一、高度重視解決拖欠農民工工資問題

二、明確(que)目標,開(kai)展專項(xiang)檢查

為(wei)確保農民(min)工(gong)工(gong)資(zi)(zi)(zi)按(an)(an)時足額發放,決定(ding)從現在至(zhi)期間(jian),在全區(qu)范圍內(nei)開展一次清理(li)拖(tuo)欠農民(min)工(gong)工(gong)資(zi)(zi)(zi)專項(xiang)檢查(cha)(cha)活動。檢查(cha)(cha)內(nei)容主要是用人單位按(an)(an)照國(guo)家工(gong)資(zi)(zi)(zi)支付(fu)和最低工(gong)資(zi)(zi)(zi)規(gui)定(ding)支付(fu)職(zhi)工(gong)工(gong)資(zi)(zi)(zi)的情況。專項(xiang)檢查(cha)(cha)分二個階(jie)段進行:

第一(yi)階段(duan)為(wei)自查(cha)階段(duan)(12月(yue)18日(ri)前)。各鎮(zhen)(街道)、園(yuan)區和區直有關(guan)部門要(yao)根據通知要(yao)求(qiu),開展檢(jian)(jian)查(cha)工(gong)(gong)作,掌握了解用人單(dan)位(wei)拖欠職工(gong)(gong)工(gong)(gong)資(zi)(zi)情(qing)況(kuang)(拖欠職工(gong)(gong)工(gong)(gong)資(zi)(zi)的數量及規模),有針(zhen)對性(xing)地采取預(yu)警措施,對存(cun)在克扣、無故拖欠職工(gong)(gong)工(gong)(gong)資(zi)(zi)現象的,要(yao)責令用人單(dan)位(wei)籌集(ji)資(zi)(zi)金,按(an)時(shi)足額補(bu)發,防止欠薪事件的發生。各鎮(zhen)(街道)和園(yuan)區要(yao)在轄(xia)區內積(ji)極開展檢(jian)(jian)查(cha)工(gong)(gong)作,督促用人單(dan)位(wei)按(an)照(zhao)職工(gong)(gong)工(gong)(gong)資(zi)(zi)發放的規定查(cha)漏補(bu)缺,認真填寫(xie)《用人單(dan)位(wei)工(gong)(gong)資(zi)(zi)支付情(qing)況(kuang)自查(cha)自糾登記表》。自查(cha)結束后,各鎮(zhen)(街道)、各園(yuan)區要(yao)把檢(jian)(jian)查(cha)情(qing)況(kuang)匯總后,填寫(xie)《農民(min)工(gong)(gong)工(gong)(gong)資(zi)(zi)支付專項(xiang)檢(jian)(jian)查(cha)統計(ji)表》,于12月(yue)18日(ri)前報(bao)區勞動局。

第二(er)階段(duan)(duan)為重點檢(jian)查(cha)階段(duan)(duan)(12月18日至)。根據欠薪(xin)排查(cha)和(he)群(qun)眾舉(ju)報(bao)投訴的情況,確定(ding)重點檢(jian)查(cha)對(dui)象,區政府將(jiang)成立農民(min)工(gong)工(gong)資清(qing)欠專項檢(jian)查(cha)組,加大對(dui)舉(ju)報(bao)投訴案(an)件的查(cha)處力度(du),對(dui)無故拖欠和(he)克扣農民(min)工(gong)工(gong)資數額大、時(shi)間(jian)長、性質惡劣的用(yong)人單位,在依法進行處理的同(tong)時(shi),還要給(gei)予通報(bao)或在媒體上曝(pu)光(guang)。

三、加強領導,落(luo)實(shi)責任

一個(ge)民工(gong)打來的求助電話

2013年6月(yue)初,劉昌偉(wei)的(de)(de)一(yi)位老(lao)鄉找到他,說大(da)理賓川縣有(you)一(yi)個電力工(gong)(gong)程施(shi)工(gong)(gong)項目需要大(da)量的(de)(de)工(gong)(gong)人(ren)(ren),對方開(kai)出(chu)了一(yi)個月(yue)6000元(yuan)的(de)(de)工(gong)(gong)資(zi),還管吃住(zhu),問他能不能找人(ren)(ren)過(guo)去一(yi)起干。

劉昌偉覺(jue)得雖然施(shi)工(gong)的(de)(de)地方離自(zi)己的(de)(de)老家四川省(sheng)遠了(le)些(xie),但覺(jue)得對方開(kai)的(de)(de)待(dai)遇還不(bu)錯(cuo),決(jue)定到(dao)那邊(bian)去(qu)干半年(nian)。隨后他聯系(xi)了(le)幾位平時(shi)做工(gong)的(de)(de)時(shi)候(hou)認識的(de)(de)工(gong)友(you)和(he)老鄉,大家也都覺(jue)得可以(yi)過(guo)去(qu)干幾個月,于是一伙人(ren)買(mai)了(le)車票(piao)坐(zuo)到(dao)賓(bin)川縣,并和(he)自(zi)稱(cheng)為(wei)項目負責人(ren)的(de)(de)包工(gong)頭見了(le)面。

這(zhe)位(wei)包工(gong)頭(tou)讓他們安心跟著他干(gan),到年底(di)會把每個(ge)月6000元(yuan)的工(gong)資一分也不少地(di)結(jie)給他們。看到包工(gong)頭(tou)如此(ci)豪爽,大家也就安心地(di)在(zai)工(gong)地(di)上干(gan)了起來。然(ran)而,這(zhe)一切(qie)都只(zhi)是口頭(tou)約定,并沒有簽訂(ding)正(zheng)式的勞動(dong)合同或(huo)是可以證(zheng)明用工(gong)關系的書面材料(liao)。

轉眼到(dao)了年底(di),電力工(gong)程也基本完工(gong)了,考慮(lv)到(dao)在外辛苦(ku)了一年,再加上大家的(de)(de)老家都在四川、昭通等地,所以大家決定早點找包工(gong)頭(tou)把工(gong)資(zi)結了回家過年。大家相互合計(ji)了一下,50多位工(gong)人干的(de)(de)時間長的(de)(de)能拿到(dao)3萬多的(de)(de)工(gong)資(zi),干的(de)(de)短的(de)(de)也有好幾千元。

可是(shi)包工(gong)頭的(de)一番話卻把他們回家過年(nian)的(de)高興勁一下子全(quan)澆滅了,這位(wei)包工(gong)頭告訴大家由于(yu)(yu)項目部(bu)還沒有把工(gong)程款結算下來,所(suo)以民工(gong)們的(de)工(gong)資暫時還拿不到,至(zhi)于(yu)(yu)什(shen)么(me)時候能(neng)拿到,他也不清楚。

大家(jia)都以為可(ke)能推遲(chi)一兩(liang)天(tian)工(gong)(gong)(gong)(gong)程款(kuan)肯定就(jiu)會(hui)撥(bo)下來了(le)(le),那就(jiu)再等兩(liang)天(tian)也無妨,也就(jiu)沒有再過(guo)分糾纏(chan)這(zhe)位包工(gong)(gong)(gong)(gong)頭(tou)(tou)。但(dan)是(shi)好幾(ji)(ji)天(tian)過(guo)去了(le)(le),他(ta)們盼望(wang)的工(gong)(gong)(gong)(gong)程款(kuan)還是(shi)遲(chi)遲(chi)不到(dao),這(zhe)位包工(gong)(gong)(gong)(gong)頭(tou)(tou)也開始刻意躲著他(ta)們。再聯想到(dao)其他(ta)項目的工(gong)(gong)(gong)(gong)人前幾(ji)(ji)天(tian)就(jiu)已經拿到(dao)工(gong)(gong)(gong)(gong)錢回家(jia)了(le)(le),大家(jia)才(cai)隱隱覺得此事必有蹊(xi)蹺。

再一次找到(dao)包(bao)工(gong)(gong)頭被以(yi)同樣的(de)(de)原因搪塞(sai)后(hou),工(gong)(gong)人(ren)們決定(ding)到(dao)項(xiang)目(mu)部(bu)去問個(ge)究竟(jing)。沒想(xiang)到(dao)項(xiang)目(mu)部(bu)的(de)(de)工(gong)(gong)作人(ren)員對他(ta)(ta)們說工(gong)(gong)程款早就已經結(jie)算給各(ge)個(ge)項(xiang)目(mu)的(de)(de)負責人(ren)了,讓(rang)他(ta)(ta)們直接去找包(bao)工(gong)(gong)頭要工(gong)(gong)資,項(xiang)目(mu)部(bu)只負責和項(xiang)目(mu)負責人(ren)對接,而且他(ta)(ta)們也(ye)無法提供有(you)效(xiao)的(de)(de)證據證明項(xiang)目(mu)部(bu)拖欠他(ta)(ta)們工(gong)(gong)資。

接下(xia)來(lai)的十多天時(shi)間里,工人(ren)們分別(bie)多次找了項目部和包工頭,但都被雙(shuang)方反復地當(dang)作皮球一(yi)樣踢來(lai)踢去,工資的事遲遲沒(mei)有(you)著(zhu)落。

“懷揣著理想在外(wai)闖蕩,酸甜苦辣(la)不(bu)愿對人(ren)講”,當(dang)這(zhe)首平時(shi)大(da)家(jia)(jia)都(dou)(dou)很喜歡聽的(de)歌曲《有(you)錢(qian)沒錢(qian)回(hui)家(jia)(jia)過年(nian)(nian)》的(de)旋(xuan)律(lv)再次響起的(de)時(shi)候,大(da)家(jia)(jia)的(de)心里仿佛被針(zhen)狠狠地扎了(le)一下,他(ta)們(men)辛辛苦苦干(gan)了(le)大(da)半年(nian)(nian)就是為(wei)了(le)掙(zheng)到(dao)錢(qian)回(hui)家(jia)(jia)過年(nian)(nian),但(dan)是如今卻拿不(bu)到(dao)本該屬于(yu)自己回(hui)家(jia)(jia)過年(nian)(nian)的(de)錢(qian),就目前的(de)情況來(lai)看,連回(hui)家(jia)(jia)的(de)車費錢(qian)都(dou)(dou)不(bu)可能拿到(dao)。每當(dang)家(jia)(jia)里人(ren)打電話詢問什么時(shi)候回(hui)去的(de)時(shi)候,他(ta)們(men)都(dou)(dou)只能撒(sa)謊說再過兩天就回(hui)。但(dan)內(nei)心深處希望過兩天就真的(de)能把工資(zi)要回(hui)來(lai),雖然他(ta)們(men)也知(zhi)道這(zhe)個希望很渺(miao)茫。

萬般無奈之下,劉(liu)昌偉撥打了賓川(chuan)縣人(ren)力資(zi)源和社會保障局勞(lao)動保障監察(cha)大(da)隊的(de)電話,雖然他對這(zhe)根最后(hou)的(de)救命稻草沒報多(duo)大(da)的(de)希(xi)望(wang),但(dan)從內心深處他還是多(duo)么希(xi)望(wang)相關(guan)部門能夠為他們撐腰(yao),出面幫(bang)助他們把工資(zi)討回來。此時,離過春節只有不到半個(ge)月的(de)時間了,再遲幾(ji)天(tian),他們就很可能買(mai)不到回家的(de)火車票了。

24萬元的工資去哪(na)了(le)?

接到舉報電(dian)話之后,賓川縣人(ren)社局(ju)立(li)即召集縣總(zong)工(gong)會、公安(an)局(ju)、住建局(ju)等(deng)部門組(zu)(zu)成調(diao)查(cha)組(zu)(zu)進(jin)行(xing)調(diao)查(cha)。經查(cha)實,該電(dian)力工(gong)程(cheng)不僅涉(she)嫌拖欠(qian)農(nong)民工(gong)工(gong)資(zi),且非法層層轉包工(gong)程(cheng)的行(xing)為也讓調(diao)查(cha)組(zu)(zu)工(gong)作人(ren)員大吃一驚。

在(zai)接(jie)到劉昌偉的(de)舉(ju)報(bao)電話(hua)前,賓川(chuan)縣人力資源部門根本(ben)查不到工(gong)(gong)程主管(guan)部門報(bao)備的(de)用(yong)(yong)工(gong)(gong)資料,也(ye)就是(shi)說如果不是(shi)劉昌偉的(de)舉(ju)報(bao),當地的(de)人力資源部門根本(ben)就不知(zhi)道賓川(chuan)縣有這樣(yang)一個(ge)用(yong)(yong)工(gong)(gong)單位(wei)在(zai)施工(gong)(gong),更談不上對其用(yong)(yong)工(gong)(gong)行為進(jin)行監督和管(guan)理。

通過(guo)查閱(yue)相關文件和資料,工(gong)(gong)作人員發(fa)現(xian)涉嫌(xian)拖欠農(nong)民(min)工(gong)(gong)工(gong)(gong)資的(de)工(gong)(gong)程為賓川縣干塘子并網光伏(fu)電(dian)站35kv輸出(chu)線(xian)路,文件上顯示負責(ze)總承包(bao)建設該工(gong)(gong)程的(de)是云南省電(dian)力設計院。

調查組根據(ju)劉(liu)昌偉、劉(liu)志洪(hong)等農民工(gong)介紹的(de)情況(kuang),找到了拖欠他們工(gong)資的(de)負責(ze)人,結果發現該負責(ze)人只是負責(ze)該電力工(gong)程其中(zhong)一個項目的(de)包工(gong)頭(tou)。

通過(guo)詢(xun)問調查組了解到(dao),這(zhe)位包(bao)(bao)工(gong)(gong)頭(tou)負責的項(xiang)目又是從(cong)其他包(bao)(bao)工(gong)(gong)頭(tou)手里承包(bao)(bao)過(guo)來的。工(gong)(gong)程經過(guo)層層轉包(bao)(bao)之后,這(zhe)些包(bao)(bao)工(gong)(gong)頭(tou)均沒有施(shi)工(gong)(gong)資質。關于拖欠農民工(gong)(gong)工(gong)(gong)資的問題(ti),這(zhe)些包(bao)(bao)工(gong)(gong)頭(tou)一致表示他們沒有拿到(dao)上面撥付的工(gong)(gong)程款,所以沒辦(ban)法給(gei)大(da)家(jia)開工(gong)(gong)資。

然而,調(diao)查(cha)組到工(gong)(gong)程(cheng)項(xiang)(xiang)目(mu)部調(diao)查(cha)時得到的(de)(de)卻(que)又是另外一(yi)種說法:“我們的(de)(de)工(gong)(gong)程(cheng)款在扣(kou)除質保金之后已經(jing)足額結(jie)算給各個項(xiang)(xiang)目(mu)的(de)(de)負(fu)責人(ren)了,根本不(bu)存在拖欠(qian)農民工(gong)(gong)工(gong)(gong)資的(de)(de)情況。”項(xiang)(xiang)目(mu)部一(yi)位叫(jiao)李開燦(can)的(de)(de)臨時負(fu)責人(ren)對調(diao)查(cha)組的(de)(de)工(gong)(gong)作人(ren)員說。而他口(kou)中(zhong)(zhong)的(de)(de)所謂項(xiang)(xiang)目(mu)負(fu)責人(ren),就是上文中(zhong)(zhong)沒有施工(gong)(gong)資質的(de)(de)包工(gong)(gong)頭(tou)。

一邊是(shi)包工(gong)(gong)頭說項目部沒(mei)有結算工(gong)(gong)資(zi)(zi),另(ling)一邊項目部又說工(gong)(gong)資(zi)(zi)已經足額結算給包工(gong)(gong)頭,但(dan)是(shi)50余名農民工(gong)(gong)確實沒(mei)有拿到工(gong)(gong)資(zi)(zi)。那么,24萬的農民工(gong)(gong)工(gong)(gong)資(zi)(zi)到底去哪了?

