保險誠信問題的出現,最主要的原因來自于人們對于保險的不信任。而人們對于保險不信任首先是從人們接觸保險開始的。從保險公司的業務流程來看,主要是保險人的展業、簽定保險合同后的保單有效期以及理賠期三個階段。在這三個階段中,又以展(zhan)業和理(li)賠最容易產生不誠信現象(xiang)。

(一)保險(xian)人的展業期

保險人尤其是個人人的展業是人們接觸保險產品的第一步。通過展業這一階段,保險人向客戶介紹保險公司的產品和各種保險服務,并盡力去促成(cheng)保險產品(pin)的交易。由于(yu)個人(ren)人(ren)的工作業(ye)績與(yu)個人(ren)的傭金(jin)有(you)著緊密(mi)的正相(xiang)關關系,所以在這個過程(cheng)中,不(bu)誠信現象(xiang)容易產生。產生的原因(yin)主要有(you):

1.保險人的專(zhuan)業素質不高。

(一)加強對保險(xian)人的(de)管(guan)理

第一,要提(ti)高(gao)(gao)保(bao)險人的(de)(de)(de)專(zhuan)業(ye)(ye)以(yi)及業(ye)(ye)務(wu)水平(ping),使人具備扎實的(de)(de)(de)保(bao)險基礎知識,能夠為(wei)客戶提(ti)供專(zhuan)業(ye)(ye)的(de)(de)(de)保(bao)險服務(wu)咨(zi)詢。因(yin)此為(wei)了提(ti)高(gao)(gao)他們的(de)(de)(de)專(zhuan)業(ye)(ye)以(yi)及業(ye)(ye)務(wu)水平(ping),必須提(ti)高(gao)(gao)人的(de)(de)(de)上(shang)崗持證率(lv)。只有(you)人的(de)(de)(de)持證率(lv)的(de)(de)(de)提(ti)高(gao)(gao),才能進一步促使他們的(de)(de)(de)專(zhuan)業(ye)(ye)和業(ye)(ye)務(wu)水平(ping)的(de)(de)(de)上(shang)升。

第二,要提高(gao)(gao)保(bao)險人的(de)職業道德(de)素質(zhi)。為了(le)提高(gao)(gao)保(bao)險人的(de)職業道德(de)素質(zhi),保(bao)險公司在引進(jin)人的(de)時候,應(ying)嚴把質(zhi)量關,應(ying)把那些業務能(neng)力強(qiang)、思(si)想素質(zhi)高(gao)(gao)的(de)人吸納進(jin)公司來。

第四,構建(jian)保險(xian)(xian)(xian)人(ren)信(xin)用數據庫(ku),進而(er)加強保險(xian)(xian)(xian)人(ren)的(de)(de)信(xin)用機制(zhi)建(jian)設。投保人(ren)或(huo)者被保險(xian)(xian)(xian)人(ren)可(ke)以(yi)通(tong)過進入這個數據庫(ku),了解各個人(ren)的(de)(de)信(xin)用情(qing)況,從(cong)而(er)選擇自(zi)己(ji)可(ke)以(yi)值得(de)信(xin)賴的(de)(de)保險(xian)(xian)(xian)人(ren)。同時要將(jiang)那些不(bu)合(he)格的(de)(de)人(ren)實行黑名(ming)單制(zhi),在數據庫(ku)中(zhong)充分的(de)(de)顯現出(chu)來,真正(zheng)做到(dao)信(xin)息的(de)(de)共享和透明。

保險(xian)行業協會等(deng)組織應(ying)繼續大力加強保險(xian)誠(cheng)信(xin)(xin)教育,普及信(xin)(xin)用知識(shi),使保險(xian)人、保險(xian)人等(deng)市場行為(wei)人充分(fen)認識(shi)到(dao)誠(cheng)信(xin)(xin)對它(ta)們的重要性。并使誠(cheng)信(xin)(xin)文化建(jian)設(she)逐(zhu)漸成(cheng)為(wei)保險(xian)公司企(qi)業文化建(jian)設(she)的重要組成(cheng)部分(fen)。

