山市社區網格化管理的初步成(cheng)效(xiao)
建立(li)(li)“鎮-社(she)(she)區(qu)(qu)-網格(ge)(ge)-小區(qu)(qu)-樓棟-住戶(hu)”六級(ji)管(guan)理(li)(li)機(ji)制(zhi)。韶發[2011]17號文件中(zhong)將(jiang)城(cheng)市網格(ge)(ge)化(hua)服(fu)務(wu)管(guan)理(li)(li)體系納入(ru)市綜治管(guan)理(li)(li)中(zhong),建立(li)(li)六級(ji)管(guan)理(li)(li)機(ji)制(zhi),將(jiang)社(she)(she)區(qu)(qu)內的市場、學校、醫院等駐(zhu)區(qu)(qu)單位(wei)以及樓棟、院落等歸(gui)入(ru)基(ji)層網格(ge)(ge),建立(li)(li)以“人(ren)、地、物、情、事、組織(zhi)”為核心的社(she)(she)區(qu)(qu)基(ji)礎信息數據庫,將(jiang)社(she)(she)會(hui)管(guan)理(li)(li)、社(she)(she)區(qu)(qu)服(fu)務(wu)和(he)社(she)(she)區(qu)(qu)自(zi)治納入(ru)網格(ge)(ge),使每一個網格(ge)(ge)真正(zheng)成(cheng)為社(she)(she)會(hui)管(guan)理(li)(li)服(fu)務(wu)的基(ji)本單位(wei)和(he)組織(zhi)節點。
健全社(she)區網格(ge)管(guan)理創新(xin),提(ti)(ti)升社(she)區服務水平(ping)“全覆蓋(gai)”。社(she)區網格(ge)化(hua)(hua)管(guan)理強(qiang)調資(zi)源整(zheng)合(he)(he),信(xin)息(xi)共享(xiang)。網格(ge)化(hua)(hua)要(yao)求建立(li)高(gao)(gao)(gao)度協同的行(xing)政管(guan)理機(ji)制,改變資(zi)源部門所有(you)、多頭重復(fu)建設(she)的弊(bi)端,從而提(ti)(ti)高(gao)(gao)(gao)了對社(she)會事(shi)件的綜合(he)(he)反應能力(li)、公(gong)共資(zi)源的科學(xue)供給水平(ping),推動社(she)區均衡(heng)發展,提(ti)(ti)高(gao)(gao)(gao)管(guan)理、提(ti)(ti)高(gao)(gao)(gao)服務效率(lv)。
管理主體的(de)多元化。韶山市(shi)社區網格(ge)化管理主體不再是單一的(de)政府部門(men),而有(you)(you)很多社區內(nei)威望比較高、退休工(gong)人(ren)等任職(zhi)。這樣更能夠有(you)(you)利于該(gai)網格(ge)內(nei)的(de)管理效率和實現該(gai)網格(ge)內(nei)人(ren)的(de)全(quan)面發展。
(二)韶(shao)山市社區網(wang)格(ge)化管理出現的問題
缺乏制度保障。社區網格化管(guan)(guan)理(li)作為韶山市一種新生的(de)(de)城(cheng)市管(guan)(guan)理(li)創新模式,還正(zheng)處(chu)于探索(suo)階段,配(pei)套的(de)(de)相關法律(lv)法規并沒有(you)及(ji)時的(de)(de)跟進,因此(ci),導致在管(guan)(guan)理(li)過程中會出現諸多(duo)管(guan)(guan)理(li)上的(de)(de)糾紛事件(jian)等。
觀念陳舊(jiu)。不(bu)論是管理者(zhe)或是被管理者(zhe)還沒有正確的(de)認識到韶山(shan)現代城市(shi)管理的(de)創(chuang)新需求,也沒有意識到信息化手(shou)段在當前社區網格化管理工作(zuo)中的(de)重要地位。
缺(que)乏監督。社(she)區網格化管理的有效運行(xing)也(ye)必須在公(gong)眾(zhong)的有力(li)監督下進行(xing),但(dan)目前韶山(shan)并沒有賦予公(gong)眾(zhong)相(xiang)關的權利以及制(zhi)定相(xiang)關制(zhi)度保障,沒有實現公(gong)眾(zhong)與政府的良性互動。
三(san)、基于韶山市(shi)社區網格化管理的幾(ji)點建議(yi)及思考
(一)加(jia)強社區網格化(hua)的法制化(hua)建設
社(she)區網格化管理(li)(li)是(shi)現(xian)代城(cheng)市管理(li)(li)衍生出的一種(zhong)新型城(cheng)市模式,與(yu)傳統城(cheng)市管理(li)(li)有(you)一定(ding)的矛盾(dun),現(xian)有(you)的制度法(fa)規都是(shi)與(yu)傳統的城(cheng)市社(she)區管理(li)(li)相對應(ying)的,在(zai)具體(ti)實施的過(guo)程中會(hui)不可避免(mian)的出現(xian)一些問題。為了保證社(she)區網格化能夠長期(qi)有(you)效的運行,就必須建立健全的法(fa)律法(fa)規,用(yong)及時有(you)效的制度來保障這一模式走(zou)向(xiang)成熟與(yu)規范(fan)。
(二)轉變觀念、創新社區管(guan)理(li)理(li)念
社(she)區網(wang)格(ge)化(hua)(hua)管(guan)理(li)在韶山市的(de)實施是(shi)對傳(chuan)統(tong)社(she)區管(guan)理(li)的(de)創新(xin),是(shi)一種新(xin)生(sheng)(sheng)事物,管(guan)理(li)者(zhe)和被管(guan)理(li)者(zhe)對于這一新(xin)生(sheng)(sheng)事物并不能夠全面了解。尤其是(shi)從(cong)管(guan)理(li)者(zhe)的(de)角度來(lai)講,要從(cong)傳(chuan)統(tong)的(de)管(guan)理(li)理(li)念轉(zhuan)變為(wei)效率至上、服務至上的(de)理(li)念,完(wan)善政(zheng)府職能,充分利用信息(xi)化(hua)(hua)手段(duan)科(ke)學劃分網(wang)格(ge)分區,為(wei)社(she)區網(wang)格(ge)化(hua)(hua)管(guan)理(li)提供有力的(de)制(zhi)度、資金保障。
(三)完善民主(zhu)考評機制
社(she)區(qu)(qu)(qu)網格(ge)化(hua)管理的(de)最(zui)(zui)終目的(de)就是實現資(zi)源整合、民眾(zhong)利(li)益最(zui)(zui)大化(hua)。在(zai)社(she)區(qu)(qu)(qu)網格(ge)化(hua)管理的(de)過程中應該賦予公眾(zhong)的(de)監督(du)和參與權利(li),使(shi)社(she)區(qu)(qu)(qu)網格(ge)化(hua)管理在(zai)法律(lv)上獲得認可(ke)的(de)同時,又在(zai)公眾(zhong)監督(du)之下。通過法律(lv)保(bao)障和社(she)會監督(du)的(de)形式(shi)使(shi)社(she)區(qu)(qu)(qu)網格(ge)化(hua)有(you)效(xiao)(xiao)實施,這也是推(tui)進城市(shi)管理效(xiao)(xiao)率的(de)的(de)外在(zai)機制。

一、當前(qian)城市管理(li)存(cun)在(zai)的主要(yao)問題
(1)城(cheng)市(shi)基礎設(she)施(shi)建設(she)滯后(hou)
一(yi)是市政設(she)施(shi)(shi)不(bu)夠完善(shan),各類專業經營(ying)場(chang)所硬件設(she)施(shi)(shi)不(bu)完備(bei),部分住宅(zhai)小區內部功能不(bu)全(quan),車(che)庫、停(ting)車(che)場(chang)、垃(la)圾池等必(bi)須(xu)設(she)施(shi)(shi)配套(tao)不(bu)足(zu),影響(xiang)了居民生活(huo)。二是秩序(xu)比較混亂。占道經營(ying)現象(xiang)嚴(yan)重,交通秩序(xu)管理不(bu)規范,違(wei)章(zhang)建筑(zhu)問題突出。一(yi)些(xie)居民私自(zi)圈(quan)地建房,不(bu)僅(jin)破壞城(cheng)市規劃,而且(qie)存在(zai)安全(quan)隱患;少(shao)數居民在(zai)屋頂違(wei)章(zhang)搭蓋加層,影響(xiang)了建筑(zhu)物(wu)整體(ti)景觀。
(2)城市管理相關法律保(bao)障機制不健全
到目前為止全國(guo)還沒有(you)(you)一部關于(yu)城(cheng)管(guan)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)的(de)(de)專(zhuan)門法(fa)(fa)(fa)規(gui),現在城(cheng)管(guan)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)的(de)(de)依(yi)據僅是《行(xing)(xing)(xing)政(zheng)(zheng)處(chu)罰法(fa)(fa)(fa)》中(zhong)關于(yu)相對集中(zhong)行(xing)(xing)(xing)政(zheng)(zheng)處(chu)罰權(quan)的(de)(de)規(gui)定(ding),因此(ci)城(cheng)市(shi)管(guan)理(li)行(xing)(xing)(xing)政(zheng)(zheng)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)一直處(chu)于(yu)“借法(fa)(fa)(fa)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)”的(de)(de)局面。這(zhe)導致城(cheng)管(guan)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)的(de)(de)法(fa)(fa)(fa)律(lv)(lv)效(xiao)力和法(fa)(fa)(fa)律(lv)(lv)地位明顯不(bu)足,城(cheng)管(guan)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)主體在執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)過程中(zhong)處(chu)于(yu)一種尷尬(ga)境地。同時(shi),也沒有(you)(you)法(fa)(fa)(fa)律(lv)(lv)對城(cheng)管(guan)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)人員的(de)(de)權(quan)利(li)義(yi)務(wu)、法(fa)(fa)(fa)定(ding)職責以(yi)及履職范圍(wei)等問題做出明確的(de)(de)規(gui)定(ding),城(cheng)管(guan)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)的(de)(de)范圍(wei)不(bu)斷擴(kuo)大,從(cong)市(shi)容環境到工商管(guan)理(li),從(cong)城(cheng)市(shi)節水到公安(an)交通,幾(ji)乎無所不(bu)包。此(ci)外,缺(que)少有(you)(you)效(xiao)的(de)(de)監督(du)制約機制,使(shi)得行(xing)(xing)(xing)政(zheng)(zheng)處(chu)罰自由裁量權(quan)被城(cheng)管(guan)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)者任意使(shi)用,這(zhe)就使(shi)城(cheng)管(guan)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)方式(shi)簡單化、粗暴化,增大了(le)發生的(de)(de)幾(ji)率。
(3)政(zheng)府執(zhi)法觀(guan)念相對滯后
長期(qi)以來(lai),我國實行政(zheng)(zheng)(zheng)府社(she)會高度(du)合一(yi)的(de)管(guan)理(li)模(mo)式(shi),政(zheng)(zheng)(zheng)府把對社(she)會公共事務(wu)的(de)管(guan)理(li)看成(cheng)僅僅是政(zheng)(zheng)(zheng)府的(de)管(guan)理(li)。公民主體在(zai)城管(guan)執(zhi)(zhi)(zhi)法中的(de)參與權(quan)被剝奪(duo)了,執(zhi)(zhi)(zhi)法部(bu)門與執(zhi)(zhi)(zhi)法對象(xiang)處(chu)于直接對立的(de)境地。在(zai)“官本位”思(si)想(xiang)的(de)阻礙下(xia),政(zheng)(zheng)(zheng)府在(zai)管(guan)理(li)中往往先以官員自身(shen)為中心(xin),脫離了實際需要,導致政(zheng)(zheng)(zheng)府的(de)所為并不是群(qun)(qun)眾真正需要的(de)。這種執(zhi)(zhi)(zhi)法方式(shi)很(hen)難使被管(guan)理(li)者心(xin)服(fu)口服(fu),被處(chu)罰(fa)的(de)群(qun)(qun)眾不但會叫屈(qu)喊冤,而且也(ye)不會對法律產生敬畏的(de)思(si)想(xiang)。因此(ci)執(zhi)(zhi)(zhi)法部(bu)門與執(zhi)(zhi)(zhi)法對象(xiang)之間的(de)矛(mao)盾、沖(chong)突將會更加頻(pin)繁,非文明(ming)執(zhi)(zhi)(zhi)法的(de)現象(xiang)也(ye)會更加突顯。
