關鍵詞:主任檢察官;改革;權力監督
最高人民(min)檢察(cha)(cha)(cha)院(yuan)(yuan)(yuan)分別于2013年12月(yue)(yue)和2014年3月(yue)(yue)相繼印發了《檢察(cha)(cha)(cha)官辦(ban)案責(ze)任(ren)(ren)(ren)制改革(ge)試點(dian)方案》和《檢察(cha)(cha)(cha)官辦(ban)案責(ze)任(ren)(ren)(ren)制改革(ge)試點(dian)實(shi)(shi)施工(gong)作指導意見(jian)》,確(que)定了17個基層檢察(cha)(cha)(cha)院(yuan)(yuan)(yuan)及地市(shi)級(ji)檢察(cha)(cha)(cha)院(yuan)(yuan)(yuan)作為檢察(cha)(cha)(cha)官辦(ban)案責(ze)任(ren)(ren)(ren)制改革(ge)的(de)試點(dian)單位。對主任(ren)(ren)(ren)檢察(cha)(cha)(cha)官辦(ban)案責(ze)任(ren)(ren)(ren)制試點(dian)工(gong)作,結合(he)渝北(bei)區院(yuan)(yuan)(yuan)近年來的(de)實(shi)(shi)踐經驗(yan),筆者(zhe)也(ye)有自己的(de)一些觀點(dian):
一、關(guan)于主任檢察(cha)官辦案組(zu)的定位
(一)關于主任檢察(cha)官辦(ban)案(an)組的組織形式問(wen)題
筆者同意將主任檢察官辦案組作為檢察機關基本辦案組織的定位,不同意某些地方提出將這一辦案組織稱為“主任檢察官辦公室”的提法,這種提法給人的印象就是建立一些新的科室。同時,筆者認為:不能將主任檢察官辦案組建成類似于法院合議制的辦案組織。法院的合議制和主任檢察官辦案組的不同點在于:法院的合議制(合議庭)是相當靈活的組織,它是根據個案的審判需要而建立的臨時的組織,它只對個案負責;而主任檢察官辦案組是相對固定的組織,它在一定時期內是固定的,它對這一時期所辦理的案件負責。其次,法院的合議制(合議庭)組成人員是在審判長主持下對個案進行審理,成員之間權力平等;而主任檢察官辦案組的成員是在主任檢察官指揮、領導下辦理案件,主任檢察官有案件處理決定權(根據檢察長授權),其它成員(檢察官助理)則(ze)不具有案件處理決定權。
(二(er))關于主(zhu)任檢察官辦案組(zu)的職能(neng)問(wen)題
“必須對檢(jian)(jian)察(cha)(cha)機關內部權力(li)結構(gou)進行(xing)(xing)適當調整,積極構(gou)建主任檢(jian)(jian)察(cha)(cha)官享有一定(ding)(ding)獨立(li)性(xing)的(de)(de)有關職權行(xing)(xing)使規(gui)則。在現有法(fa)律框架內,特別是依據檢(jian)(jian)察(cha)(cha)官法(fa)第六條關于檢(jian)(jian)察(cha)(cha)官職責的(de)(de)四項規(gui)定(ding)(ding),可以(yi)考慮(lv)將一些非終局性(xing)決定(ding)(ding)的(de)(de)權力(li),由檢(jian)(jian)察(cha)(cha)長(chang)授(shou)權主任檢(jian)(jian)察(cha)(cha)官行(xing)(xing)使,解決主任檢(jian)(jian)察(cha)(cha)官權力(li)來源(yuan)的(de)(de)合(he)法(fa)性(xing)問題”。筆者(zhe)贊同以(yi)上認識,并推薦(jian)重慶市渝北區(qu)人(ren)民檢(jian)(jian)察(cha)(cha)院試(shi)行(xing)(xing)的(de)(de)檢(jian)(jian)察(cha)(cha)官辦案(an)責任制的(de)(de)做法(fa)和經(jing)驗。
從2005年(nian)開始,重慶(qing)市渝北區人(ren)民檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)院(yuan)試(shi)行(xing)了檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)人(ren)員(yuan)分(fen)(fen)類(lei)管理(li)(li)改革,其中(zhong)重點就是(shi)對(dui)(dui)(dui)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)辦(ban)(ban)(ban)案(an)(an)責(ze)(ze)任(ren)(ren)制(zhi)進(jin)行(xing)探索。該院(yuan)在(zai)試(shi)點工作中(zhong),把(ba)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)人(ren)員(yuan)分(fen)(fen)為檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)、檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)助(zhu)理(li)(li)、檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)行(xing)政人(ren)員(yuan)三類(lei),并設計了“三局(ju)(ju)(ju)兩部一(yi)辦(ban)(ban)(ban)”的(de)(de)(de)組織構(gou)架(即職務犯罪偵查局(ju)(ju)(ju)、刑事(shi)(shi)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)局(ju)(ju)(ju)、訴(su)訟(song)監督局(ju)(ju)(ju)、政治部、檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)事(shi)(shi)務部、檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)長(chang)辦(ban)(ban)(ban)公室)。在(zai)刑事(shi)(shi)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)局(ju)(ju)(ju)、訴(su)訟(song)監督局(ju)(ju)(ju)試(shi)行(xing)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)(相當于(yu)現在(zai)的(de)(de)(de)主任(ren)(ren)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan))辦(ban)(ban)(ban)案(an)(an)責(ze)(ze)任(ren)(ren)制(zhi),按照(zhao)1名檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)帶2名以(yi)上檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)助(zhu)理(li)(li)的(de)(de)(de)辦(ban)(ban)(ban)案(an)(an)模(mo)式,設若干檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)辦(ban