一、我市行政復議(yi)工作的基本情況

(you)很大(da)的(de)差距,還存在(zai)一些(xie)有(you)待(dai)解決(jue)的(de)問題。

一是(shi)對行政(zheng)復議(yi)工(gong)(gong)作的(de)重(zhong)(zhong)要(yao)(yao)性認識(shi)不(bu)明確。有的(de)行政(zheng)復議(yi)機關領導(dao)對行政(zheng)復議(yi)是(shi)政(zheng)府工(gong)(gong)作的(de)重(zhong)(zhong)要(yao)(yao)組成(cheng)部分的(de)認識(shi)不(bu)足(zu),把復議(yi)工(gong)(gong)作混同于一般行政(zheng)工(gong)(gong)作,對行政(zheng)復議(yi)在構建社會主義和諧(xie)社會中(zhong)的(de)重(zhong)(zhong)要(yao)(yao)性認識(shi)不(bu)足(zu);有的(de)法制(zhi)機構報喜不(bu)報憂(you)、多一事不(bu)如(ru)少一事,沒有把行政(zheng)復議(yi)工(gong)(gong)作放(fang)到重(zhong)(zhong)要(yao)(yao)位置來(lai)抓。

二是隊伍建設和(he)物質保障力度不(bu)夠。有(you)的(de)區(qu)、縣(xian)(市(shi))政(zheng)(zheng)(zheng)府法(fa)制(zhi)部門目前(qian)只有(you)1-2名(ming)法(fa)制(zhi)工(gong)(gong)(gong)作(zuo)人員,連3人行政(zheng)(zheng)(zheng)復(fu)(fu)議合議組都(dou)成立不(bu)了;有(you)的(de)復(fu)(fu)議人員還承擔(dan)著政(zheng)(zheng)(zheng)府其他(ta)方面(mian)的(de)工(gong)(gong)(gong)作(zuo),行政(zheng)(zheng)(zheng)復(fu)(fu)議隊伍不(bu)穩(wen)定,整體業(ye)務(wu)素質也不(bu)很(hen)高。有(you)的(de)法(fa)制(zhi)部門行政(zheng)(zheng)(zheng)復(fu)(fu)議經費得不(bu)到保證;有(you)的(de)在辦公設備、接(jie)待場所等方面(mian)無(wu)法(fa)保障,直接(jie)影響(xiang)了行政(zheng)(zheng)(zheng)復(fu)(fu)議工(gong)(gong)(gong)作(zuo)的(de)順利開(kai)展(zhan)。

三是依(yi)(yi)法辦理(li)(li)行政復(fu)議案(an)(an)件(jian)(jian)的(de)能力不(bu)強。有(you)的(de)單(dan)(dan)位(wei)(wei)收到行政復(fu)議申請后(hou),不(bu)依(yi)(yi)法受(shou)理(li)(li),故意推脫,甚至(zhi)有(you)的(de)區、縣(xian)全年(nian)(nian)沒有(you)受(shou)理(li)(li)一起(qi)案(an)(an)件(jian)(jian);有(you)的(de)單(dan)(dan)位(wei)(wei)受(shou)理(li)(li)案(an)(an)件(jian)(jian)后(hou)不(bu)能及(ji)時(shi)依(yi)(yi)法審查,久(jiu)拖不(bu)決;有(you)的(de)單(dan)(dan)位(wei)(wei)違(wei)反法定辦案(an)(an)程(cheng)序,該依(yi)(yi)法告(gao)知的(de)不(bu)告(gao)知,該辦理(li)(li)延期手續的(de)不(bu)辦理(li)(li);還有(you)的(de)單(dan)(dan)位(wei)(wei)全年(nian)(nian)受(shou)理(li)(li)多起(qi)案(an)(an)件(jian)(jian),由于復(fu)議人員(yuan)業務素質(zhi)不(bu)高,又怕麻煩,都作出(chu)維持的(de)決定,政府的(de)公信(xin)度受(shou)到影(ying)響。