(4)宣(xuan)傳教育(yu)不夠深(shen)入,市民城(cheng)市意識(shi)比較淡薄(bo)
實現(xian)真(zhen)正意(yi)(yi)(yi)義上的城市(shi)化,要求(qiu)(qiu)市(shi)民(min)(min)必須具(ju)備良好的社會公(gong)德意(yi)(yi)(yi)識(shi)(shi)、衛生意(yi)(yi)(yi)識(shi)(shi)、環境意(yi)(yi)(yi)識(shi)(shi)。目前,我(wo)國對市(shi)民(min)(min)在(zai)城市(shi)管(guan)理方面的宣(xuan)傳教育(yu)力(li)度(du)還很不夠,市(shi)民(min)(min)愛護城市(shi)、愛護公(gong)共(gong)設施(shi)的意(yi)(yi)(yi)識(shi)(shi)還很淡薄,亂(luan)(luan)(luan)丟(diu)、亂(luan)(luan)(luan)吐(tu)、亂(luan)(luan)(luan)停、亂(luan)(luan)(luan)放、亂(luan)(luan)(luan)倒、亂(luan)(luan)(luan)搭、亂(luan)(luan)(luan)建的現(xian)象(xiang)還十分突出,人為(wei)(wei)破壞、盜竊公(gong)共(gong)設施(shi)的行為(wei)(wei)時有發生。一方面,市(shi)民(min)(min)對城市(shi)管(guan)理提出了高要求(qiu)(qiu),希望城市(shi)管(guan)理部門加大(da)管(guan)理力(li)度(du),提升管(guan)理水平;而(er)另一方面,當城市(shi)管(guan)理與個人利益(yi)出現(xian)矛盾時,市(shi)民(min)(min)的自我(wo)約束能力(li)就會下降(jiang),公(gong)共(gong)意(yi)(yi)(yi)識(shi)(shi)往往被拋在(zai)一邊。
二、加(jia)強城市管(guan)理工作的對策建議(yi)
(1)統籌規劃,完善(shan)城市基礎設(she)施建(jian)設(she)
要堅(jian)持以規(gui)劃(hua)(hua)為(wei)綱(gang),把城(cheng)市(shi)管(guan)(guan)理(li)(li)(li)(li)(li)納入城(cheng)市(shi)建設(she)(she)發展總體(ti)規(gui)劃(hua)(hua),實行同(tong)步(bu)規(gui)劃(hua)(hua),同(tong)步(bu)推進,從源頭加(jia)強城(cheng)市(shi)管(guan)(guan)理(li)(li)(li)(li)(li)。同(tong)時,本著(zhu)量(liang)力而行的(de)原則(ze),合(he)理(li)(li)(li)(li)(li)規(gui)劃(hua)(hua),進一(yi)步(bu)完善市(shi)政基礎設(she)(she)施(shi)配(pei)套(tao)。如加(jia)強環(huan)衛設(she)(she)施(shi)的(de)規(gui)劃(hua)(hua)與(yu)(yu)建設(she)(she)、加(jia)快(kuai)垃(la)(la)圾(ji)處理(li)(li)(li)(li)(li)廠、垃(la)(la)圾(ji)中轉站、垃(la)(la)圾(ji)收容器及公廁的(de)規(gui)劃(hua)(hua)布點與(yu)(yu)配(pei)建步(bu)伐,提高環(huan)衛保潔(jie)能力和(he)水平。加(jia)強停(ting)車場的(de)規(gui)劃(hua)(hua)與(yu)(yu)建設(she)(she)、加(jia)強行業市(shi)場的(de)規(gui)劃(hua)(hua)與(yu)(yu)建設(she)(she),本著(zhu)“管(guan)(guan)理(li)(li)(li)(li)(li)優先”和(he)“誰投資,誰受益(yi)”的(de)原則(ze),分批實施(shi),打造分類合(he)理(li)(li)(li)(li)(li)、特色鮮 明(ming)、統一(yi)管(guan)(guan)理(li)(li)(li)(li)(li)、集中經(jing)營的(de)各類專(zhuan)業市(shi)場。
(2)吸收經(jing)驗,完(wan)善城市管理法律體系(xi)

(3)更新觀念(nian),牢(lao)固樹立(li)科(ke)學(xue)管理城市理念(nian)
要堅持以(yi)(yi)科學發展(zhan)觀為指導(dao),在(zai)(zai)創新城市管(guan)理(li)(li)(li)理(li)(li)(li)念上進一(yi)(yi)步解(jie)放思(si)想,強化調(diao)控職能,立(li)足打基礎、管(guan)長遠,由側重(zhong)于管(guan)人(ren)、管(guan)事、管(guan)物轉為更加重(zhong)視改善人(ren)的生存(cun)和(he)發展(zhan)環境,實(shi)現(xian)城市管(guan)理(li)(li)(li)從“以(yi)(yi)物為本”向(xiang)“以(yi)(yi)人(ren)為本”的思(si)維(wei)(wei)(wei)轉變(bian)。強化服(fu)務(wu)職能,一(yi)(yi)切(qie)從維(wei)(wei)(wei)護群眾根本利益出發,在(zai)(zai)管(guan)理(li)(li)(li)中體現(xian)服(fu)務(wu),在(zai)(zai)服(fu)務(wu)中實(shi)施管(guan)理(li)(li)(li),實(shi)現(xian)城市管(guan)理(li)(li)(li)從效益至上向(xiang)服(fu)務(wu)至上的思(si)維(wei)(wei)(wei)轉變(bian)。強化監督職能,健全(quan)有法必依、執(zhi)法必嚴的執(zhi)法監督體系,不(bu)斷推進城市管(guan)理(li)(li)(li)的法制化、規(gui)范化進程,實(shi)現(xian)城市管(guan)理(li)(li)(li)從人(ren)治(zhi)向(xiang)法治(zhi)的轉變(bian)。

第一(yi),管(guan)理(li)(li)制度不夠健全(quan),管(guan)理(li)(li)流程不夠規(gui)范(fan)(fan)。雖(sui)然各(ge)級地方(fang)政(zheng)(zheng)府都(dou)成立(li)(li)了(le)城(cheng)(cheng)市管(guan)理(li)(li)行(xing)(xing)政(zheng)(zheng)執法(fa)(fa)(fa)(fa)(fa)(fa)的(de)專門(men)機構和(he)部門(men),也對(dui)其工(gong)作(zuo)職責和(he)工(gong)作(zuo)任務有(you)了(le)明(ming)確的(de)規(gui)定(ding)。但(dan)從國家立(li)(li)法(fa)(fa)(fa)(fa)(fa)(fa)層(ceng)面(mian)來看,到(dao)目前(qian)(qian)為止還(huan)沒有(you)一(yi)部專門(men)的(de)城(cheng)(cheng)市管(guan)理(li)(li)法(fa)(fa)(fa)(fa)(fa)(fa),城(cheng)(cheng)市管(guan)理(li)(li)行(xing)(xing)政(zheng)(zheng)執法(fa)(fa)(fa)(fa)(fa)(fa)工(gong)作(zuo)的(de)執法(fa)(fa)(fa)(fa)(fa)(fa)主體(ti)、執法(fa)(fa)(fa)(fa)(fa)(fa)手段、執法(fa)(fa)(fa)(fa)(fa)(fa)范(fan)(fan)圍(wei)等問題(ti)還(huan)是不夠明(ming)確和(he)具體(ti)。在目前(qian)(qian)的(de)國家立(li)(li)法(fa)(fa)(fa)(fa)(fa)(fa)中(zhong)(zhong),除了(le)《中(zhong)(zhong)國人民共和(he)國行(xing)(xing)政(zheng)(zheng)處(chu)罰(fa)法(fa)(fa)(fa)(fa)(fa)(fa)》對(dui)相對(dui)集中(zhong)(zhong)行(xing)(xing)政(zheng)(zheng)處(chu)罰(fa)權(quan)制度有(you)原則性(xing)規(gui)定(ding)外,尚無(wu)一(yi)部權(quan)威性(xing)的(de)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)對(dui)各(ge)試(shi)點城(cheng)(cheng)市的(de)成功經驗予(yu)以肯(ken)定(ding),并(bing)對(dui)存(cun)在問題(ti)予(yu)以規(gui)范(fan)(fan)。柳州市政(zheng)(zheng)府雖(sui)然也出(chu)臺(tai)了(le)指導(dao)規(gui)范(fan)(fan)城(cheng)(cheng)市管(guan)理(li)(li)的(de)相關(guan)文件和(he)規(gui)定(ding),但(dan)是其法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)效力過(guo)低,內容比較分散,不足(zu)以規(gui)范(fan)(fan)相對(dui)集中(zhong)(zhong)行(xing)(xing)政(zheng)(zheng)處(chu)罰(fa)權(quan)工(gong)作(zuo)中(zhong)(zhong)出(chu)現的(de)各(ge)種新情況、新問題(ti)。
此(ci)外,從(cong)柳(liu)州城(cheng)市管(guan)理(li)行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)(zhi)法(fa)局自身來(lai)說,雖然在成立(li)的(de)(de)(de)6年(nian)中制(zhi)(zhi)定(ding)(ding)了相關管(guan)理(li)規(gui)章(zhang)和(he)制(zhi)(zhi)度(du),對于執(zhi)(zhi)(zhi)(zhi)法(fa)局的(de)(de)(de)工作職(zhi)責、處罰權(quan)限(xian)、執(zhi)(zhi)(zhi)(zhi)法(fa)過(guo)(guo)程(cheng)進行(xing)(xing)了相應的(de)(de)(de)約束和(he)規(gui)范,但是這些(xie)規(gui)章(zhang)和(he)制(zhi)(zhi)度(du)還是不(bu)(bu)夠(gou)全面和(he)具體(ti)(ti),對于行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)(zhi)法(fa)人(ren)員的(de)(de)(de)行(xing)(xing)為(wei)規(gui)范、工作職(zhi)責等方面的(de)(de)(de)規(gui)定(ding)(ding)過(guo)(guo)于籠統,一(yi)定(ding)(ding)程(cheng)度(du)上影響了行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)(zhi)法(fa)流程(cheng)和(he)規(gui)范的(de)(de)(de)管(guan)理(li)。由(you)于管(guan)理(li)制(zhi)(zhi)度(du)不(bu)(bu)健(jian)全,體(ti)(ti)制(zhi)(zhi)不(bu)(bu)夠(gou)完(wan)善(shan),難以(yi)(yi)做到監督執(zhi)(zhi)(zhi)(zhi)法(fa)隊員各個方面的(de)(de)(de)表(biao)現,不(bu)(bu)利于行(xing)(xing)政(zheng)執(zhi)(zhi)(zhi)(zhi)法(fa)隊伍的(de)(de)(de)建設(she)。在完(wan)成執(zhi)(zhi)(zhi)(zhi)法(fa)文書的(de)(de)(de)過(guo)(guo)程(cheng)中,因為(wei)沒(mei)有詳(xiang)細、嚴格(ge)的(de)(de)(de)規(gui)定(ding)(ding),填寫過(guo)(guo)程(cheng)不(bu)(bu)夠(gou)統一(yi),采集證言筆錄、送達回執(zhi)(zhi)(zhi)(zhi)過(guo)(guo)程(cheng)也出現很多問題,以(yi)(yi)致(zhi)辦案效率下降。