為(wei)了盡快幫助50余名農(nong)民工討回工資,讓他們能夠(gou)順利回家過(guo)年,調查組決定(ding)特事特辦,指派縣勞(lao)動保障監察大(da)隊(dui)(dui)的(de)大(da)隊(dui)(dui)長王解帶領(ling)隊(dui)(dui)員何月秋立(li)刻召(zhao)集(ji)工程施工單位項目部(bu)負責人(ren)、包工頭和被(bei)拖欠(qian)(qian)工資的(de)農(nong)民工代(dai)表召(zhao)開協(xie)調會(hui),查清拖欠(qian)(qian)的(de)24萬(wan)元(yuan)農(nong)民工工資去向。

通(tong)過(guo)三方(fang)的(de)(de)(de)當堂對質,最終查明工程(cheng)項(xiang)目(mu)部(bu)的(de)(de)(de)確已經(jing)把工程(cheng)款足額(e)支付給各(ge)個項(xiang)目(mu)的(de)(de)(de)負責(ze)人(即包(bao)(bao)(bao)工頭),但是由于包(bao)(bao)(bao)工頭逐級把項(xiang)目(mu)進行(xing)層層轉包(bao)(bao)(bao),再加(jia)上(shang)管理不善,導(dao)(dao)致所承包(bao)(bao)(bao)的(de)(de)(de)項(xiang)目(mu)出(chu)現虧(kui)損,無奈之下只(zhi)得挪用農(nong)民工的(de)(de)(de)工資來彌補虧(kui)損,也就直(zhi)接(jie)導(dao)(dao)致拖欠農(nong)民工工資事件的(de)(de)(de)發生。

兩(liang)天就拿到工(gong)錢回家過年

拖(tuo)欠(qian)(qian)農民工(gong)(gong)工(gong)(gong)資(zi)的(de)事實和原因都已經查清(qing)楚,但是由于包工(gong)(gong)頭(tou)已經將(jiang)(jiang)拖(tuo)欠(qian)(qian)的(de)工(gong)(gong)資(zi)用來(lai)(lai)彌(mi)補虧損,導致其無法拿出這么多錢來(lai)(lai)支付(fu)農民工(gong)(gong)的(de)工(gong)(gong)資(zi),如何將(jiang)(jiang)拖(tuo)欠(qian)(qian)的(de)工(gong)(gong)資(zi)及時討(tao)要回來(lai)(lai)也(ye)就(jiu)成(cheng)了調查組面(mian)臨的(de)最大困難。

此(ci)次(ci)事(shi)件中,無(wu)論拖(tuo)欠農民(min)工工資(zi)的原因是什么,最無(wu)辜的受(shou)害(hai)者都(dou)是50余位(wei)農民(min)工。通(tong)過對(dui)相關法律的研究和協(xie)商(shang),調查組最終決定無(wu)論如(ru)何都(dou)要優先保證農民(min)工拿(na)到被拖(tuo)欠的工資(zi),如(ru)果(guo)包(bao)工頭拿(na)不出(chu)這(zhe)筆錢來,就要求項目部把這(zhe)筆錢拿(na)出(chu)來,至于最終誰該擔責(ze),可以(yi)下一步再作調查。

不過(guo)要(yao)求項目部先墊資(zi)支付(fu)農(nong)民工(gong)工(gong)資(zi)的要(yao)求遭到了項目部的拒(ju)絕,他(ta)們認為過(guo)失(shi)不在他(ta)們身上,不應該(gai)出這筆錢。

面對項(xiang)目部(bu)(bu)的斷然拒絕(jue),調查組工(gong)(gong)(gong)(gong)(gong)作人員(yuan)并沒(mei)(mei)有(you)(you)放棄(qi),而(er)是依據《勞(lao)動(dong)法(fa)(fa)》、《勞(lao)動(dong)合同法(fa)(fa)》、《農(nong)民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)支付(fu)保障規定(ding)》等(deng)法(fa)(fa)律法(fa)(fa)規對施(shi)(shi)工(gong)(gong)(gong)(gong)(gong)單(dan)位(wei)的違法(fa)(fa)行為(wei)逐條指(zhi)出(chu)。首先,施(shi)(shi)工(gong)(gong)(gong)(gong)(gong)單(dan)位(wei)將工(gong)(gong)(gong)(gong)(gong)程項(xiang)目承包(bao)給沒(mei)(mei)有(you)(you)施(shi)(shi)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)質(zhi)的包(bao)工(gong)(gong)(gong)(gong)(gong)頭本身就(jiu)是違法(fa)(fa)行為(wei);其(qi)次施(shi)(shi)工(gong)(gong)(gong)(gong)(gong)單(dan)位(wei)沒(mei)(mei)有(you)(you)依據相(xiang)關(guan)規定(ding)按(an)中標(biao)價的3%繳(jiao)納農(nong)民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)保證(zheng)金,涉(she)及勞(lao)務用(yong)工(gong)(gong)(gong)(gong)(gong)也(ye)沒(mei)(mei)有(you)(you)在相(xiang)關(guan)勞(lao)動(dong)主管部(bu)(bu)門(men)備案(an);再(zai)次,拖欠農(nong)民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)的行為(wei)可以直接追究施(shi)(shi)工(gong)(gong)(gong)(gong)(gong)單(dan)位(wei)負(fu)責(ze)人的法(fa)(fa)律責(ze)任(ren),若項(xiang)目部(bu)(bu)拒絕(jue)支付(fu)拖欠的工(gong)(gong)(gong)(gong)(gong)資(zi)(zi),勞(lao)動(dong)執法(fa)(fa)部(bu)(bu)門(men)將直接追究云(yun)南省電力(li)設計院相(xiang)關(guan)負(fu)責(ze)人的法(fa)(fa)律責(ze)任(ren)。

經過調查組工(gong)作人員的(de)(de)法律法規宣傳教育,項(xiang)目部負責人終于(yu)意(yi)識到自身的(de)(de)過失(shi),同意(yi)先墊付(fu)(fu)資金支付(fu)(fu)被拖欠(qian)的(de)(de)農民(min)工(gong)工(gong)資。為了防止項(xiang)目部找(zhao)理由拖延支付(fu)(fu)的(de)(de)時間,調查組工(gong)作人員要求現(xian)場(chang)監督其足額支付(fu)(fu)。

最(zui)終,項目部現場(chang)墊付了(le)24萬資金足額(e)結清了(le)50余位農民工的工資,就連其(qi)中(zhong)一些工人(ren)的工資總數存在爭議的,也都按照工人(ren)們的要求足額(e)支(zhi)付了(le)。

一、專(zhuan)項(xiang)檢(jian)查的范圍、內容和目(mu)標

專項檢查范圍包括使用(yong)農民工(gong)的各類用(yong)人(ren)單(dan)位,特別是招用(yong)農民工(gong)較多的國家(jia)工(gong)程、建(jian)筑(zhu)工(gong)程以(yi)及曾經(jing)發生(sheng)拖欠工(gong)資和(he)生(sheng)產經(jing)營有(you)困(kun)難的企業等(deng)。

專項檢查內容:用人單位按照工資(zi)(zi)支付(fu)有關規定(ding)支付(fu)農民(min)工工資(zi)(zi)情(qing)況(kuang)(kuang)、遵守最低工資(zi)(zi)規定(ding)情(qing)況(kuang)(kuang)及依(yi)法(fa)支付(fu)加班工資(zi)(zi)情(qing)況(kuang)(kuang);企(qi)業經營者拖欠農民(min)工工資(zi)(zi)逃匿情(qing)況(kuang)(kuang);用人單位與(yu)農民(min)工簽訂勞動合同情(qing)況(kuang)(kuang)等。

檢查主要目標:保證春節前涉及農(nong)民工(gong)工(gong)資(zi)案件基(ji)本結案,基(ji)本得到控制。

二(er)、專項檢(jian)查時間安(an)排

專項(xiang)檢查時(shi)間為,分三個階段(duan)進行(xing):

(一)宣(xuan)傳自(zi)查階段(duan)。采用(yong)多種形(xing)式(shi)(shi),廣泛宣(xuan)傳解決拖欠農(nong)民工(gong)(gong)工(gong)(gong)資(zi)問題的(de)重要(yao)意(yi)義,普及《勞(lao)(lao)動(dong)法(fa)(fa)》、《勞(lao)(lao)動(dong)合同法(fa)(fa)》、《勞(lao)(lao)動(dong)保障監察(cha)條例》、《工(gong)(gong)資(zi)支(zhi)付(fu)(fu)(fu)暫行(xing)規定》、《建(jian)設領域(yu)農(nong)民工(gong)(gong)工(gong)(gong)資(zi)支(zhi)付(fu)(fu)(fu)管理暫行(xing)辦法(fa)(fa)》等(deng)法(fa)(fa)律(lv)法(fa)(fa)規知(zhi)(zhi)識,通過送(song)法(fa)(fa)律(lv)知(zhi)(zhi)識上門、設立農(nong)民工(gong)(gong)維權(quan)(quan)告示牌、張(zhang)貼(tie)相關宣(xuan)傳品等(deng)形(xing)式(shi)(shi),提(ti)高廣大農(nong)民工(gong)(gong)運用(yong)法(fa)(fa)律(lv)手段(duan)維護自(zi)身(shen)合法(fa)(fa)權(quan)(quan)益(yi)的(de)意(yi)識和能力,營(ying)造(zao)維護農(nong)民工(gong)(gong)合法(fa)(fa)權(quan)(quan)益(yi)的(de)法(fa)(fa)制環境。同時(shi),用(yong)人單位要(yao)對年(nian)1月以(yi)來(lai)工(gong)(gong)資(zi)支(zhi)付(fu)(fu)(fu)情況認(ren)真開(kai)展自(zi)查,主動(dong)糾正存(cun)在的(de)問題。

(二)執法(fa)檢查(cha)(cha)階段。勞(lao)動、住建、公安(an)、國資、工商、工會(hui)等部門要組(zu)成聯合執法(fa)檢查(cha)(cha)組(zu),集中(zhong)力量(liang)對(dui)用(yong)人單位(wei)進(jin)行檢查(cha)(cha),對(dui)重點行業、重點區域及發(fa)(fa)(fa)生(sheng)過拖欠農民工工資問題的(de)用(yong)人單位(wei)進(jin)行重點督(du)查(cha)(cha),對(dui)發(fa)(fa)(fa)現(xian)的(de)問題,及時處理。對(dui)檢查(cha)(cha)中(zhong)發(fa)(fa)(fa)現(xian)的(de)非(fei)法(fa)用(yong)工、限制人身自(zi)由、強迫勞(lao)動等嚴重違法(fa)行為(wei),要依法(fa)及時查(cha)(cha)處。

(三)分析總結階段。各(ge)地對專項(xiang)檢(jian)查中發(fa)現的(de)問題(ti)要進行匯總分析,梳理(li)存在的(de)問題(ti),提出解決問題(ti)的(de)對策(ce)及政策(ce)建議,并(bing)及時將專項(xiang)檢(jian)查情況表及書面總結報區專項(xiang)檢(jian)查領導小組(zu)辦(ban)公室。

三、工作要求

(一)高度重視(shi),加(jia)強領(ling)導。勞(lao)動、住建(jian)、公安、國(guo)資(zi)(zi)(zi)、工(gong)(gong)(gong)商、工(gong)(gong)(gong)會(hui)組(zu)織(zhi)要(yao)(yao)(yao)充分認(ren)識解(jie)(jie)(jie)決拖欠(qian)(qian)(qian)(qian)農(nong)(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)(zi)問題(ti)的(de)重要(yao)(yao)(yao)意義,認(ren)真貫徹國(guo)務院、省政(zheng)府(fu)和市政(zheng)府(fu)關(guan)于解(jie)(jie)(jie)決農(nong)(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)(zi)問題(ti)文(wen)件(jian)精(jing)神,切(qie)實按照“政(zheng)府(fu)主管(guan)、屬地(di)(di)管(guan)理、行業(ye)(ye)歸口”的(de)原則,把預防和解(jie)(jie)(jie)決企(qi)業(ye)(ye)拖欠(qian)(qian)(qian)(qian)農(nong)(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)(zi)問題(ti)作為(wei)當前一項(xiang)重要(yao)(yao)(yao)而緊迫的(de)任務抓(zhua)緊抓(zhua)細,高度重視(shi),精(jing)心(xin)安排,切(qie)實組(zu)織(zhi)好專項(xiang)檢查工(gong)(gong)(gong)作。各(ge)地(di)(di)要(yao)(yao)(yao)建(jian)立健全解(jie)(jie)(jie)決拖欠(qian)(qian)(qian)(qian)農(nong)(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)(zi)問題(ti)的(de)相關(guan)工(gong)(gong)(gong)作機制(zhi),并設專人(ren)負責(ze)此項(xiang)工(gong)(gong)(gong)作,確保聯絡渠道暢通,積(ji)極(ji)應對和妥善處置因拖欠(qian)(qian)(qian)(qian)農(nong)(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)(zi)引(yin)發的(de)。