)(ban)(ban)案(an)(an)組,實行(xing)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)相對(dui)(dui)(dui)獨立負(fu)責(ze)(ze)辦(ban)(ban)(ban)案(an)(an)的(de)(de)(de)工作機(ji)制(zhi),著力突出檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)在(zai)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)業(ye)務工作中(zhong)的(de)(de)(de)主體地位,成(cheng)為責(ze)(ze)任(ren)(ren)主體,直接對(dui)(dui)(dui)分(fen)(fen)管檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)長(chang)或檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)長(chang)負(fu)責(ze)(ze)。檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)助(zhu)理(li)(li)在(zai)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)領導、指揮下(xia)工作,協助(zhu)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)辦(ban)(ban)(ban)理(li)(li)案(an)(an)件,對(dui)(dui)(dui)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)負(fu)責(ze)(ze)。該院(yuan)規定(ding):檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)對(dui)(dui)(dui)帶有(you)訴(su)訟(song)終(zhong)局(ju)(ju)(ju)性(xing)的(de)(de)(de)決定(ding)(不捕(bu)、不訴(su))享有(you)建議權(quan),對(dui)(dui)(dui)非終(zhong)局(ju)(ju)(ju)性(xing)的(de)(de)(de)享有(you)決定(ding)權(quan)(批準逮捕(bu)、提起公訴(su))。
2014年(nian),重慶市(shi)渝北區人(ren)民檢(jian)察(cha)(cha)院(yuan)根(gen)據(ju)最(zui)高(gao)人(ren)民檢(jian)察(cha)(cha)院(yuan)的安排部(bu)署,開始試行主(zhu)任(ren)檢(jian)察(cha)(cha)官辦案責(ze)任(ren)制(zhi),進一(yi)步放權(quan)給(gei)主(zhu)任(ren)檢(jian)察(cha)(cha)官,將(jiang)部(bu)分案件的審查逮捕(批(pi)(pi)捕、不(bu)捕)、審查(、不(bu))實體決定(ding)權(quan)配置給(gei)主(zhu)任(ren)檢(jian)察(cha)(cha)官,又將(jiang)部(bu)分科級以(yi)下干部(bu)的初查權(quan)配置給(gei)主(zhu)任(ren)檢(jian)察(cha)(cha)官,這些權(quan)限(xian)一(yi)般由主(zhu)任(ren)檢(jian)察(cha)(cha)官獨(du)立行使,不(bu)再報請審批(pi)(pi)。
(三(san))關于主(zhu)任檢察官辦案組與業務部門的(de)關系
關(guan)(guan)(guan)于業務部門與(yu)主(zhu)(zhu)任檢(jian)察官(guan)辦案組的(de)(de)關(guan)(guan)(guan)系,兩者既不能形成(cheng)領導與(yu)被領導關(guan)(guan)(guan)系,又不能把主(zhu)(zhu)任檢(jian)察官(guan)辦案組完全獨立成(cheng)變相的(de)(de)小(xiao)科室,其(qi)核心就是淡化行政色彩,要注(zhu)意以下(xia)幾(ji)點(dian):
一是淡化業(ye)務(wu)部門的(de)行(xing)(xing)(xing)政管(guan)理色彩。業(ye)務(wu)部門只行(xing)(xing)(xing)使行(xing)(xing)(xing)政事務(wu)管(guan)理和案(an)件流程(cheng)監督(du)管(guan)理,不對主任檢察官(guan)辦案(an)組的(de)案(an)件負責。
二是精簡業務(wu)(wu)(wu)機(ji)構,減少行(xing)政(zheng)管理(li)環(huan)節。重(zhong)慶市渝北(bei)區人(ren)民檢(jian)察(cha)(cha)(cha)院在檢(jian)察(cha)(cha)(cha)人(ren)員分(fen)類(lei)管理(li)改(gai)革試點工作(zuo)中(zhong),把原來的(de)(de)13個部門精簡為“三(san)局(ju)(ju)(ju)二部一(yi)辦”模(mo)式。即:職(zhi)務(wu)(wu)(wu)犯(fan)罪偵(zhen)查局(ju)(ju)(ju)、刑(xing)事(shi)檢(jian)察(cha)(cha)(cha)局(ju)(ju)(ju)、訴訟(song)監督局(ju)(ju)(ju)、政(zheng)治部、檢(jian)察(cha)(cha)(cha)事(shi)務(wu)(wu)(wu)部、檢(jian)察(cha)(cha)(cha)長(chang)辦公室(案(an)件管理(li)中(zhong)心(xin))的(de)(de)組(zu)織架(jia)構。刑(xing)事(shi)檢(jian)察(cha)(cha)(cha)局(ju)(ju)(ju)、訴訟(song)監督局(ju)(ju)(ju)的(de)(de)機(ji)構職(zhi)能主要負責行(xing)政(zheng)事(shi)務(wu)(wu)(wu)和業務(wu)(wu)(wu)工作(zuo)監督,不對具體辦案(an)負責,而職(zhi)務(wu)(wu)(wu)犯(fan)罪偵(zhen)查局(ju)(ju)(ju)則根據偵(zhen)查工作(zuo)的(de)(de)特點和需要,實行(xing)行(xing)政(zheng)領導與檢(jian)察(cha)(cha)(cha)官(guan)合一(yi)的(de)(de)辦案(an)工作(zuo)機(ji)制,檢(jian)察(cha)(cha)(cha)長(chang)辦公室(案(an)件管理(li)中(zhong)心(xin))的(de)(de)主要職(zhi)能是對檢(jian)察(cha)(cha)(cha)官(guan)履行(xing)檢(jian)察(cha)(cha)(cha)權實施監督,政(zheng)治部、檢(jian)察(cha)(cha)(cha)事(shi)務(wu)(wu)(wu)部負責隊伍建設和行(xing)政(zheng)事(shi)務(wu)(wu)(wu)管理(li)。