(四)強化保監(jian)會的信用監(jian)管職能

保監(jian)會(hui)應充(chong)分(fen)發揮(hui)其(qi)政府的(de)監(jian)督管理職能(neng),通過監(jian)管,加(jia)強法律法規的(de)執法力度,使保險行(xing)為主體有法可依(yi),能(neng)夠自(zi)覺的(de)去實現(xian)誠信行(xing)為;同時對(dui)守信者要給予獎勵,對(dui)失信者加(jia)大它們的(de)失信成本,以保障(zhang)保險市場(chang)的(de)有序運(yun)作(zuo)。

根(gen)據災(zai)情,中國保(bao)監會(hui)決定(ding)啟(qi)動保(bao)險業重(zhong)(zhong)大(da)(da)突發事件應(ying)急預(yu)案(an)一(yi)級響(xiang)應(ying)程(cheng)序。各(ge)保(bao)監局和各(ge)保(bao)險公(gong)司要(yao)根(gen)據應(ying)急預(yu)案(an)的(de)要(yao)求(qiu),迅速開展抗震救災(zai)工(gong)(gong)作。各(ge)單位要(yao)充分認識做(zuo)好(hao)(hao)抗震救災(zai)的(de)重(zhong)(zhong)要(yao)性(xing),切實加強組(zu)織領導,根(gen)據保(bao)險業應(ying)急預(yu)案(an)的(de)要(yao)求(qiu),立即啟(qi)動相應(ying)的(de)預(yu)案(an),真(zhen)正做(zuo)到(dao)組(zu)織到(dao)位、責任到(dao)人(ren)、措施有力;各(ge)級領導干部要(yao)深入一(yi)線,指(zhi)導災(zai)區保(bao)險機構(gou)抗震救災(zai)工(gong)(gong)作;要(yao)強化大(da)(da)局意(yi)識和服務意(yi)識,把(ba)抗震救災(zai)和做(zuo)好(hao)(hao)理賠(pei)服務工(gong)(gong)作作為當(dang)前(qian)工(gong)(gong)作的(de)重(zhong)(zhong)中之重(zhong)(zhong),抓緊(jin)抓好(hao)(hao)。

二(er)、切實(shi)做(zuo)好抗震(zhen)救災和理賠服(fu)務工作

各保(bao)險公司要切實加強對抗震救災工作(zuo)(zuo)的領導(dao),統(tong)籌(chou)協調(diao)公司資源,按(an)照“主(zhu)動、迅(xun)速、準確、合理(li)(li)”的要求,認真部署和督促落實理(li)(li)賠(pei)(pei)(pei)服務措(cuo)施,要簡化理(li)(li)賠(pei)(pei)(pei)程序(xu)和環(huan)節(jie),建立綠色理(li)(li)賠(pei)(pei)(pei)通道(dao),提(ti)高理(li)(li)賠(pei)(pei)(pei)效率,讓受(shou)災群眾盡早得到保(bao)險賠(pei)(pei)(pei)款,全力保(bao)障災區人民(min)的人身(shen)安全,幫助災區人民(min)樹立重(zhong)建家園和恢復(fu)生產(chan)信心;要增配相關(guan)人員(yuan)和設備,建立24小時值班制度,保(bao)持(chi)報案(an)電話暢通,保(bao)證人員(yuan)及時到位(wei);要加強對基層公司重(zhong)大災情賠(pei)(pei)(pei)案(an)處(chu)理(li)(li)工作(zuo)(zuo)的指導(dao),妥(tuo)善處(chu)理(li)(li)可能出現的各種問題。

三、強化對保險理賠(pei)工作的指(zhi)導

受(shou)災地區保(bao)(bao)(bao)監局要積極指(zhi)導(dao)轄內(nei)各保(bao)(bao)(bao)險(xian)(xian)公司加強和改善理賠服務,特別是對(dui)涉(she)及(ji)人身傷亡(wang)、基礎設施等相關業務的(de)保(bao)(bao)(bao)險(xian)(xian)理賠進(jin)行指(zhi)導(dao)協調(diao),確保(bao)(bao)(bao)保(bao)(bao)(bao)險(xian)(xian)理賠及(ji)時到位。