四(si)是落實行(xing)政(zheng)復(fu)議(yi)配(pei)套(tao)制(zhi)度(du)(du)不全面。有(you)(you)的(de)(de)區、縣(市)還(huan)沒有(you)(you)建立(li)起(qi)復(fu)議(yi)案件內(nei)部處(chu)理程(cheng)序,特別是對行(xing)政(zheng)復(fu)議(yi)人員培(pei)訓制(zhi)度(du)(du)、重大行(xing)政(zheng)復(fu)議(yi)案件集(ji)體討論制(zhi)度(du)(du)、復(fu)議(yi)應訴案件統計分析制(zhi)度(du)(du)等的(de)(de)落實不夠自(zi)覺。

五(wu)是條塊(kuai)分割的(de)管(guan)轄體(ti)制使復議(yi)(yi)功能弱化。從(cong)復議(yi)(yi)實踐來看(kan),條塊(kuai)并存(cun)的(de)行(xing)政復議(yi)(yi)管(guan)轄體(ti)制存(cun)在(zai)一定(ding)弊(bi)端:容易(yi)出現部門保(bao)護問題,行(xing)政復議(yi)(yi)決定(ding)執行(xing)力(li)度(du)較(jiao)弱,增加行(xing)政成本(ben)和申(shen)請人負擔,也影響了復議(yi)(yi)效率,不利于社(she)會和諧(xie)。

二、正確把(ba)握行政復議工作(zuo)在構建和(he)諧社會中(zhong)的定位(wei)

黨的(de)(de)十(shi)六屆六中全會《關(guan)于(yu)構(gou)(gou)建社(she)(she)會主義和諧社(she)(she)會若干重(zhong)大(da)問題決定》提出,構(gou)(gou)建社(she)(she)會主義和諧社(she)(she)會是一(yi)(yi)個不(bu)斷化解社(she)(she)會矛(mao)(mao)盾(dun)的(de)(de)持續過程。明確提出加強和完善(shan)行政復(fu)議(yi)(yi)(yi)制度(du)的(de)(de)要求。行政復(fu)議(yi)(yi)(yi)制度(du)的(de)(de)重(zhong)要性越(yue)(yue)來越(yue)(yue)突(tu)出,它所承擔的(de)(de)任務越(yue)(yue)來越(yue)(yue)明確,定位越(yue)(yue)來越(yue)(yue)清晰,責任越(yue)(yue)來越(yue)(yue)重(zhong)大(da)。進(jin)一(yi)(yi)步做好行政復(fu)議(yi)(yi)(yi)工作是構(gou)(gou)建社(she)(she)會主義和諧社(she)(she)會的(de)(de)迫切(qie)(qie)需要,是人(ren)民(min)(min)群(qun)眾的(de)(de)殷(yin)切(qie)(qie)期盼(pan)。行政復(fu)議(yi)(yi)(yi)制度(du)作為保(bao)護(hu)人(ren)民(min)(min)群(qun)眾合法(fa)權益、保(bao)障和監督(du)行政機關(guan)依法(fa)行使職權的(de)(de)法(fa)律制度(du),是化解矛(mao)(mao)盾(dun)和解決行政爭議(yi)(yi)(yi)的(de)(de)重(zhong)要法(fa)定渠道。

(一)加(jia)強行(xing)(xing)政(zheng)復議(yi)工作(zuo),有(you)利(li)于(yu)(yu)構建和(he)諧(xie)社(she)會。行(xing)(xing)政(zheng)復議(yi)制度(du)具(ju)有(you)把矛盾(dun)化解(jie)在(zai)基層、化解(jie)在(zai)初始階段的(de)特點(dian)。由于(yu)(yu)我國(guo)正處于(yu)(yu)經(jing)濟轉(zhuan)軌、社(she)會轉(zhuan)型(xing)時(shi)期(qi),各種(zhong)社(she)會矛盾(dun)和(he)糾紛(fen)加(jia)劇,發生在(zai)基層的(de)行(xing)(xing)政(zheng)爭(zheng)議(yi)呈逐年增多趨勢,已經(jing)影(ying)響到了社(she)會的(de)和(he)諧(xie)穩定。加(jia)強行(xing)(xing)政(zheng)復議(yi)工作(zuo),通(tong)過秉公(gong)辦(ban)案、體諒民情來贏得民心,通(tong)過解(jie)決行(xing)(xing)政(zheng)糾紛(fen),化解(jie)矛盾(dun),不僅為(wei)人民群(qun)眾以理性、合法的(de)方式(shi)表達訴(su)求搭建了法律平臺(tai),更(geng)為(wei)構建和(he)諧(xie)社(she)會提(ti)供了重要保障。