(二)密切配(pei)合,齊抓共管(guan)(guan)。區勞(lao)(lao)(lao)動(dong)(dong)、住建(jian)、公安(an)、國(guo)(guo)(guo)資(zi)(zi)(zi)、工(gong)(gong)(gong)(gong)商、工(gong)(gong)(gong)(gong)會等部門(men)(men)(men)(men)要成立專項檢查(cha)(cha)(cha)領導(dao)小(xiao)組,加強對(dui)此項工(gong)(gong)(gong)(gong)作(zuo)的(de)(de)(de)檢查(cha)(cha)(cha)督辦,并結合實(shi)(shi)際明確檢查(cha)(cha)(cha)方案,落實(shi)(shi)工(gong)(gong)(gong)(gong)作(zuo)任(ren)務。勞(lao)(lao)(lao)動(dong)(dong)保(bao)(bao)(bao)障(zhang)(zhang)部門(men)(men)(men)(men)要加強對(dui)解決企業(ye)(ye)(ye)(ye)拖(tuo)(tuo)(tuo)欠(qian)農(nong)民(min)(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)問題(ti)的(de)(de)(de)組織(zhi)協調和(he)督促檢查(cha)(cha)(cha),加大勞(lao)(lao)(lao)動(dong)(dong)保(bao)(bao)(bao)障(zhang)(zhang)監(jian)察(cha)執法(fa)(fa)(fa)和(he)勞(lao)(lao)(lao)動(dong)(dong)爭議(yi)調處力度(du);發(fa)改、監(jian)察(cha)、財政(zheng)等部門(men)(men)(men)(men)和(he)工(gong)(gong)(gong)(gong)會要按照職(zhi)責(ze)分工(gong)(gong)(gong)(gong),積極做好解決建(jian)設領域拖(tuo)(tuo)(tuo)欠(qian)工(gong)(gong)(gong)(gong)程(cheng)款及企業(ye)(ye)(ye)(ye)拖(tuo)(tuo)(tuo)欠(qian)農(nong)民(min)(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)相關工(gong)(gong)(gong)(gong)作(zuo);住建(jian)、交通、水利和(he)鐵路等行(xing)(xing)業(ye)(ye)(ye)(ye)主管(guan)(guan)部門(men)(men)(men)(men)要切實(shi)(shi)履行(xing)(xing)行(xing)(xing)業(ye)(ye)(ye)(ye)管(guan)(guan)理(li)(li)責(ze)任(ren),監(jian)督企業(ye)(ye)(ye)(ye)落實(shi)(shi)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)支(zhi)付保(bao)(bao)(bao)障(zhang)(zhang)金制度(du),并牽頭處理(li)(li)本行(xing)(xing)業(ye)(ye)(ye)(ye)內(nei)因拖(tuo)(tuo)(tuo)欠(qian)農(nong)民(min)(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)引發(fa)的(de)(de)(de)群體性突發(fa)事(shi)件;公安(an)部門(men)(men)(men)(men)要負(fu)責(ze)調查(cha)(cha)(cha)處理(li)(li)涉嫌《中華(hua)人(ren)民(min)(min)共和(he)國(guo)(guo)(guo)刑法(fa)(fa)(fa)修(xiu)正案(八)》規定的(de)(de)(de)拒不(bu)支(zhi)付勞(lao)(lao)(lao)動(dong)(dong)報酬罪的(de)(de)(de)行(xing)(xing)為(wei),協助(zhu)(zhu)處理(li)(li)拖(tuo)(tuo)(tuo)欠(qian)農(nong)民(min)(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)引發(fa)的(de)(de)(de);工(gong)(gong)(gong)(gong)商行(xing)(xing)政(zheng)管(guan)(guan)理(li)(li)部門(men)(men)(men)(men)要依照《勞(lao)(lao)(lao)動(dong)(dong)保(bao)(bao)(bao)障(zhang)(zhang)監(jian)察(cha)條例》的(de)(de)(de)相關規定負(fu)責(ze)依法(fa)(fa)(fa)取(qu)締檢查(cha)(cha)(cha)發(fa)現的(de)(de)(de)無照經營(ying)行(xing)(xing)為(wei);國(guo)(guo)(guo)資(zi)(zi)(zi)部門(men)(men)(men)(men)要負(fu)責(ze)協助(zhu)(zhu)勞(lao)(lao)(lao)動(dong)(dong)保(bao)(bao)(bao)障(zhang)(zhang)等有關部門(men)(men)(men)(men)處理(li)(li)國(guo)(guo)(guo)有企業(ye)(ye)(ye)(ye)及國(guo)(guo)(guo)有控(kong)股企業(ye)(ye)(ye)(ye)發(fa)生(sheng)的(de)(de)(de)拖(tuo)(tuo)(tuo)欠(qian)農(nong)民(min)(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)的(de)(de)(de)案件。

(三(san))認(ren)真執法(fa)(fa),嚴肅(su)處理(li)。各地各有關部(bu)門要按照(zhao)要求,認(ren)真組織專項檢查,對(dui)發現(xian)的(de)(de)(de)問(wen)(wen)題依(yi)法(fa)(fa)處理(li)。對(dui)存在拖(tuo)(tuo)欠(qian)(qian)工(gong)資問(wen)(wen)題的(de)(de)(de)用人單位,勞(lao)動(dong)和社會保障局要按照(zhao)《勞(lao)動(dong)保障監(jian)察條(tiao)例(li)》有關規(gui)(gui)定(ding)(ding),責(ze)令其(qi)改正(zheng),對(dui)拒不(bu)(bu)改正(zheng)的(de)(de)(de),處以罰款(kuan);對(dui)符合《中華人民(min)共(gong)和國刑(xing)法(fa)(fa)修正(zheng)案(an)(八)》規(gui)(gui)定(ding)(ding)的(de)(de)(de)拒不(bu)(bu)支付勞(lao)動(dong)報酬罪(zui)情(qing)形的(de)(de)(de)拖(tuo)(tuo)欠(qian)(qian)農民(min)工(gong)工(gong)資案(an)件,應(ying)依(yi)法(fa)(fa)及時向公安機關移交(jiao)。對(dui)惡意拖(tuo)(tuo)欠(qian)(qian)、情(qing)節嚴重的(de)(de)(de),可(ke)依(yi)法(fa)(fa)責(ze)令停業(ye)整頓、降低(di)或取消資質,直至吊銷營業(ye)執照(zhao)。對(dui)無故拖(tuo)(tuo)欠(qian)(qian)農民(min)工(gong)工(gong)資數(shu)額大、時間長(chang)、性質惡劣的(de)(de)(de)用人單位,在依(yi)法(fa)(fa)進行處理(li)的(de)(de)(de)同時,還要按照(zhao)《勞(lao)動(dong)保障監(jian)察條(tiao)例(li)》有關規(gui)(gui)定(ding)(ding)向社會公布。

一、我國農民工工資支付現狀

經濟高速發(fa)展帶(dai)來的負面問題(ti)之一就是建(jian)設領域農(nong)民工(gong)工(gong)資拖(tuo)欠(qian)問題(ti)。據(ju)統計,2013年(nian)以來,80%的欠(qian)薪來自建(jian)設領域。欠(qian)薪造成(cheng)大(da)規模群體(ti)上訪事件,尤其是在年(nian)末,情況越嚴(yan)重。2004年(nian)《建(jian)設領域農(nong)民工(gong)工(gong)資支付(fu)管(guan)理暫(zan)行辦法(fa)》出臺之后,各地紛(fen)紛(fen)加大(da)監督管(guan)理力度(du),新聞媒體(ti)及社(she)會組(zu)織也對此高度(du)關注,農(nong)民工(gong)工(gong)資拖(tuo)欠(qian)情況有所改(gai)善,但仍然還有很多問題(ti)亟待解(jie)決(jue)。

二、開(kai)發區農民工工資支付現狀(zhuang)

1.總體概況

開發區正(zheng)處于經濟發展的上坡路,建設項目不斷(duan)上馬,大批本地(di)及(ji)外地(di)的農民工(gong)進入建筑工(gong)程,隨之而(er)來的是(shi)農民工(gong)工(gong)資(zi)拖欠(qian)問(wen)題(ti)。

2.施(shi)工企(qi)業(ye)用工情況

主要是(shi)(shi)“包(bao)工(gong)(gong)(gong)頭(tou)”形式,包(bao)工(gong)(gong)(gong)頭(tou)個(ge)人組織小班(ban)組,小班(ban)組招(zhao)聘農民(min)工(gong)(gong)(gong),并進行(xing)管理,這種組織不規范、不合(he)法,沒有(you)施(shi)(shi)工(gong)(gong)(gong)資(zi)質,其通過借用其他單位資(zi)質或(huo)從有(you)資(zi)質的(de)單位承包(bao)工(gong)(gong)(gong)程。勞動合(he)同并不受(shou)重視(shi)。施(shi)(shi)工(gong)(gong)(gong)單位、包(bao)工(gong)(gong)(gong)頭(tou)、班(ban)組長、農民(min)工(gong)(gong)(gong)這個(ge)鏈條(tiao),通常是(shi)(shi)熟人、朋友、老鄉(xiang)的(de)關(guan)系(xi)鏈,之間的(de)關(guan)系(xi)靠傳統(tong)(tong)的(de)信(xin)義支(zhi)持而不是(shi)(shi)合(he)同,已(yi)成“行(xing)業慣例”。且鏈條(tiao)越往下越處于弱勢,農民(min)工(gong)(gong)(gong)想(xiang)簽合(he)同也會(hui)被(bei)輕易(yi)推(tui)脫。工(gong)(gong)(gong)資(zi)基(ji)本不是(shi)(shi)按(an)月(yue)支(zhi)付(fu)(fu),通常是(shi)(shi)到(dao)工(gong)(gong)(gong)程結束統(tong)(tong)一(yi)清(qing)算(suan),或(huo)是(shi)(shi)年底(di)按(an)量支(zhi)付(fu)(fu)部分工(gong)(gong)(gong)資(zi)。

三、建設領域農民工工資拖欠問(wen)題的成因(yin)

1.項目資金(jin)管理力度不足

為求經濟(ji)發(fa)(fa)展(zhan),對建設項(xiang)目往往有(you)扶持的(de)態度,在一(yi)些(xie)監管方面疏(shu)于要(yao)求,個別資金不(bu)足的(de)項(xiang)目上馬后,依靠建筑施工(gong)企業墊資建設,一(yi)旦資金鏈斷裂,不(bu)僅項(xiang)目本身(shen)發(fa)(fa)展(zhan)困(kun)難,還把(ba)危機轉到了農民(min)工(gong)身(shen)上。

2.建筑市場管理不規范(fan)

(1)建(jian)(jian)設(she)項目墊(dian)資(zi)(zi)現象(xiang)普遍建(jian)(jian)筑市(shi)場競爭激烈(lie),為求生存,出現了建(jian)(jian)筑企(qi)業(ye)墊(dian)資(zi)(zi)建(jian)(jian)設(she)的情況,建(jian)(jian)設(she)單位(wei)按進度給建(jian)(jian)筑施(shi)工(gong)(gong)公(gong)司付款(kuan)。一(yi)旦建(jian)(jian)設(she)單位(wei)資(zi)(zi)金緊張(zhang)、出現經濟糾紛或者其它(ta)意外(wai)情況,建(jian)(jian)設(she)單位(wei)拖(tuo)欠施(shi)工(gong)(gong)企(qi)業(ye)工(gong)(gong)程款(kuan),施(shi)工(gong)(gong)企(qi)業(ye)就會拖(tuo)欠農民(min)工(gong)(gong)工(gong)(gong)資(zi)(zi),以農民(min)工(gong)(gong)討薪來(lai)挾制建(jian)(jian)設(she)單位(wei)。

(2)建設工(gong)程(cheng)其他(ta)違法現(xian)象一是(shi)普遍(bian)存(cun)在層(ceng)層(ceng)轉包、分(fen)包的(de)現(xian)象,其中(zhong)任(ren)何一家參與(yu)者出(chu)現(xian)問題(ti),就導(dao)致整個鏈條崩潰;二(er)是(shi)普遍(bian)存(cun)在靠(kao)掛現(xian)象,有些(xie)沒有資(zi)質(zhi)或資(zi)質(zhi)不足的(de)施(shi)工(gong)企(qi)業或個人,通過靠(kao)掛在高資(zi)質(zhi)的(de)企(qi)業名下或借用資(zi)質(zhi)施(shi)工(gong)。這(zhe)兩種情況(kuang)都(dou)是(shi)不穩定的(de),容(rong)易(yi)出(chu)現(xian)經濟(ji)糾(jiu)紛,責任(ren)推(tui)諉,農民工(gong)討薪困(kun)難。

(3)保證金制度約(yue)(yue)束力低農民工(gong)(gong)工(gong)(gong)資支付保證金是(shi)保障底線,但施(shi)工(gong)(gong)企業主觀上并不(bu)(bu)主動繳(jiao)(jiao)納,加上客觀約(yue)(yue)束(行政監管、處罰、后續(xu)建設(she)手續(xu)制約(yue)(yue)等)不(bu)(bu)到(dao)位、力度不(bu)(bu)夠,導致保證金繳(jiao)(jiao)納無法(fa)保證。

(4)拖欠責(ze)(ze)任主(zhu)體(ti)不明確責(ze)(ze)任往往在建設單位、施工(gong)單位、包(bao)工(gong)頭(tou)之(zhi)間推諉,責(ze)(ze)任主(zhu)體(ti)很(hen)難界定。而且建設單位與施工(gong)單位之(zhi)間是(shi)經濟合同關系,不在勞動保障法律法規調整范(fan)圍,勞動監察(cha)部門(men)在處(chu)理此(ci)類問(wen)題時缺乏依據,這也(ye)是(shi)造成(cheng)“討薪難”的重(zhong)要原因。

(5)勞(lao)動監(jian)察執法力量(liang)不足一(yi)是(shi)勞(lao)動監(jian)察人力物力匱乏。目前,我縣(xian)勞(lao)動保障(zhang)監(jian)察機構1個(ge),工(gong)作(zuo)人員只(zhi)有個(ge)位數字(zi),處理上門投訴(su)的(de)事件還捉襟見肘,遑論進行全(quan)面無死角(jiao)的(de)循(xun)環檢查工(gong)作(zuo)。二是(shi)勞(lao)動監(jian)察缺少強(qiang)制執法手段,遭遇陽奉(feng)陰違、逃避執法的(de)用人單(dan)位,力度不足,難以(yi)有效解(jie)決。

四、建設領域農民工(gong)工(gong)資支付問題(ti)解(jie)決(jue)建議(yi)

我認為(wei)要解(jie)決拖(tuo)欠(qian)農民工工資問(wen)題,需(xu)從以下(xia)三方面著手:

1.施工(gong)前加強(qiang)項(xiang)目(mu)資(zi)金(jin)審(shen)查一要(yao)(yao)要(yao)(yao)嚴(yan)格審(shen)查項(xiang)目(mu)資(zi)金(jin)到位(wei)情況(kuang),對于資(zi)金(jin)不到位(wei)的項(xiang)目(mu)要(yao)(yao)堅(jian)決叫停(ting),且要(yao)(yao)加強(qiang)資(zi)金(jin)使(shi)用情況(kuang)的動態管理,常態檢查,避(bi)免驗資(zi)報(bao)告弄虛作假。二要(yao)(yao)將農民工(gong)工(gong)資(zi)保(bao)證金(jin)繳(jiao)(jiao)納(na)環節提前到項(xiang)目(mu)征地前某一節點,由(you)建設單位(wei)繳(jiao)(jiao)納(na),確保(bao)保(bao)證金(jin)在項(xiang)目(mu)落地前到位(wei)。

2.施(shi)工(gong)中杜絕違法(fa)(fa)操作要防止欠(qian)薪(xin)事件(jian)發生(sheng),關(guan)鍵(jian)就要加(jia)強對(dui)(dui)違法(fa)(fa)行為(wei)的監管力(li)度。要提高政府對(dui)(dui)欠(qian)薪(xin)事件(jian)的重視度,監管者(zhe)(zhe)的輕(qing)視,會使違規者(zhe)(zhe)更加(jia)肆無(wu)(wu)忌憚。要增(zeng)派人力(li),加(jia)大監察力(li)度,力(li)求(qiu)覆蓋所(suo)有(you)施(shi)工(gong)企(qi)業。對(dui)(dui)所(suo)有(you)施(shi)工(gong)項目和施(shi)工(gong)企(qi)業建立(li)檢查(cha)(cha)臺(tai)賬(zhang),避免漏查(cha)(cha)。要嚴格按照(zhao)相(xiang)關(guan)法(fa)(fa)律法(fa)(fa)規逐條(tiao)排查(cha)(cha),針對(dui)(dui)墊資(zi)(zi)施(shi)工(gong)、層層轉(zhuan)包、分包、無(wu)(wu)資(zi)(zi)質承攬建筑工(gong)程等違法(fa)(fa)行為(wei),立(li)即叫(jiao)停(ting),對(dui)(dui)涉及違法(fa)(fa)的建設單位、施(shi)工(gong)企(qi)業、個人按照(zhao)情結輕(qing)重,一(yi)一(yi)進行處(chu)罰。對(dui)(dui)于(yu)存在(zai)不(bu)簽訂(ding)合同、不(bu)按月發放(fang)工(gong)資(zi)(zi)的施(shi)工(gong)單位,嚴厲查(cha)(cha)處(chu),限期(qi)整(zheng)改,情節嚴重者(zhe)(zhe),列入黑(hei)名單,清出我縣建筑市場。

【關鍵詞】 民工(gong)(gong);工(gong)(gong)資拖欠;工(gong)(gong)資機制

近年來,民(min)工(gong)工(gong)資有所增(zeng)加(jia),但是(shi)雇(gu)主卻(que)經常拖欠民(min)工(gong)工(gong)資,致(zhi)使民(min)工(gong)的實際工(gong)資縮水。雖然(ran)也對該現象進行(xing)了(le)相關處理(li),但是(shi)至今(jin)為止拖欠民(min)工(gong)工(gong)資的現象依然(ran)存在[1]。為了(le)尋找解該問題的有效辦法,筆者對當(dang)前(qian)拖欠工(gong)資的現狀及特點進行(xing)了(le)相關分(fen)析與總結(jie),并(bing)最終提(ti)出了(le)合理(li)化建議。

1 拖欠民(min)工工資現狀及特點

1.1 民工文化水平偏低

在龐大的民工隊伍(wu)中,小學、初中文化程度占據了80%以(yi)上(shang)的比例,高中文化的僅為5%到(dao)7%左右,致使(shi)民工缺乏(fa)最基本法律常識。在其權(quan)益受(shou)到(dao)威脅時,不能實行強有力(li)的維權(quan),甚至(zhi)還用“卑(bei)躬屈(qu)膝”或恐(kong)嚇等極端方式(shi)對自(zi)己的血汗錢進行追(zhui)索[2]。

1.2 無理由拖欠民工(gong)工(gong)資

雇主一般用以下(xia)理由(you)推(tui)脫工資的下(xia)發:現(xian)金周(zhou)轉不變、工期沒結束、對(dui)工程(cheng)質量“雞蛋挑骨頭”,并以克扣工資為補償(chang),更有(you)甚者(zhe)直接(jie)拖欠或克扣,并不說明(ming)任何(he)理由(you)。雇主對(dui)處(chu)于弱勢地位(wei)的民工給予不公正(zheng)的待遇,并進行利益的剝奪。

1.3 低齡化的民工結構

民(min)(min)工(gong)年齡偏低,無法應對(dui)社會(hui)(hui)經(jing)驗(yan)豐(feng)富的雇主。民(min)(min)工(gong)多是來自(zi)農村的青壯年,為了養家(jia)糊(hu)口(kou)外出打工(gong),年齡偏小,也(ye)沒有受(shou)過(guo)專業(ye)的就業(ye)培訓,而且(qie)社會(hui)(hui)經(jing)驗(yan)也(ye)不足。當和雇主產生禮儀糾(jiu)紛時,維權能力也(ye)明顯低于(yu)雇主,處(chu)于(yu)劣勢地位。

1.4 區域性動蕩

由拖(tuo)欠工資(zi)引(yin)起的(de)(de)刑(xing)事案(an)件偶有發(fa)生(sheng),致使(shi)事件發(fa)生(sheng)區域性的(de)(de)社(she)會動蕩[3]。近幾年(nian),因(yin)拖(tuo)欠工資(zi)誘發(fa)的(de)(de)刑(xing)事案(an)件不(bu)在少數,其多是(shi)因(yin)為矛(mao)盾(dun)激化所引(yin)發(fa),民工工資(zi)可能是(shi)其家庭唯(wei)一的(de)(de)經濟(ji)來源。若(ruo)長(chang)期拖(tuo)欠無果,會使(shi)民工心理(li)失衡,并導致偏激的(de)(de)行為,這種狀(zhuang)況下很容(rong)易發(fa)生(sheng)刑(xing)事案(an)件。

2 出(chu)現拖欠民工(gong)工(gong)資的原因

在我國建(jian)筑、餐(can)飲娛(yu)樂等行(xing)業(ye)(ye)普遍會發生(sheng)拖欠(qian)(qian)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)之事(shi),而(er)(er)出現這種現象的(de)(de)(de)(de)(de)原因(yin)(yin),主(zhu)要(yao)有(you)(you)以下四(si)點:①層(ceng)層(ceng)轉包(bao)(bao)(bao)。這主(zhu)要(yao)出現在建(jian)筑行(xing)業(ye)(ye),因(yin)(yin)為(wei)在現有(you)(you)的(de)(de)(de)(de)(de)施(shi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)合同(tong)(tong)(tong)當中,對(dui)(dui)民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)的(de)(de)(de)(de)(de)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)償付(fu)條款(kuan)沒有(you)(you)相(xiang)應的(de)(de)(de)(de)(de)規(gui)定(ding),致(zhi)使(shi)(shi)沒有(you)(you)相(xiang)應的(de)(de)(de)(de)(de)約束(shu)機(ji)制(zhi)對(dui)(dui)施(shi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)單(dan)(dan)位(wei)拖欠(qian)(qian)行(xing)為(wei)進行(xing)規(gui)范。同(tong)(tong)(tong)時(shi),在層(ceng)層(ceng)轉包(bao)(bao)(bao)過(guo)程中,發包(bao)(bao)(bao)人與轉包(bao)(bao)(bao)人之間缺少法(fa)(fa)律(lv)約束(shu)與監(jian)(jian)督。當發包(bao)(bao)(bao)人對(dui)(dui)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)程打款(kuan)時(shi),轉包(bao)(bao)(bao)人可(ke)(ke)能在提款(kuan)后(hou)溜之大吉,最終使(shi)(shi)民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)在付(fu)出大量艱辛勞動(dong)(dong)后(hou),還無工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)可(ke)(ke)拿。有(you)(you)的(de)(de)(de)(de)(de)則是發包(bao)(bao)(bao)人在工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)程結束(shu)后(hou)惡意拖欠(qian)(qian),致(zhi)使(shi)(shi)承(cheng)包(bao)(bao)(bao)方無資(zi)(zi)(zi)金支付(fu)民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)[4];②法(fa)(fa)律(lv)保障體系(xi)不健全,政府及勞動(dong)(dong)的(de)(de)(de)(de)(de)部門監(jian)(jian)督也不到位(wei),從(cong)而(er)(er)致(zhi)使(shi)(shi)出現拖欠(qian)(qian)民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)的(de)(de)(de)(de)(de)問題。一(yi)些企業(ye)(ye)不按照勞動(dong)(dong)制(zhi)度的(de)(de)(de)(de)(de)規(gui)定(ding),只是進行(xing)口頭上的(de)(de)(de)(de)(de)協定(ding),民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)也就失去了法(fa)(fa)律(lv)保障。同(tong)(tong)(tong)時(shi),勞動(dong)(dong)監(jian)(jian)察部門也沒有(you)(you)對(dui)(dui)施(shi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)單(dan)(dan)位(wei)進行(xing)有(you)(you)效的(de)(de)(de)(de)(de)監(jian)(jian)督,執法(fa)(fa)力(li)度也不強,并被動(dong)(dong)的(de)(de)(de)(de)(de)查(cha)處(chu)違法(fa)(fa)事(shi)件(jian),民(min)(min)(min)(min)(min)(min)告則官辦,這也使(shi)(shi)企業(ye)(ye)雇主(zhu)肆更無忌憚的(de)(de)(de)(de)(de)克(ke)扣(kou)或拖欠(qian)(qian)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)。此(ci)外,一(yi)些地方政府也不重視民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)保障,為(wei)給予(yu)農民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)過(guo)多的(de)(de)(de)(de)(de)保障,一(yi)定(ding)程度上,也是造成(cheng)拖欠(qian)(qian)或克(ke)扣(kou)民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)的(de)(de)(de)(de)(de)原因(yin)(yin)[5];③鉆法(fa)(fa)律(lv)空子。在民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)勞動(dong)(dong)市場不健全、法(fa)(fa)律(lv)監(jian)(jian)督機(ji)制(zhi)不完善的(de)(de)(de)(de)(de)情況下,企業(ye)(ye)進行(xing)不正當競爭(zheng),并非法(fa)(fa)用工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)。而(er)(er)當前城鄉收入分配(pei)也嚴重失衡(heng),尤其是收入差(cha)距最為(wei)突(tu)出,且民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)較(jiao)(jiao)多,而(er)(er)崗位(wei)卻(que)有(you)(you)限(xian)。所(suo)以,找到工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)已很難得。因(yin)(yin)此(ci)在雇主(zhu)拖欠(qian)(qian)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)時(shi),為(wei)保住(zhu)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo),民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)只好(hao)忍氣吞聲;④民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)維權(quan)(quan)成(cheng)本(ben)三(san)倍于收益,討薪(xin)成(cheng)本(ben)過(guo)高也使(shi)(shi)民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)未進行(xing)司(si)法(fa)(fa)維權(quan)(quan)。據調查(cha)[6],當前民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)討薪(xin)是收益的(de)(de)(de)(de)(de)3倍,用3000元才可(ke)(ke)以討回(hui)1000元工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi),這是民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)承(cheng)受不起(qi)的(de)(de)(de)(de)(de)資(zi)(zi)(zi)金壓力(li)。從(cong)法(fa)(fa)律(lv)角度看,現在的(de)(de)(de)(de)(de)勞動(dong)(dong)爭(zheng)議時(shi)“一(yi)調一(yi)裁(cai)二審”制(zhi),工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)會調解,勞動(dong)(dong)局仲(zhong)裁(cai),如果民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)對(dui)(dui)以上處(chu)理結果均不服,才可(ke)(ke)以上訴于法(fa)(fa)院。這樣再三(san)推脫,浪費(fei)民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)的(de)(de)(de)(de)(de)時(shi)間與成(cheng)本(ben),而(er)(er)且由于民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)與施(shi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)單(dan)(dan)位(wei)未辦勞動(dong)(dong)合同(tong)(tong)(tong),發生(sheng)糾紛時(shi)往往缺少最直接的(de)(de)(de)(de)(de)法(fa)(fa)律(lv)憑證。同(tong)(tong)(tong)時(shi),司(si)法(fa)(fa)取證的(de)(de)(de)(de)(de)成(cheng)本(ben)也較(jiao)(jiao)高,時(shi)間耗費(fei)較(jiao)(jiao)長(chang),所(suo)以使(shi)(shi)民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)對(dui)(dui)司(si)法(fa)(fa)維權(quan)(quan)只是空能望(wang)而(er)(er)卻(que)步。

3 對策

拖欠民(min)工(gong)工(gong)資(zi)不僅影響了物質文明和政治文明建(jian)設(she)(she),同時(shi)也嚴重影響了社會(hui)主義(yi)和諧社會(hui)的(de)建(jian)設(she)(she),所以必(bi)須采取(qu)有效的(de)措施解(jie)決拖欠民(min)工(gong)工(gong)資(zi)的(de)問題。

3.1 提(ti)高民工(gong)職業技能,提(ti)升民工(gong)發展潛力(li)