三是探索(suo)取消業務(wu)機(ji)(ji)構(gou)的辦案(an)工(gong)作機(ji)(ji)制。為(wei)了更好地突出檢(jian)察機(ji)(ji)關的司法屬性,淡化行(xing)(xing)政(zheng)色彩(cai),筆者建(jian)議人員較少(50人以下)的基層檢(jian)察機(ji)(ji)關,取消業務(wu)機(ji)(ji)構(gou)的設(she)(she)置 。即按自偵(zhen)、偵(zhen)監(jian)、公訴、控申、民行(xing)(xing)、監(jian)所等業務(wu)設(she)(she)若干主任檢(jian)察官辦案(an)組(zu),按照(zhao)分(fen)工(gong)獨(du)立負(fu)(fu)(fu)責(ze)履(lv)行(xing)(xing)檢(jian)察職責(ze),直(zhi)接對(dui)檢(jian)察長負(fu)(fu)(fu)責(ze),業務(wu)工(gong)作管(guan)理職能由案(an)件管(guan)理中心(xin)負(fu)(fu)(fu)責(ze),由政(zheng)治部(bu)(處)、事務(wu)部(bu)分(fen)別負(fu)(fu)(fu)責(ze)隊伍建(jian)設(she)(she)和行(xing)(xing)政(zheng)事務(wu)管(guan)理工(gong)作。
(四)關于主任檢察官辦案組內(nei)部人員管理問題
主(zhu)任(ren)(ren)(ren)(ren)(ren)檢(jian)察(cha)官(guan)(guan)指揮(hui)、領導內(nei)部(bu)成員(yuan)辦(ban)(ban)(ban)(ban)理(li)(li)案(an)(an)(an)件,這種(zhong)管理(li)(li)關系已成為共識。但多(duo)數人(ren)(ren)認為,主(zhu)任(ren)(ren)(ren)(ren)(ren)檢(jian)察(cha)官(guan)(guan)責任(ren)(ren)(ren)(ren)(ren)大(da)(da)、壓力(li)大(da)(da),對(dui)(dui)內(nei)部(bu)組(zu)(zu)成人(ren)(ren)員(yuan)沒有(you)選(xuan)(xuan)任(ren)(ren)(ren)(ren)(ren)權(quan),不(bu)便于管理(li)(li)。其矛盾焦(jiao)點就是對(dui)(dui)個別(bie)素質較(jiao)差的(de)人(ren)(ren)員(yuan),沒有(you)主(zhu)任(ren)(ren)(ren)(ren)(ren)檢(jian)察(cha)官(guan)(guan)辦(ban)(ban)(ban)(ban)案(an)(an)(an)組(zu)(zu)愿意選(xuan)(xuan),是黨(dang)組(zu)(zu)硬性安排的(de)。其實(shi),在現行體制(zhi)下(xia),黨(dang)組(zu)(zu)對(dui)(dui)全(quan)院人(ren)(ren)員(yuan)也只有(you)管理(li)(li)權(quan),對(dui)(dui)中層干(gan)部(bu)、主(zhu)任(ren)(ren)(ren)(ren)(ren)檢(jian)察(cha)官(guan)(guan)有(you)較(jiao)大(da)(da)的(de)選(xuan)(xuan)任(ren)(ren)(ren)(ren)(ren)權(quan),但對(dui)(dui)所有(you)檢(jian)察(cha)人(ren)(ren)員(yuan)也沒有(you)絕對(dui)(dui)的(de)選(xuan)(xuan)任(ren)(ren)(ren)(ren)(ren)權(quan)(都是組(zu)(zu)織部(bu)門和上級檢(jian)察(cha)機關統一招錄(lu))。所以(yi),主(zhu)任(ren)(ren)(ren)(ren)(ren)檢(jian)察(cha)官(guan)(guan)辦(ban)(ban)(ban)(ban)案(an)(an)(an)組(zu)(zu)要有(you)絕對(dui)(dui)的(de)選(xuan)(xuan)任(ren)(ren)(ren)(ren)(ren)權(quan)是不(bu)可(ke)能(neng)的(de)。筆者建議:主(zhu)任(ren)(ren)(ren)(ren)(ren)檢(jian)察(cha)官(guan)(guan)辦(ban)(ban)(ban)(ban)案(an)(an)(an)組(zu)(zu)采取雙(shuang)向選(xuan)(xuan)擇(ze)(ze)與領導決定相結合(he)的(de)方式組(zu)(zu)成,每(mei)個主(zhu)任(ren)(ren)(ren)(ren)(ren)檢(jian)察(cha)官(guan)(guan)辦(ban)(ban)(ban)(ban)案(an)(an)(an)組(zu)(zu)可(ke)以(yi)雙(shuang)向選(xuan)(xuan)擇(ze)(ze)1-2名辦(ban)(ban)(ban)(ban)案(an)(an)(an)骨干(gan)人(ren)(ren)員(yuan),其它(ta)人(ren)(ren)員(yuan)由黨(dang)組(zu)(zu)統一調配,這才(cai)是現行體制(zhi)下(xia)能(neng)夠行使的(de)模式。
二、關于(yu)主任檢(jian)察官的任職資格
主(zhu)(zhu)(zhu)任(ren)(ren)(ren)(ren)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)官(guan)的(de)素質(zhi)是確(que)保(bao)主(zhu)(zhu)(zhu)任(ren)(ren)(ren)(ren)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)官(guan)依法(fa)獨立履行檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)權(quan)是關健,也是主(zhu)(zhu)(zhu)任(ren)(ren)(ren)(ren)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)官(guan)辦案(an)責任(ren)(ren)(ren)(ren)制試點(dian)工(gong)作取得成效的(de)保(bao)障。對主(zhu)(zhu)(zhu)任(ren)(ren)(ren)(ren)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)官(guan)素質(zhi)問題,必(bi)須(xu)(xu)明(ming)確(que)主(zhu)(zhu)(zhu)任(ren)(ren)(ren)(ren)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)官(guan)素質(zhi)要(yao)求肯定要(yao)高于(yu)一般檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)官(guan),同時也要(yao)提高主(zhu)(zhu)(zhu)任(ren)(ren)(ren)(ren)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)官(guan)的(de)政治、經(jing)(jing)(jing)濟待遇(yu)和職(zhi)業(ye)(ye)榮譽感,充分體(ti)(ti)現責、權(quan)、利的(de)統一。