(二(er))加強(qiang)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)復(fu)議工(gong)作(zuo),有利(li)于維護人民(min)(min)群(qun)眾(zhong)(zhong)(zhong)合法權(quan)(quan)益。黨的(de)十六屆六中全會(hui)(hui)《決定》明確(que)指出,構建社會(hui)(hui)主義和(he)(he)諧社會(hui)(hui),要以解決人民(min)(min)群(qun)眾(zhong)(zhong)(zhong)最關(guan)心、最直接、最現實的(de)利(li)益問題(ti)為(wei)重點(dian)。行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)復(fu)議制度的(de)核心內容(rong)是防(fang)止和(he)(he)糾(jiu)正(zheng)違法或者不當的(de)具體行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)行(xing)(xing)(xing)為(wei),保(bao)障公民(min)(min)、法人和(he)(he)其(qi)他組織的(de)合法權(quan)(quan)益,保(bao)障和(he)(he)監督(du)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)機關(guan)依法行(xing)(xing)(xing)使職權(quan)(quan)。行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)復(fu)議工(gong)作(zuo)是行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)機關(guan)直接面向社會(hui)(hui)、面向人民(min)(min)群(qun)眾(zhong)(zhong)(zhong)開展內部層(ceng)級監督(du)的(de)主要工(gong)作(zuo)形式之一,其(qi)受案范(fan)圍(wei)幾乎涉及行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)機關(guan)的(de)所(suo)有具體行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)行(xing)(xing)(xing)為(wei),并實行(xing)(xing)(xing)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)復(fu)議的(de)全面審查制度,加強(qiang)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)復(fu)議工(gong)作(zuo)有利(li)于人民(min)(min)群(qun)眾(zhong)(zhong)(zhong)保(bao)護自(zi)己的(de)合法權(quan)(quan)益。

(三)加強(qiang)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)復議(yi)工(gong)作,有利于監督和保(bao)障行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)機(ji)關(guan)(guan)(guan)依法(fa)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)。行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)復議(yi)制度是行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)機(ji)關(guan)(guan)(guan)內部(bu)自我糾錯的(de)層級(ji)監督機(ji)制。通過行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)復議(yi),上級(ji)復議(yi)機(ji)關(guan)(guan)(guan)可(ke)(ke)以(yi)及時(shi)發現下級(ji)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)機(ji)關(guan)(guan)(guan)在(zai)工(gong)作中存在(zai)的(de)問題,與其(qi)他監督方式相比,對行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)行(xing)(xing)(xing)(xing)為的(de)監督更(geng)具有直接性、強(qiang)制性和權威性,可(ke)(ke)以(yi)更(geng)有效地(di)保(bao)證行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)機(ji)關(guan)(guan)(guan)合法(fa)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)、合理行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng),從而建立起權責明確、行(xing)(xing)(xing)(xing)為規范、監督有效、保(bao)障有力的(de)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執法(fa)體(ti)制。

