摘要:大數據時代,個人信息既擁有基本的人格屬性,也具備巨大的經濟價值。在此時代下信息傳播范圍越來越廣,傳播速度越來越快,而個人信息安全也因此面臨著更大的風險。大數據時代也改變了個人信息的采集與利用方式,致使我國目前的行政法,無法良好保護公民個人信息。鑒于此,本文重點分析了大數據時代下個人信息行政法保護現狀及問題,并據此探究了相應的保護策略。

一、引言
海量的(de)(de)個(ge)(ge)人(ren)(ren)(ren)信(xin)息(xi)(xi),是(shi)大(da)(da)(da)(da)數(shu)據(ju)技(ji)術誕(dan)生(sheng)與更(geng)新的(de)(de)關鍵,大(da)(da)(da)(da)數(shu)據(ju)是(shi)個(ge)(ge)人(ren)(ren)(ren)信(xin)息(xi)(xi)的(de)(de)集合體(ti)。個(ge)(ge)人(ren)(ren)(ren)信(xin)息(xi)(xi)在《民(min)法(fa)典(dian)》中被列入人(ren)(ren)(ren)格權編(bian),雖然(ran)個(ge)(ge)人(ren)(ren)(ren)信(xin)息(xi)(xi)是(shi)公(gong)(gong)民(min)人(ren)(ren)(ren)格權益的(de)(de)重要體(ti)現(xian)之一,但在邁入大(da)(da)(da)(da)數(shu)據(ju)時(shi)代后,個(ge)(ge)人(ren)(ren)(ren)信(xin)息(xi)(xi)價值(zhi)產生(sheng)一定變(bian)(bian)化,具(ju)有(you)了經濟和公(gong)(gong)共(gong)利(li)益價值(zhi)。依托于個(ge)(ge)人(ren)(ren)(ren)信(xin)息(xi)(xi),行政機關能為公(gong)(gong)民(min)帶(dai)去更(geng)好的(de)(de)服務,使(shi)社會得到更(geng)好治(zhi)理,提升公(gong)(gong)共(gong)利(li)益價值(zhi);企業(ye)能夠利(li)用個(ge)(ge)人(ren)(ren)(ren)信(xin)息(xi)(xi)實(shi)現(xian)商業(ye)利(li)益的(de)(de)獲(huo)(huo)取(qu)。然(ran)而(er)凡事均有(you)兩面性,技(ji)術的(de)(de)發展(zhan)讓(rang)廣大(da)(da)(da)(da)人(ren)(ren)(ren)群受益的(de)(de)同時(shi),也將帶(dai)來一些(xie)新型危機。其(qi)中最不(bu)容忽(hu)視的(de)(de),便是(shi)大(da)(da)(da)(da)數(shu)據(ju)技(ji)術的(de)(de)快速發展(zhan),很(hen)大(da)(da)(da)(da)程度(du)降低了公(gong)(gong)民(min)個(ge)(ge)人(ren)(ren)(ren)信(xin)息(xi)(xi)的(de)(de)被獲(huo)(huo)取(qu)難度(du),加上上網搜索留下(xia)的(de)(de)痕跡(ji)、App各(ge)種權限的(de)(de)獲(huo)(huo)取(qu)等,都讓(rang)人(ren)(ren)(ren)們變(bian)(bian)得愈加“透明”。這(zhe)也是(shi)為何近(jin)些(xie)年個(ge)(ge)人(ren)(ren)(ren)信(xin)息(xi)(xi)被不(bu)法(fa)利(li)用、泄露(lu)的(de)(de)事件越來越多(duo),重則(ze)帶(dai)給公(gong)(gong)民(min)不(bu)可(ke)預估的(de)(de)財產損失(shi)、危害其(qi)身(shen)心,輕則(ze)打(da)亂公(gong)(gong)民(min)的(de)(de)日常(chang)生(sheng)活。而(er)反(fan)觀我國(guo)行政法(fa)在保護個(ge)(ge)人(ren)(ren)(ren)信(xin)息(xi)(xi)上,還存在著一些(xie)不(bu)足,故此為使(shi)公(gong)(gong)民(min)個(ge)(ge)人(ren)(ren)(ren)信(xin)息(xi)(xi)安(an)全得到有(you)效保護,應加強該領(ling)域的(de)(de)相關研究。
二、大數據時代下個人信息的行政法保護現狀