各受災(zai)地區保(bao)監(jian)局在協(xie)調(diao)、督導當地保(bao)險機構(gou)開(kai)展保(bao)險理賠工作時,發現當地保(bao)險機構(gou)存在困(kun)難,需要其總公司(si)給予進(jin)一步(bu)支持的(de),應及(ji)時予以協(xie)調(diao),或報請(qing)中國保(bao)監(jian)會(hui)予以協(xie)調(diao)。

四、加大與地方政府的(de)溝通協調力(li)度

險企的非常時刻

各保(bao)(bao)險公司迅速啟動應急(ji)預(yu)案,緊急(ji)調度(du)、增(zeng)派人手、通宵接轉客戶報案、第(di)一時(shi)間(jian)出動查(cha)勘定損(sun)。北京保(bao)(bao)監局建立了保(bao)(bao)險理賠信息日報制度(du),督(du)促(cu)保(bao)(bao)險公司切(qie)實做(zuo)好理賠服(fu)務工作。

表現可圈可點

接到(dao)(dao)報案后(hou),不少查(cha)勘理(li)賠員顧不得瓢潑大(da)雨,第一時間趕赴現場(chang),趟(tang)過沒(mei)過大(da)腿的(de)(de)積水,與車(che)主一步一步將(jiang)車(che)推(tui)到(dao)(dao)安全地帶(dai);不顧危險(xian)(xian),深入災害(hai)一線(xian),搶險(xian)(xian)救(jiu)援。這一切,在暴(bao)雨中(zhong)樹立(li)起了保險(xian)(xian)行業良好的(de)(de)社會形象。這場(chang)暴(bao)雨,成了各家保險(xian)(xian)公(gong)司(si)(si)的(de)(de)快速反應能(neng)力和(he)理(li)賠辦事(shi)程(cheng)度的(de)(de)交鋒場(chang)。雖然此次暴(bao)雨給保險(xian)(xian)公(gong)司(si)(si)帶(dai)來巨額損失,但(dan)也必然成為(wei)對(dui)在這場(chang)比(bi)拼(pin)中(zhong)勝出(chu)的(de)(de)險(xian)(xian)企的(de)(de)最好告(gao)白(bai)。

事實上,多(duo)家(jia)保險公司在暴雨前(qian)已多(duo)次向客戶發送防護提(ti)醒(xing)短(duan)信,暴雨后又(you)通過多(duo)種渠道教(jiao)事故(gu)車主如(ru)(ru)何(he)(he)施救,如(ru)(ru)何(he)(he)保護愛(ai)車。如(ru)(ru)太平洋產險通過官方(fang)微博提(ti)醒(xing),“如(ru)(ru)果(guo)車子行駛在過深的積水路段而(er)熄火,一(yi)定要立即關閉點火開關,千(qian)萬不要再嘗試(shi)啟動(dong)發動(dong)機,否則會造成發動(dong)機連桿(gan)被頂彎,損壞(huai)發動(dong)機”。