第二(er),財政(zheng)(zheng)(zheng)(zheng)撥款(kuan)不足,員(yuan)工工作待遇不高。伴隨著我國城(cheng)(cheng)(cheng)(cheng)市(shi)(shi)(shi)化的(de)快速發展和城(cheng)(cheng)(cheng)(cheng)市(shi)(shi)(shi)規模的(de)不斷擴(kuo)充,城(cheng)(cheng)(cheng)(cheng)市(shi)(shi)(shi)管(guan)(guan)理(li)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)的(de)范圍和對(dui)象也日益擴(kuo)大,城(cheng)(cheng)(cheng)(cheng)市(shi)(shi)(shi)管(guan)(guan)理(li)相對(dui)集中(zhong)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)處罰(fa)權(quan)正是在這(zhe)一背景(jing)下作為應對(dui)城(cheng)(cheng)(cheng)(cheng)市(shi)(shi)(shi)管(guan)(guan)理(li)難(nan)題而出(chu)現的(de)。地方政(zheng)(zheng)(zheng)(zheng)府部門(men)對(dui)于城(cheng)(cheng)(cheng)(cheng)市(shi)(shi)(shi)管(guan)(guan)理(li)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)部門(men)重(zhong)要(yao)性的(de)認識有(you)一個過程(cheng),對(dui)于執(zhi)(zhi)法(fa)局(ju)(ju)(ju)的(de)部門(men)設置、辦公條件、人(ren)(ren)員(yuan)編制等(deng)問題還缺乏(fa)深(shen)入的(de)了解。柳州市(shi)(shi)(shi)政(zheng)(zheng)(zheng)(zheng)府最初設立城(cheng)(cheng)(cheng)(cheng)市(shi)(shi)(shi)管(guan)(guan)理(li)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)局(ju)(ju)(ju)主(zhu)要(yao)是迫于城(cheng)(cheng)(cheng)(cheng)市(shi)(shi)(shi)管(guan)(guan)理(li)壓力,應付城(cheng)(cheng)(cheng)(cheng)市(shi)(shi)(shi)管(guan)(guan)理(li)的(de)需要(yao)。柳州市(shi)(shi)(shi)城(cheng)(cheng)(cheng)(cheng)市(shi)(shi)(shi)管(guan)(guan)理(li)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)局(ju)(ju)(ju)與(yu)市(shi)(shi)(shi)容管(guan)(guan)理(li)局(ju)(ju)(ju)合署辦公,一套人(ren)(ren)員(yuan),兩塊牌(pai)子,是柳州市(shi)(shi)(shi)人(ren)(ren)民政(zheng)(zheng)(zheng)(zheng)府在城(cheng)(cheng)(cheng)(cheng)市(shi)(shi)(shi)管(guan)(guan)理(li)方面相對(dui)集中(zhong)行(xing)(xing)使行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)處罰(fa)權(quan)的(de)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)機關。由此(ci)可(ke)以看出(chu),柳州市(shi)(shi)(shi)城(cheng)(cheng)(cheng)(cheng)市(shi)(shi)(shi)管(guan)(guan)理(li)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)局(ju)(ju)(ju)實(shi)際(ji)上是在原市(shi)(shi)(shi)容部門(men)管(guan)(guan)理(li)機構基礎(chu)上進行(xing)(xing)的(de)簡單重(zhong)組(zu)。
柳(liu)州市(shi)(shi)對(dui)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)局(ju)(ju)的(de)(de)財政撥款(kuan)和(he)人(ren)員(yuan)編(bian)制安排(pai)與(yu)(yu)其應(ying)當承擔的(de)(de)工作職責和(he)工作任務(wu)不相匹配,現(xian)有的(de)(de)城管執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)經(jing)(jing)費(fei)與(yu)(yu)日益(yi)增加的(de)(de)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)辦案實際(ji)需要有很(hen)大差(cha)距,以(yi)致辦公經(jing)(jing)費(fei)拮據(ju),基礎設施落后。目前,柳(liu)州市(shi)(shi)局(ju)(ju)各部門特(te)別是(shi)市(shi)(shi)局(ju)(ju)直(zhi)屬(shu)大隊、各城區執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)局(ju)(ju)等一(yi)線執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)單位,辦公經(jing)(jing)費(fei)不足、車輛短缺、硬件設施缺乏(fa)。此外,由于(yu)受(shou)編(bian)制限制,執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)局(ju)(ju)聘用的(de)(de)編(bian)外人(ren)員(yuan)占(zhan)較大比重,這(zhe)些執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)人(ren)員(yuan)工資(zi)待遇普遍較低,對(dui)于(yu)日常工作的(de)(de)開展產生了一(yi)系列不良影響,容易出(chu)現(xian)“靠執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)養執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)”、“執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)靠狠、經(jing)(jing)費(fei)靠罰”的(de)(de)作法(fa)(fa),形(xing)成“執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)經(jing)(jing)濟”的(de)(de)不正常現(xian)象,從而背離城市(shi)(shi)管理工作的(de)(de)宗旨,激化執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)人(ren)員(yuan)與(yu)(yu)普通大眾的(de)(de)矛盾。
第三,執(zhi)法(fa)(fa)(fa)人員綜合(he)素質不(bu)高,行政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)水平有(you)待提(ti)升。柳州市(shi)城(cheng)市(shi)管理行政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)局(ju)的(de)(de)(de)員工(gong)(gong)來源比較(jiao)復(fu)雜,有(you)一部分(fen)(fen)是(shi)復(fu)轉軍人和(he)地方農村(cun)城(cheng)管人員,雖然2005年以來新(xin)進入的(de)(de)(de)人員主(zhu)要(yao)是(shi)通(tong)過國家公務(wu)員考(kao)試招錄(lu)的(de)(de)(de),對文化程度、政(zheng)(zheng)治面貌、專業(ye)知識(shi)等的(de)(de)(de)要(yao)求都比較(jiao)嚴(yan)格,但受到單位編制(zhi)限制(zhi),這部分(fen)(fen)人員在(zai)(zai)整個(ge)行政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)隊(dui)伍中所占的(de)(de)(de)比重較(jiao)低。行政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)人員的(de)(de)(de)綜合(he)素質總體上來說還是(shi)偏(pian)(pian)低,并且(qie)參(can)差不(bu)齊。某些同志(zhi)有(you)熱情、有(you)社會經(jing)驗,但是(shi)缺少(shao)法(fa)(fa)(fa)律(lv)知識(shi)和(he)業(ye)務(wu)知識(shi),更(geng)主(zhu)要(yao)的(de)(de)(de)是(shi)缺少(shao)行政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)的(de)(de)(de)工(gong)(gong)作經(jing)驗,在(zai)(zai)現實工(gong)(gong)作中表現為對法(fa)(fa)(fa)律(lv)的(de)(de)(de)理解(jie)和(he)適(shi)用上存在(zai)(zai)偏(pian)(pian)差,在(zai)(zai)執(zhi)法(fa)(fa)(fa)的(de)(de)(de)程序的(de)(de)(de)理解(jie)不(bu)完備。部分(fen)(fen)隊(dui)員的(de)(de)(de)思(si)想狀態不(bu)穩定,思(si)想情緒波動,在(zai)(zai)工(gong)(gong)作中不(bu)能團(tuan)結(jie)協作,對于自己(ji)的(de)(de)(de)工(gong)(gong)作目標和(he)責任(ren)主(zhu)觀認識(shi)不(bu)到位。
某些執(zhi)(zhi)法(fa)一(yi)線的(de)(de)(de)大隊(dui)長(chang)、中隊(dui)長(chang)等基層領導(dao)不(bu)(bu)能(neng)正(zheng)確(que)地(di)指導(dao)工(gong)作(zuo),對(dui)隊(dui)員(yuan)(yuan)的(de)(de)(de)思(si)想教育不(bu)(bu)夠重(zhong)視,關心(xin)不(bu)(bu)多。極(ji)少數執(zhi)(zhi)法(fa)人(ren)(ren)員(yuan)(yuan)政(zheng)治觀念淡(dan)(dan)薄,理想信念動搖,對(dui)黨的(de)(de)(de)方針政(zheng)策理解不(bu)(bu)透,執(zhi)(zhi)行(xing)不(bu)(bu)力,特權思(si)想嚴重(zhong),全心(xin)全意(yi)為(wei)人(ren)(ren)民服務的(de)(de)(de)宗旨(zhi)觀念淡(dan)(dan)化。此外,由于人(ren)(ren)事體制(zhi)上的(de)(de)(de)差異(yi),在(zai)編人(ren)(ren)員(yuan)(yuan)享受國家公務員(yuan)(yuan)待(dai)遇,工(gong)作(zuo)穩定且社會地(di)位較(jiao)高,而一(yi)些臨時(shi)聘用人(ren)(ren)員(yuan)(yuan)的(de)(de)(de)工(gong)資和(he)福利較(jiao)低(di)(di),在(zai)單位內部的(de)(de)(de)地(di)位也較(jiao)低(di)(di),容(rong)易(yi)產生(sheng)不(bu)(bu)滿(man)情緒,造成(cheng)在(zai)編執(zhi)(zhi)法(fa)人(ren)(ren)員(yuan)(yuan)和(he)部分(fen)聘用人(ren)(ren)員(yuan)(yuan)存在(zai)不(bu)(bu)同的(de)(de)(de)價值取向。少數執(zhi)(zhi)法(fa)人(ren)(ren)員(yuan)(yuan)缺乏依(yi)法(fa)執(zhi)(zhi)法(fa)的(de)(de)(de)自覺(jue)意(yi)識,不(bu)(bu)尊重(zhong)行(xing)政(zheng)相對(dui)人(ren)(ren)的(de)(de)(de)人(ren)(ren)格,濫用強制(zhi)措施,越權辦案,容(rong)易(yi)造成(cheng)執(zhi)(zhi)法(fa)過程(cheng)中與執(zhi)(zhi)法(fa)對(dui)象產生(sheng)激烈沖突,影響城市管理行(xing)政(zheng)執(zhi)(zhi)法(fa)的(de)(de)(de)權威性(xing)和(he)公正(zheng)性(xing)。