有(you)研究提出(chu):大數(shu)(shu)據擁有(you)快速的(de)(de)(de)(de)數(shu)(shu)據流(liu)轉(zhuan)、海(hai)量(liang)的(de)(de)(de)(de)數(shu)(shu)據規模、多樣數(shu)(shu)據類型(xing)和(he)價值密(mi)度(du)低等特征,屬于(yu)在多個(ge)(ge)方面遠(yuan)(yuan)遠(yuan)(yuan)超過(guo)傳統數(shu)(shu)據庫軟(ruan)件(jian)工具的(de)(de)(de)(de)數(shu)(shu)據集合(he),如信(xin)(xin)(xin)(xin)息(xi)(xi)獲取(qu)、管(guan)理、存(cun)儲及分析(xi)等。大數(shu)(shu)據的(de)(de)(de)(de)來(lai)源(yuan)與形(xing)成機制(zhi),都決(jue)定了(le)(le)其(qi)內部勢必包含(han)海(hai)量(liang)的(de)(de)(de)(de)個(ge)(ge)人(ren)(ren)(ren)(ren)(ren)信(xin)(xin)(xin)(xin)息(xi)(xi)。雖(sui)然(ran)當前關于(yu)個(ge)(ge)人(ren)(ren)(ren)(ren)(ren)信(xin)(xin)(xin)(xin)息(xi)(xi)的(de)(de)(de)(de)定義有(you)所不(bu)同(tong),但(dan)均認(ren)(ren)可(ke)其(qi)是(shi)以電子形(xing)式(shi)保存(cun)公(gong)民(min)個(ge)(ge)人(ren)(ren)(ren)(ren)(ren)的(de)(de)(de)(de)各種(zhong)身(shen)份信(xin)(xin)(xin)(xin)息(xi)(xi),如身(shen)份證件(jian)號碼、電話號碼、住址、出(chu)生(sheng)(sheng)日(ri)期、公(gong)民(min)姓名(ming)等。大數(shu)(shu)據時(shi)(shi)代(dai)(dai)公(gong)民(min)借助網絡(luo)就可(ke)完成酒店(dian)、車票及機票的(de)(de)(de)(de)預訂,日(ri)常(chang)出(chu)行更為(wei)(wei)(wei)便(bian)捷(jie),但(dan)由此(ci)也產生(sheng)(sheng)了(le)(le)新的(de)(de)(de)(de)隱(yin)患(huan),即個(ge)(ge)人(ren)(ren)(ren)(ren)(ren)信(xin)(xin)(xin)(xin)息(xi)(xi)泄露或被(bei)不(bu)法(fa)使用。似乎越(yue)來(lai)越(yue)多人(ren)(ren)(ren)(ren)(ren)開始(shi)默認(ren)(ren)“大數(shu)(shu)據時(shi)(shi)代(dai)(dai)無(wu)個(ge)(ge)人(ren)(ren)(ren)(ren)(ren)隱(yin)私(si)”。在此(ci)時(shi)(shi)代(dai)(dai)下(xia),時(shi)(shi)常(chang)發(fa)生(sheng)(sheng)公(gong)民(min)征信(xin)(xin)(xin)(xin)記(ji)錄、身(shen)份證信(xin)(xin)(xin)(xin)息(xi)(xi)、酒店(dian)住宿(su)記(ji)錄等個(ge)(ge)人(ren)(ren)(ren)(ren)(ren)信(xin)(xin)(xin)(xin)息(xi)(xi)被(bei)非法(fa)出(chu)售、披露、獲取(qu)的(de)(de)(de)(de)情況。例如,2016年(nian)山東(dong)臨沂發(fa)生(sheng)(sheng)的(de)(de)(de)(de)徐(xu)(xu)玉(yu)(yu)(yu)(yu)玉(yu)(yu)(yu)(yu)事件(jian),便(bian)是(shi)不(bu)法(fa)人(ren)(ren)(ren)(ren)(ren)員通過(guo)個(ge)(ge)人(ren)(ren)(ren)(ren)(ren)信(xin)(xin)(xin)(xin)息(xi)(xi)實施刑(xing)事犯罪(zui)的(de)(de)(de)(de)典型(xing)案例。犯罪(zui)嫌疑(yi)人(ren)(ren)(ren)(ren)(ren)黃進春、鄭賢聰等人(ren)(ren)(ren)(ren)(ren),通過(guo)利用徐(xu)(xu)玉(yu)(yu)(yu)(yu)玉(yu)(yu)(yu)(yu)的(de)(de)(de)(de)個(ge)(ge)人(ren)(ren)(ren)(ren)(ren)信(xin)(xin)(xin)(xin)息(xi)(xi),將(jiang)剛考(kao)上(shang)大學(xue)的(de)(de)(de)(de)徐(xu)(xu)玉(yu)(yu)(yu)(yu)玉(yu)(yu)(yu)(yu)學(xue)費(fei)騙(pian)光,年(nian)僅18歲的(de)(de)(de)(de)徐(xu)(xu)玉(yu)(yu)(yu)(yu)玉(yu)(yu)(yu)(yu)在此(ci)打(da)擊下(xia)心臟驟停,不(bu)幸離(li)世(shi)。