基礎設施相對落后

在(zai)突發(fa)事件(jian)來臨(lin)時做出快速積極反(fan)應,正(zheng)是(shi)保險行(xing)業(ye)發(fa)揮(hui)社(she)會保險功能(neng)的(de)價(jia)值所(suo)在(zai),也(ye)是(shi)保險行(xing)業(ye)風險管控(kong)專業(ye)優勢的(de)體現(xian)。在(zai)暴(bao)雨(yu)中,保險行(xing)業(ye)展現(xian)了良好(hao)的(de)形象,但(dan)也(ye)暴(bao)露出一些(xie)不足(zu)(zu)。由于拖車(che)(che)(che)不足(zu)(zu),導(dao)致部分(fen)報案的(de)車(che)(che)(che)主苦(ku)等拖車(che)(che)(che)救(jiu)援(yuan)。以某(mou)家(jia)(jia)財險公(gong)司(si)為(wei)例,與之(zhi)合作的(de)VIP合作修理廠(chang)約(yue)30家(jia)(jia),二類修理廠(chang)大約(yue)近200家(jia)(jia)。一般來說,一家(jia)(jia)修理廠(chang)大約(yue)有2~3輛(liang)拖車(che)(che)(che),照此計算(suan),能(neng)為(wei)該公(gong)司(si)服(fu)務(wu)的(de)拖車(che)(che)(che)最多為(wei)690輛(liang)。而暴(bao)雨(yu)發(fa)生時,該公(gong)司(si)接到的(de)報案有數千起,690輛(liang)拖車(che)(che)(che)根本無法滿足(zu)(zu)公(gong)司(si)所(suo)需;更(geng)何況在(zai)業(ye)內(nei),一家(jia)(jia)汽(qi)車(che)(che)(che)修理廠(chang)幾家(jia)(jia)保險公(gong)司(si)業(ye)務(wu)的(de)情況十分(fen)普遍。

非常行(xing)動提升行(xing)業形象

在京(jing)各保險公司(si)估損金額將近10億元(yuan),這一(yi)數字相對于(yu)北京(jing)保險企業的(de)(de)收(shou)入(ru)來說并不算什么。根據(ju)權威數據(ju)推算,上(shang)半年北京(jing)保險業收(shou)入(ru)約達361億元(yuan),其中財產險收(shou)入(ru)約69億元(yuan)。保險公司(si)沒(mei)有(you)理由規(gui)避暴雨(yu)招致的(de)(de)合理賠付,而(er)事(shi)實上(shang),他們更希望以此為(wei)契機來提(ti)升行業和企業的(de)(de)形象。

寬松理賠顯人性

面對(dui)(dui)理(li)賠(pei)(pei)通道不暢等問題,北(bei)(bei)京(jing)保(bao)(bao)監(jian)局(ju)第(di)一(yi)時間(jian)啟動(dong)(dong)保(bao)(bao)險業(ye)(ye)(ye)突發事件應(ying)急預(yu)案。7月22日(ri)(ri)上午,該(gai)局(ju)組織各有(you)關險企分公(gong)(gong)司(si)和北(bei)(bei)京(jing)保(bao)(bao)險行業(ye)(ye)(ye)協(xie)會(hui)負責人召開緊(jin)急會(hui)議(yi),并向轄內各保(bao)(bao)險公(gong)(gong)司(si)下發緊(jin)急通知,協(xie)調(diao)部署(shu)理(li)賠(pei)(pei)工(gong)作,就下一(yi)步(bu)理(li)賠(pei)(pei)服務、救援和保(bao)(bao)全等工(gong)作提出(chu)6點明(ming)確要求。7月25日(ri)(ri),北(bei)(bei)京(jing)市保(bao)(bao)險行業(ye)(ye)(ye)協(xie)會(hui)產險處(chu)主(zhu)任李楓表示,針對(dui)(dui)7·21暴雨,北(bei)(bei)京(jing)市保(bao)(bao)監(jian)局(ju)、北(bei)(bei)京(jing)市保(bao)(bao)險行業(ye)(ye)(ye)協(xie)會(hui)提倡(chang)(chang)保(bao)(bao)險公(gong)(gong)司(si)采取“寬松(song)理(li)賠(pei)(pei)”措(cuo)施,對(dui)(dui)投保(bao)(bao)了涉(she)水(shui)(shui)險的(de)車(che)主(zhu)在發動(dong)(dong)機(ji)進水(shui)(shui)后二(er)次點火造成的(de)損失,只要沒有(you)明(ming)確證據證明(ming)是(shi)人為的(de)故意損壞發動(dong)(dong)機(ji),保(bao)(bao)險公(gong)(gong)司(si)都要予以賠(pei)(pei)償。多家財險公(gong)(gong)司(si)相關負責人也都表示將接受北(bei)(bei)京(jing)市保(bao)(bao)監(jian)局(ju)的(de)倡(chang)(chang)議(yi),只要車(che)主(zhu)投保(bao)(bao)了涉(she)水(shui)(shui)險,二(er)次點火都給予賠(pei)(pei)付(fu)。