(四)加(jia)(jia)強(qiang)(qiang)行(xing)(xing)(xing)政復(fu)議工作,有利于推動政府職(zhi)能轉變(bian)。轉變(bian)政府職(zhi)能,建(jian)(jian)設(she)人(ren)民滿(man)意的服務型政府,是加(jia)(jia)強(qiang)(qiang)政府自身建(jian)(jian)設(she)的主要(yao)目的。暢通行(xing)(xing)(xing)政復(fu)議渠道,便于人(ren)民群眾通過申(shen)請(qing)行(xing)(xing)(xing)政復(fu)議,發揮其監督(du)和保障、救濟(ji)的功效(xiao),對行(xing)(xing)(xing)政亂(luan)作為(wei)和不作為(wei)進(jin)行(xing)(xing)(xing)審查,從根(gen)本上規范行(xing)(xing)(xing)政機關行(xing)(xing)(xing)為(wei),切(qie)實將政府職(zhi)能轉變(bian)到經(jing)濟(ji)調節、市場監管、社會(hui)管理、公共服務職(zhi)能上來,進(jin)而(er)有效(xiao)促進(jin)服務型政府建(jian)(jian)設(she),構建(jian)(jian)和諧社會(hui)。

三(san)、充分發揮行政復議工(gong)作在和諧(xie)社會建設(she)中(zhong)的重要(yao)作用

新形(xing)勢下的(de)(de)行政(zheng)復議(yi)(yi)工(gong)(gong)作已經成為(wei)政(zheng)府工(gong)(gong) 作的(de)(de)重(zhong)要組(zu)成部(bu)分。我們要切實把行政(zheng)復議(yi)(yi)工(gong)(gong)作放到構(gou)建(jian)社會主義(yi)和(he)諧社會的(de)(de)大局中來(lai)(lai)考慮、來(lai)(lai)開展、來(lai)(lai)推進(jin),深入貫徹落實科學發展觀(guan),以構(gou)建(jian)和(he)諧社會為(wei)目標,全面推進(jin)行政(zheng)復議(yi)(yi)工(gong)(gong)作。

(一)要努(nu)力營(ying)造有(you)利于行(xing)政(zheng)(zheng)復議(yi)(yi)(yi)工作的(de)(de)良(liang)好(hao)(hao)環(huan)境(jing)。要進一步加大宣(xuan)(xuan)傳(chuan)(chuan)的(de)(de)廣(guang)度和深度,堅持做到法律條文宣(xuan)(xuan)傳(chuan)(chuan)與典型案例宣(xuan)(xuan)傳(chuan)(chuan)相(xiang)結合(he),經常(chang)宣(xuan)(xuan)傳(chuan)(chuan)與集(ji)中宣(xuan)(xuan)傳(chuan)(chuan)相(xiang)結合(he),面向行(xing)政(zheng)(zheng)機關宣(xuan)(xuan)傳(chuan)(chuan)與面向社會宣(xuan)(xuan)傳(chuan)(chuan)相(xiang)結合(he)。尤(you)其是要注重向領導干部宣(xuan)(xuan)傳(chuan)(chuan),提高做好(hao)(hao)行(xing)政(zheng)(zheng)復議(yi)(yi)(yi)工作的(de)(de)責(ze)任(ren)感和自覺性(xing)(xing)。要建立宣(xuan)(xuan)傳(chuan)(chuan)工作長效機制,采取廣(guang)播、電視等人民群(qun)眾(zhong)喜(xi)聞樂見(jian)的(de)(de)多(duo)種(zhong)形式,把行(xing)政(zheng)(zheng)復議(yi)(yi)(yi)法律知識(shi)普及到千家萬戶(hu),使廣(guang)大人民群(qun)眾(zhong)知曉并熟練運用行(xing)政(zheng)(zheng)復議(yi)(yi)(yi)這一法定(ding)渠道,合(he)法、理性(xing)(xing)地表達利益(yi)訴求(qiu),努(nu)力營(ying)造行(xing)政(zheng)(zheng)復議(yi)(yi)(yi)工作的(de)(de)良(liang)好(hao)(hao)氛(fen)圍。