后經過(guo)相關部門調(diao)查,同(tong)年(nian)個(ge)(ge)人(ren)(ren)(ren)(ren)(ren)信(xin)(xin)(xin)(xin)息(xi)(xi)在網上(shang)被(bei)非法(fa)兜售的(de)(de)(de)(de)并(bing)非徐(xu)(xu)玉(yu)(yu)(yu)(yu)玉(yu)(yu)(yu)(yu)一人(ren)(ren)(ren)(ren)(ren),共約有(you)五(wu)萬多名(ming)考(kao)生(sheng)(sheng)信(xin)(xin)(xin)(xin)息(xi)(xi)。雖(sui)然(ran)為(wei)(wei)(wei)了(le)(le)打(da)擊個(ge)(ge)人(ren)(ren)(ren)(ren)(ren)信(xin)(xin)(xin)(xin)息(xi)(xi)的(de)(de)(de)(de)侵犯行為(wei)(wei)(wei),各級行政機關加大了(le)(le)監管(guan)力度(du),并(bing)且最高人(ren)(ren)(ren)(ren)(ren)民(min)檢察(cha)院和(he)人(ren)(ren)(ren)(ren)(ren)民(min)法(fa)院,也頒布了(le)(le)一些典型(xing)案例。然(ran)而客(ke)觀來(lai)講(jiang),個(ge)(ge)人(ren)(ren)(ren)(ren)(ren)信(xin)(xin)(xin)(xin)息(xi)(xi)的(de)(de)(de)(de)民(min)事侵權行為(wei)(wei)(wei)、刑(xing)事犯罪(zui)行為(wei)(wei)(wei)與行政違法(fa)行為(wei)(wei)(wei),依舊(jiu)不(bu)斷發(fa)生(sheng)(sheng)。因此(ci),大數(shu)(shu)據背(bei)景下(xia)怎樣使公(gong)民(min)個(ge)(ge)人(ren)(ren)(ren)(ren)(ren)信(xin)(xin)(xin)(xin)息(xi)(xi)得到良(liang)好(hao)保護(hu),顯得愈加迫切。
三、大數據時代下個人信息行政法保護存在的問題
(一)網(wang)絡環境層面(mian)
大(da)數據時(shi)(shi)代(dai)下(xia)(xia)人(ren)(ren)們的(de)(de)消費方式(shi)與消費認(ren)(ren)知均發(fa)生變化,由此也(ye)增加了(le)個(ge)(ge)人(ren)(ren)信(xin)(xin)息(xi)(xi)(xi)的(de)(de)保(bao)護(hu)(hu)難(nan)度(du)。因(yin)(yin)為(wei)在此時(shi)(shi)代(dai)下(xia)(xia),各個(ge)(ge)社(she)交(jiao)平(ping)臺均能快(kuai)速分(fen)享公(gong)民個(ge)(ge)人(ren)(ren)信(xin)(xin)息(xi)(xi)(xi),但因(yin)(yin)年齡、網名、職業或性別等信(xin)(xin)息(xi)(xi)(xi)存在不(bu)(bu)確定(ding)性,也(ye)較大(da)程度(du)阻礙(ai)了(le)信(xin)(xin)息(xi)(xi)(xi)保(bao)護(hu)(hu)工(gong)作(zuo)的(de)(de)開展。出(chu)(chu)現信(xin)(xin)息(xi)(xi)(xi)外流,常常不(bu)(bu)能及時(shi)(shi)找(zhao)出(chu)(chu)外流源頭,這(zhe)會(hui)使得(de)流散信(xin)(xin)息(xi)(xi)(xi)的(de)(de)團(tuan)體(ti)或個(ge)(ge)人(ren)(ren)更為(wei)肆無忌憚(dan)。并且行(xing)(xing)政機關認(ren)(ren)定(ding)和(he)劃分(fen)責任時(shi)(shi),也(ye)會(hui)受到虛假信(xin)(xin)息(xi)(xi)(xi)的(de)(de)影響,導致工(gong)作(zuo)進(jin)程延長,進(jin)而降(jiang)低(di)個(ge)(ge)人(ren)(ren)信(xin)(xin)息(xi)(xi)(xi)的(de)(de)保(bao)護(hu)(hu)效(xiao)果。另外,在網絡平(ping)臺上(shang)信(xin)(xin)息(xi)(xi)(xi)傳(chuan)播速度(du)極快(kuai),若被有心人(ren)(ren)篡改和(he)竊取信(xin)(xin)息(xi)(xi)(xi),就(jiu)可能進(jin)行(xing)(xing)不(bu)(bu)正當經濟效(xiao)益的(de)(de)謀(mou)取,加大(da)行(xing)(xing)政法保(bao)護(hu)(hu)難(nan)度(du),降(jiang)低(di)個(ge)(ge)人(ren)(ren)信(xin)(xin)息(xi)(xi)(xi)補救效(xiao)率(lv)。因(yin)(yin)此,需要進(jin)一步改善網絡數據環境(jing),為(wei)公(gong)民個(ge)(ge)人(ren)(ren)信(xin)(xin)息(xi)(xi)(xi)行(xing)(xing)政法保(bao)護(hu)(hu)提供助力。