保(bao)監會(hui)7月31日特別通知,要(yao)求各保(bao)險(xian)公(gong)司(si)立即啟動應(ying)急預案,做好(hao)關于極端天氣造成的(de)案件理賠(pei)工作;主動承擔車主自行(xing)施救后(hou)產生(sheng)的(de)合理費用,對(dui)受災嚴重(zhong)的(de)企業和地區啟動預估(gu)預賠(pei)程序,并特別提出,按照(zhao)“重(zhong)合同,守信(xin)用”的(de)原則,各保(bao)險(xian)公(gong)司(si)要(yao)按照(zhao)保(bao)險(xian)合同約定及時(shi)、足額賠(pei)付(fu)。保(bao)監會(hui)在通知中要(yao)求各保(bao)險(xian)公(gong)司(si)從服務社會(hui)的(de)角度,對(dui)于有爭議的(de)案件,要(yao)按照(zhao)有利于被保(bao)險(xian)人的(de)原則給(gei)予(yu)及時(shi)賠(pei)付(fu)。

快速理賠獲口碑

在(zai)(zai)突(tu)發(fa)性的自然災害(hai)面(mian)前,做好各(ge)種理(li)(li)賠(pei)(pei)服務(wu)是(shi)保險公司的最好廣告(gao),各(ge)險企在(zai)(zai)理(li)(li)賠(pei)(pei)方(fang)面(mian)開設(she)了(le)(le)綠色通道。在(zai)(zai)車險理(li)(li)賠(pei)(pei)方(fang)面(mian),在(zai)(zai)滿足提(ti)交的資料齊全、不存在(zai)(zai)傷人或第三方(fang)物品損失的條(tiao)件下(xia),各(ge)家公司也都規定(ding)了(le)(le)快速理(li)(li)賠(pei)(pei)。車險損失金額在(zai)(zai)1萬元以下(xia),人保財險承諾在(zai)(zai)1小時內完成(cheng)單證收(shou)集、理(li)(li)算、核賠(pei)(pei)工作并安排付款(kuan)。而中國人壽財險于7月21日在(zai)(zai)各(ge)定(ding)損中心加強了(le)(le)一線查勘定(ding)損理(li)(li)賠(pei)(pei)人員配(pei)置,并簡化理(li)(li)賠(pei)(pei)流程,對因(yin)7月21日暴雨、暴風雷擊等導致(zhi)的車、物損一律免提(ti)供氣象證明(ming)。

新的問題和挑戰

此(ci)次暴雨(yu)巨災(zai),也(ye)給保險行業帶來了新(xin)的問題(ti)和挑戰。

巨災保險亟待推廣

暴雨(yu)過后(hou),從人道主義出發,政府進行公共救濟(ji),補償經濟(ji)損失是(shi)應(ying)(ying)該(gai)的,但(dan)是(shi)這并不應(ying)(ying)當成為一種常態,也不應(ying)(ying)該(gai)由政府承擔所有經濟(ji)損失,應(ying)(ying)建立巨災賠償機(ji)制,歸為商(shang)業保險范疇。

商業保險定價和運作的(de)基(ji)礎(chu)是(shi)大數法(fa)則,但巨災(zai)保險打破(po)了這一基(ji)礎(chu),一個(ge)災(zai)難可能(neng)會吞噬(shi)掉一個(ge)保險公(gong)司10年(nian)甚至20年(nian)的(de)保費(fei),靠個(ge)人(ren)交費(fei),商業保險公(gong)司單(dan)獨運作肯定行不(bu)通。業內人(ren)士表示,對于巨災(zai)風(feng)險,國際上通用的(de)規則是(shi),一定要有(you)政府相關的(de)配(pei)套政策實施(shi)和國家財稅的(de)扶持,結合國際再(zai)保險公(gong)司分散風(feng)險。