(二)要(yao)提高行政(zheng)復(fu)(fu)議案(an)(an)(an)(an)件辦(ban)(ban)理(li)質量(liang)。要(yao)嚴格按照(zhao)《行政(zheng)復(fu)(fu)議法》、《__市行政(zheng)復(fu)(fu)議規(gui)(gui)(gui)定(ding)》、《__市行政(zheng)復(fu)(fu)議聽(ting)(ting)證規(gui)(gui)(gui)則》等法律、政(zheng)府(fu)規(gui)(gui)(gui)章和有(you)關規(gui)(gui)(gui)范性文件的規(gui)(gui)(gui)定(ding),做到(dao)辦(ban)(ban)案(an)(an)(an)(an)人員、辦(ban)(ban)案(an)(an)(an)(an)場所、辦(ban)(ban)案(an)(an)(an)(an)程序(xu)、辦(ban)(ban)案(an)(an)(an)(an)依據、辦(ban)(ban)案(an)(an)(an)(an)結(jie)果的“五(wu)個公開(kai)”;要(yao)堅(jian)持深入實地調查(cha)研究,做到(dao)事實認定(ding)清楚,證據查(cha)證屬實;要(yao)堅(jian)持合法性審(shen)查(cha)與適當性審(shen)查(cha)相結(jie)合,實體性問(wen)題審(shen)查(cha)與程序(xu)性問(wen)題審(shen)查(cha)相結(jie)合,對于重特大和涉(she)及公共利益、群體性因素(su),疑難、復(fu)(fu)雜的行政(zheng)復(fu)(fu)議案(an)(an)(an)(an)件,召(zhao)開(kai)聽(ting)(ting)證會進(jin)行審(shen)查(cha),通(tong)過(guo)聽(ting)(ting)證實現陽光辦(ban)(ban)案(an)(an)(an)(an);要(yao)堅(jian)持案(an)(an)(an)(an)件合議制(zhi)度,通(tong)過(guo)強化(hua)辦(ban)(ban)案(an)(an)(an)(an)流程管理(li),切實保證辦(ban)(ban)案(an)(an)(an)(an)質量(liang),真正做到(dao)“定(ding)紛止爭、案(an)(an)(an)(an)結(jie)事了(le)”。

(三)要進一步完(wan)善(shan)行政(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)配套(tao)制(zhi)(zhi)(zhi)(zhi)度(du)建設。要加強行政(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)聽(ting)證制(zhi)(zhi)(zhi)(zhi)度(du)、調(diao)查(cha)制(zhi)(zhi)(zhi)(zhi)度(du)、和解(jie)制(zhi)(zhi)(zhi)(zhi)度(du)、法律文書備案(an)制(zhi)(zhi)(zhi)(zhi)度(du)、行政(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)人員資格制(zhi)(zhi)(zhi)(zhi)度(du)、行政(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)機構(gou)考(kao)核評價(jia)制(zhi)(zhi)(zhi)(zhi)度(du)、行政(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)申(shen)請(qing)集中接轉制(zhi)(zhi)(zhi)(zhi)度(du)、行政(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)責(ze)任(ren)追究制(zhi)(zhi)(zhi)(zhi)度(du)建設,通過健全和完(wan)善(shan)配套(tao)制(zhi)(zhi)(zhi)(zhi)度(du),進一步規(gui)范行政(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)行為。要在完(wan)善(shan)指導(dao)和監督制(zhi)(zhi)(zhi)(zhi)度(du)上加大力度(du)。完(wan)善(shan)案(an)卷評查(cha)辦法和標(biao)準,采取普查(cha)與(yu)抽查(cha)相結合(he)的辦法,著重檢查(cha)區、縣(市(shi))政(zheng)(zheng)(zheng)府(fu)和市(shi)政(zheng)(zheng)(zheng)府(fu)所屬部門無正當理(li)由(you)不(bu)受理(li)行政(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)申(shen)請(qing)、在法定(ding)期限(xian)內不(bu)作出行政(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)決定(ding)、不(bu)履行行政(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)決定(ding)或者(zhe)嚴重不(bu)負責(ze)任(ren)等情況,確保行政(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)工作受理(li)有(you)據(ju)、審(shen)理(li)有(you)序(xu)、裁決合(he)法,促進全市(shi)行政(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)工作向更高(gao)層次發展。