國家對(dui)民(min)(min)工(gong)(gong)(gong)進行(xing)義(yi)務(wu)教(jiao)育(yu)的(de)(de)同時,要結合職(zhi)業(ye)(ye)教(jiao)育(yu),對(dui)完(wan)成或未(wei)完(wan)成義(yi)務(wu)教(jiao)育(yu)的(de)(de)民(min)(min)工(gong)(gong)(gong)進行(xing)不同專(zhuan)業(ye)(ye)技能培訓和(he)(he)思想教(jiao)育(yu),提(ti)高(gao)(gao)民(min)(min)工(gong)(gong)(gong)素(su)質,提(ti)升(sheng)就(jiu)(jiu)業(ye)(ye)競爭力,使其(qi)進入市場后,可以獲(huo)得(de)更好的(de)(de)發(fa)(fa)展(zhan)前景(jing)。這也(ye)(ye)會(hui)從根源上(shang)解(jie)(jie)決民(min)(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資結構,保障民(min)(min)工(gong)(gong)(gong)的(de)(de)家庭收入來源。同時也(ye)(ye)會(hui)提(ti)高(gao)(gao)民(min)(min)工(gong)(gong)(gong)的(de)(de)維權意識,在就(jiu)(jiu)業(ye)(ye)之(zhi)初就(jiu)(jiu)會(hui)對(dui)自己的(de)(de)勞(lao)動(dong)權益進行(xing)維護(hu)。此外,還會(hui)提(ti)高(gao)(gao)產(chan)品質量和(he)(he)勞(lao)動(dong)生產(chan)率,實(shi)現民(min)(min)工(gong)(gong)(gong)與企業(ye)(ye)雙贏(ying),也(ye)(ye)有(you)利于實(shi)現社會(hui)的(de)(de)可持續(xu)和(he)(he)諧發(fa)(fa)展(zhan)。還要保正民(min)(min)工(gong)(gong)(gong)子(zi)女(nv)受到公平教(jiao)育(yu),提(ti)高(gao)(gao)民(min)(min)工(gong)(gong)(gong)子(zi)女(nv)的(de)(de)文化水平,以獲(huo)得(de)更好的(de)(de)發(fa)(fa)展(zhan)空(kong)間,避免民(min)(min)工(gong)(gong)(gong)子(zi)女(nv)延續(xu)父輩的(de)(de)艱辛之(zhi)路(lu),解(jie)(jie)決民(min)(min)工(gong)(gong)(gong)長(chang)期發(fa)(fa)展(zhan)問題。

3.2 建立與完善民工勞(lao)動力市場體制

城(cheng)鄉(xiang)分(fen)割了(le)勞(lao)(lao)動力(li)(li)市(shi)場(chang)(chang)的(de)(de)(de)(de)統一(yi)性(xing),將農村(cun)勞(lao)(lao)動力(li)(li)分(fen)入二(er)級勞(lao)(lao)動力(li)(li)市(shi)場(chang)(chang),降(jiang)低了(le)民工的(de)(de)(de)(de)社會(hui)地位,并且也受(shou)到不(bu)了(le)平等的(de)(de)(de)(de)勞(lao)(lao)動待(dai)(dai)遇。解決以(yi)(yi)上問題首先要(yao)消除市(shi)場(chang)(chang)對城(cheng)鄉(xiang)勞(lao)(lao)動力(li)(li)的(de)(de)(de)(de)分(fen)割,所(suo)以(yi)(yi)要(yao)加大戶籍改革的(de)(de)(de)(de)強度,攻(gong)破(po)城(cheng)鄉(xiang)及區(qu)域間的(de)(de)(de)(de)勞(lao)(lao)動力(li)(li)市(shi)場(chang)(chang)壁(bi)壘,取締城(cheng)市(shi)就業(ye)政策(ce)中(zhong)的(de)(de)(de)(de)歧(qi)視待(dai)(dai)遇。同時,政府也要(yao)逐步(bu)將利(li)益特(te)權從戶籍上加以(yi)(yi)分(fen)離,對城(cheng)鄉(xiang)勞(lao)(lao)動力(li)(li)市(shi)場(chang)(chang)進行統一(yi)規劃與管(guan)理,實現無歧(qi)視就業(ye)。

3.3 創新企業管理機制

民(min)(min)(min)工(gong)(gong)(gong)(gong)資(zi)(zi)源是企業(ye)(ye)(ye)(ye)生存(cun)與(yu)發展的(de)(de)重要人力(li)(li)資(zi)(zi)源,關系到了企業(ye)(ye)(ye)(ye)競爭力(li)(li)。因此用(yong)人單位應重新(xin)認識,并(bing)(bing)改(gai)(gai)(gai)變現行的(de)(de)經營理(li)(li)(li)念及管理(li)(li)(li)體制(zhi)(zhi)(zhi)。剔除歧視,努(nu)力(li)(li)改(gai)(gai)(gai)善民(min)(min)(min)工(gong)(gong)(gong)(gong)的(de)(de)保障體系,使其(qi)享受與(yu)城市員工(gong)(gong)(gong)(gong)同等的(de)(de)就業(ye)(ye)(ye)(ye)待遇。同時,創新(xin)管理(li)(li)(li)機(ji)制(zhi)(zhi)(zhi)。將民(min)(min)(min)工(gong)(gong)(gong)(gong)的(de)(de)管理(li)(li)(li)納入企業(ye)(ye)(ye)(ye)的(de)(de)管理(li)(li)(li)機(ji)制(zhi)(zhi)(zhi)中(zhong),并(bing)(bing)作為重要的(de)(de)管理(li)(li)(li)對(dui)象,善待民(min)(min)(min)工(gong)(gong)(gong)(gong),調(diao)動(dong)民(min)(min)(min)工(gong)(gong)(gong)(gong)的(de)(de)工(gong)(gong)(gong)(gong)作積(ji)極性。國家要扭轉企業(ye)(ye)(ye)(ye)當前(qian)拖欠(qian)民(min)(min)(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)的(de)(de)情況,就要加強對(dui)企業(ye)(ye)(ye)(ye)理(li)(li)(li)念及管理(li)(li)(li)體制(zhi)(zhi)(zhi)的(de)(de)監督,促使企業(ye)(ye)(ye)(ye)改(gai)(gai)(gai)變原有的(de)(de)用(yong)工(gong)(gong)(gong)(gong)理(li)(li)(li)念,改(gai)(gai)(gai)變傳統的(de)(de)民(min)(min)(min)工(gong)(gong)(gong)(gong)管理(li)(li)(li)體制(zhi)(zhi)(zhi)。

3.4 加強(qiang)法(fa)律(lv)保護

司法機(ji)關要(yao)重視民(min)(min)工(gong)討薪(xin)的民(min)(min)事(shi)糾紛,為民(min)(min)工(gong)維(wei)權(quan)之路(lu)提供(gong)法律上的援(yuan)助(zhu)。同時(shi),也要(yao)加大(da)法律的宣傳力度,提高(gao)民(min)(min)工(gong)自我保護的意識和能力。對民(min)(min)工(gong)討薪(xin)案件進行(xing)及時(shi)的立案處理,并優先審理。此外,還要(yao)完善民(min)(min)工(gong)勞動處理的程序,降低民(min)(min)工(gong)維(wei)權(quan)的成本,以(yi)減少民(min)(min)工(gong)維(wei)權(quan)的后顧之憂(you)。

4 結論

本(ben)文(wen)主(zhu)要(yao)分析了民(min)工(gong)(gong)討(tao)薪的(de)(de)特點及造(zao)成(cheng)拖(tuo)欠(qian)民(min)工(gong)(gong)工(gong)(gong)資的(de)(de)原(yuan)因,筆者認為解決(jue)拖(tuo)欠(qian)民(min)工(gong)(gong)工(gong)(gong)資是(shi)一項長期工(gong)(gong)程。雖然(ran)國(guo)家(jia)政府給予了高度重(zhong)視,并采取了相應措施,但是(shi)效果微著。民(min)工(gong)(gong)、企(qi)業、國(guo)家(jia)要(yao)共同努(nu)力(li)解決(jue)該問題,其(qi)中最(zui)為重(zhong)要(yao)的(de)(de)是(shi)民(min)工(gong)(gong)要(yao)提高自(zi)身的(de)(de)素質(zhi)。同時,國(guo)家(jia)也要(yao)加(jia)強對(dui)民(min)工(gong)(gong)的(de)(de)保護力(li)度,最(zui)終將民(min)工(gong)(gong)工(gong)(gong)資及其(qi)他保障納(na)入法制管理。

為進一步推進服務(wu)企業(ye)(ye)改(gai)革,減(jian)輕企業(ye)(ye)負擔,全面提升我市民(min)(min)營經濟發(fa)展環境(jing),結合(he)浙(zhe)江省建設廳(ting)《關(guan)于印發(fa)〈浙(zhe)江省省外建筑業(ye)(ye)企業(ye)(ye)和(he)中介(jie)服務(wu)機構(gou)備案管(guan)理(li)暫行辦法(fa)〉的(de)通知》(浙(zhe)建〔2015〕3號(hao))、《浙(zhe)江省人(ren)民(min)(min)政府辦公廳(ting)關(guan)于進一步降(jiang)低(di)企業(ye)(ye)成本(ben)優化發(fa)展環境(jing)的(de)若干意見(jian)》(浙(zhe)政辦發(fa)〔2016〕39號(hao))等文(wen)件要求,調整民(min)(min)工工資(zi)支付保障金管(guan)理(li)辦法(fa),清退建筑(市政)民(min)(min)工工資(zi)保證(zheng)金,實實在在為企業(ye)(ye)減(jian)負。

一、主要做法

一、從清(qing)退(tui)(tui)(tui)之(zhi)日(ri)起項(xiang)(xiang)目已完工(gong)(gong)(gong)(gong)、或項(xiang)(xiang)目至(zhi)清(qing)退(tui)(tui)(tui)之(zhi)日(ri)滿三年(nian)且未發生嚴(yan)重拖欠工(gong)(gong)(gong)(gong)資(zi)行為的(de)(de)建筑(市政)企(qi)業,憑《民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)保障金退(tui)(tui)(tui)還(huan)登記表》辦理清(qing)退(tui)(tui)(tui)手續(xu),清(qing)退(tui)(tui)(tui)工(gong)(gong)(gong)(gong)作截止(zhi)2019年(nian)6月25日(ri)。逾(yu)期未辦理清(qing)退(tui)(tui)(tui)手續(xu)的(de)(de),將按(an)照浙江省(sheng)審計(ji)廳(ting)專項(xiang)(xiang)設計(ji)調查報(bao)告(浙審財調報(bao)〔2019〕14號)的(de)(de)意見,對未退(tui)(tui)(tui)款項(xiang)(xiang)予以解(jie)繳國庫(ku)。截至(zhi)目前,應退(tui)(tui)(tui)未退(tui)(tui)(tui)的(de)(de)工(gong)(gong)(gong)(gong)程(cheng)項(xiang)(xiang)目總(zong)計(ji)4654萬元(yuan),已基本清(qing)退(tui)(tui)(tui)完畢。

二、至(zhi)清退(tui)(tui)之(zhi)日(ri)項(xiang)(xiang)目(mu)尚未(wei)完(wan)工的(de)建筑(市(shi)政(zheng))企業,憑保(bao)(bao)函(han)(或保(bao)(bao)證保(bao)(bao)險)、擔(dan)保(bao)(bao)公(gong)司(si)相關紙質復印件加蓋公(gong)司(si)公(gong)章及《民工工資保(bao)(bao)障(zhang)金退(tui)(tui)還登記表(biao)》辦理(li)清退(tui)(tui)手續。企業有多個項(xiang)(xiang)目(mu)的(de),提供(gong)一(yi)份(fen)保(bao)(bao)函(han)進行統一(yi)清退(tui)(tui)。三年(nian)內(nei)未(wei)發生(sheng)嚴(yan)重(zhong)(zhong)拖欠工資行為(wei)(wei)的(de)企業,在義(yi)烏(wu)(wu)內(nei)保(bao)(bao)額為(wei)(wei)20萬;三年(nian)內(nei)有發生(sheng)嚴(yan)重(zhong)(zhong)拖欠工資行為(wei)(wei)的(de),在義(yi)烏(wu)(wu)內(nei)保(bao)(bao)額為(wei)(wei)40萬。保(bao)(bao)函(han)有效(xiao)(xiao)期(qi)為(wei)(wei)開立之(zhi)日(ri)至(zhi)最晚竣工的(de)項(xiang)(xiang)目(mu)合同約(yue)定(ding)工期(qi)后6個月。項(xiang)(xiang)目(mu)延期(qi)的(de),保(bao)(bao)函(han)有效(xiao)(xiao)期(qi)視實際情況相應順(shun)延。

三(san)、新辦(ban)(ban)理施(shi)工許可證的(de),臺(tai)州(zhou)市(shi)建筑(zhu)業(ye)(ye)信用評定等(deng)級(ji)在(zai)(zai)2A以上(含2A)的(de)建筑(zhu)(市(shi)政(zheng))企(qi)(qi)業(ye)(ye)免于(yu)繳納;其它建筑(zhu)(市(shi)政(zheng))企(qi)(qi)業(ye)(ye)以企(qi)(qi)業(ye)(ye)為單位,采用銀(yin)行保(bao)函(han)或保(bao)證保(bao)險等(deng)形式繳納,三(san)年內未(wei)發(fa)(fa)生嚴(yan)重(zhong)拖欠工資(zi)行為的(de)企(qi)(qi)業(ye)(ye),在(zai)(zai)義烏內保(bao)額為20萬(wan);三(san)年內有(you)發(fa)(fa)生嚴(yan)重(zhong)拖欠工資(zi)行為的(de),在(zai)(zai)義烏內保(bao)額為40萬(wan)。建筑(zhu)(市(shi)政(zheng))企(qi)(qi)業(ye)(ye)每次在(zai)(zai)辦(ban)(ban)理施(shi)工許可證前,將保(bao)函(han)及擔保(bao)公(gong)司相關紙質復印件(jian)加蓋公(gong)章交(jiao)至義烏市(shi)建設局。保(bao)函(han)有(you)效期(qi)根據該企(qi)(qi)業(ye)(ye)最晚竣工的(de)項目合同工期(qi)進行調(diao)整。

二、存在問題

采用(yong)銀行保(bao)函(han)或保(bao)證(zheng)保(bao)險等形式繳納,有效減輕了企業負擔,但也存在(zai)著以(yi)下問(wen)(wen)題(ti)。(一)易造(zao)成企業思想意(yi)識淡薄。因政策支持,企業下意(yi)識放松對民(min)工(gong)(gong)工(gong)(gong)資的(de)管理,出現拖欠民(min)工(gong)(gong)工(gong)(gong)資問(wen)(wen)題(ti)。(二)增加了監管難度(du)。保(bao)函(han)有效期(qi)根(gen)據企業最(zui)晚竣(jun)工(gong)(gong)的(de)項(xiang)目合同工(gong)(gong)期(qi)進行調整,可能出現到期(qi)未及(ji)(ji)時存續保(bao)函(han)的(de)問(wen)(wen)題(ti)。(三)保(bao)額(e)額(e)度(du)不(bu)足以(yi)支付民(min)工(gong)(gong)工(gong)(gong)資。一家企業一張保(bao)函(han),而保(bao)函(han)額(e)度(du)只有20萬,當年發生一家企業多個項(xiang)目拖欠民(min)工(gong)(gong)工(gong)(gong)資問(wen)(wen)題(ti)時,將無法及(ji)(ji)時兌(dui)現民(min)工(gong)(gong)工(gong)(gong)資。