第(di)四,行(xing)(xing)政執法(fa)(fa)(fa)(fa)(fa)人(ren)(ren)員的(de)(de)(de)(de)形象不(bu)佳(jia),綜合監督機(ji)制不(bu)完善(shan)。柳(liu)州(zhou)城(cheng)市(shi)管理行(xing)(xing)政執法(fa)(fa)(fa)(fa)(fa)的(de)(de)(de)(de)方式和(he)方法(fa)(fa)(fa)(fa)(fa)相對(dui)(dui)來說比較溫和(he),暴力(li)(li)執法(fa)(fa)(fa)(fa)(fa)或者野(ye)蠻(man)執法(fa)(fa)(fa)(fa)(fa)的(de)(de)(de)(de)現象也(ye)相對(dui)(dui)較少,但是由于(yu)執法(fa)(fa)(fa)(fa)(fa)人(ren)(ren)員需(xu)要和(he)違章群(qun)眾(zhong)(zhong)正(zheng)面接觸(chu),并且(qie)雙方存(cun)在(zai)明顯的(de)(de)(de)(de)利(li)益沖突(tu),使得柳(liu)州(zhou)城(cheng)市(shi)管理行(xing)(xing)政執法(fa)(fa)(fa)(fa)(fa)工作人(ren)(ren)員與執法(fa)(fa)(fa)(fa)(fa)對(dui)(dui)象發(fa)生沖突(tu)的(de)(de)(de)(de)事(shi)件還時有發(fa)生,一定程(cheng)(cheng)度上(shang)影響了(le)整個行(xing)(xing)政執法(fa)(fa)(fa)(fa)(fa)隊伍的(de)(de)(de)(de)公眾(zhong)(zhong)形象。此(ci)外,在(zai)全國(guo)范圍(wei)來看,關于(yu)“城(cheng)管野(ye)蠻(man)執法(fa)(fa)(fa)(fa)(fa)”、“毆(ou)打(da)當事(shi)人(ren)(ren)”等的(de)(de)(de)(de)負面報道不(bu)少,執法(fa)(fa)(fa)(fa)(fa)對(dui)(dui)象“暴力(li)(li)抗法(fa)(fa)(fa)(fa)(fa)、執法(fa)(fa)(fa)(fa)(fa)后(hou)遭報復(fu)”的(de)(de)(de)(de)事(shi)也(ye)屢見不(bu)鮮,也(ye)在(zai)很大(da)程(cheng)(cheng)度上(shang)影響了(le)社會公眾(zhong)(zhong)對(dui)(dui)行(xing)(xing)政執法(fa)(fa)(fa)(fa)(fa)隊伍的(de)(de)(de)(de)印象。
城管執法(fa)(fa)部門手(shou)中的(de)權(quan)力集(ji)中,地(di)位高,但配(pei)套內外(wai)監(jian)(jian)(jian)督(du)(du)制(zhi)(zhi)約(yue)機制(zhi)(zhi)不(bu)夠(gou)健全(quan),權(quan)力和金錢交換的(de)問題屢禁不(bu)止。缺乏應有的(de)監(jian)(jian)(jian)督(du)(du)獨立(li)性(xing),執法(fa)(fa)監(jian)(jian)(jian)督(du)(du)制(zhi)(zhi)度(du)不(bu)夠(gou)健全(quan),監(jian)(jian)(jian)督(du)(du)工(gong)作尚未做到(dao)經常化(hua)、制(zhi)(zhi)度(du)化(hua),靠搞突擊檢查,過后依然如(ru)故。未普(pu)遍建立(li)并認(ren)真實(shi)行(xing)監(jian)(jian)(jian)督(du)(du)責(ze)任制(zhi)(zhi),出現執法(fa)(fa)違法(fa)(fa)行(xing)為(wei)時相(xiang)互推諉,無人查究。執法(fa)(fa)監(jian)(jian)(jian)督(du)(du)機制(zhi)(zhi)的(de)缺失(shi),往往導致監(jian)(jian)(jian)督(du)(du)不(bu)力,心有余而力不(bu)足(zu),造成許多(duo)空(kong)擋,執法(fa)(fa)監(jian)(jian)(jian)督(du)(du)工(gong)作中形(xing)式主義嚴重(zhong)(zhong)。此外(wai),群眾監(jian)(jian)(jian)督(du)(du)難以受(shou)到(dao)重(zhong)(zhong)視,因而逐漸喪(sang)失(shi)民主監(jian)(jian)(jian)督(du)(du)的(de)積(ji)極性(xing)。輿論監(jian)(jian)(jian)督(du)(du)的(de)獨立(li)性(xing)不(bu)夠(gou),相(xiang)應的(de)安全(quan)保障不(bu)夠(gou),對重(zhong)(zhong)大(da)監(jian)(jian)(jian)督(du)(du)案(an)件往往只(zhi)能避重(zhong)(zhong)就輕地(di)作事后報道(dao)。社會(hui)組織(zhi)的(de)監(jian)(jian)(jian)督(du)(du)分散(san)和乏力,人民群眾的(de)監(jian)(jian)(jian)督(du)(du)渠道(dao)有限(xian)。
三、改進(jin)和完善柳州市城市管理行政執法工作的對策與(yu)建議(yi)
第一(yi),建立(li)健全管(guan)(guan)(guan)理制(zhi)度(du),加強對行政(zheng)執(zhi)法(fa)(fa)工作的規(gui)范(fan)管(guan)(guan)(guan)理。為保(bao)證(zheng)日常(chang)行政(zheng)工作的正常(chang)運(yun)行,要(yao)制(zhi)定(ding)(ding)(ding)出臺(tai)《柳(liu)(liu)州(zhou)市(shi)(shi)(shi)城(cheng)(cheng)(cheng)市(shi)(shi)(shi)管(guan)(guan)(guan)理行政(zheng)執(zhi)法(fa)(fa)人(ren)(ren)員(yuan)規(gui)范(fan)用(yong)語》、《柳(liu)(liu)州(zhou)市(shi)(shi)(shi)城(cheng)(cheng)(cheng)市(shi)(shi)(shi)管(guan)(guan)(guan)理行政(zheng)執(zhi)法(fa)(fa)人(ren)(ren)員(yuan)儀容(rong)風紀規(gui)定(ding)(ding)(ding)》、《柳(liu)(liu)州(zhou)市(shi)(shi)(shi)城(cheng)(cheng)(cheng)市(shi)(shi)(shi)管(guan)(guan)(guan)理行政(zheng)執(zhi)法(fa)(fa)人(ren)(ren)員(yuan)執(zhi)勤規(gui)則》、《柳(liu)(liu)州(zhou)市(shi)(shi)(shi)城(cheng)(cheng)(cheng)市(shi)(shi)(shi)管(guan)(guan)(guan)理行政(zheng)執(zhi)法(fa)(fa)人(ren)(ren)員(yuan)廉潔自律規(gui)定(ding)(ding)(ding)》、《柳(liu)(liu)州(zhou)市(shi)(shi)(shi)城(cheng)(cheng)(cheng)市(shi)(shi)(shi)管(guan)(guan)(guan)理行政(zheng)執(zhi)法(fa)(fa)人(ren)(ren)員(yuan)禁(jin)酒(jiu)規(gui)定(ding)(ding)(ding)》等(deng)相關(guan)規(gui)定(ding)(ding)(ding),切(qie)實(shi)做到(dao)(dao)以制(zhi)度(du)約束人(ren)(ren),以制(zhi)度(du)規(gui)范(fan)人(ren)(ren)。并對著裝、儀容(rong)、稱呼、舉止(zhi)、風紀行為、違反規(gui)定(ding)(ding)(ding)的處罰都做出明確(que)規(gui)定(ding)(ding)(ding),要(yao)求執(zhi)法(fa)(fa)人(ren)(ren)員(yuan)執(zhi)行公(gong)務(wu)時(shi),必須佩戴統一(yi)制(zhi)發(fa)的標志及(ji)行政(zheng)執(zhi)法(fa)(fa)證(zheng),做到(dao)(dao)持證(zheng)上(shang)崗,著裝整齊,切(qie)實(shi)達到(dao)(dao)儀容(rong)端正、風紀嚴謹、統一(yi)化、規(gui)范(fan)化。同(tong)時(shi)將內部管(guan)(guan)(guan)理制(zhi)度(du)印制(zhi)成冊,逐(zhu)個(ge)下發(fa),做到(dao)(dao)人(ren)(ren)手一(yi)冊,便于人(ren)(ren)員(yuan)學(xue)習和(he)提高執(zhi)法(fa)(fa)質量。在使用(yong)全市(shi)(shi)(shi)范(fan)圍(wei)內統一(yi)的行政(zheng)執(zhi)法(fa)(fa)文(wen)書(shu)的基礎上(shang),從采集證(zheng)言筆(bi)錄,規(gui)范(fan)填寫使用(yong)各(ge)類執(zhi)法(fa)(fa)文(wen)書(shu),到(dao)(dao)下達處罰決定(ding)(ding)(ding)、送(song)達回執(zhi)、建檔立(li)卷(juan)等(deng)各(ge)個(ge)執(zhi)法(fa)(fa)環(huan)節,都由市(shi)(shi)(shi)局法(fa)(fa)制(zhi)科及(ji)執(zhi)法(fa)(fa)大(da)隊長(chang)嚴格把關(guan),以達到(dao)(dao)依(yi)法(fa)(fa)辦案、依(yi)程(cheng)序辦案、處罰適當(dang),適用(yong)法(fa)(fa)律準確(que)的目標。
第二,積極(ji)爭(zheng)取(qu)上級(ji)財(cai)政(zheng)(zheng)支持,改(gai)善辦公條(tiao)件和(he)員工(gong)待(dai)遇(yu)。隨著(zhu)柳(liu)州(zhou)城市(shi)(shi)(shi)管(guan)(guan)理(li)行(xing)(xing)(xing)政(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)局的(de)(de)成立(li),柳(liu)州(zhou)市(shi)(shi)(shi)城市(shi)(shi)(shi)管(guan)(guan)理(li)相對集中處(chu)罰的(de)(de)范圍(wei)和(he)內容不(bu)斷(duan)擴充,城市(shi)(shi)(shi)管(guan)(guan)理(li)行(xing)(xing)(xing)政(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)的(de)(de)難度也(ye)(ye)在(zai)不(bu)斷(duan)加(jia)大,特別是(shi)隨著(zhu)廣大人(ren)(ren)民群眾(zhong)權益(yi)保護意識的(de)(de)增強(qiang),也(ye)(ye)對柳(liu)州(zhou)城市(shi)(shi)(shi)管(guan)(guan)理(li)工(gong)作提(ti)出(chu)了更(geng)高(gao)的(de)(de)要(yao)求。因此,柳(liu)州(zhou)市(shi)(shi)(shi)城市(shi)(shi)(shi)管(guan)(guan)理(li)行(xing)(xing)(xing)政(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)局應通過相關(guan)途(tu)徑(jing)積極(ji)爭(zheng)取(qu)各級(ji)政(zheng)(zheng)府的(de)(de)財(cai)政(zheng)(zheng)支持,提(ti)高(gao)辦公經(jing)費(fei)等的(de)(de)投入水平。要(yao)改(gai)變“以(yi)(yi)罰代管(guan)(guan)”的(de)(de)“執(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)經(jing)濟”,樹立(li)公正、廉潔的(de)(de)執(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)形(xing)象(xiang),惟有(you)(you)從根本上解(jie)決辦公經(jing)費(fei)不(bu)足、車(che)輛短缺、硬(ying)件設施缺乏以(yi)(yi)及執(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)人(ren)(ren)員工(gong)資(zi)、福(fu)利(li)待(dai)遇(yu)保障(zhang)等問(wen)題。執(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)機(ji)構所需經(jing)費(fei)必(bi)須由市(shi)(shi)(shi)政(zheng)(zheng)府財(cai)政(zheng)(zheng)予以(yi)(yi)全(quan)額保障(zhang),嚴禁以(yi)(yi)“罰沒收入返還(huan)”作為經(jing)費(fei)來源或補(bu)充,真正做到權力與利(li)益(yi)完全(quan)脫(tuo)鉤。提(ti)高(gao)城市(shi)(shi)(shi)管(guan)(guan)理(li)行(xing)(xing)(xing)政(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)人(ren)(ren)員的(de)(de)工(gong)資(zi)及福(fu)利(li)待(dai)遇(yu),有(you)(you)利(li)于調動廣大行(xing)(xing)(xing)政(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)隊員的(de)(de)工(gong)作積極(ji)性,可以(yi)(yi)有(you)(you)效杜絕(jue)“靠(kao)執(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)養執(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)”、“執(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)靠(kao)狠、經(jing)費(fei)靠(kao)罰”的(de)(de)作法(fa)(fa)(fa)(fa)(fa)(fa),避免“執(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)經(jing)濟”的(de)(de)不(bu)正常現(xian)象(xiang)。