(二)行(xing)政(zheng)監(jian)管層面(mian)
落(luo)實行(xing)政(zheng)監(jian)(jian)(jian)(jian)管(guan),是規范公(gong)(gong)民個人信息(xi)(xi)行(xing)政(zheng)法(fa)(fa)保(bao)護(hu)行(xing)為,完成(cheng)良好社會風氣營造的(de)重(zhong)要舉措。首(shou)先,目前行(xing)政(zheng)監(jian)(jian)(jian)(jian)督(du)力度(du)較(jiao)弱,這主(zhu)要體(ti)現在(zai)行(xing)業自(zi)律性監(jian)(jian)(jian)(jian)管(guan)體(ti)制較(jiao)為單一,公(gong)(gong)眾監(jian)(jian)(jian)(jian)督(du)窗口(kou)局限性明顯,因(yin)此,頻(pin)頻(pin)出現公(gong)(gong)民個人信息(xi)(xi)被盜取、不(bu)法(fa)(fa)利用(yong)的(de)現象(xiang),導致信息(xi)(xi)行(xing)政(zheng)法(fa)(fa)保(bao)護(hu)效(xiao)果無法(fa)(fa)達到預期。其(qi)次(ci),相對寬泛的(de)監(jian)(jian)(jian)(jian)管(guan)標(biao)準。保(bao)護(hu)個人信息(xi)(xi)的(de)主(zhu)體(ti)多元,但(dan)主(zhu)體(ti)之間并未形(xing)成(cheng)較(jiao)強合力,時常由于各(ge)自(zi)為政(zheng)給信息(xi)(xi)保(bao)護(hu)質量形(xing)成(cheng)負面影響,降低監(jian)(jian)(jian)(jian)管(guan)效(xiao)率。在(zai)實際(ji)監(jian)(jian)(jian)(jian)管(guan)過程中,各(ge)個部門的(de)標(biao)準與(yu)程序等(deng)具(ju)有差異,也一定弱化(hua)了監(jian)(jian)(jian)(jian)管(guan)質量,不(bu)利于行(xing)政(zheng)機(ji)關(guan)公(gong)(gong)信力的(de)提升。
(三)救濟層面
賦(fu)予公民(min)行(xing)政訴訟(song)權(quan)利(li),是目前(qian)我國行(xing)政法(fa)關于(yu)公民(min)個人(ren)信(xin)息(xi)受侵(qin)害的(de)主要救(jiu)濟方式,但公民(min)在進(jin)行(xing)訴訟(song)維(wei)(wei)權(quan)時,常面臨和行(xing)政機(ji)關的(de)利(li)益博弈。客觀來講(jiang),公民(min)維(wei)(wei)權(quan)救(jiu)濟處(chu)在劣(lie)勢(shi)地位,尤其在進(jin)行(xing)維(wei)(wei)權(quan)時,公民(min)需完成證(zheng)據采集。而相較于(yu)行(xing)政機(ji)關或企業,公民(min)獲取(qu)有利(li)證(zheng)據的(de)難度較大,因此多數公民(min)不(bu)具有和行(xing)政機(ji)關、企業博弈的(de)能力,加之(zhi)繁(fan)瑣復雜的(de)訴訟(song)程序(xu),致(zhi)使很多公民(min)在個人(ren)信(xin)息(xi)受侵(qin)害后,無法(fa)得(de)到良好(hao)的(de)救(jiu)濟。
四、大數據時代個人信息行政法保護的改善策略
(一)優化網絡環境
1.在凈化網絡環(huan)(huan)境,確保公(gong)(gong)民個人信(xin)(xin)息(xi)(xi)(xi)得(de)到良好保護(hu)方面(mian),政(zheng)府應(ying)重(zhong)(zhong)視正(zheng)面(mian)作(zuo)用(yong)的(de)(de)發揮(hui)(hui)。相(xiang)關部門應(ying)立足行政(zheng)法保護(hu)予以(yi)政(zheng)策支持,將自身職(zhi)能(neng)優勢發揮(hui)(hui)出來,有序凈化市場環(huan)(huan)境。對(dui)于非法利(li)用(yong)個人信(xin)(xin)息(xi)(xi)(xi)的(de)(de)行為(wei),要加(jia)(jia)(jia)大懲處力度,結(jie)合(he)(he)相(xiang)關法律予以(yi)制裁,以(yi)免(mian)(mian)重(zhong)(zhong)復出現類似行為(wei)。