差別化產品創新需提速

今年3月,保監會(hui)出臺了《關于加(jia)強(qiang)機動車(che)輛商業(ye)保險條(tiao)(tiao)款(kuan)費率(lv)的通知》,直面(mian)部分不(bu)(bu)合(he)理(li)條(tiao)(tiao)款(kuan)的質疑,強(qiang)化消(xiao)費者利益保障。此(ci)次車(che)險新規正(zheng)體現了差異化,其(qi)中對(dui)不(bu)(bu)同的保險公(gong)司(si)規定了差異化的車(che)險產品開發機制,并鼓勵符(fu)合(he)條(tiao)(tiao)件的公(gong)司(si)自行(xing)確定條(tiao)(tiao)款(kuan)費率(lv)等(deng)。

暴(bao)雨災(zai)害(hai),讓涉(she)水(shui)險(xian)(xian)(xian)(xian)一(yi)下熱了起來。不(bu)少(shao)業內人士認(ren)為,雖(sui)然目前(qian)涉(she)水(shui)險(xian)(xian)(xian)(xian)是附加(jia)險(xian)(xian)(xian)(xian),但(dan)隨著車輛(liang)被浸泡的危險(xian)(xian)(xian)(xian)性不(bu)斷增大(da),在(zai)險(xian)(xian)(xian)(xian)種改(gai)革中,涉(she)水(shui)險(xian)(xian)(xian)(xian)不(bu)排除有(you)上(shang)升(sheng)為主險(xian)(xian)(xian)(xian)甚至被納入車輛(liang)全(quan)險(xian)(xian)(xian)(xian)的可能性。

1.2 理(li)賠風險(xian)的(de)分析

理賠(pei)風險(xian)(xian)是指保(bao)險(xian)(xian)公司對合同規定(ding)范圍內發生的保(bao)險(xian)(xian)事故(gu)進行勘(kan)查(cha)核損(sun)以(yi)后對保(bao)險(xian)(xian)人進行賠(pei)償(chang)的風險(xian)(xian)。理賠(pei)的基本流程為:報案(an)―勘(kan)察―核損(sun)―結案(an)―復(fu)核―審批―賠(pei)償(chang)。

1.3 聲譽(yu)風(feng)險的分析

聲(sheng)譽風(feng)險是指保險公(gong)司經營、管理等(deng)行為導致(zhi)的負面評(ping)價的風(feng)險。

2 財產保險(xian)公司風險(xian)控制的主(zhu)要對策(ce)

2.1 承(cheng)保風(feng)險的(de)控(kong)制對策

承保(bao)(bao)(bao)是整個(ge)保(bao)(bao)(bao)險活動的(de)(de)第一(yi)步,關系著保(bao)(bao)(bao)險公(gong)司(si)(si)業務的(de)(de)質量(liang),對承保(bao)(bao)(bao)風(feng)險進(jin)行正確的(de)(de)控制有助于增(zeng)加公(gong)司(si)(si)收益(yi),增(zeng)強公(gong)司(si)(si)競(jing)爭力,擴大市場份(fen)額。而想(xiang)要正確有效地(di)控制承保(bao)(bao)(bao)風(feng)險就勢必(bi)需要建立健全有效的(de)(de)承保(bao)(bao)(bao)管理體系,可以(yi)從(cong)以(yi)下幾個(ge)方面著手:

社會環境影響

以北京市場為例,2003年北京騙賠案(an)件(jian)達到正(zheng)常案(an)件(jian)的(de)20%以上,,但是由于交通狀況、調(diao)查(cha)取證(zheng)困難(nan)等(deng)因(yin)素,造(zao)成詐騙保(bao)(bao)險(xian)(xian)案(an)件(jian)有增無減(jian)的(de)態勢,雖然保(bao)(bao)險(xian)(xian)法中規定保(bao)(bao)險(xian)(xian)欺詐應(ying)負嚴重的(de)刑事責任,但是由于保(bao)(bao)險(xian)(xian)公(gong)司和公(gong)、檢、法等(deng)部門的(de)配合不到位,詐保(bao)(bao)案(an)件(jian)時有發生,嚴重影響了保(bao)(bao)險(xian)(xian)公(gong)司正(zheng)常經營(ying)。