(四)要(yao)(yao)(yao)加(jia)強行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)復(fu)議機構(gou)(gou)和(he)(he)(he)(he)人(ren)員(yuan)(yuan)(yuan)隊伍建設(she)。辦理行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)復(fu)議案件,是(shi)一項(xiang)政(zheng)(zheng)(zheng)(zheng)治性(xing)(xing)、政(zheng)(zheng)(zheng)(zheng)策(ce)性(xing)(xing)、專業性(xing)(xing)很強的(de)(de)(de)(de)工作(zuo)(zuo),它涉(she)及的(de)(de)(de)(de)法律關系復(fu)雜,程序和(he)(he)(he)(he)期限要(yao)(yao)(yao)求嚴格。而且隨著(zhu)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)復(fu)議案件數量的(de)(de)(de)(de)增加(jia)、難度的(de)(de)(de)(de)加(jia)大,辦案的(de)(de)(de)(de)壓力(li)(li)與責任也越來越重(zhong),這些都對(dui)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)復(fu)議機構(gou)(gou)和(he)(he)(he)(he)人(ren)員(yuan)(yuan)(yuan)素質(zhi)(zhi)提出了更新更高的(de)(de)(de)(de)要(yao)(yao)(yao)求,必須以健全的(de)(de)(de)(de)機構(gou)(gou)和(he)(he)(he)(he)高素質(zhi)(zhi)的(de)(de)(de)(de)工作(zuo)(zuo)隊伍作(zuo)(zuo)保障。區、縣(市)政(zheng)(zheng)(zheng)(zheng)府(fu)法制機構(gou)(gou)要(yao)(yao)(yao)進一步充(chong)實,工作(zuo)(zuo)人(ren)員(yuan)(yuan)(yuan)配備(bei)不(bu)能少于3名,確(que)保行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)復(fu)議的(de)(de)(de)(de)一般案件至少有2人(ren)承辦,重(zhong)大復(fu)雜案件有3人(ren)承辦;要(yao)(yao)(yao)依法加(jia)大行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)復(fu)議專項(xiang)經(jing)費的(de)(de)(de)(de)保障力(li)(li)度。要(yao)(yao)(yao)大興學(xue)習(xi)研(yan)究之(zhi)風,形(xing)成(cheng)人(ren)人(ren)學(xue)習(xi)、自覺學(xue)習(xi)、終(zhong)身學(xue)習(xi)、學(xue)以致用的(de)(de)(de)(de)好風氣,使(shi)(shi)復(fu)議人(ren)員(yuan)(yuan)(yuan)具備(bei)較(jiao)強的(de)(de)(de)(de)研(yan)究力(li)(li)、創(chuang)新力(li)(li)和(he)(he)(he)(he)戰斗(dou)力(li)(li);要(yao)(yao)(yao)進一步落實行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)復(fu)議人(ren)員(yuan)(yuan)(yuan)持證上崗(gang)制度,加(jia)大培訓(xun)力(li)(li)度,重(zhong)點在(zai)加(jia)強人(ren)員(yuan)(yuan)(yuan)的(de)(de)(de)(de)政(zheng)(zheng)(zheng)(zheng)治素質(zhi)(zhi)、業務素質(zhi)(zhi)和(he)(he)(he)(he)作(zuo)(zuo)風建設(she)上下功夫,使(shi)(shi)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)復(fu)議人(ren)員(yuan)(yuan)(yuan)具備(bei)較(jiao)強的(de)(de)(de)(de)業務能力(li)(li)、協調能力(li)(li)和(he)(he)(he)(he)參(can)謀(mou)能力(li)(li)。