2.加(jia)(jia)(jia)強綜(zong)合(he)(he)技(ji)術(shu)(shu)(shu)(shu)的(de)(de)應(ying)用(yong)。大數據(ju)時(shi)代(dai)下(xia)信(xin)(xin)息(xi)(xi)(xi)安全(quan)技(ji)術(shu)(shu)(shu)(shu)、大數據(ju)技(ji)術(shu)(shu)(shu)(shu)等發展迅猛(meng),這些(xie)都能(neng)在技(ji)術(shu)(shu)(shu)(shu)層面(mian)予以(yi)公(gong)(gong)民個人信(xin)(xin)息(xi)(xi)(xi)的(de)(de)保護(hu)支持。相(xiang)比于傳統信(xin)(xin)息(xi)(xi)(xi)保護(hu)方法,綜(zong)合(he)(he)技(ji)術(shu)(shu)(shu)(shu)無疑具(ju)(ju)有更(geng)強的(de)(de)適(shi)用(yong)性,與大數據(ju)時(shi)代(dai)發展趨(qu)勢相(xiang)符合(he)(he),能(neng)讓行政(zheng)機關信(xin)(xin)息(xi)(xi)(xi)保護(hu)工(gong)作(zuo)更(geng)具(ju)(ju)效(xiao)率(lv),以(yi)免(mian)(mian)由于人工(gong)環(huan)(huan)節(jie)導致種種失誤(wu)。同(tong)時(shi),以(yi)往單一技(ji)術(shu)(shu)(shu)(shu)的(de)(de)不(bu)足,能(neng)夠(gou)通過結(jie)合(he)(he)式的(de)(de)技(ji)術(shu)(shu)(shu)(shu)應(ying)用(yong)得(de)到良好補充,使(shi)公(gong)(gong)民個人信(xin)(xin)息(xi)(xi)(xi)得(de)到全(quan)方位維護(hu),以(yi)免(mian)(mian)信(xin)(xin)息(xi)(xi)(xi)安全(quan)漏洞(dong)的(de)(de)出現。3.注重(zhong)(zhong)人才支持。網絡環(huan)(huan)境內的(de)(de)信(xin)(xin)息(xi)(xi)(xi)行政(zheng)法保護(hu)工(gong)作(zuo),離不(bu)開人才的(de)(de)參與,如個人信(xin)(xin)息(xi)(xi)(xi)收集(ji)、信(xin)(xin)息(xi)(xi)(xi)對(dui)接、信(xin)(xin)息(xi)(xi)(xi)審核及實名認證(zheng)等,需要有效(xiao)辨別信(xin)(xin)息(xi)(xi)(xi)真假(jia)性。對(dui)此(ci),政(zheng)府應(ying)加(jia)(jia)(jia)大網絡技(ji)術(shu)(shu)(shu)(shu)人才的(de)(de)培養力,搭建一支水平過硬的(de)(de)網絡技(ji)術(shu)(shu)(shu)(shu)隊(dui)伍,從而使(shi)行政(zheng)機關工(gong)作(zuo)更(geng)具(ju)(ju)效(xiao)率(lv),更(geng)好落實公(gong)(gong)民個人信(xin)(xin)息(xi)(xi)(xi)的(de)(de)保護(hu)。
(二)加大行政監管(guan)力度
想要(yao)(yao)(yao)持續提升(sheng)大數據時(shi)(shi)代下行(xing)(xing)(xing)(xing)政法保(bao)護(hu)效能(neng)(neng),就應(ying)階段(duan)性(xing)(xing)考(kao)核信(xin)(xin)息(xi)保(bao)護(hu)實踐,然(ran)后根據考(kao)核結果對(dui)行(xing)(xing)(xing)(xing)政法保(bao)護(hu)策略展(zhan)(zhan)開(kai)適當調整。在(zai)(zai)(zai)這(zhe)一(yi)過程(cheng)中(zhong),需(xu)加強行(xing)(xing)(xing)(xing)政監(jian)(jian)管(guan)(guan)(guan)(guan)(guan),使(shi)(shi)信(xin)(xin)息(xi)保(bao)護(hu)行(xing)(xing)(xing)(xing)為(wei)具(ju)有(you)規(gui)(gui)范性(xing)(xing),完(wan)(wan)成行(xing)(xing)(xing)(xing)政法權(quan)威性(xing)(xing)的(de)良好(hao)凸顯(xian)。