所以,主(zhu)(zhu)(zhu)任(ren)(ren)(ren)(ren)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)官(guan)的(de)任(ren)(ren)(ren)(ren)職(zhi)資格(ge)必(bi)須(xu)(xu)體(ti)(ti)現上(shang)(shang)述要(yao)求,不同地區(qu)(qu)可根據(ju)具(ju)(ju)(ju)體(ti)(ti)情(qing)況(kuang)設置,如《上(shang)(shang)海主(zhu)(zhu)(zhu)任(ren)(ren)(ren)(ren)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)官(guan)辦案(an)責任(ren)(ren)(ren)(ren)制改(gai)革試點(dian)實(shi)施方案(an)》要(yao)求主(zhu)(zhu)(zhu)任(ren)(ren)(ren)(ren)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)官(guan)應(ying)該(gai)具(ju)(ju)(ju)有(you)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)員身(shen)(shen)份(fen)(fen),具(ju)(ju)(ju)有(you)十年以上(shang)(shang)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)工(gong)作經(jing)(jing)(jing)歷或具(ju)(ju)(ju)有(you)市級以上(shang)(shang)“三優一能”等(deng)業(ye)(ye)務能手(shou)稱號(hao)。重(zhong)慶市渝中區(qu)(qu)院要(yao)求主(zhu)(zhu)(zhu)任(ren)(ren)(ren)(ren)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)官(guan)必(bi)須(xu)(xu)具(ju)(ju)(ju)有(you)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)員身(shen)(shen)份(fen)(fen),重(zhong)慶市渝北區(qu)(qu)院和武隆縣院根據(ju)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)官(guan)隊伍(wu)實(shi)際,規定特別(bie)優秀(xiu)的(de)助理檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)員也可選任(ren)(ren)(ren)(ren)主(zhu)(zhu)(zhu)任(ren)(ren)(ren)(ren)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)官(guan)。筆者認為(wei),主(zhu)(zhu)(zhu)任(ren)(ren)(ren)(ren)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)官(guan)起碼(ma)應(ying)該(gai)具(ju)(ju)(ju)有(you)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)員身(shen)(shen)份(fen)(fen),具(ju)(ju)(ju)有(you)五年以上(shang)(shang)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)(cha)業(ye)(ye)務工(gong)作經(jing)(jing)(jing)歷。

目(mu)(mu)前(qian),造(zao)成檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)官(guan)(guan)(guan)人數(shu)(shu)過(guo)多的(de)(de)原因是(shi):現在(zai)各級院的(de)(de)新(xin)近(jin)人員(yuan),只要(yao)通(tong)過(guo)了司法(fa)考(kao)試,達到(dao)一(yi)定工作(zuo)年限(一(yi)般是(shi)兩年),就任(ren)(ren)命為(wei)(wei)助理檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)員(yuan),這主要(yao)是(shi)為(wei)(wei)了解(jie)(jie)決(jue)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)官(guan)(guan)(guan)等級問題(ti),也就是(shi)解(jie)(jie)決(jue)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)官(guan)(guan)(guan)等級津貼問題(ti)。但是(shi),最高人民檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)院于2011年7月起就不再評定檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)官(guan)(guan)(guan)等級了,將建立新(xin)的(de)(de)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)官(guan)(guan)(guan)等級制度。個人建議(yi),今后,即(ji)使通(tong)過(guo)了司法(fa)考(kao)試的(de)(de)人員(yuan),也沒有必要(yao)任(ren)(ren)命為(wei)(wei)助理檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)員(yuan)(達到(dao)逐步消化現有檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)官(guan)(guan)(guan)數(shu)(shu)量的(de)(de)目(mu)(mu)的(de)(de)),可(ke)(ke)以先任(ren)(ren)命為(wei)(wei)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)官(guan)(guan)(guan)助理,在(zai)有了主任(ren)(ren)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)官(guan)(guan)(guan)職數(shu)(shu)后,通(tong)過(guo)一(yi)定的(de)(de)選拔(ba)程序,晉升為(wei)(wei)主任(ren)(ren)檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)官(guan)(guan)(guan)。至于這種意(yi)見與現有法(fa)律存在(zai)沖突的(de)(de)問題(ti),可(ke)(ke)以通(tong)過(guo)修改法(fa)律(檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)官(guan)(guan)(guan)法(fa)和人民檢(jian)(jian)(jian)(jian)察(cha)(cha)(cha)院組織法(fa))來(lai)解(jie)(jie)決(jue),因為(wei)(wei)改革(ge)本身就應該對現有法(fa)律作(zuo)適當修改,不然改革(ge)就失去其意(yi)義了。