第(di)三,努力(li)提(ti)升(sheng)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)人(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)的(de)綜合素質(zhi),提(ti)高執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)人(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)業(ye)(ye)(ye)(ye)務(wu)水平。近(jin)年來,城(cheng)(cheng)(cheng)市管(guan)(guan)理(li)(li)(li)行(xing)(xing)政執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)人(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)的(de)素質(zhi)和業(ye)(ye)(ye)(ye)務(wu)水平問(wen)題越(yue)來越(yue)受到(dao)關注,柳州市城(cheng)(cheng)(cheng)市管(guan)(guan)理(li)(li)(li)行(xing)(xing)政執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)局應結(jie)合現(xian)有人(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)實際,采(cai)取多種(zhong)途徑進(jin)一步(bu)提(ti)升(sheng)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)人(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)的(de)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治觀念(nian)、溝通協調(diao)能力(li)、專業(ye)(ye)(ye)(ye)知識、專業(ye)(ye)(ye)(ye)技(ji)能等(deng)(deng),從而更好地(di)適(shi)應新(xin)形勢下(xia)城(cheng)(cheng)(cheng)市管(guan)(guan)理(li)(li)(li)工作的(de)需要(yao)。城(cheng)(cheng)(cheng)市管(guan)(guan)理(li)(li)(li)行(xing)(xing)政執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)工作的(de)對(dui)抗性較強(qiang),且直接面(mian)(mian)對(dui)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)對(dui)象,如果(guo)簡單地(di)采(cai)取強(qiang)制(zhi)措施,很可能引(yin)發矛盾,嚴重的(de)情況下(xia)甚至可能引(yin)發暴力(li)沖突(tu)和。因(yin)此,平時(shi)應加強(qiang)對(dui)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)人(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)知識、人(ren)(ren)(ren)(ren)本(ben)觀念(nian)的(de)學習,引(yin)導執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)人(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)牢固樹(shu)立依法(fa)(fa)(fa)(fa)(fa)(fa)(fa)行(xing)(xing)政、法(fa)(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)面(mian)(mian)前人(ren)(ren)(ren)(ren)人(ren)(ren)(ren)(ren)平等(deng)(deng)、尊重和保障人(ren)(ren)(ren)(ren)權等(deng)(deng)社會主(zhu)義法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治理(li)(li)(li)念(nian),確(que)立“以人(ren)(ren)(ren)(ren)為本(ben),公平正義”的(de)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)理(li)(li)(li)念(nian),使(shi)得(de)城(cheng)(cheng)(cheng)管(guan)(guan)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)人(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)將合法(fa)(fa)(fa)(fa)(fa)(fa)(fa)、合理(li)(li)(li)性結(jie)合起來,既要(yao)考(kao)慮現(xian)行(xing)(xing)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)的(de)規范(fan)性,也(ye)要(yao)考(kao)慮城(cheng)(cheng)(cheng)管(guan)(guan)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)的(de)社會效果(guo)。此外,還要(yao)強(qiang)化對(dui)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)人(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)業(ye)(ye)(ye)(ye)務(wu)知識和業(ye)(ye)(ye)(ye)務(wu)技(ji)能的(de)培(pei)訓(xun)和考(kao)核,加強(qiang)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)人(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)業(ye)(ye)(ye)(ye)務(wu)技(ji)能訓(xun)練(lian),培(pei)養扎實的(de)業(ye)(ye)(ye)(ye)務(wu)能力(li)。執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)過程中復雜多變的(de)情況,要(yao)求執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)人(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)苦(ku)練(lian)基本(ben)功,能在(zai)最(zui)短(duan)的(de)時(shi)間,準(zhun)確(que)無(wu)誤(wu)地(di)填好執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)文(wen)書,以最(zui)簡單、最(zui)方便的(de)辦法(fa)(fa)(fa)(fa)(fa)(fa)(fa)處理(li)(li)(li)問(wen)題,以減少沖突(tu)和對(dui)抗。
第(di)四,樹立(li)(li)(li)行(xing)政執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)的(de)良好(hao)形象(xiang),強化各(ge)項監(jian)(jian)(jian)督(du)制約機(ji)制建設(she)。城市(shi)管(guan)(guan)(guan)理(li)行(xing)政執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)的(de)對象(xiang)主(zhu)要是(shi)社(she)會(hui)(hui)(hui)(hui)(hui)的(de)弱勢(shi)群體,他(ta)們生活在(zai)社(she)會(hui)(hui)(hui)(hui)(hui)的(de)底層,生活條件和(he)(he)生活環(huan)境都相對較(jiao)差,如(ru)果簡單地對他(ta)們在(zai)城市(shi)中的(de)違章行(xing)為進行(xing)強制處(chu)理(li),甚(shen)至采取暴力執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)手段(duan)沒收其生產經營工(gong)(gong)具,無法(fa)(fa)有(you)效達到城市(shi)管(guan)(guan)(guan)理(li)的(de)最終目的(de),也容易引發社(she)會(hui)(hui)(hui)(hui)(hui)各(ge)界對城市(shi)管(guan)(guan)(guan)理(li)行(xing)政執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)工(gong)(gong)作(zuo)(zuo)(zuo)的(de)誤解(jie)和(he)(he)偏見(jian)。因此,應(ying)深入開(kai)(kai)展對城管(guan)(guan)(guan)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)人(ren)(ren)員(yuan)全(quan)心(xin)全(quan)意為人(ren)(ren)民服務的(de)宗旨(zhi)教育,大力弘揚(yang)文明執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)、秉公(gong)(gong)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)的(de)工(gong)(gong)作(zuo)(zuo)(zuo)作(zuo)(zuo)(zuo)風(feng),樹立(li)(li)(li)行(xing)政執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)隊伍中的(de)先(xian)進典型(xing),宣傳他(ta)們的(de)先(xian)進事(shi)(shi)跡,引導執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)人(ren)(ren)員(yuan)學(xue)習他(ta)們的(de)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)技巧和(he)(he)工(gong)(gong)作(zuo)(zuo)(zuo)經驗,從(cong)而切(qie)實(shi)改(gai)善(shan)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)人(ren)(ren)員(yuan)的(de)工(gong)(gong)作(zuo)(zuo)(zuo)作(zuo)(zuo)(zuo)風(feng),樹立(li)(li)(li)行(xing)政執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)人(ren)(ren)員(yuan)的(de)良好(hao)形象(xiang)。此外,應(ying)強化對柳州城市(shi)管(guan)(guan)(guan)理(li)行(xing)政執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)工(gong)(gong)作(zuo)(zuo)(zuo)的(de)監(jian)(jian)(jian)督(du)制約機(ji)制,特別是(shi)充分(fen)利(li)用信息網(wang)絡環(huan)境下的(de)監(jian)(jian)(jian)督(du)手段(duan)和(he)(he)方式,采取公(gong)(gong)開(kai)(kai)辦(ban)事(shi)(shi)制度(du)、公(gong)(gong)開(kai)(kai)辦(ban)事(shi)(shi)程序、公(gong)(gong)開(kai)(kai)辦(ban)事(shi)(shi)結果等(deng)形式,完(wan)善(shan)外部的(de)監(jian)(jian)(jian)督(du),特別是(shi)權力機(ji)關的(de)監(jian)(jian)(jian)督(du),主(zhu)動地接(jie)受人(ren)(ren)大的(de)監(jian)(jian)(jian)督(du)以及社(she)會(hui)(hui)(hui)(hui)(hui)輿(yu)論(lun)和(he)(he)人(ren)(ren)民群眾的(de)民主(zhu)監(jian)(jian)(jian)督(du)。在(zai)群團組織、社(she)會(hui)(hui)(hui)(hui)(hui)各(ge)界聘請廉政監(jian)(jian)(jian)督(du)員(yuan),健全(quan)群眾性監(jian)(jian)(jian)督(du)網(wang)絡,定期召(zhao)開(kai)(kai)座談會(hui)(hui)(hui)(hui)(hui),傾聽意見(jian)和(he)(he)建議,虛(xu)心(xin)接(jie)受批評和(he)(he)監(jian)(jian)(jian)督(du)。通(tong)過健全(quan)制度(du)、舉報(bao)投訴(su)制度(du)等(deng)方式接(jie)受社(she)會(hui)(hui)(hui)(hui)(hui)的(de)監(jian)(jian)(jian)督(du),把嚴格執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)、秉公(gong)(gong)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)落實(shi)到人(ren)(ren)。