查勘模式屬于粗放型

目前,查(cha)勘(kan)模(mo)式無(wu)外(wai)乎外(wai)包和(he)自行查(cha)勘(kan)兩種(zhong)模(mo)式,無(wu)論是(shi)那種(zhong)就目前條件保險公司的查(cha)勘(kan)時效(xiao)根(gen)本無(wu)法得(de)以保證,第一現場查(cha)勘(kan)率不(bu)能達到所規(gui)定的要求,從而致使事故(gu)現場及涉及的第三者(zhe)材(cai)料得(de)不(bu)到證實,責任無(wu)法按照(zhao)正常來確定,造成(cheng)部(bu)分損失無(wu)形(xing)擴大。

價格之爭

交強險影響

    三、我國公估人發展中存在的問(wen)題及成因分析

1.公(gong)(gong)估人(ren)(ren)的(de)(de)社會認知度(du)低(di)。鑒于我(wo)國的(de)(de)保險公(gong)(gong)估是(shi)(shi)(shi)“舶(bo)來品”,_巨“來遲了”,真正得到發展(zhan)也(ye)就是(shi)(shi)(shi)近兩年,故(gu)保險公(gong)(gong)估對多(duo)(duo)數人(ren)(ren)而言,是(shi)(shi)(shi)一個新名詞。甚至社會上(shang)很多(duo)(duo)人(ren)(ren)認為,公(gong)(gong)估人(ren)(ren)是(shi)(shi)(shi)保險人(ren)(ren)的(de)(de)下(xia)屬機(ji)構。這些是(shi)(shi)(shi)與公(gong)(gong)估人(ren)(ren)的(de)(de)宣傳工(gong)作(zuo)(zuo)力度(du)不夠大有關系的(de)(de)。如(ru)何(he)想讓更多(duo)(duo)的(de)(de)部(bu)門、單位和家庭了解(jie)公(gong)(gong)估人(ren)(ren)在(zai)(zai)保險市(shi)場中的(de)(de)地位、站(zhan)在(zai)(zai)什么的(de)(de)立場上(shang)發揮(hui)怎樣(yang)的(de)(de)作(zuo)(zuo)用、其業(ye)務范圍有哪些、如(ru)何(he)開展(zhan)工(gong)作(zuo)(zuo)、公(gong)(gong)估結論是(shi)(shi)(shi)否可信、起何(he)種作(zuo)(zuo)用、作(zuo)(zuo)業(ye)態度(du)、效率是(shi)(shi)(shi)否優(you)良、如(ru)何(he)辦理委(wei)托、怎樣(yang)配合公(gong)(gong)估工(gong)作(zuo)(zuo)等等重要問題(ti),必須通過(guo)有效的(de)(de)宣傳讓全社會在(zai)(zai)最(zui)短(duan)的(de)(de)時期內充分認知。當然,政府有關部(bu)門的(de)(de)正面(mian)介(jie)紹也(ye)是(shi)(shi)(shi)十分重要和必要的(de)(de)。