三、關于(yu)主(zhu)任檢(jian)察官的員(yuan)額問題(ti)
實(shi)行(xing)主(zhu)(zhu)任(ren)檢(jian)察(cha)(cha)官(guan)員(yuan)額制,有人(ren)認為會阻擋部(bu)分年(nian)輕人(ren)的(de)晉(jin)升渠道,影響他們的(de)進取心。其實(shi),主(zhu)(zhu)任(ren)檢(jian)察(cha)(cha)官(guan)員(yuan)額制,本身(shen)不是問題,關鍵是第一次(ci)實(shi)行(xing)主(zhu)(zhu)任(ren)檢(jian)察(cha)(cha)官(guan)員(yuan)額制,一定要(yao)(yao)嚴(yan)格(ge)主(zhu)(zhu)任(ren)檢(jian)察(cha)(cha)官(guan)資格(ge)標(biao)準,不能濫竽充數,要(yao)(yao)寧缺毋濫。同時要(yao)(yao)實(shi)行(xing)主(zhu)(zhu)任(ren)檢(jian)察(cha)(cha)官(guan)淘汰制,這才能給(gei)檢(jian)察(cha)(cha)官(guan)助理留出晉(jin)升空(kong)間。
目前,高檢(jian)院規定的(de)主(zhu)(zhu)任(ren)(ren)(ren)檢(jian)察官(guan)員額不超過所有(you)檢(jian)察官(guan)(助(zhu)理檢(jian)察員以上人員)人數的(de)三分之一,各地基本(ben)是按照這一比例執行的(de)。但在配置主(zhu)(zhu)任(ren)(ren)(ren)檢(jian)察官(guan)工作(zuo)中,存在以下問題(ti):一是個(ge)別單位(wei)過分強(qiang)調主(zhu)(zhu)任(ren)(ren)(ren)檢(jian)察官(guan)資歷,變(bian)相論資排輩(bei),致使同一個(ge)單位(wei)內部主(zhu)(zhu)任(ren)(ren)(ren)檢(jian)察官(guan)素質差(cha)異大(da);二是不重視(shi)資歷和經(jing)驗,致使選拔的(de)個(ge)別主(zhu)(zhu)任(ren)(ren)(ren)檢(jian)察官(guan)能(neng)力不過硬,不能(neng)服眾;第(di)三,不承(cheng)擔辦案工作(zuo)的(de)主(zhu)(zhu)任(ren)(ren)(ren)檢(jian)察官(guan)較(jiao)多,影響辦案工作(zuo)。個(ge)人建議(yi):
(一)選任主任檢察官要做到(dao)寧缺毋濫
目前,基層(ceng)檢察(cha)院(yuan)(yuan)普遍是年輕人多,雖然學歷(li)都很高(gao),但(dan)工(gong)作(zuo)經歷(li)較短,業務工(gong)作(zuo)經驗缺乏。在這種(zhong)情況下,個別院(yuan)(yuan)為了解決(jue)職級(ji)問題,不(bu)管條件是否成熟(shu),全額(e)配足或(huo)大量配設主(zhu)任(ren)檢察(cha)官(guan),致使(shi)個別主(zhu)任(ren)檢察(cha)官(guan)與同(tong)齡同(tong)事(shi)(shi)相比(bi)任(ren)職優勢并不(bu)太明顯,擔任(ren)主(zhu)任(ren)檢察(cha)官(guan)不(bu)能服眾(zhong),這就會影響其它同(tong)齡同(tong)事(shi)(shi)的積極性。
(二(er))解決主任(ren)檢察官的內(nei)部配(pei)置問題
主(zhu)(zhu)任檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)內(nei)部配(pei)置問題中(zhong)(zhong)(zhong)最(zui)難(nan)解決的(de)(de)就是(shi)目前(qian)檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)機關(guan)內(nei)部領導(dao)職(zhi)(zhi)數太多(duo)。比如(ru)一(yi)個60人(ren)(ren)(ren)(ren)(ren)的(de)(de)中(zhong)(zhong)(zhong)等(deng)規模(mo)檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)院(yuan),主(zhu)(zhu)任檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)應(ying)該配(pei)備20人(ren)(ren)(ren)(ren)(ren)左右(you),其(qi)中(zhong)(zhong)(zhong),檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)長(chang)(1人(ren)(ren)(ren)(ren)(ren))、副檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)長(chang)(3人(ren)(ren)(ren)(ren)(ren))、專委(1-2人(ren)(ren)(ren)(ren)(ren))就要占(zhan)5人(ren)(ren)(ren)(ren)(ren)以上(shang),如(ru)果(guo)紀(ji)檢(jian)(jian)組(zu)(zu)長(chang)、政治處主(zhu)(zhu)任是(shi)檢(jian)(jian)委會成員(yuan),還要增(zeng)加2人(ren)(ren)(ren)(ren)(ren),也就是(shi)7人(ren)(ren)(ren)(ren)(ren),占(zhan)20人(ren)(ren)(ren)(ren)(ren)的(de)(de)35%。另外的(de)(de)13人(ren)(ren)(ren)(ren)(ren)如(ru)何設(she)(she)置呢?設(she)(she)想方案(an):偵監2人(ren)(ren)(ren)(ren)(ren),公訴4人(ren)(ren)(ren)(ren)(ren),職(zhi)(zhi)偵3人(ren)(ren)(ren)(ren)(ren),民行1人(ren)(ren)(ren)(ren)(ren),控申1人(ren)(ren)(ren)(ren)(ren),檢(jian)(jian)委會辦(ban)(ban)事(shi)機構(案(an)管中(zhong)(zhong)(zhong)心或研究室)1人(ren)(ren)(ren)(ren)(ren),監所1人(ren)(ren)(ren)(ren)(ren)。如(ru)果(guo)這樣,除了(le)現有的(de)(de)局(ju)長(chang)、科(ke)長(chang)轉任主(zhu)(zhu)任檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan),其(qi)他檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)就只(zhi)(zhi)能(neng)任檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)助理了(le),改(gai)(gai)革就沒(mei)有實際(ji)意(yi)義了(le)。