要(yao)點提示:針對(dui)街(jie)(jie)道(dao)建設發展(zhan)(zhan)資金流量大、平衡難的現狀,圍繞街(jie)(jie)道(dao)長(chang)遠發展(zhan)(zhan)建設資金平衡要(yao)求,分析街(jie)(jie)道(dao)資金平衡現狀,提出街(jie)(jie)道(dao)短(duan)期以及長(chang)遠發展(zhan)(zhan)資金平衡的途徑和對(dui)策。
2、在太湖新城快速推進形勢下(xia),如何做好企(qi)業(ye)穩心(xin)留根工作。
要點(dian)提示:圍繞太湖新(xin)城(cheng)建設,加快傳統企業轉型(xing)升級,幫(bang)助企業解決發展所面臨的難(nan)題(ti)等方面,提出思路與措施,提升穩心留根(gen)的實效性(xing)。

城市的(de)(de)(de)(de)系(xi)統性(xing)是研究城市管(guan)理與規劃的(de)(de)(de)(de)系(xi)統性(xing)的(de)(de)(de)(de)基礎。從浩瀚(han)無際的(de)(de)(de)(de)宇(yu)宙,到(dao)分(fen)子、原子,均可稱之為系(xi)統。城市當然也是一個由復雜交錯(cuo)的(de)(de)(de)(de)各種成分(fen)組成的(de)(de)(de)(de)系(xi)統,其具有系(xi)統的(de)(de)(de)(de)整體性(xing)、關聯性(xing)、功能性(xing)和(he)環境(jing)適應(ying)性(xing)等基本特征。
通過對城(cheng)(cheng)市(shi)定義(yi)的(de)(de)理解,可(ke)以發現城(cheng)(cheng)市(shi)作為(wei)(wei)一個(ge)(ge)系(xi)(xi)(xi)統,有(you)以下(xia)幾(ji)個(ge)(ge)要點:首先,城(cheng)(cheng)市(shi)是一個(ge)(ge)灰色系(xi)(xi)(xi)統,具有(you)自然(ran)系(xi)(xi)(xi)統與(yu)人工(gong)系(xi)(xi)(xi)統復(fu)合(he),硬系(xi)(xi)(xi)統與(yu)軟(ruan)系(xi)(xi)(xi)統相復(fu)合(he)的(de)(de)特點;其次,城(cheng)(cheng)市(shi)是一個(ge)(ge)開放性系(xi)(xi)(xi)統,既(ji)系(xi)(xi)(xi)統本身與(yu)系(xi)(xi)(xi)統外部環境(jing)有(you)物質(zhi)、能量和信息(xi)的(de)(de)交換;再次,城(cheng)(cheng)市(shi)是極為(wei)(wei)復(fu)雜(za)的(de)(de),包括眾多元素的(de)(de)社會復(fu)雜(za)巨系(xi)(xi)(xi)統。最(zui)后,城(cheng)(cheng)市(shi)是動(dong)態系(xi)(xi)(xi)統,處于(yu)不斷(duan)發展變化的(de)(de)背景之(zhi)中,經歷(li)了(le)從無到有(you),從小(xiao)至(zhi)大,從簡入(ru)繁,從單一到綜(zong)合(he)。這些特點,顯示出城(cheng)(cheng)市(shi)系(xi)(xi)(xi)統既(ji)存在空間層面的(de)(de)轉移,有(you)包含(han)時間軸的(de)(de)演化,貫穿于(yu)城(cheng)(cheng)市(shi)系(xi)(xi)(xi)統的(de)(de)始終。
3 系統科學在(zai)城市管理與(yu)規劃(hua)中的(de)應用
對(dui)城(cheng)市系(xi)統(tong)(tong)(tong)性分析,也(ye)就(jiu)是(shi)將系(xi)統(tong)(tong)(tong)科學的原(yuan)理(li)、觀點和方法(fa)運(yun)用(yong)于城(cheng)市系(xi)統(tong)(tong)(tong)的管理(li)與規劃中。主(zhu)要的城(cheng)市系(xi)統(tong)(tong)(tong)分析的方法(fa)有(you)三種:系(xi)統(tong)(tong)(tong)分析方法(fa)、系(xi)統(tong)(tong)(tong)規劃方法(fa)、功能模擬方法(fa)。
3.1 系統分析方法
系統(tong)分(fen)(fen)析(xi)方法是為(wei)確定(ding)系統(tong)的(de)(de)(de)(de)組成、結構、功能、效(xiao)用,而對系統(tong)各種(zhong)要素(su)過程和(he)關系進行考察的(de)(de)(de)(de)方法。在城(cheng)(cheng)市(shi)(shi)研(yan)究中。系統(tong)分(fen)(fen)析(xi)方法是作為(wei)城(cheng)(cheng)市(shi)(shi)總體(ti)研(yan)究方法出現的(de)(de)(de)(de),它的(de)(de)(de)(de)主要功能特點(dian)是:(1)始(shi)終把城(cheng)(cheng)市(shi)(shi)看作一個由眾(zhong)多要素(su)構成的(de)(de)(de)(de)一個有機整體(ti),要把城(cheng)(cheng)市(shi)(shi)整體(ti)作為(wei)研(yan)究問題的(de)(de)(de)(de)出發點(dian)。(2)為(wei)城(cheng)(cheng)市(shi)(shi)在“協(xie)調、合理”的(de)(de)(de)(de)原則下,尋求最優(you)的(de)(de)(de)(de)發展道路提(ti)供研(yan)究方法上的(de)(de)(de)(de)可能性(xing)。唯有從城(cheng)(cheng)市(shi)(shi)整體(ti)出發的(de)(de)(de)(de)系統(tong)分(fen)(fen)析(xi)方法有可能把握那些最能反(fan)映城(cheng)(cheng)市(shi)(shi)問題特征的(de)(de)(de)(de)變量(liang)或(huo)參(can)數,從而在定(ding)性(xing)和(he)定(ding)量(liang)相結合的(de)(de)(de)(de)前提(ti)下找(zhao)出一條最佳發展道路。
在目(mu)前條件下(xia),系統方法(fa)在城(cheng)市研(yan)究中(zhong)還(huan)(huan)主要用(yong)來進行一些宏(hong)觀領域(yu)的(de)分析和宏(hong)觀政策的(de)評(ping)價,定(ding)量化(hua)的(de)水平(ping)還(huan)(huan)有(you)待(dai)大力提高。系統方法(fa)在城(cheng)市研(yan)究中(zhong)的(de)有(you)效使(shi)用(yong)程度(du),仍然是(shi)擺在城(cheng)市問題(ti)專家和系統方法(fa)專家面前的(de)一大問題(ti)。
3.2 系統(tong)規劃方法
系統(tong)(tong)規劃(hua)(hua)方(fang)法(fa)(fa)主要有PER方(fang)法(fa)(fa)、PDCA方(fang)法(fa)(fa)。PER方(fang)法(fa)(fa)是指(zhi)科學研究計(ji)(ji)(ji)劃(hua)(hua)的(de)(de)選擇修定方(fang)法(fa)(fa)。PER是計(ji)(ji)(ji)劃(hua)(hua)(Plan)、選擇(Elect)、修定(Revise)三個英文的(de)(de)簡稱(cheng)。運(yun)用(yong)PER方(fang)法(fa)(fa)時,按以下步驟進行(xing):(1)按照(zhao)系統(tong)(tong)方(fang)法(fa)(fa)的(de)(de)原則,通(tong)過(guo)系統(tong)(tong)分析,了解全部工(gong)程(cheng)要素和(he)關(guan)(guan)系的(de)(de)邏輯順序(xu),制定初步方(fang)案和(he)計(ji)(ji)(ji)劃(hua)(hua),計(ji)(ji)(ji)劃(hua)(hua)可有幾套(tao)以供選擇;(2)根據工(gong)程(cheng)順序(xu)列出明細表,通(tong)過(guo)計(ji)(ji)(ji)算分析。畫出工(gong)作計(ji)(ji)(ji)劃(hua)(hua)的(de)(de)網(wang)絡圖,找(zhao)出“關(guan)(guan)鍵線(xian)路(lu)”;(3)進行(xing)系統(tong)(tong)的(de)(de)可行(xing)性研究,根據網(wang)絡圖的(de)(de)“關(guan)(guan)鍵線(xian)路(lu)”篩(shai)選方(fang)案,確定最佳方(fang)案;(4)執行(xing)計(ji)(ji)(ji)劃(hua)(hua)或方(fang)案。在使用(yong)PER方(fang)法(fa)(fa)的(de)(de)執行(xing)方(fang)案過(guo)程(cheng)中(zhong),為不斷完善和(he)提(ti)高,通(tong)常用(yong)“PDCA計(ji)(ji)(ji)劃(hua)(hua)循環法(fa)(fa)”(PDCA是計(ji)(ji)(ji)劃(hua)(hua)(Plan)、執行(xing)(Do)、檢(jian)查(Cheek)、總結處理(Action))。
3.3 功(gong)能(neng)模擬方法
所謂(wei)功能模(mo)擬法,是指(zhi)在暫不考慮系(xi)統(tong)內部組成要素及結(jie)構(gou)的(de)條(tiao)件(jian)下,運(yun)用模(mo)型(xing)來再現原型(xing)功能的(de)方(fang)法。城市系(xi)統(tong)模(mo)擬的(de)基本特(te)征(zheng)是用定(ding)性和定(ding)量(liang)分析的(de)方(fang)法,把城市生態系(xi)統(tong)的(de)結(jie)構(gou)與功能加以模(mo)仿、簡化(hua)與抽象。
常用(yong)的(de)模(mo)擬分析(xi)方法是“列昂節夫”的(de)投人(ren)―產出(chu)模(mo)型(xing),及其擴充模(mo)型(xing)-SAM(社(she)會(hui)核算(suan)矩陣(zhen))。在系(xi)統動力學思想方法的(de)基礎(chu)上。德(de)國(guo)科學家維斯特(Vester))和赫斯勒(Hester))博(bo)士70年代(dai)末提出(chu)了(le)“靈敏度模(mo)型(xing)”,它適用(yong)于(yu)城市生態系(xi)統關系(xi)的(de)模(mo)擬與(yu)調控(kong)。
4 結語
從(cong)我(wo)國規(gui)(gui)劃(hua)(hua)(hua)理(li)論(lun)的建設(she)來(lai)看,目前正處于理(li)性規(gui)(gui)劃(hua)(hua)(hua)的階段,也與系(xi)統規(gui)(gui)劃(hua)(hua)(hua)的基(ji)本原理(li)相符合。并以系(xi)統論(lun)的基(ji)本觀點(dian)來(lai)指導城市規(gui)(gui)劃(hua)(hua)(hua)實踐活動。只(zhi)有(you)這樣(yang),才(cai)能(neng)更(geng)好(hao)地(di)實現城市管理(li)者(zhe)與研(yan)究學(xue)者(zhe)由來(lai)以久的使(shi)命感,從(cong)而(er)才(cai)能(neng)使(shi)規(gui)(gui)劃(hua)(hua)(hua)更(geng)好(hao)地(di)為城市建設(she)服務。

2014年4月,西城區開啟國家級社會管(guan)(guan)理(li)與公共(gong)服務(wu)綜合(he)標(biao)準(zhun)(zhun)化試點項目后,廣(guang)大(da)城市管(guan)(guan)理(li)工(gong)作者認(ren)真學習(xi)、貫(guan)徹中(zhong)央(yang)和北京市關于精細化管(guan)(guan)理(li)的(de)系(xi)(xi)列指示精神,深(shen)刻(ke)思考如(ru)何將城市環境分類分級管(guan)(guan)理(li)模(mo)式耦合(he)交融為精細化城市管(guan)(guan)理(li)的(de)工(gong)作責任體(ti)(ti)系(xi)(xi)和技術標(biao)準(zhun)(zhun)體(ti)(ti)系(xi)(xi),使精細管(guan)(guan)理(li)從理(li)念優化為一套可(ke)操作、可(ke)度量的(de)工(gong)作目標(biao)、操作規(gui)范和具(ju)體(ti)(ti)措施,在圓滿完成(cheng)試點項目的(de)同時,讓標(biao)準(zhun)(zhun)體(ti)(ti)系(xi)(xi)建設(she)規(gui)范實用,標(biao)準(zhun)(zhun)化工(gong)作卓(zhuo)有(you)成(cheng)效。