三、對策建議

(一)強(qiang)化(hua)思想(xiang)意識。積極引(yin)導和規范(fan)企業(ye)的(de)民(min)工(gong)(gong)工(gong)(gong)資管理,不因拖欠(qian)民(min)工(gong)(gong)工(gong)(gong)資影響生產經營。通過提供民(min)工(gong)(gong)工(gong)(gong)資保函等(deng)形式,合理減輕企業(ye)財務負(fu)擔,推動企業(ye)步入良性循環發(fa)展軌(gui)道(dao)。

一、農(nong)民工(gong)工(gong)資問題相關概念

(一)農(nong)(nong)(nong)民(min)工(gong)是(shi)勞(lao)動(dong)相關(guan)法(fa)律(lv)法(fa)規保(bao)(bao)護的(de)對象。農(nong)(nong)(nong)民(min)工(gong),是(shi)指(zhi)進(jin)入城市打工(gong)的(de)農(nong)(nong)(nong)民(min)。根據我國相關(guan)勞(lao)動(dong)法(fa)律(lv)法(fa)規,只(zhi)要農(nong)(nong)(nong)民(min)工(gong)與企(qi)業或(huo)者個人(ren)發生勞(lao)動(dong)關(guan)系,就是(shi)勞(lao)動(dong)相關(guan)法(fa)律(lv)法(fa)規保(bao)(bao)護的(de)對象。(二)農(nong)(nong)(nong)民(min)工(gong)工(gong)資(zi)。指(zhi)農(nong)(nong)(nong)民(min)工(gong)付出勞(lao)動(dong)后所獲得的(de)經濟回報,工(gong)資(zi)也是(shi)農(nong)(nong)(nong)民(min)工(gong)付出勞(lao)動(dong)所追求的(de)目標,農(nong)(nong)(nong)民(min)家庭(ting)的(de)大部分生活來(lai)源(yuan)均來(lai)源(yuan)于工(gong)資(zi)。

二(er)、拖欠(qian)農民工工資(zi)問題的現狀

工(gong)資(zi)(zi)拖欠現象(xiang)屢見(jian)不(bu)(bu)鮮,有(you)些農民工(gong)并不(bu)(bu)是按固定時間獲得工(gong)資(zi)(zi),而是等(deng)到逢年過節(jie)回老家時一次性結算(suan)工(gong)資(zi)(zi)。這顯然不(bu)(bu)符合(he)工(gong)資(zi)(zi)支付的(de)規范。有(you)的(de)公司高層突然逃離(li),工(gong)人無法追討追討工(gong)資(zi)(zi)的(de)現象(xiang)十分常見(jian)。

三(san)、出現拖欠(qian)農(nong)民(min)工工資問題的(de)原因(yin)

農(nong)(nong)民工(gong)定(ding)義不明問題凸顯。農(nong)(nong)民工(gong)只(zhi)是習慣稱謂,需(xu)要在法(fa)律上明確定(ding)義,應(ying)當受《勞動法(fa)》保護(hu)(hu)(hu)。此(ci)外,保護(hu)(hu)(hu)農(nong)(nong)民工(gong)相關(guan)法(fa)律法(fa)規(gui)(gui)不成體系(xi),難以(yi)系(xi)統保護(hu)(hu)(hu)弱勢勞動群體利益(yi)。盡(jin)管《刑法(fa)》規(gui)(gui)定(ding)惡意欠(qian)薪罪,但是該條法(fa)律在實際運(yun)用時也遇到很多的(de)問題,難以(yi)有(you)效保護(hu)(hu)(hu)農(nong)(nong)民工(gong)權益(yi)。此(ci)外,企業不遵守相關(guan)法(fa)律時,對他們(men)的(de)約束力度極(ji)為有(you)限。用人單位也不遵守相關(guan)法(fa)律法(fa)規(gui)(gui),與勞動者(zhe)該簽訂合(he)同(tong)卻不簽訂合(he)同(tong),應(ying)當保護(hu)(hu)(hu)弱者(zhe)利益(yi)卻不保護(hu)(hu)(hu)。農(nong)(nong)民工(gong)的(de)力量難以(yi)集(ji)中,同(tong)時由于文(wen)化素(su)質不高,難以(yi)捍衛自(zi)己利益(yi)。

四、拖欠(qian)農民工(gong)工(gong)資的危害(hai)

首(shou)先,不(bu)利(li)于社會(hui)安定(ding)(ding)。該現象若得(de)不(bu)到及時處(chu)置,必然引(yin)發極端事件。農(nong)(nong)民(min)工(gong)(gong)(gong)拿(na)不(bu)到工(gong)(gong)(gong)資(zi),走(zou)投無路(lu)的(de)情況下(xia)可能(neng)會(hui)采取很(hen)多過(guo)激行為(wei)(wei),這(zhe)將會(hui)嚴重破壞大環境的(de)和諧和穩定(ding)(ding)。此外(wai),企業(ye)該行為(wei)(wei)不(bu)利(li)于其自身長遠生(sheng)存。如果一(yi)個企業(ye)連普通工(gong)(gong)(gong)人的(de)工(gong)(gong)(gong)資(zi)都付不(bu)出,必定(ding)(ding)會(hui)留下(xia)惡(e)商的(de)不(bu)誠信形象,且自身實(shi)(shi)力也會(hui)飽(bao)受質疑(yi),這(zhe)都不(bu)利(li)于企業(ye)長遠生(sheng)存。農(nong)(nong)村(cun)各項開資(zi)都需要農(nong)(nong)民(min)工(gong)(gong)(gong)打工(gong)(gong)(gong)掙錢(qian)支付,如果農(nong)(nong)民(min)打工(gong)(gong)(gong)拿(na)不(bu)到工(gong)(gong)(gong)資(zi),就(jiu)無法支付生(sheng)活中的(de)各項費用,不(bu)利(li)于農(nong)(nong)村(cun)經濟(ji)發展。政府一(yi)直將實(shi)(shi)現人民(min)利(li)益作為(wei)(wei)工(gong)(gong)(gong)作重點,若農(nong)(nong)民(min)工(gong)(gong)(gong)拿(na)不(bu)到工(gong)(gong)(gong)資(zi),無法實(shi)(shi)現自身權益,人權得(de)不(bu)到保障,將會(hui)嚴重影響到黨的(de)施(shi)政方針。

五、解決該問題的建(jian)議

(一)司法救濟

司(si)法機關(guan)要著力提高司(si)法保護效率,對(dui)不遵(zun)守(shou)勞動法律法規的問題,要及時調查取證,及時、迅速處理(li),極(ji)大程度地(di)發(fa)揮司(si)法救濟作用(yong)。

(二)行政治理

1.增強預(yu)防措(cuo)(cuo)施(shi),有(you)問題(ti)及(ji)(ji)時(shi)(shi)解決。行(xing)(xing)政(zheng)部(bu)(bu)門要加強對企(qi)(qi)業的(de)監管,可(ke)(ke)組織工(gong)(gong)商(shang)(shang)部(bu)(bu)門、勞(lao)動保障(zhang)等(deng)多(duo)部(bu)(bu)門,根(gen)據工(gong)(gong)資支(zhi)(zhi)付情(qing)況(kuang)指定(ding)不同(tong)應(ying)對措(cuo)(cuo)施(shi)。若符合(he)法律規定(ding),工(gong)(gong)商(shang)(shang)可(ke)(ke)登記在(zai)冊,作為衡量企(qi)(qi)業誠(cheng)實信用(yong)的(de)重要參考(kao)標準,并(bing)向(xiang)社會公示以發揮帶頭(tou)模范作用(yong)。對于存在(zai)危害農民工(gong)(gong)利益(yi)的(de)行(xing)(xing)為,及(ji)(ji)時(shi)(shi)給與警(jing)告、罰款等(deng)處罰措(cuo)(cuo)施(shi),列入工(gong)(gong)商(shang)(shang)負面(mian)企(qi)(qi)業清單(dan),降低該企(qi)(qi)業誠(cheng)實信用(yong)評級,向(xiang)社會公示,并(bing)不定(ding)時(shi)(shi)查詢企(qi)(qi)業整改情(qing)況(kuang)。2.加大檢查力(li)(li)度。一方面(mian),工(gong)(gong)商(shang)(shang)部(bu)(bu)門、勞(lao)動保障(zhang)等(deng)多(duo)部(bu)(bu)門可(ke)(ke)協(xie)同(tong)配合(he),不定(ding)時(shi)(shi)地(di)對企(qi)(qi)業有(you)無(wu)侵害農民工(gong)(gong)利益(yi)情(qing)況(kuang)進行(xing)(xing)排查。另一方面(mian),行(xing)(xing)政(zheng)部(bu)(bu)門可(ke)(ke)發揮群(qun)眾力(li)(li)量,鼓勵群(qun)眾對拖延支(zhi)(zhi)付貨拒(ju)絕(jue)支(zhi)(zhi)付工(gong)(gong)資問題(ti)進行(xing)(xing)舉報,并(bing)對舉報信息進行(xing)(xing)排查。

(三(san))企(qi)業和農民工(gong)個人方面

企業須(xu)遵守勞(lao)動相(xiang)關法(fa)律法(fa)規,不得克(ke)扣工(gong)(gong)資,不得危(wei)害農民(min)(min)工(gong)(gong)合法(fa)權(quan)益(yi)。農民(min)(min)工(gong)(gong)需要(yao)提高個人意識,及時要(yao)求訂立合同,并了解維護自(zi)身權(quan)益(yi)的途徑。

六、結語

如今拖欠工資現象(xiang)已日(ri)益引起各界的(de)廣泛重視,為了解(jie)決這(zhe)一(yi)問題,不僅要考慮人性的(de)良知,更重要的(de)是需要司法救濟(ji)、行(xing)政管理(li)、企業以及農民工之間的(de)相(xiang)互協調和配合,不能僅依靠某一(yi)單方面力量,只(zhi)有多方通力合作,才(cai)能徹底解(jie)決該問題。

這一群體(ti)性農民工(gong)工(gong)資拖欠(qian)事件發(fa)生后,7月19日,昭通(tong)市人民政府(fu)成立了(le)由市勞(lao)動保障部(bu)門牽頭,從總工(gong)會、公(gong)安(an)、監察、經委等部(bu)門抽調人員組(zu)成了(le)工(gong)作組(zu),于(yu)當天中午出發(fa)趕赴綏江縣了(le)解情況,協助縣委、政府(fu)做好穩(wen)定事態工(gong)作,及(ji)時追回農民工(gong)工(gong)資。

案情就是命令,維護職工(gong)(gong)(gong)、農民(min)工(gong)(gong)(gong)合法權益是工(gong)(gong)(gong)會(hui)(hui)組織的(de)基本(ben)職責。昭通市(shi)總工(gong)(gong)(gong)會(hui)(hui)領導高度(du)重視,及時安排我參加市(shi)政府工(gong)(gong)(gong)作組趕赴綏江。

浙(zhe)浦(pu)水(shui)泥(ni)(ni)有限(xian)公(gong)司(si)(si)位(wei)于綏江縣(xian)新(xin)灘鎮銀廠(chang)村,屬(shu)浙(zhe)江人(ren)張國良(liang)投資(zi)上億(yi)元新(xin)建(jian)(jian)的(de)(de)120萬噸千法(fa)水(shui)泥(ni)(ni)生產(chan)(chan)線。水(shui)泥(ni)(ni)廠(chang)場(chang)平(ping)、土建(jian)(jian)和料場(chang)場(chang)平(ping)工(gong)程,由四川宜(yi)賓高縣(xian)人(ren)謝(xie)某(mou)總(zong)承包(bao),工(gong)程造價約590萬元。2008年10月(yue),浙(zhe)浦(pu)水(shui)泥(ni)(ni)有限(xian)公(gong)司(si)(si)應(ying)本人(ren)申請與謝(xie)某(mou)簽訂(ding)了石(shi)(shi)(shi)(shi)灰(hui)(hui)(hui)石(shi)(shi)(shi)(shi)礦山(shan)承包(bao)合同(tong)(tong)及水(shui)泥(ni)(ni)生產(chan)(chan)線投產(chan)(chan)后石(shi)(shi)(shi)(shi)灰(hui)(hui)(hui)石(shi)(shi)(shi)(shi)原料的(de)(de)生產(chan)(chan)供應(ying)合同(tong)(tong)。2009年5月(yue)14日,石(shi)(shi)(shi)(shi)灰(hui)(hui)(hui)石(shi)(shi)(shi)(shi)礦山(shan)建(jian)(jian)設安裝完(wan)畢,轉入石(shi)(shi)(shi)(shi)灰(hui)(hui)(hui)石(shi)(shi)(shi)(shi)原料的(de)(de)生產(chan)(chan)供應(ying)。7月(yue)11日,謝(xie)某(mou)與浙(zhe)浦(pu)水(shui)泥(ni)(ni)有限(xian)公(gong)司(si)(si)根據(ju)承建(jian)(jian)合同(tong)(tong)進(jin)行結(jie)算(suan),除扣下(xia)10%的(de)(de)質量保證金(jin)外,支付給謝(xie)某(mou)258萬元。7月(yue)13目中午,謝(xie)某(mou)突然攜款潛逃,導致該公(gong)司(si)(si)新(xin)建(jian)(jian)生產(chan)(chan)線石(shi)(shi)(shi)(shi)灰(hui)(hui)(hui)石(shi)(shi)(shi)(shi)供應(ying)中斷,農民(min)工(gong)隨即罷工(gong)聚集討要工(gong)資(zi)。

7月的(de)(de)(de)綏(sui)江(jiang)(jiang)正值酷暑高(gao)溫,異常炎熱。工(gong)(gong)作組一(yi)行到達綏(sui)江(jiang)(jiang)后(hou),當(dang)天晚上及時(shi)聽取(qu)了(le)綏(sui)江(jiang)(jiang)縣(xian)對該事(shi)件(jian)調(diao)查處理情(qing)況(kuang)(kuang)的(de)(de)(de)匯報,并于20目(mu)分(fen)別與(yu)新灘鎮黨委政府工(gong)(gong)作組、縣(xian)工(gong)(gong)作組、浙浦(pu)水泥有(you)限公司董(dong)(dong)事(shi)長(chang)張(zhang)國(guo)良(liang)進行了(le)座談。在(zai)充分(fen)聽取(qu)各(ge)方意(yi)見之后(hou),及時(shi)查清了(le)情(qing)況(kuang)(kuang),首先穩定了(le)農(nong)(nong)(nong)(nong)民(min)(min)工(gong)(gong)情(qing)緒,同時(shi)要求公司必(bi)須承(cheng)擔總承(cheng)包(bao)方“拖(tuo)欠的(de)(de)(de)農(nong)(nong)(nong)(nong)民(min)(min)工(gong)(gong)工(gong)(gong)資由發(fa)包(bao)方承(cheng)擔相應的(de)(de)(de)支付(fu)義務”的(de)(de)(de)責(ze)任(ren),進一(yi)步規范用(yong)工(gong)(gong)管理,建立和(he)(he)諧勞動關系,促進企業自(zi)身的(de)(de)(de)發(fa)展(zhan)壯(zhuang)大。同時(shi)宣(xuan)傳了(le)勞動保障相關法(fa)律(lv)法(fa)規和(he)(he)維護農(nong)(nong)(nong)(nong)民(min)(min)工(gong)(gong)合(he)法(fa)權益的(de)(de)(de)有(you)關政策。張(zhang)國(guo)良(liang)董(dong)(dong)事(shi)長(chang)表示:服從工(gong)(gong)作組和(he)(he)當(dang)地黨委、政府的(de)(de)(de)決定,盡快兌現拖(tuo)欠的(de)(de)(de)農(nong)(nong)(nong)(nong)民(min)(min)工(gong)(gong)工(gong)(gong)資。