(五)要積極探(tan)索(suo)行政(zheng)(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)(yi)(yi)(yi)工(gong)(gong)作(zuo)(zuo)創(chuang)新(xin)(xin)機制(zhi)。評價行政(zheng)(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)(yi)(yi)(yi)工(gong)(gong)作(zuo)(zuo)的(de)好壞(huai),不能(neng)簡單地看行政(zheng)(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)(yi)(yi)(yi)案(an)件(jian)的(de)多少,更要看是否解(jie)決了(le)爭議(yi)(yi)(yi)(yi)(yi),是否保護了(le)人民群眾(zhong)的(de)合法權(quan)(quan)益,是否促(cu)進了(le)社(she)會和諧穩定。這就要求我們在(zai)工(gong)(gong)作(zuo)(zuo)中必(bi)須放開眼界,以(yi)探(tan)索(suo)新(xin)(xin)機制(zhi)來打(da)開行政(zheng)(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)(yi)(yi)(yi)工(gong)(gong)作(zuo)(zuo)的(de)新(xin)(xin)局面。要重點圍繞利(li)益協(xie)調(diao)機制(zhi)、訴(su)求表達(da)(da)機制(zhi)、矛盾調(diao)處機制(zhi)和權(quan)(quan)益保障(zhang)機制(zhi),探(tan)索(suo)創(chuang)新(xin)(xin)行政(zheng)(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)(yi)(yi)(yi)組(zu)織體制(zhi)和行政(zheng)(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)(yi)(yi)(yi)工(gong)(gong)作(zuo)(zuo)運行方(fang)式(shi):深(shen)入推進集中接收轉(zhuan)送行政(zheng)(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)(yi)(yi)(yi)申請新(xin)(xin)機制(zhi),暢通訴(su)求表達(da)(da)渠道;完善行政(zheng)(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)(yi)(yi)(yi)委員會,保證復(fu)(fu)(fu)議(yi)(yi)(yi)(yi)(yi)機構的(de)獨立性(xing)和專業性(xing);探(tan)索(suo)建(jian)立相對集中行政(zheng)(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)(yi)(yi)(yi)權(quan)(quan),改革復(fu)(fu)(fu)議(yi)(yi)(yi)(yi)(yi)管轄體制(zhi)。要積極探(tan)索(suo)和完善以(yi)協(xie)調(diao)方(fang)式(shi)辦理案(an)件(jian),弘揚“和為貴”的(de)中華民族傳統美(mei)德,注重將協(xie)調(diao)和解(jie)貫穿于行政(zheng)(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)(yi)(yi)(yi)工(gong)(gong)作(zuo)(zuo)的(de)始終(zhong),促(cu)進當事人與行政(zheng)(zheng)(zheng)(zheng)機關的(de)互相理解(jie)、信任和支持(chi),把行政(zheng)(zheng)(zheng)(zheng)爭議(yi)(yi)(yi)(yi)(yi)的(de)負面效應降到(dao)最(zui)低點。同時,注重強化行政(zheng)(zheng)(zheng)(zheng)復(fu)(fu)(fu)議(yi)(yi)(yi)(yi)(yi)理論研(yan)究工(gong)(gong)作(zuo)(zuo),圍繞具(ju)有(you)全局性(xing)、前瞻性(xing)、戰略性(xing)的(de)重大課題進行深(shen)入探(tan)索(suo),不斷(duan)研(yan)究新(xin)(xin)情況、總(zong)結新(xin)(xin)經驗、拓展新(xin)(xin)思路、形成(cheng)新(xin)(xin)理論,以(yi)理論的(de)創(chuang)新(xin)(xin)帶(dai)動(dong)工(gong)(gong)作(zuo)(zuo)。

構建社會(hui)主義和(he)諧社會(hui)給行政復議(yi)工(gong)作(zuo)提供了難(nan)得的(de)歷史發展(zhan)機遇,也提出了新的(de)更高(gao)要求。我們一(yi)定要深入貫徹落實科(ke)學發展(zhan)觀,以高(gao)度的(de)責任感和(he)使命感,扎實推進行政復議(yi)工(gong)作(zuo),高(gao)效快捷地化解行政爭議(yi),為(wei)和(he)諧社會(hui)建設做出更大貢獻。