經過兩(liang)年(nian)來的攻(gong)堅克難,超越革(ge)新(xin),截至(zhi)2016年(nian)6月29日,西城(cheng)區城(cheng)市環(huan)境(jing)分類分級管理綜(zong)合標(biao)準(zhun)化(hua)試點項目圓滿通過國家標(biao)準(zhun)化(hua)管理委員會(以下簡稱國標(biao)委)驗收,城(cheng)市環(huan)境(jing)建設(she)管理標(biao)準(zhun)化(hua)工作取得初步成效。

確保試點工作順利推進
從(cong)2014年4月(yue),西城(cheng)區(qu)申報社(she)會(hui)管理和公共服務綜合標(biao)準化(hua)試點(dian)(dian)被(bei)國標(biao)委聯席會(hui)議審核通過后,區(qu)市(shi)政市(shi)容委立(li)即編(bian)(bian)(bian)制、下發了(le)(le)《西城(cheng)區(qu)城(cheng)市(shi)環(huan)境(jing)分(fen)類分(fen)級(ji)管理綜合標(biao)準化(hua)試點(dian)(dian)工(gong)作方案》。全區(qu)成(cheng)(cheng)立(li)了(le)(le)以姜立(li)光(guang)副區(qu)長為組(zu)(zu)(zu)長、區(qu)環(huan)境(jing)辦等14個(ge)職能部門(men)和15個(ge)街道辦事處的(de)主要(yao)領(ling)導為成(cheng)(cheng)員的(de)試點(dian)(dian)工(gong)作領(ling)導小組(zu)(zu)(zu)。領(ling)導小組(zu)(zu)(zu)下設辦公室于區(qu)市(shi)政市(shi)容委,負(fu)責統(tong)籌協(xie)調專家(jia)顧(gu)問(wen)組(zu)(zu)(zu)、技術保障(zhang)組(zu)(zu)(zu)、標(biao)準體(ti)系(xi)工(gong)作組(zu)(zu)(zu)推(tui)進標(biao)準體(ti)系(xi)編(bian)(bian)(bian)制和試點(dian)(dian)工(gong)作的(de)落(luo)實(shi)。各成(cheng)(cheng)員單位按照要(yao)求(qiu),相繼成(cheng)(cheng)立(li)了(le)(le)專項標(biao)準編(bian)(bian)(bian)寫機(ji)構(gou),具體(ti)負(fu)責各個(ge)專業的(de)標(biao)準編(bian)(bian)(bian)制與(yu)試點(dian)(dian)推(tui)進。
試點辦自成立以來,共組織試點啟(qi)動(dong)與(yu)(yu)中末期驗收、標準體系專家評審與(yu)(yu)、各類考察培訓等會務32次,編(bian)發(fa)文件(jian)、通知30個,信息(xi)23篇,外宣(xuan)稿(gao)件(jian)8篇,出刊會議紀要14份(fen)、信息(xi)專刊17期。
廣泛開展學習研究
保證試點工作正確方向
為使試(shi)點工作少(shao)走(zou)彎(wan)路,定向前行,試(shi)點辦廣(guang)泛開(kai)展走(zou)出去(qu)學習考察、請進(jin)來培訓(xun)授課等活動。
試(shi)點辦先后組(zu)織外出學(xue)習考察4次(ci)、研討培訓(xun)10次(ci)。邀請中國標準(zhun)(zhun)化研究院、北京(jing)市(shi)城市(shi)管理委(wei)員會(hui)(原北京(jing)市(shi)市(shi)政市(shi)容管理委(wei)員會(hui))、首(shou)都經貿(mao)大學(xue)等(deng)單(dan)位的領導、專家,對(dui)試(shi)點工(gong)作(zuo)方案(an)、標準(zhun)(zhun)編(bian)制原則與(yu)范(fan)圍、參加試(shi)點單(dan)位與(yu)標準(zhun)(zhun)體系編(bian)寫等(deng)問(wen)題,進(jin)行深刻的研究討論,確定將試(shi)點工(gong)作(zuo)劃分(fen)(fen)為宣傳啟(qi)動、體系建設、組(zu)織實施、總結(jie)驗收四個階段;工(gong)作(zuo)細化分(fen)(fen)解(jie)為35項任務,并于2014年(nian)11月18日在全區啟(qi)動大會(hui)上進(jin)行了部署。
按照“看得(de)見(jian)、管(guan)得(de)了”的要求,以城(cheng)市“功能(neng)(neng)區域分類、環(huan)境(jing)管(guan)理分級(ji)、專業(ye)工(gong)作(zuo)支(zhi)撐”為基本(ben)思路,研討(tao)、確定、建設(she)涵蓋西城(cheng)區各(ge)個功能(neng)(neng)區域的市政道路、交(jiao)通(tong)秩序、市容市貌、環(huan)境(jing)衛生、園林綠化(hua)、施工(gong)管(guan)理和環(huan)境(jing)保護(hu)各(ge)個環(huan)境(jing)專業(ye)領域,以及城(cheng)市環(huan)境(jing)建設(she)、管(guan)理、作(zuo)業(ye)、監(jian)督、執法、考評等各(ge)個環(huan)節與層(ceng)面的標準(zhun)體系。
積極開展環(huan)境要素調查
完善城市功(gong)能區域劃分(fen)
為(wei)(wei)完善城市(shi)環境分類(lei)分級管理的(de)標準體(ti)系(xi)架構,充分了(le)解與切實掌(zhang)握全區(qu)(qu)各個功(gong)能(neng)區(qu)(qu)域(yu)的(de)環境特(te)征和管理要素,試點辦于2015年7月委(wei)托社會(hui)專業組(zu)織,開展(zhan)了(le)七(qi)大功(gong)能(neng)區(qu)(qu)域(yu)的(de)環境要素調查,摸清了(le)各個功(gong)能(neng)區(qu)(qu)的(de)人(ren)口(kou)特(te)點、區(qu)(qu)位(wei)功(gong)能(neng)、人(ren)文特(te)征,以及建筑(zhu)風格和屬性(xing)、道(dao)路(lu)交通特(te)點、街(jie)面公共服務(wu)設施、園林綠(lv)化、商(shang)業業態等7大要素構成(cheng),為(wei)(wei)全區(qu)(qu)功(gong)能(neng)區(qu)(qu)域(yu)劃分與標準體(ti)系(xi)最終(zhong)編制(zhi)提供(gong)了(le)依據。
同時,按照區(qu)(qu)域(yu)(yu)功能(neng)主導、公共空間全(quan)覆蓋、能(neng)夠動態調(diao)整、便(bian)于(yu)末(mo)端(duan)研判的原則,對全(quan)區(qu)(qu)功能(neng)區(qu)(qu)域(yu)(yu)進行重新(xin)(xin)調(diao)整,共劃分(fen)為7個(ge)(ge)(ge)區(qu)(qu)、2個(ge)(ge)(ge)金融(rong)商(shang)務區(qu)(qu)、3個(ge)(ge)(ge)繁華商(shang)業區(qu)(qu)、3個(ge)(ge)(ge)傳統風貌區(qu)(qu)、1個(ge)(ge)(ge)交通樞紐區(qu)(qu)、10個(ge)(ge)(ge)公共休閑區(qu)(qu)和其他若(ruo)干個(ge)(ge)(ge)生活居住(zhu)區(qu)(qu),并重新(xin)(xin)核實(shi)了各個(ge)(ge)(ge)區(qu)(qu)域(yu)(yu)的四至范圍、面積、道路、網格和社區(qu)(qu)數量,納入(ru)城管(guan)監督指揮中心平臺體(ti)系,有力(li)完善了標準體(ti)系中考評子體(ti)系。

經過權威評審對外
2015年8月初,在區領導(dao)的(de)關心(xin)指導(dao)、試點辦(ban)全體(ti)人員(yuan)的(de)強(qiang)力推進、各成員(yuan)單位的(de)大力協同下,經過(guo)廣泛征求意見、數(shu)次修改完善的(de)《西城(cheng)區城(cheng)市(shi)環境(jing)分(fen)類分(fen)級管理標準體(ti)系(xi)》終于完成初稿。

根(gen)據專家的(de)評審意見,在進一步修改完善后,西(xi)(xi)城區(qu)于2015年10月16日以區(qu)市政(zheng)市容委的(de)名義下發(fa)了《西(xi)(xi)城區(qu)城市環境分類分級管(guan)理標準體(ti)系》,確(que)定(ding)10月30日正式實(shi)施。
整個標準體(ti)系(xi)包括通用(yong)基礎、分類分級管(guan)理、專業支撐和(he)監(jian)督考評四個子體(ti)系(xi),共(gong)有標準251項(xiang)(xiang)(xiang)(xiang)。其中,收錄國家標準57項(xiang)(xiang)(xiang)(xiang)、行業標準35項(xiang)(xiang)(xiang)(xiang)、北京市地方標準86項(xiang)(xiang)(xiang)(xiang),自制標準73項(xiang)(xiang)(xiang)(xiang)(已完(wan)成56項(xiang)(xiang)(xiang)(xiang),尚有17項(xiang)(xiang)(xiang)(xiang)建議制訂的標準正(zheng)在研究中)。

為了(le)(le)促進標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)體(ti)(ti)(ti)系(xi)實施(shi),試點(dian)辦(ban)一(yi)是將所(suo)有(you)(you)收錄(lu)引用的(de)標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)與(yu)自制(zhi)(zhi)標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)一(yi)起,在令標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)體(ti)(ti)(ti)系(xi)明細表(biao)中形成(cheng)鏈(lian)接,刻盤(pan)發放(fang)各成(cheng)員(yuan)單位(wei)學習應用,并與(yu)相關工(gong)(gong)作手冊和(he)工(gong)(gong)作記錄(lu)一(yi)同(tong)印制(zhi)(zhi),發放(fang)各單位(wei)實施(shi);二(er)是制(zhi)(zhi)訂、下發了(le)(le)《西城區城市環境分類分級管理標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)體(ti)(ti)(ti)系(xi)實施(shi)方(fang)案(an)》和(he)具(ju)體(ti)(ti)(ti)《檢(jian)查工(gong)(gong)作方(fang)案(an)》,于2015年12月(yue),每周(zhou)安排2個(ge)單位(wei),逐一(yi)檢(jian)查各成(cheng)員(yuan)單位(wei)標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)體(ti)(ti)(ti)系(xi)的(de)實施(shi)情況;三是2016年1月(yue)集中組織了(le)(le)標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)體(ti)(ti)(ti)系(xi)宣(xuan)講與(yu)培訓(xun),協調(diao)各成(cheng)員(yuan)單位(wei)廣泛開(kai)展宣(xuan)貫活動;四是根據各成(cheng)員(yuan)單位(wei)的(de)實施(shi)反饋情況、檢(jian)查與(yu)驗收意見,分3次對整個(ge)標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)體(ti)(ti)(ti)系(xi)和(he)20個(ge)具(ju)體(ti)(ti)(ti)標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)進行了(le)(le)重(zhong)新修訂,有(you)(you)效(xiao)促進了(le)(le)標(biao)(biao)(biao)(biao)準(zhun)(zhun)(zhun)化(hua)工(gong)(gong)作落地。
試點(dian)工作圓滿通過驗收
城市管理標(biao)準(zhun)化取(qu)得新成效