一、造成拖欠民(min)工工資現狀的原因

我(wo)國普遍(bian)存在拖欠(qian)農(nong)民工工資的(de)現象多發生于建筑、餐飲、煤礦(kuang)、制造等(deng)勞動密集(ji)型企業,成為了影響(xiang)社(she)會穩(wen)定的(de)一個不(bu)可忽視的(de)問題。肩負(fu)著家(jia)庭重任的(de)農(nong)民工們,由于不(bu)能給(gei)家(jia)庭帶來基(ji)本的(de)生活保障,從而走上追討(tao)工資的(de)艱難道路。為此,從以下幾方面分析造成拖欠(qian)農(nong)民工工資現狀產生的(de)原(yuan)因(yin):

1.行(xing)(xing)業(ye)市場不(bu)(bu)規(gui)范。以農民(min)工(gong)(gong)(gong)較為(wei)集中的(de)(de)(de)建(jian)筑(zhu)行(xing)(xing)業(ye)為(wei)例,目前這個行(xing)(xing)業(ye)吸(xi)納(na)了(le)絕(jue)人(ren)多(duo)數的(de)(de)(de)農民(min)工(gong)(gong)(gong)就業(ye),由于(yu)建(jian)筑(zhu)施(shi)工(gong)(gong)(gong)合(he)同不(bu)(bu)完(wan)善,沒有明確規(gui)定民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)償付條款(kuan),施(shi)工(gong)(gong)(gong)單位(wei)不(bu)(bu)受條款(kuan)制限,一些(xie)有關(guan)系的(de)(de)(de)人(ren)將建(jian)筑(zhu)工(gong)(gong)(gong)程(cheng)(cheng)的(de)(de)(de)層(ceng)層(ceng)轉(zhuan)包(bao),產(chan)生了(le)大量非法用工(gong)(gong)(gong)主體,資(zi)金支(zhi)付扯皮,責權(quan)(quan)利不(bu)(bu)明確,形成惡性循環(huan),這就造(zao)成拖欠農民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)的(de)(de)(de)主要原因(yin)。另外,現在的(de)(de)(de)施(shi)工(gong)(gong)(gong)單位(wei)大多(duo)是“包(bao)工(gong)(gong)(gong)頭”對民(min)工(gong)(gong)(gong)進行(xing)(xing)直(zhi)接管理(li)(li)。他(ta)們從(cong)某一項工(gong)(gong)(gong)程(cheng)(cheng)中取得(de)部分施(shi)工(gong)(gong)(gong)權(quan)(quan)后(hou)(hou),以自然人(ren)名義招(zhao)收民(min)工(gong)(gong)(gong),其中有些(xie)不(bu)(bu)法“包(bao)工(gong)(gong)(gong)頭”從(cong)施(shi)工(gong)(gong)(gong)單位(wei)領取工(gong)(gong)(gong)程(cheng)(cheng)款(kuan)后(hou)(hou)便攜款(kuan)而逃,施(shi)工(gong)(gong)(gong)單位(wei)以農民(min)工(gong)(gong)(gong)不(bu)(bu)屬其管理(li)(li)為(wei)由拒絕(jue)支(zhi)付其工(gong)(gong)(gong)資(zi);也有的(de)(de)(de)是發包(bao)方(fang)在工(gong)(gong)(gong)程(cheng)(cheng)已(yi)經(jing)或(huo)快完(wan)工(gong)(gong)(gong)的(de)(de)(de)情況下,惡意拖欠工(gong)(gong)(gong)程(cheng)(cheng)款(kuan),造(zao)成承包(bao)方(fang)無力(li)支(zhi)付民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)。

2.農民(min)(min)工自我保護意識(shi)差。按目前的(de)(de)(de)相關法規(gui)規(gui)定,農民(min)(min)工外(wai)出打工須持有(you)“三證(zheng)”,即身份證(zheng)、外(wai)出就(jiu)業證(zheng)和計生(sheng)證(zheng)。由(you)于(yu)證(zheng)件不全和中介費用較高(gao)等原因,大部分民(min)(min)工不愿到勞(lao)動(dong)(dong)保障(zhang)部門(men)設立(li)的(de)(de)(de)或(huo)是(shi)正規(gui)的(de)(de)(de)職業介紹機構求職,而是(shi)通過(guo)其他手段尋找工作(例如“打黑工”、熟(shu)人(ren)推(tui)薦或(huo)直接找包(bao)工頭等),他們由(you)于(yu)各種(zhong)原因沒有(you)簽訂勞(lao)動(dong)(dong)合(he)同(tong)或(huo)者簽訂的(de)(de)(de)勞(lao)動(dong)(dong)合(he)同(tong)過(guo)于(yu)簡單(dan),致使發(fa)生(sheng)工資拖欠(qian)時缺乏法律依據,勞(lao)動(dong)(dong)部門(men)無從下手解(jie)決。

3.行(xing)政執法(fa)(fa)部(bu)門執法(fa)(fa)力度不(bu)夠。對(dui)勞(lao)(lao)動者的(de)工(gong)(gong)(gong)資(zi)的(de)支付(fu)(fu)和對(dui)克扣(kou)工(gong)(gong)(gong)資(zi)的(de)行(xing)為處罰在(zai)《勞(lao)(lao)動法(fa)(fa)》第(di)五十(shi)條(tiao)和第(di)九十(shi)一(yi)條(tiao)、《違反〈中華人(ren)民(min)(min)共和國(guo)勞(lao)(lao)動法(fa)(fa)〉行(xing)政處罰辦(ban)法(fa)(fa)》第(di)六(liu)條(tiao)和《工(gong)(gong)(gong)資(zi)支付(fu)(fu)暫行(xing)規定》都做出(chu)了相應的(de)規定,但是對(dui)于此行(xing)為的(de)處罰偏輕,而(er)對(dui)于克扣(kou)民(min)(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)后逃匿的(de)行(xing)為更沒有(you)相關的(de)法(fa)(fa)律規定;行(xing)政程(cheng)序處理耗時過長,根(gen)據《勞(lao)(lao)動法(fa)(fa)》第(di)八十(shi)二條(tiao)從(cong)勞(lao)(lao)動爭議發生到仲(zhong)裁裁決就(jiu)需要四個月(yue)時間,在(zai)加上法(fa)(fa)院漫長的(de)訴(su)訟,農民(min)(min)工(gong)(gong)(gong)根(gen)本拖不(bu)起;勞(lao)(lao)動監(jian)察(cha)執法(fa)(fa)力度疲(pi)軟,不(bu)能主動有(you)力地查處勞(lao)(lao)動用工(gong)(gong)(gong)方(fang)面的(de)違法(fa)(fa)事(shi)件,往往采取民(min)(min)告官辦(ban),不(bu)告不(bu)理的(de)被(bei)動態度來對(dui)待勞(lao)(lao)動糾(jiu)紛。

二、解決拖欠農(nong)民工工資的(de)法律(lv)對策(ce)

拖欠農(nong)民工(gong)工(gong)資現象(xiang)盡管(guan)原因是多方面(mian)的(de)(de)(de),但反映(ying)了我國現階段在(zai)勞(lao)動(dong)保障、勞(lao)動(dong)就業和(he)(he)勞(lao)動(dong)管(guan)理方面(mian)的(de)(de)(de)機(ji)(ji)制薄(bo)弱,也說明(ming)了勞(lao)動(dong)者的(de)(de)(de)生存權沒有(you)(you)(you)在(zai)真正意義(yi)上得到保障,平等的(de)(de)(de)勞(lao)動(dong)關(guan)系和(he)(he)有(you)(you)(you)力的(de)(de)(de)監督(du)機(ji)(ji)制尚(shang)未牢固(gu)確立。這一現象(xiang)的(de)(de)(de)存在(zai),既影響著物質文(wen)(wen)明(ming)的(de)(de)(de)發展,也有(you)(you)(you)悖于精神文(wen)(wen)明(ming)和(he)(he)政治文(wen)(wen)明(ming)的(de)(de)(de)要求,有(you)(you)(you)必要采(cai)取有(you)(you)(you)力措施進(jin)行整頓和(he)(he)矯治。建議以法律的(de)(de)(de)角度從以下幾方面(mian)予(yu)以治理:

1.廢除勞動(dong)仲(zhong)裁(cai)前(qian)置程序(xu)(xu)或專項(xiang)賦予仲(zhong)裁(cai)機構的(de)(de)(de)(de)仲(zhong)裁(cai)強(qiang)制性。勞動(dong)仲(zhong)裁(cai)和勞動(dong)訴(su)訟是(shi)追償工(gong)資的(de)(de)(de)(de)有(you)效手段,但是(shi)從(cong)司(si)法(fa)實(shi)踐上(shang)看(kan),解決(jue)欠(qian)薪等勞動(dong)爭議(yi)案(an)件,從(cong)欠(qian)薪情況(kuang)(kuang)的(de)(de)(de)(de)發生到(dao)法(fa)院訴(su)訟解決(jue)至(zhi)少需要一年的(de)(de)(de)(de)時間(jian)(jian),使處(chu)在(zai)弱勢地位的(de)(de)(de)(de)農民(min)工(gong)很難(nan)通過法(fa)律(lv)途徑為自己討回公道,簡(jian)化勞動(dong)爭議(yi)糾紛的(de)(de)(de)(de)程序(xu)(xu),使民(min)工(gong)能(neng)(neng)夠(gou)在(zai)不進(jin)行仲(zhong)裁(cai)的(de)(de)(de)(de)情況(kuang)(kuang)下直接(jie)。勞動(dong)仲(zhong)裁(cai)程序(xu)(xu)是(shi)法(fa)律(lv)訴(su)訟之前(qian)的(de)(de)(de)(de)必經環節,但是(shi)由于(yu)其(qi)仲(zhong)裁(cai)結果沒有(you)強(qiang)制性,因此(ci)對用工(gong)單位沒有(you)實(shi)際意義的(de)(de)(de)(de)約束力。針對民(min)工(gong)欠(qian)薪情況(kuang)(kuang),專項(xiang)賦予其(qi)仲(zhong)裁(cai)強(qiang)制性,不僅時間(jian)(jian)上(shang)大大的(de)(de)(de)(de)縮(suo)短,而且(qie)大量的(de)(de)(de)(de)節省了司(si)法(fa)資源。總之,這(zhe)樣不僅能(neng)(neng)增(zeng)強(qiang)法(fa)律(lv)法(fa)規的(de)(de)(de)(de)震懾力,還能(neng)(neng)體現人(ren)文(wen)的(de)(de)(de)(de)關懷,盡(jin)可能(neng)(neng)方便打工(gong)者(zhe),有(you)效避免拖欠(qian)民(min)工(gong)工(gong)資問題的(de)(de)(de)(de)發生。

2.建立舉(ju)(ju)證(zheng)(zheng)(zheng)(zheng)責(ze)任(ren)(ren)倒置(zhi)制度。這(zhe)對保護處(chu)(chu)于(yu)(yu)弱勢地位(wei)(wei)的(de)(de)(de)勞動者(zhe)(zhe)(zhe)至(zhi)關(guan)(guan)重要(yao),也能徹底(di)根(gen)治用(yong)人單位(wei)(wei)不(bu)與勞動者(zhe)(zhe)(zhe)簽訂勞動合同,拒(ju)不(bu)提供證(zheng)(zheng)(zheng)(zheng)據(ju)(ju)的(de)(de)(de)違(wei)法行為。用(yong)人單位(wei)(wei)或(huo)者(zhe)(zhe)(zhe)雇(gu)(gu)主(zhu)(zhu)處(chu)(chu)于(yu)(yu)強勢地位(wei)(wei),其對于(yu)(yu)工資(zi)支付信息擁(yong)有(you)絕對的(de)(de)(de)控制和支配權(quan),就工資(zi)支付的(de)(de)(de)有(you)關(guan)(guan)事(shi)項的(de)(de)(de)舉(ju)(ju)證(zheng)(zheng)(zheng)(zheng)能力遠遠強于(yu)(yu)民工,況且他(ta)們(men)本身就是(shi)拖欠(qian)風險(xian)的(de)(de)(de)制造者(zhe)(zhe)(zhe)。因(yin)此(ci)根(gen)據(ju)(ju)《證(zheng)(zheng)(zheng)(zheng)據(ju)(ju)法》的(de)(de)(de)一般原理,實(shi)行舉(ju)(ju)證(zheng)(zheng)(zheng)(zheng)責(ze)任(ren)(ren)倒置(zhi),讓用(yong)人單位(wei)(wei)或(huo)者(zhe)(zhe)(zhe)雇(gu)(gu)主(zhu)(zhu)承(cheng)擔對工資(zi)支付事(shi)項的(de)(de)(de)舉(ju)(ju)證(zheng)(zheng)(zheng)(zheng)責(ze)任(ren)(ren),一旦勞動者(zhe)(zhe)(zhe)舉(ju)(ju)報或(huo),用(yong)人單位(wei)(wei)要(yao)承(cheng)擔舉(ju)(ju)證(zheng)(zheng)(zheng)(zheng)的(de)(de)(de)責(ze)任(ren)(ren),規定期限內舉(ju)(ju)證(zheng)(zheng)(zheng)(zheng)不(bu)能或(huo)證(zheng)(zheng)(zheng)(zheng)據(ju)(ju)不(bu)足,將被行政處(chu)(chu)理或(huo)敗訴,這(zhe)樣的(de)(de)(de)規定,有(you)利于(yu)(yu)強化對用(yong)人單位(wei)(wei)和雇(gu)(gu)主(zhu)(zhu)的(de)(de)(de)約束,降(jiang)低農民工的(de)(de)(de)維(wei)權(quan)成(cheng)本,提高(gao)司法效率。