推進行(xing)(xing)(xing)(xing)政監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)工(gong)作的(de)過程(cheng)中(zhong),要(yao)(yao)(yao)想保(bao)證監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)工(gong)作具(ju)有(you)針對(dui)性(xing)(xing),就不能(neng)(neng)忽(hu)視(shi)對(dui)公(gong)(gong)(gong)(gong)民(min)(min)(min)個人(ren)信(xin)(xin)息(xi)受侵害的(de)表現(xian)與(yu)(yu)(yu)原因(yin)的(de)了(le)(le)解,如此才(cai)能(neng)(neng)夠有(you)序、規(gui)(gui)范開(kai)展(zhan)(zhan)個人(ren)信(xin)(xin)息(xi)處理工(gong)作,使(shi)(shi)負面影響大大減(jian)少。1.大力監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)政府機構。在(zai)(zai)(zai)選(xuan)拔監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)人(ren)員(yuan)、組建監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)團隊時(shi)(shi),要(yao)(yao)(yao)明確分配權(quan)責,使(shi)(shi)之(zhi)能(neng)(neng)夠在(zai)(zai)(zai)履行(xing)(xing)(xing)(xing)責任(ren)時(shi)(shi),做到(dao)信(xin)(xin)息(xi)收集行(xing)(xing)(xing)(xing)為(wei)規(gui)(gui)范,確保(bao)信(xin)(xin)息(xi)有(you)效且完(wan)(wan)整。2.落實市場(chang)主(zhu)(zhu)體(ti)的(de)監(jian)(jian)督(du)。利(li)用(yong)公(gong)(gong)(gong)(gong)民(min)(min)(min)個人(ren)信(xin)(xin)息(xi)的(de)一(yi)個重(zhong)要(yao)(yao)(yao)主(zhu)(zhu)體(ti),便是(shi)市場(chang)主(zhu)(zhu)體(ti),對(dui)此為(wei)了(le)(le)最大化(hua)體(ti)現(xian)監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)效用(yong),應(ying)注重(zhong)全方(fang)位監(jian)(jian)督(du)市場(chang)主(zhu)(zhu)體(ti)的(de)信(xin)(xin)用(yong)使(shi)(shi)用(yong)行(xing)(xing)(xing)(xing)為(wei)。當前(qian),我國行(xing)(xing)(xing)(xing)業(ye)自律性(xing)(xing)監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)體(ti)制(zhi)正處在(zai)(zai)(zai)持續完(wan)(wan)善階段(duan),規(gui)(gui)范化(hua)、制(zhi)度化(hua)建設要(yao)(yao)(yao)求在(zai)(zai)(zai)近些年逐步(bu)(bu)提升(sheng),明顯(xian)提高(gao)(gao)了(le)(le)建設實踐速度,順勢形(xing)成了(le)(le)一(yi)些行(xing)(xing)(xing)(xing)業(ye)自律規(gui)(gui)則,對(dui)其展(zhan)(zhan)開(kai)監(jian)(jian)督(du)時(shi)(shi)需(xu)要(yao)(yao)(yao)政府發揮(hui)主(zhu)(zhu)導作用(yong),健全自律監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)體(ti)系。3.拓展(zhan)(zhan)公(gong)(gong)(gong)(gong)眾(zhong)監(jian)(jian)督(du)渠道。政府應(ying)充分發揮(hui)公(gong)(gong)(gong)(gong)眾(zhong)的(de)作用(yong),通過拓寬監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)渠道,使(shi)(shi)公(gong)(gong)(gong)(gong)眾(zhong)積極(ji)參與(yu)(yu)(yu)到(dao)這(zhe)一(yi)過程(cheng)中(zhong)建言獻(xian)策。