2016年6月28日-29日,受(shou)國標(biao)委委托(tuo),北京市(shi)質(zhi)監局邀請了(le)標(biao)準化與(yu)城市(shi)管理領域的知(zhi)名專(zhuan)家(jia),對西城區(qu)城市(shi)環(huan)境分類(lei)分級管理綜合(he)(he)標(biao)準化試點項目(mu)進(jin)行(xing)驗收(shou)。經(jing)過(guo)專(zhuan)家(jia)組的聽、看、詢、查、評,認為兩(liang)年來的試點工作(zuo)取得了(le)很(hen)好的成效,完成了(le)全部(bu)規定任務,符(fu)合(he)(he)國標(biao)委下(xia)發的試點細則(ze)要求,綜合(he)(he)評分93分,一致(zhi)同(tong)意通(tong)過(guo)考(kao)核評估。
評估報告認為(wei)試(shi)點(dian)項目一是領(ling)導(dao)重(zhong)視,試(shi)點(dian)工作推進(jin)有(you)力(li);二是切合實(shi)(shi)際,標(biao)(biao)準(zhun)(zhun)體(ti)系(xi)覆蓋(gai)全(quan)(quan)面,實(shi)(shi)現(xian)了(le)(le)分(fen)類分(fen)級(ji)清(qing)晰(xi)、管(guan)(guan)(guan)理(li)(li)程序(xu)規范(fan)、質量要求(qiu)明(ming)確、執法(fa)監督(du)嚴(yan)明(ming)的(de)(de)閉環(huan)式管(guan)(guan)(guan)理(li)(li);三(san)是注重(zhong)宣(xuan)貫,各級(ji)標(biao)(biao)準(zhun)(zhun)化(hua)意識明(ming)顯(xian)增強(qiang),形成了(le)(le)以標(biao)(biao)準(zhun)(zhun)為(wei)引領(ling)、按(an)標(biao)(biao)準(zhun)(zhun)實(shi)(shi)施(shi)(shi)的(de)(de)良好氛圍,崗位人(ren)員(yuan)知標(biao)(biao)準(zhun)(zhun)要求(qiu)、明(ming)標(biao)(biao)準(zhun)(zhun)職責、依(yi)標(biao)(biao)準(zhun)(zhun)辦事,提(ti)高(gao)了(le)(le)標(biao)(biao)準(zhun)(zhun)化(hua)意識與(yu)執行標(biao)(biao)準(zhun)(zhun)的(de)(de)自(zi)覺性;四是實(shi)(shi)施(shi)(shi)到位,試(shi)點(dian)取(qu)得顯(xian)著(zhu)成效,能(neng)夠圍繞城(cheng)市(shi)環(huan)境(jing)管(guan)(guan)(guan)理(li)(li)的(de)(de)內在要求(qiu),以分(fen)級(ji)管(guan)(guan)(guan)理(li)(li)為(wei)核心(xin),細化(hua)區域分(fen)類管(guan)(guan)(guan)理(li)(li),并針(zhen)對試(shi)點(dian)涉及(ji)面廣的(de)(de)特(te)(te)點(dian),突出全(quan)(quan)員(yuan)參(can)與(yu),注重(zhong)收(shou)集意見,實(shi)(shi)現(xian)持續(xu)改進(jin)與(yu)有(you)效的(de)(de)質量控(kong)制。特(te)(te)別(bie)是運用(yong)標(biao)(biao)準(zhun)(zhun)化(hua)原理(li)(li),積極探(tan)索(suo)特(te)(te)大城(cheng)市(shi)管(guan)(guan)(guan)理(li)(li)規律(lv),創新城(cheng)市(shi)環(huan)境(jing)分(fen)類分(fen)級(ji)管(guan)(guan)(guan)理(li)(li)模(mo)式,提(ti)高(gao)了(le)(le)城(cheng)市(shi)環(huan)境(jing)管(guan)(guan)(guan)理(li)(li)的(de)(de)精(jing)細化(hua)、規范(fan)化(hua)水平(ping),有(you)效促進(jin)了(le)(le)城(cheng)市(shi)治理(li)(li)體(ti)系(xi)的(de)(de)完(wan)善(shan)與(yu)治理(li)(li)能(neng)力(li)的(de)(de)提(ti)升,成效顯(xian)著(zhu)。

西(xi)城(cheng)(cheng)區(qu)(qu)城(cheng)(cheng)市環境分類分級(ji)管(guan)理(li)(li)(li)綜合標準(zhun)體系(xi)的(de)(de)(de)研究建設(she)與宣貫實施(shi),特別是西(xi)城(cheng)(cheng)區(qu)(qu)國(guo)家級(ji)社(she)會(hui)管(guan)理(li)(li)(li)與公共服務綜合標準(zhun)化試(shi)點項(xiang)目的(de)(de)(de)最終驗收圓滿通過,標志著西(xi)城(cheng)(cheng)區(qu)(qu)城(cheng)(cheng)市環境建設(she)與管(guan)理(li)(li)(li)工作進(jin)入了一個(ge)以標準(zhun)化為引領的(de)(de)(de)新時代,對于提高(gao)政府行政效能、促(cu)進(jin)城(cheng)(cheng)市精(jing)細化管(guan)理(li)(li)(li)具有重(zhong)要意(yi)義。
就(jiu)標準體系建設而言,一是(shi)鞏(gong)固、提升(sheng)了(le)(le)城(cheng)市(shi)環(huan)(huan)境(jing)(jing)(jing)分(fen)類分(fen)級管(guan)(guan)(guan)(guan)理新(xin)模式,創新(xin)形成了(le)(le)城(cheng)市(shi)精細(xi)(xi)化(hua)(hua)管(guan)(guan)(guan)(guan)理新(xin)成果;二是(shi)核實了(le)(le)城(cheng)市(shi)環(huan)(huan)境(jing)(jing)(jing)管(guan)(guan)(guan)(guan)理要(yao)素,健全(quan)了(le)(le)全(quan)程管(guan)(guan)(guan)(guan)控(kong)指(zhi)標體系,厘清了(le)(le)各職能(neng)(neng)部門工作關(guan)系,實現了(le)(le)對城(cheng)市(shi)環(huan)(huan)境(jing)(jing)(jing)的科學化(hua)(hua)、精細(xi)(xi)化(hua)(hua)管(guan)(guan)(guan)(guan)理;三(san)是(shi)編制了(le)(le)城(cheng)市(shi)環(huan)(huan)境(jing)(jing)(jing)建設、市(shi)容市(shi)貌管(guan)(guan)(guan)(guan)理、功能(neng)(neng)區(qu)域管(guan)(guan)(guan)(guan)控(kong)等標準,填補(bu)了(le)(le)城(cheng)市(shi)管(guan)(guan)(guan)(guan)理標準體系空白,解決了(le)(le)部分(fen)環(huan)(huan)境(jing)(jing)(jing)管(guan)(guan)(guan)(guan)控(kong)難(nan)題;四是(shi)強(qiang)化(hua)(hua)了(le)(le)“管(guan)(guan)(guan)(guan)理前置(zhi)”理念,增強(qiang)了(le)(le)城(cheng)市(shi)管(guan)(guan)(guan)(guan)理的前瞻性與預見性,進一步(bu)優化(hua)(hua)了(le)(le)環(huan)(huan)境(jing)(jing)(jing)資源配(pei)置(zhi),提升(sheng)了(le)(le)政府行政效(xiao)能(neng)(neng)。
同(tong)時,通過(guo)標準體系的建(jian)設與(yu)(yu)試(shi)點工作(zuo)(zuo),各個城市環(huan)境(jing)建(jian)設管(guan)理(li)(li)單位工作(zuo)(zuo)職能進(jin)一步(bu)(bu)明晰;市政建(jian)設、環(huan)境(jing)治理(li)(li)、交通秩序、園林綠化、環(huan)衛(wei)保潔、工地管(guan)理(li)(li)等專(zhuan)業(ye)作(zuo)(zuo)業(ye)進(jin)一步(bu)(bu)規范(fan);臨街社會單位與(yu)(yu)商戶參與(yu)(yu)“門前(qian)三包(bao)”的積極(ji)性進(jin)一步(bu)(bu)提(ti)高;城管(guan)執法行為與(yu)(yu)能力(li)進(jin)一步(bu)(bu)加強(qiang),環(huan)境(jing)問題發現與(yu)(yu)處(chu)置渠道(dao)進(jin)一步(bu)(bu)暢通;轄區功能區域分類管(guan)控能力(li)與(yu)(yu)分級作(zuo)(zuo)業(ye)水平進(jin)一步(bu)(bu)提(ti)升。
據統計,2015年(nian)(nian),在城(cheng)市(shi)環(huan)境管(guan)理任務沒有大的(de)變(bian)化(hua)的(de)前(qian)提下(xia),西城(cheng)區(qu)市(shi)政(zheng)市(shi)容(rong)(rong)委用于城(cheng)市(shi)環(huan)境整(zheng)治項目和(he)基礎建設的(de)經費支出為(wei)(wei)8.16億元(yuan),2014年(nian)(nian)為(wei)(wei)9.89億元(yuan),同(tong)(tong)比減少(shao)(shao)17.51%;區(qu)市(shi)政(zheng)市(shi)容(rong)(rong)委共(gong)接受(shou)(shou)各類意(yi)見、投訴、曝光68件(jian)(jian)(jian)(起),而(er)(er)2014年(nian)(nian)為(wei)(wei)91件(jian)(jian)(jian),同(tong)(tong)比減少(shao)(shao)25.2%;西城(cheng)行政(zheng)服務大廳市(shi)政(zheng)市(shi)容(rong)(rong)服務窗口共(gong)接待1.03萬人(ren)次,受(shou)(shou)辦理事項1357件(jian)(jian)(jian),而(er)(er)2014年(nian)(nian)度接待1.04萬人(ren)次,受(shou)(shou)辦理事項1423件(jian)(jian)(jian),同(tong)(tong)比分別(bie)減少(shao)(shao)1%和(he)5%;轄區(qu)空氣中主要污染物二(er)氧化(hua)硫、二(er)氧化(hua)氮(dan)、可吸入顆粒物和(he)細顆粒物濃度平(ping)均(jun)(jun)分別(bie)為(wei)(wei)14.5、54.0、105.8、83.0微(wei)克(ke)/立方(fang)米,而(er)(er)2014年(nian)(nian)平(ping)均(jun)(jun)分別(bie)為(wei)(wei)23.1、62.9、115.2、88.4微(wei)克(ke)/立方(fang)米,同(tong)(tong)比平(ping)均(jun)(jun)分別(bie)下(xia)降(jiang)37.3%、14.2%、8.2%、6.2%;降(jiang)塵(chen)量(liang)為(wei)(wei)5.4噸(dun)/平(ping)方(fang)公里/月,而(er)(er)2014年(nian)(nian)為(wei)(wei)5.8噸(dun)/平(ping)方(fang)公里/月,同(tong)(tong)比下(xia)降(jiang)6.9%;全區(qu)生活(huo)垃(la)圾總量(liang)59.323萬噸(dun),同(tong)(tong)比減少(shao)(shao)96.97噸(dun);道路(lu)養護、園林綠化(hua)全市(shi)第一(yi);居(ju)民對城(cheng)市(shi)環(huan)境秩序(xu)和(he)管(guan)理水平(ping)入戶調(diao)查滿意(yi)度平(ping)均(jun)(jun)為(wei)(wei)95.69%和(he)96.31%,而(er)(er)2014年(nian)(nian)平(ping)均(jun)(jun)為(wei)(wei)92.56%和(he)93.47%,同(tong)(tong)比增長3.38%和(he)3.03%。
國家(jia)級的西城(cheng)區城(cheng)市環(huan)境分類分級管(guan)理綜合標(biao)準化試(shi)點工(gong)(gong)(gong)作(zuo)項目(mu)雖然有(you)期(qi),但是城(cheng)市環(huan)境分類分級管(guan)理標(biao)準化工(gong)(gong)(gong)作(zuo)卻無涯。西城(cheng)區城(cheng)市環(huan)境建設管(guan)理工(gong)(gong)(gong)作(zuo)者將(jiang)堅定信心,持續推(tui)進,將(jiang)標(biao)準實施(shi)與監督指揮平臺銜接起(qi)來,與全國文明城(cheng)區、國家(jia)衛生區等檢查工(gong)(gong)(gong)作(zuo)結合起(qi)來,與日常工(gong)(gong)(gong)作(zuo)任(ren)務一(yi)致起(qi)來,繼續做好做細做實做強標(biao)準化工(gong)(gong)(gong)作(zuo),努力再(zai)創西城(cheng)區城(cheng)市管(guan)理工(gong)(gong)(gong)作(zuo)的新佳(jia)績。