所以,筆者認(ren)為,必須改(gai)(gai)革現有領導(dao)體制,建(jian)議基(ji)層檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)院(yuan)設(she)(she)檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)長(chang)1人(ren)(ren)(ren)(ren)(ren),只(zhi)(zhi)設(she)(she)副檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)長(chang)1人(ren)(ren)(ren)(ren)(ren)(負責(ze)(ze)日(ri)常管理工作),不設(she)(she)部門(men)負責(ze)(ze)人(ren)(ren)(ren)(ren)(ren)(其(qi)只(zhi)(zhi)占(zhan)職(zhi)(zhi)數,一(yi)般都不辦(ban)(ban)案(an)或少辦(ban)(ban)案(an)),根據業務需要設(she)(she)置若干主(zhu)(zhu)任檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)辦(ban)(ban)案(an)組(zu)(zu),直接(jie)對檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)長(chang)負責(ze)(ze),紀(ji)檢(jian)(jian)組(zu)(zu)長(chang)、政治處主(zhu)(zhu)任不納(na)入主(zhu)(zhu)任檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)序列。這樣,一(yi)線辦(ban)(ban)案(an)的(de)(de)主(zhu)(zhu)任檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)官(guan)(guan)就更多(duo)了(le),這才能(neng)突出檢(jian)(jian)察(cha)(cha)(cha)(cha)(cha)(cha)機關(guan)的(de)(de)司(si)法屬性,這才是(shi)司(si)法改(gai)(gai)革的(de)(de)目的(de)(de)。

四、關于(yu)主任檢察官的監督問題
“為了(le)保證主(zhu)任(ren)(ren)檢(jian)察(cha)(cha)(cha)(cha)(cha)官(guan)(guan)一定的相對獨立性,特別應當處理好對其(qi)履(lv)(lv)職(zhi)監(jian)督(du)問題,尤其(qi)是在檢(jian)察(cha)(cha)(cha)(cha)(cha)官(guan)(guan)整體素質(zhi)不(bu)(bu)高、執法(fa)(fa)環境不(bu)(bu)優(you)、司法(fa)(fa)腐敗(bai)多發(fa)易發(fa)、司法(fa)(fa)保障與問責(ze)機制(zhi)均不(bu)(bu)健全的當下。……在厘清主(zhu)任(ren)(ren)檢(jian)察(cha)(cha)(cha)(cha)(cha)官(guan)(guan)職(zhi)權(quan)(quan)邊界的同(tong)時(shi),建立責(ze)權(quan)(quan)配套的工作(zuo)機制(zhi),使主(zhu)任(ren)(ren)檢(jian)察(cha)(cha)(cha)(cha)(cha)官(guan)(guan)有(you)權(quan)(quan)必有(you)責(ze),用權(quan)(quan)受監(jian)督(du)”③。檢(jian)察(cha)(cha)(cha)(cha)(cha)機關作(zuo)為法(fa)(fa)律(lv)監(jian)督(du)機關,在履(lv)(lv)行法(fa)(fa)律(lv)監(jian)督(du)職(zhi)能的同(tong)時(shi),對檢(jian)察(cha)(cha)(cha)(cha)(cha)機關行使職(zhi)權(quan)(quan)的活動也(ye)應該有(you)比較完善的外部和內部監(jian)督(du)制(zhi)約機制(zhi),加強對主(zhu)任(ren)(ren)檢(jian)察(cha)(cha)(cha)(cha)(cha)官(guan)(guan)執法(fa)(fa)辦(ban)案的監(jian)督(du)制(zhi)約是確保改革試點取得成效的必然之舉,渝北(bei)區(qu)院在主(zhu)任(ren)(ren)檢(jian)察(cha)(cha)(cha)(cha)(cha)官(guan)(guan)監(jian)督(du)制(zhi)約方面進行了(le)如(ru)下探(tan)索(suo):
(一)創新內(nei)部監督(du)制約(yue)機(ji)制
一是加強檢(jian)(jian)(jian)(jian)(jian)察(cha)長(chang)、檢(jian)(jian)(jian)(jian)(jian)委(wei)(wei)會(hui)對(dui)執法(fa)辦案(an)(an)(an)(an)活動的領導和監督。檢(jian)(jian)(jian)(jian)(jian)察(cha)長(chang)、分管副(fu)檢(jian)(jian)(jian)(jian)(jian)察(cha)長(chang)定(ding)期檢(jian)(jian)(jian)(jian)(jian)查主任(ren)檢(jian)(jian)(jian)(jian)(jian)察(cha)官辦案(an)(an)(an)(an)組織的工(gong)作,可以(yi)指令主任(ren)檢(jian)(jian)(jian)(jian)(jian)察(cha)官匯報某一案(an)(an)(an)(an)件(jian)或(huo)一段時間(jian)內(nei)的辦案(an)(an)(an)(an)情況。對(dui)于疑(yi)難、復雜和有重大社會(hui)影響的案(an)(an)(an)(an)件(jian)以(yi)及對(dui)主任(ren)檢(jian)(jian)(jian)(jian)(jian)察(cha)官作出的案(an)(an)(an)(an)件(jian)處理決定(ding)有不同意見的案(an)(an)(an)(an)件(jian),檢(jian)(jian)(jian)(jian)(jian)察(cha)長(chang)可直接作出決定(ding)或(huo)提交檢(jian)(jian)(jian)(jian)(jian)委(wei)(wei)會(hui)討論(lun)決定(ding)。必要時,檢(jian)(jian)(jian)(jian)(jian)察(cha)長(chang)可以(yi)更換(huan)辦案(an)(an)(an)(an)主任(ren)檢(jian)(jian)(jian)(jian)(jian)察(cha)官。
二是創新業務部門負(fu)責人監督制(zhi)約機制(zhi)。部門負(fu)責人不(bu)再審核(he)主任(ren)(ren)檢察(cha)官案(an)件所辦(ban)案(an)件,但可(ke)以(yi)(yi)通過主任(ren)(ren)檢察(cha)官聯席會議(yi)制(zhi)度,適時討論重大疑難案(an)件以(yi)(yi)及證據審查(cha)標準和執法尺度,定期分析各(ge)辦(ban)案(an)組織辦(ban)理案(an)件的(de)質量和效果,達到監督目的(de)。必要時,部門負(fu)責人也可(ke)以(yi)(yi)建議(yi)更換辦(ban)案(an)主任(ren)(ren)檢察(cha)官。