進一(yi)步(bu)(bu)調動(dong)(dong)公(gong)(gong)(gong)(gong)眾(zhong)的(de)參與(yu)(yu)(yu)積極(ji)性(xing)(xing),開(kai)展(zhan)(zhan)相關宣傳活動(dong)(dong),大力宣傳個人(ren)信(xin)(xin)息(xi)保(bao)護(hu)的(de)重(zhong)要(yao)(yao)(yao)性(xing)(xing),引導公(gong)(gong)(gong)(gong)眾(zhong)完(wan)(wan)成個人(ren)信(xin)(xin)息(xi)保(bao)護(hu)理念的(de)樹立,使(shi)(shi)之(zhi)能(neng)(neng)夠在(zai)(zai)(zai)監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)實踐中(zhong)積極(ji)發力,與(yu)(yu)(yu)市場(chang)主(zhu)(zhu)體(ti)、政府等形(xing)成監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)合(he)力,從(cong)而促使(shi)(shi)公(gong)(gong)(gong)(gong)民(min)(min)(min)個人(ren)信(xin)(xin)息(xi)行(xing)(xing)(xing)(xing)政法保(bao)護(hu)工(gong)作更高(gao)(gao)效開(kai)展(zhan)(zhan)。
(三(san))積極開(kai)展公民網絡(luo)安(an)全教育工作
在大(da)數(shu)據(ju)時代下,要(yao)想提高個人(ren)信(xin)(xin)(xin)息(xi)的(de)行(xing)政法(fa)保護成(cheng)效,不可(ke)忽視公(gong)(gong)民的(de)網(wang)(wang)絡(luo)安(an)(an)全(quan)教(jiao)育(yu)(yu)(yu)。就(jiu)(jiu)信(xin)(xin)(xin)息(xi)層面(mian)而(er)言(yan),當(dang)前公(gong)(gong)民具(ju)有(you)多重(zhong)身(shen)份(fen),既是信(xin)(xin)(xin)息(xi)受害者(zhe)、使用者(zhe),也是信(xin)(xin)(xin)息(xi)所(suo)有(you)者(zhe)。當(dang)前時代下,個人(ren)信(xin)(xin)(xin)息(xi)具(ju)有(you)傳播范圍廣泛(fan)、傳播速度(du)快的(de)特征,所(suo)以更(geng)應落實好(hao)公(gong)(gong)民的(de)網(wang)(wang)絡(luo)安(an)(an)全(quan)教(jiao)育(yu)(yu)(yu)工作。據(ju)相關統計顯示,我國(guo)網(wang)(wang)民數(shu)量早在2018年時就(jiu)(jiu)已突(tu)破10億大(da)關,在全(quan)球位居首位,但其中(zhong)80%以上的(de)網(wang)(wang)民學歷都在初中(zhong)和高中(zhong)。由(you)此我們不難(nan)得知,開展公(gong)(gong)民網(wang)(wang)絡(luo)安(an)(an)全(quan)教(jiao)育(yu)(yu)(yu)的(de)緊迫性。為了落實好(hao)這項工作,一方(fang)面(mian)我國(guo)可(ke)將公(gong)(gong)民網(wang)(wang)絡(luo)安(an)(an)全(quan)教(jiao)育(yu)(yu)(yu)納入(ru)義務教(jiao)育(yu)(yu)(yu),從小學開始就(jiu)(jiu)展開網(wang)(wang)絡(luo)安(an)(an)全(quan)教(jiao)育(yu)(yu)(yu),并且對(dui)于老年人(ren)這一易受網(wang)(wang)絡(luo)詐騙(pian)群(qun)體(ti),可(ke)開展社(she)區網(wang)(wang)絡(luo)安(an)(an)全(quan)教(jiao)育(yu)(yu)(yu)主題活動,采用易懂、通俗的(de)語言(yan)進行(xing)講解,以保證網(wang)(wang)絡(luo)安(an)(an)全(quan)教(jiao)育(yu)(yu)(yu)成(cheng)效;另一方(fang)面(mian),應重(zhong)視技術手(shou)段的(de)運用,以使廣大(da)網(wang)(wang)民具(ju)有(you)更(geng)高的(de)網(wang)(wang)絡(luo)安(an)(an)全(quan)意(yi)識與信(xin)(xin)(xin)息(xi)素養。
(四)健全(quan)個(ge)人信息行政法保(bao)護(hu)的救濟制度