3.對欠(qian)薪的(de)(de)單位(wei)建(jian)立“黑名單”制度和(he)“保證金”制度。勞動監察機構徹(che)底(di)清(qing)查各個單位(wei)拖欠(qian)農民工(gong)工(gong)資的(de)(de)情況(kuang),特(te)別(bie)是建(jian)筑(zhu)、餐(can)飲、煤礦、制造等勞動密(mi)集型(xing)企(qi)業(ye),再根據其(qi)拖欠(qian)程度的(de)(de)不同(tong),將其(qi)分(fen)為不同(tong)的(de)(de)信用(yong)(yong)等級,并(bing)(bing)配合新聞媒體這(zhe)一有(you)利的(de)(de)社會喉舌,對于信用(yong)(yong)差的(de)(de)用(yong)(yong)工(gong)單位(wei)及其(qi)法人的(de)(de)名單給予曝光和(he)通報,而對及時發放民工(gong)工(gong)資的(de)(de)用(yong)(yong)人單位(wei)予以鼓勵,并(bing)(bing)對他們的(de)(de)經濟(ji)活動給予一定(ding)政策(ce)優惠(hui),如稅收優惠(hui)等。總之(zhi),要積極(ji)鼓勵、引導用(yong)(yong)工(gong)單位(wei)公平對待(dai)農民工(gong)。

4.將惡(e)意拖欠(qian)(qian)工(gong)資(zi)和(he)抽逃工(gong)資(zi)發(fa)放(fang)的(de)(de)行(xing)為(wei)納入刑(xing)法。廣大(da)的(de)(de)農民工(gong)處(chu)在社(she)(she)(she)會的(de)(de)最底層,每天辛苦工(gong)作所得的(de)(de)微薄報(bao)酬不(bu)僅(jin)是他們(men)的(de)(de)生活來源(yuan),更(geng)可(ke)能是他們(men)整個家庭的(de)(de)經濟支柱。長期的(de)(de)拖欠(qian)(qian)他們(men)的(de)(de)工(gong)資(zi)報(bao)酬,無疑是對其釜底抽薪,而(er)這還很可(ke)能會造(zao)成社(she)(she)(she)會的(de)(de)不(bu)穩定(ding)因(yin)素,因(yin)此必(bi)須(xu)妥善解決。然而(er),現行(xing)的(de)(de)相關法律法規對惡(e)意拖欠(qian)(qian)工(gong)資(zi)和(he)抽逃工(gong)資(zi)發(fa)放(fang)的(de)(de)單位和(he)個人的(de)(de)處(chu)罰力度偏軟,不(bu)足以產生威(wei)懾力。因(yin)此我們(men)應從(cong)經濟制(zhi)裁和(he)刑(xing)事(shi)制(zhi)裁上兩(liang)手抓兩(liang)手硬,根(gen)據情節(jie)輕(qing)重(zhong)及社(she)(she)(she)會影響和(he)數額的(de)(de)大(da)小,給予不(bu)同程度的(de)(de)刑(xing)事(shi)制(zhi)裁,從(cong)根(gen)本上遏制(zhi)拖欠(qian)(qian)和(he)抽逃行(xing)為(wei)的(de)(de)發(fa)生,而(er)也只有(you)(you)這樣,才(cai)能切實做到“有(you)(you)法可(ke)依(yi),有(you)(you)法必(bi)依(yi),執(zhi)法必(bi)嚴(yan),違法必(bi)究”。

5.簡(jian)化訴訟程序。因(yin)拖欠工資引發(fa)的(de)(de)民(min)事(shi)糾紛,司法(fa)(fa)(fa)機關應為民(min)工維權(quan)開(kai)辟“優先通道”,當(dang)侵犯農民(min)工合法(fa)(fa)(fa)權(quan)益的(de)(de)案件(jian)(jian)投訴到(dao)司法(fa)(fa)(fa)部門時,對(dui)欠薪案件(jian)(jian)實(shi)(shi)行(xing)優先立案,優先審理,優先執(zhi)(zhi)行(xing)。審理期間要盡量壓縮(suo)訴訟周(zhou)期和減少訴訟成本,判決(jue)結果也盡可能(neng)的(de)(de)不打“法(fa)(fa)(fa)律白(bai)條(tiao)”,把執(zhi)(zhi)行(xing)落到(dao)實(shi)(shi)處。對(dui)經濟確有困難(nan)的(de)(de)民(min)工追討勞動報酬的(de)(de)案件(jian)(jian),應依法(fa)(fa)(fa)減免緩繳訴訟費,切實(shi)(shi)為當(dang)事(shi)人減輕負(fu)擔。我(wo)們(men)應該(gai)讓廣(guang)大的(de)(de)農民(min)工都能(neng)夠利(li)(li)用(yong)法(fa)(fa)(fa)律的(de)(de)武器來維護自己的(de)(de)合法(fa)(fa)(fa)權(quan)益,不僅(jin)能(neng)使欠薪的(de)(de)單位或個人無處藏身,而且更有利(li)(li)于民(min)主(zhu)法(fa)(fa)(fa)制建(jian)設(she)的(de)(de)進程。

6.采(cai)(cai)取政(zheng)(zheng)府問(wen)責制。勞(lao)動監(jian)(jian)察(cha)執法(fa)(fa)力(li)度(du)(du)疲(pi)軟(ruan),不(bu)(bu)能主動有(you)力(li)地查處勞(lao)動用工方面的(de)(de)(de)違法(fa)(fa)事件,往往采(cai)(cai)取民告官辦(ban)(ban),不(bu)(bu)告不(bu)(bu)理的(de)(de)(de)被動態度(du)(du)來對待勞(lao)動糾紛(fen),這(zhe)種不(bu)(bu)能主動作為的(de)(de)(de)態度(du)(du)就(jiu)給拖欠工資現象提供了(le)滋生的(de)(de)(de)土(tu)壤。基層的(de)(de)(de)勞(lao)動監(jian)(jian)察(cha)執法(fa)(fa)部門是(shi)(shi)最(zui)與(yu)群眾貼近的(de)(de)(de),是(shi)(shi)最(zui)能反映政(zheng)(zheng)府機(ji)構辦(ban)(ban)事能力(li)的(de)(de)(de),而要使其(qi)能夠積極的(de)(de)(de)變被動為主動,最(zui)好的(de)(de)(de)辦(ban)(ban)法(fa)(fa)就(jiu)是(shi)(shi)勞(lao)動監(jian)(jian)察(cha)執法(fa)(fa)部門也(ye)承擔一定的(de)(de)(de)連帶責任,這(zhe)樣就(jiu)不(bu)(bu)會再有(you)“辦(ban)(ban)事人員不(bu)(bu)夠,辦(ban)(ban)公經費緊張,覆蓋范圍太廣”等諸多借口來推(tui)托(tuo)本就(jiu)屬于自己的(de)(de)(de)責任。

一(yi)、本辦法(fa)適(shi)用于在(zai)中華人(ren)民共和(he)國境(jing)內的建筑業(ye)(ye)企(qi)業(ye)(ye)(以下簡稱企(qi)業(ye)(ye))和(he)與之形成勞動(dong)關(guan)系的農(nong)民工(gong)。

本辦法(fa)所(suo)指(zhi)建(jian)筑業企業,是(shi)指(zhi)從事(shi)土(tu)木(mu)工程、建(jian)筑工程、線路管道設備安裝工程、裝修(xiu)工程的(de)新建(jian)、擴建(jian)、改建(jian)活動的(de)企業。

二、縣級以上勞(lao)動和(he)社會保障行(xing)政部門(men)負(fu)責企(qi)業(ye)工資支付的監督管理(li),建設行(xing)政主管部門(men)協助勞(lao)動和(he)社會保障行(xing)政部門(men)對(dui)企(qi)業(ye)執行(xing)本辦法的情況進(jin)行(xing)監督檢查。

三(san)、企業(ye)必須嚴格按照《勞動法》、《工(gong)資(zi)支付暫行規定》和《最(zui)低工(gong)資(zi)規定》等(deng)有關規定支付農民工(gong)工(gong)資(zi),不得拖(tuo)欠或克扣。

四、企業(ye)應依法(fa)通(tong)過集體協(xie)商(shang)或其他民主(zhu)協(xie)商(shang)形式(shi)制(zhi)定(ding)內(nei)部(bu)工資支付(fu)辦(ban)法(fa),并告知本企業(ye)全(quan)體農民工,同時抄報當地(di)勞動(dong)和社(she)會保障行政部(bu)門與建(jian)設(she)行政主(zhu)管部(bu)門。

五、企業(ye)內(nei)部(bu)工(gong)資(zi)(zi)支(zhi)(zhi)付(fu)辦法應包括以下內(nei)容:支(zhi)(zhi)付(fu)項目、支(zhi)(zhi)付(fu)標準、支(zhi)(zhi)付(fu)方式(shi)、支(zhi)(zhi)付(fu)周期和日(ri)期、加班工(gong)資(zi)(zi)計算基數、特殊情況下的工(gong)資(zi)(zi)支(zhi)(zhi)付(fu)以及其他(ta)工(gong)資(zi)(zi)支(zhi)(zhi)付(fu)內(nei)容。

六、企業應當(dang)根(gen)據勞動合同(tong)約(yue)定的(de)農民(min)工(gong)工(gong)資標準(zhun)等(deng)內(nei)容,按照(zhao)依法簽訂的(de)集體合同(tong)或勞動合同(tong)約(yue)定的(de)日(ri)期(qi)按月支(zhi)付(fu)工(gong)資,并不得低于(yu)當(dang)地最低工(gong)資標準(zhun)。具(ju)體支(zhi)付(fu)方式可由企業結(jie)合建筑

行業特點在內部(bu)工資支付辦(ban)法(fa)中規定(ding)。

七、企業應(ying)將工(gong)資(zi)直接發放(fang)給農(nong)民工(gong)本人,嚴禁發放(fang)給“包(bao)工(gong)頭”或(huo)其他不具備(bei)用工(gong)主(zhu)體資(zi)格的(de)組(zu)織和個(ge)人。

企業(ye)可(ke)委(wei)托(tuo)銀(yin)行發放農民工工資。

八、企業支付(fu)農民工(gong)工(gong)資(zi)應編制工(gong)資(zi)支付(fu)表,如實(shi)記(ji)錄(lu)支付(fu)單(dan)位、支付(fu)時間、支付(fu)對象、支付(fu)數(shu)額等(deng)工(gong)資(zi)支付(fu)情況,并保存兩年以上備(bei)查。

九、工(gong)程總承包企(qi)業應對勞務分包企(qi)業工(gong)資支付(fu)進行監督(du),督(du)促其依法(fa)支付(fu)農民工(gong)工(gong)資。

十、業主(zhu)或工(gong)(gong)程(cheng)(cheng)總承(cheng)包企業未(wei)按合同約定與建設工(gong)(gong)程(cheng)(cheng)承(cheng)包企業結(jie)清工(gong)(gong)程(cheng)(cheng)款(kuan),致使建設工(gong)(gong)程(cheng)(cheng)承(cheng)包企業拖(tuo)欠農(nong)(nong)民工(gong)(gong)工(gong)(gong)資(zi)的,由業主(zhu)或工(gong)(gong)程(cheng)(cheng)總承(cheng)包企業先行墊付(fu)農(nong)(nong)民工(gong)(gong)被拖(tuo)欠的工(gong)(gong)資(zi),先行墊付(fu)的工(gong)(gong)資(zi)數(shu)額以未(wei)結(jie)清的工(gong)(gong)程(cheng)(cheng)款(kuan)為限。

十一、企(qi)業因被拖欠(qian)工(gong)(gong)程款導致(zhi)拖欠(qian)農民工(gong)(gong)工(gong)(gong)資的(de),企(qi)業追回的(de)被拖欠(qian)工(gong)(gong)程款,應優先用于支(zhi)付拖欠(qian)的(de)農民工(gong)(gong)工(gong)(gong)資。

十二(er)、工(gong)(gong)程(cheng)總(zong)承包(bao)企業不(bu)得將工(gong)(gong)程(cheng)違反規定發包(bao)、分包(bao)給不(bu)具備用工(gong)(gong)主體(ti)資格的組織或個(ge)人(ren),否則應承擔清(qing)償拖欠(qian)工(gong)(gong)資連帶(dai)責任。

十三、企業應定期(qi)如實向當地勞動(dong)和社(she)會保障行(xing)政(zheng)部(bu)門及(ji)建(jian)設行(xing)政(zheng)主管部(bu)門報送(song)本單位工資支(zhi)付情況。

 十四、企(qi)業違反國家工資支(zhi)付規定拖欠或克扣農民工工資的,記(ji)人信用(yong)檔案,并通報有(you)關(guan)部門。

建設行(xing)(xing)政主管部門可依法對其市場準(zhun)入(ru)、招投(tou)標(biao)資格和新開工(gong)(gong)項目(mu)施工(gong)(gong)許可等進行(xing)(xing)限制,并予以(yi)相應處罰。

 十五、企業應按有關規定繳納(na)工(gong)資(zi)保障金,存入(ru)當地政府指定的專戶,用于墊付(fu)拖欠的農(nong)民工(gong)工(gong)資(zi)。

十(shi)六、農民工發現企業有下列情形之一的,有權向勞動(dong)和社(she)會保障行政(zheng)部門舉(ju)報:

(一)未(wei)按照約(yue)定支付工(gong)資的;

(二)支付工(gong)資低于當(dang)地最低工(gong)資標準(zhun)的;

(三)拖欠或克扣工資的;

(四)不支付加班(ban)工資的;

(五)侵(qin)害(hai)工資報酬(chou)權益(yi)的其他行為(wei)。

十七(qi)、各級勞動和社(she)會保障(zhang)行(xing)(xing)政部門(men)依法對(dui)企(qi)(qi)業支(zhi)付農民工工資情況(kuang)進行(xing)(xing)監(jian)察(cha),對(dui)違法行(xing)(xing)為進行(xing)(xing)處理。企(qi)(qi)業在接受監(jian)察(cha)時應當如實報(bao)告情況(kuang),提供必要(yao)的資料和證明。

十八(ba)、農民工(gong)與(yu)企業因(yin)工(gong)資支付發生爭議的(de),按照國家勞(lao)動爭議處(chu)理有關規(gui)定處(chu)理。