三(san)是創新案(an)件(jian)(jian)管理(li)部(bu)門(men)(men)日(ri)常(chang)管理(li)機制。1、強化(hua)辦(ban)案(an)流程監(jian)(jian)督(du)。案(an)件(jian)(jian)管理(li)部(bu)門(men)(men)以(yi)案(an)件(jian)(jian)受理(li)、分流、立案(an)、拘留、批捕、、抗(kang)訴、減刑等(deng)環節(jie)為關(guan)鍵節(jie)點,加強流程管理(li)和節(jie)點控制,完善預警管理(li)機制,對重(zhong)(zhong)大疑(yi)難復雜案(an)件(jian)(jian),對辦(ban)案(an)全程進行(xing)動態監(jian)(jian)督(du)。2、認(ren)真執(zhi)行(xing)案(an)件(jian)(jian)質量定期(qi)評(ping)查(cha)和通(tong)報制度(du)以(yi)及執(zhi)法(fa)過(guo)錯(cuo)責任追究制度(du)。3、重(zhong)(zhong)點通(tong)過(guo)三(san)書(意(yi)見書、書、判決書)對比(bi)審(shen)查(cha)方式對實體辦(ban)案(an)進行(xing)事(shi)后評(ping)價。
四是嚴格執行(xing)紀(ji)律(lv)檢(jian)查各項制度(du)。紀(ji)檢(jian)監察(cha)部(bu)門對主任檢(jian)察(cha)官(guan)遵守檢(jian)察(cha)職(zhi)業道德和職(zhi)業紀(ji)律(lv)的(de)情(qing)況進(jin)行(xing)監督(du)。對涉及徇私枉(wang)法、、執法不公等行(xing)為的(de)舉報反映進(jin)行(xing)調(diao)查處理,確保主任檢(jian)察(cha)官(guan)依法行(xing)使職(zhi)權。
五是建立主(zhu)任(ren)檢(jian)(jian)察官執法(fa)檔案(an)。建立健全(quan)主(zhu)任(ren)檢(jian)(jian)察官的執法(fa)質(zhi)量(liang)、執法(fa)作風(feng)、執法(fa)紀律進(jin)行檢(jian)(jian)查、督察、考核、評議所形成的各種客觀資料檔案(an),落實(shi)辦案(an)質(zhi)量(liang)和(he)責任(ren)終身制。
(二)進(jin)一步自覺接(jie)受人大監督(du)
渝北區院根據《監督法》規定,進一步完善了接受人大及其常委會監督的工作機制, 嚴格執行向人大常委會進行專項工作報告的制度(du),接(jie)受人(ren)大常(chang)委(wei)會(hui)(hui)執(zhi)法(fa)檢查(cha)工(gong)作制度(du),接(jie)受詢問和(he)質詢的工(gong)作制度(du)。開(kai)通“渝北檢察”微(wei)博、微(wei)信、手機報及互聯(lian)網站(zhan)手機版,打造“掌上檢察”,進一步加強(qiang)與人(ren)大代表和(he)人(ren)民(min)群眾的聯(lian)系(xi), 認真聽取意見、批評(ping)和(he)建議。邀(yao)請人(ren)大代表、政(zheng)協委(wei)員參加案件聽庭(ting)評(ping)議和(he)執(zhi)法(fa)檢查(cha),聽取對執(zhi)法(fa)辦案的監督意見。根據(ju)人(ren)大常(chang)委(wei)會(hui)(hui)安排(pai),每年抽選(xuan)兩(liang)名以上主(zhu)任檢察官向區(qu)人(ren)大常(chang)委(wei)會(hui)(hui)述職。
(三)深化(hua)人民監督(du)員制度
孟(meng)建柱說:“人民陪審員制度是人民群眾(zhong)依(yi)法(fa)參與和監督(du)司法(fa)的最(zui)重要、最(zui)直(zhi)接(jie)的形式”。渝北區院根據上級(ji)院的有關(guan)規定,作(zuo)了如下探索:
1、創新人民監督員接待日制度
堅持每月固定一(yi)天(tian)在控(kong)申接待(dai)大(da)廳設(she)置(zhi)(zhi)人民(min)監督(du)員(yuan)專(zhuan)屬接待(dai)窗口,由人民(min)監督(du)員(yuan)接待(dai)來訪群眾,受(shou)理監督(du)線索。同時,以控(kong)申接待(dai)窗口規范(fan)化建設(she)專(zhuan)項活動(dong)(dong)為(wei)契(qi)機,規范(fan)設(she)置(zhi)(zhi)人民(min)監督(du)員(yuan)制度(du)公(gong)告欄,向(xiang)來訪群眾廣為(wei)宣傳人民(min)監督(du)員(yuan)監督(du)的范(fan)圍及啟(qi)動(dong)(dong)監督(du)的程序等(deng),進一(yi)步擴(kuo)大(da)人民(min)監督(du)員(yuan)制度(du)的社(she)會影響力(li)。
2、創新人民監督(du)告知制度
在辦(ban)理(li)直接受(shou)理(li)立案(an)偵(zhen)查(cha)案(an)件(jian)過程中,采取發放“人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)監(jian)(jian)督(du)(du)(du)告(gao)(gao)知(zhi)卡”等形式,同(tong)步(bu)做(zuo)好(hao)人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)監(jian)(jian)督(du)(du)(du)告(gao)(gao)知(zhi)工作(zuo),主動向犯(fan)(fan)(fan)罪(zui)(zui)嫌(xian)疑(yi)(yi)人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)及其家屬(shu)(shu)、辯(bian)(bian)護(hu)人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)告(gao)(gao)知(zhi)人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)監(jian)(jian)督(du)(du)(du)員監(jian)(jian)督(du)(du)(du)的范圍及申請(qing)監(jian)(jian)督(du)(du)(du)的途徑等人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)監(jian)(jian)督(du)(du)(du)事(shi)(shi)項(xiang)(xiang)。