3.保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)人對(dui)(dui)公(gong)(gong)估人參(can)與風險(xian)(xian)(xian)(xian)和(he)價值的(de)(de)(de)(de)評(ping)估工(gong)作(zuo)的(de)(de)(de)(de)重要性認識不(bu)足(zu),導(dao)致公(gong)(gong)估人的(de)(de)(de)(de)業(ye)(ye)務拓(tuo)展并(bing)不(bu)順利。隨(sui)著社會的(de)(de)(de)(de)進步,分工(gong)細化和(he)專(zhuan)業(ye)(ye)化,從兼業(ye)(ye)經(jing)(jing)營(ying)轉(zhuan)向專(zhuan)業(ye)(ye)經(jing)(jing)營(ying)是必然 規(gui)律(lv) 。我(wo)(wo)國(guo)保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)人從險(xian)(xian)(xian)(xian)種開發、展業(ye)(ye)承(cheng)保(bao)(bao)(bao)、資金(jin)運用到(dao)出險(xian)(xian)(xian)(xian)理(li)賠(pei)(pei)、防災防損(sun)兼業(ye)(ye)經(jing)(jing)營(ying)的(de)(de)(de)(de)做法已不(bu)符(fu)國(guo)際(ji)潮(chao)流(liu),該模式(shi)的(de)(de)(de)(de)低下效率亦已為(wei)業(ye)(ye)內(nei)人士公(gong)(gong)認。實(shi)踐中(zhong)保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)人既是運動(dong)員又當裁判的(de)(de)(de)(de)理(li)賠(pei)(pei)方式(shi)已引起被保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)人的(de)(de)(de)(de)嚴重不(bu)滿,不(bu)合法理(li)且其公(gong)(gong)正性受到(dao)普遍質疑。而由公(gong)(gong)估人對(dui)(dui)保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)標的(de)(de)(de)(de)進行(xing)評(ping)估,一(yi)是其資質經(jing)(jing) 中(zhong)國(guo) 保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)監督管理(li)委員會核準(zhun),二(er)是站在公(gong)(gong)正的(de)(de)(de)(de)立場上(shang),三是其專(zhuan)業(ye)(ye)性強,且在實(shi)際(ji)操(cao)作(zuo)中(zhong)公(gong)(gong)估報告書是經(jing)(jing)保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)當事人認可后出具(ju)的(de)(de)(de)(de),故比(bi)保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)人定損(sun)更為(wei) 科(ke)學 合理(li),也符(fu)合國(guo)際(ji)慣(guan)例。但在我(wo)(wo)國(guo)理(li)賠(pei)(pei)實(shi)踐中(zhong)保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)人并(bing)不(bu)樂于委托公(gong)(gong)估人辦理(li)有(you)關事務,只有(you)遇到(dao)技術含量高的(de)(de)(de)(de)復雜賠(pei)(pei)案或矛盾激(ji)化難以(yi)處理(li)的(de)(de)(de)(de)賠(pei)(pei)案才不(bu)得已聘請(qing)公(gong)(gong)估人出面。其主要原因一(yi)是對(dui)(dui)公(gong)(gong)估人不(bu)信任;二(er)是對(dui)(dui)體制改(gai)革的(de)(de)(de)(de)困(kun)難和(he)成本(ben)過(guo)高估計。

四、確保(bao)我(wo)國公估(gu)人健(jian)康、快(kuai)速發展(zhan)的對策和建議

1.政(zheng)(zheng)府有關部門(men)(men)。公(gong)估人(ren)(ren)的(de)發(fa)展(zhan)僅靠其自身的(de)努(nu)力(li)是(shi)遠(yuan)遠(yuan)不夠(gou)的(de),還需(xu)要(yao)政(zheng)(zheng)府適(shi)時合理(li)的(de)引導、扶持。政(zheng)(zheng)府有關部門(men)(men)應盡快將保險(xian)公(gong)估人(ren)(ren)寫(xie)入《中華人(ren)(ren)民(min)共(gong)和國保險(xian)法》,以(yi)確立保險(xian)公(gong)估人(ren)(ren)的(de) 法律(lv) 地位,同時制(zhi)訂政(zheng)(zheng)策、采取(qu)措施、加(jia)強(qiang)監管,為(wei)保險(xian)公(gong)估人(ren)(ren)的(de)發(fa)展(zhan)壯大打造一個良好的(de)外部環境(jing)。筆(bi)者(zhe)認(ren)為(wei),政(zheng)(zheng)府有關部門(men)(men)至少(shao)可(ke)以(yi)加(jia)強(qiang)以(yi)下工作:一是(shi)通過多種(zhong)渠道、多種(zhong)方式做好對公(gong)估人(ren)(ren)的(de)宣(xuan)傳介(jie)紹;二(er)是(shi)通過后(hou)續培訓,提高公(gong)估從業(ye)人(ren)(ren)員的(de)素質(zhi)和技(ji)能(neng);三是(shi)利(li)用優勢地位,提供信息服務;四是(shi)改善監管方式方法,使公(gong)估業(ye)在規范中發(fa)展(zhan)。