目前(qian)行(xing)(xing)(xing)政(zheng)(zheng)訴(su)訟(song)與行(xing)(xing)(xing)政(zheng)(zheng)復(fu)(fu)議(yi),是(shi)(shi)我國對于個(ge)(ge)人(ren)(ren)信(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)行(xing)(xing)(xing)政(zheng)(zheng)法保護(hu)的(de)(de)(de)(de)主(zhu)要救(jiu)濟(ji)方(fang)式,但面(mian)對大數(shu)(shu)據時代的(de)(de)(de)(de)新形勢,上述(shu)救(jiu)濟(ji)方(fang)式常(chang)難(nan)以(yi)發揮(hui)作(zuo)(zuo)用(yong)。所(suo)以(yi),應進(jin)一(yi)步(bu)更(geng)新、完善行(xing)(xing)(xing)政(zheng)(zheng)法救(jiu)濟(ji)制度,跟上時代發展。例(li)如網絡安全法,通過對國際(ji)先(xian)進(jin)理(li)念的(de)(de)(de)(de)借(jie)鑒,融(rong)入“數(shu)(shu)字(zi)遺(yi)忘權”這(zhe)一(yi)內涵,使個(ge)(ge)人(ren)(ren)信(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)保護(hu)效(xiao)果得(de)以(yi)提(ti)升。其(qi)含義是(shi)(shi)信(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)主(zhu)體(ti)(ti)在查閱個(ge)(ge)人(ren)(ren)信(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)時,如果出現(xian)信(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)不符合現(xian)實情況(kuang)或(huo)信(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)失效(xiao)的(de)(de)(de)(de)情況(kuang),就可主(zhu)張數(shu)(shu)字(zi)遺(yi)忘權,要求(qiu)行(xing)(xing)(xing)政(zheng)(zheng)主(zhu)體(ti)(ti)刪除(chu)信(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)。如果行(xing)(xing)(xing)政(zheng)(zheng)主(zhu)體(ti)(ti)拒絕,就可采用(yong)行(xing)(xing)(xing)政(zheng)(zheng)訴(su)訟(song)或(huo)復(fu)(fu)議(yi)的(de)(de)(de)(de)方(fang)式,使自身合法權益(yi)得(de)以(yi)維護(hu),這(zhe)無疑是(shi)(shi)進(jin)一(yi)步(bu)補(bu)充傳統(tong)救(jiu)濟(ji)。其(qi)與我國的(de)(de)(de)(de)刪除(chu)權相似,但差異也較為(wei)明顯,同時倘若信(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)采集環節發生泄露問題,難(nan)以(yi)發揮(hui)刪除(chu)權的(de)(de)(de)(de)作(zuo)(zuo)用(yong)。所(suo)以(yi),為(wei)使個(ge)(ge)人(ren)(ren)信(xin)(xin)(xin)息(xi)(xi)(xi)(xi)(xi)得(de)到更(geng)好保護(hu),應對法律體(ti)(ti)系中的(de)(de)(de)(de)刪除(chu)權范疇(chou)做進(jin)一(yi)步(bu)拓展,更(geng)好落實行(xing)(xing)(xing)政(zheng)(zheng)法保護(hu)。
五、結束語
在大(da)數據時代下(xia),個(ge)人(ren)(ren)信息安全也因此(ci)面臨著更大(da)的(de)風險,為改善(shan)公民個(ge)人(ren)(ren)信息頻(pin)頻(pin)被泄露與(yu)(yu)非法(fa)使用(yong)的(de)現狀(zhuang),需(xu)要(yao)明確(que)當(dang)前行(xing)政(zheng)法(fa)保(bao)護存在的(de)不足,據此(ci)探(tan)索可行(xing)的(de)改善(shan)策略,以良好發揮行(xing)政(zheng)法(fa)對個(ge)人(ren)(ren)信息的(de)保(bao)護作用(yong),確(que)保(bao)所有(you)公民的(de)財產安全與(yu)(yu)生命健(jian)康。