職(zhi)務(wu)犯(fan)(fan)(fan)罪(zui)(zui)偵(zhen)查(cha)部(bu)(bu)門(men)(men)原則(ze)上要(yao)在作(zuo)出(chu)立案(an)決定后15日(ri)內,向犯(fan)(fan)(fan)罪(zui)(zui)嫌(xian)疑(yi)(yi)人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)告(gao)(gao)知(zhi)人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)監(jian)(jian)督(du)(du)(du)事(shi)(shi)項(xiang)(xiang);犯(fan)(fan)(fan)罪(zui)(zui)嫌(xian)疑(yi)(yi)人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)被采取強(qiang)制措施的,職(zhi)務(wu)犯(fan)(fan)(fan)罪(zui)(zui)偵(zhen)查(cha)部(bu)(bu)門(men)(men)在送(song)達(da)家屬(shu)(shu)通知(zhi)書的同(tong)時(shi)要(yao)告(gao)(gao)知(zhi)家屬(shu)(shu)人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)監(jian)(jian)督(du)(du)(du)事(shi)(shi)項(xiang)(xiang);犯(fan)(fan)(fan)罪(zui)(zui)嫌(xian)疑(yi)(yi)人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)在偵(zhen)查(cha)、審查(cha)逮捕、審查(cha)等訴(su)訟(song)環(huan)節委(wei)托有(you)(you)辯(bian)(bian)護(hu)人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)的,案(an)件(jian)管理(li)部(bu)(bu)門(men)(men)在收到辯(bian)(bian)護(hu)委(wei)托手續(xu)時(shi)要(yao)告(gao)(gao)知(zhi)辯(bian)(bian)護(hu)人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)監(jian)(jian)督(du)(du)(du)事(shi)(shi)項(xiang)(xiang)。在進(jin)行人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)監(jian)(jian)督(du)(du)(du)告(gao)(gao)知(zhi)過程中,犯(fan)(fan)(fan)罪(zui)(zui)嫌(xian)疑(yi)(yi)人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)及其家屬(shu)(shu)、辯(bian)(bian)護(hu)人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)提出(chu)申請(qing)人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)監(jian)(jian)督(du)(du)(du)員監(jian)(jian)督(du)(du)(du)的,負責告(gao)(gao)知(zhi)的部(bu)(bu)門(men)(men)應做(zuo)好(hao)記錄,并及時(shi)將(jiang)有(you)(you)關(guan)材料移交本院人(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)監(jian)(jian)督(du)(du)(du)工作(zuo)部(bu)(bu)門(men)(men)處理(li)。
3、創新人民監督員監督信息通報制度
主(zhu)動(dong)(dong)向人(ren)民(min)監(jian)(jian)(jian)督(du)(du)員(yuan)通報屬于(yu)人(ren)民(min)監(jian)(jian)(jian)督(du)(du)員(yuan)監(jian)(jian)(jian)督(du)(du)范圍內(nei)(nei)的(de)(de)控告(gao)申訴。控申部門(men)(men)在(zai)處(chu)理(li)(li)來信來訪、統(tong)一受理(li)(li)控告(gao)申訴過程中,對涉及人(ren)民(min)監(jian)(jian)(jian)督(du)(du)員(yuan)監(jian)(jian)(jian)督(du)(du)情形的(de)(de)相(xiang)關控告(gao)申訴材料(liao)要在(zai)受理(li)(li)后7日內(nei)(nei)向本(ben)院人(ren)民(min)監(jian)(jian)(jian)督(du)(du)工(gong)作(zuo)部門(men)(men)通報。人(ren)民(min)監(jian)(jian)(jian)督(du)(du)工(gong)作(zuo)部門(men)(men)對相(xiang)關材料(liao)要及時審查(cha)匯(hui)總(zong),并(bing)報檢察長審核同意后,按月向本(ben)轄區內(nei)(nei)人(ren)民(min)監(jian)(jian)(jian)督(du)(du)員(yuan)通報。人(ren)民(min)監(jian)(jian)(jian)督(du)(du)員(yuan)在(zai)聽(ting)取通報后,提出啟動(dong)(dong)人(ren)民(min)監(jian)(jian)(jian)督(du)(du)程序意見的(de)(de),由人(ren)民(min)監(jian)(jian)(jian)督(du)(du)工(gong)作(zuo)部門(men)(men)負責處(chu)理(li)(li)。
(四)深化檢務(wu)公開制度
孟建柱(zhu)說:“陽光是(shi)最好(hao)的防腐(fu)劑”。深(shen)化司(si)(si)法(fa)(fa)公(gong)(gong)(gong)開,讓司(si)(si)法(fa)(fa)權力(li)在陽光下(xia)運行,有(you)利于(yu)保障公(gong)(gong)(gong)眾對(dui)(dui)司(si)(si)法(fa)(fa)工作(zuo)的知情權,增強有(you)效監督,促進司(si)(si)法(fa)(fa)公(gong)(gong)(gong)正,提高(gao)司(si)(si)法(fa)(fa)能力(li),樹立司(si)(si)法(fa)(fa)公(gong)(gong)(gong)信,提高(gao)人民群眾對(dui)(dui)司(si)(si)法(fa)(fa)工作(zuo)的滿意度(du)。渝北區(qu)院在深(shen)化檢務公(gong)(gong)(gong)開方面作(zuo)了如(ru)下(xia)探索(suo):
1、嚴格落實執法辦案告知制度
執(zhi)法(fa)(fa)辦案告知(zhi)(zhi)(zhi)制度是司法(fa)(fa)程(cheng)序(xu)中(zhong)的法(fa)(fa)定(ding)公開環(huan)節,嚴格落實(shi)好法(fa)(fa)定(ding)的訴(su)訟權利(li)義(yi)務(wu)告知(zhi)(zhi)(zhi),嚴格依法(fa)(fa)向(xiang)舉報(bao)(bao)、偵查(cha)、逮捕、、申訴(su)等(deng)各個環(huan)節的舉報(bao)(bao)人(ren)(ren)、犯(fan)(fan)罪(zui)嫌疑(yi)人(ren)(ren)、被告人(ren)(ren)、證(zheng)人(ren)(ren)、被害人(ren)(ren)、申訴(su)人(ren)(ren),以(yi)及律(lv)師、人(ren)(ren)告知(zhi)(zhi)(zhi)權利(li)義(yi)務(wu)。同時(shi),本著(zhu)公開透明(ming)的要(yao)求,將執(zhi)法(fa)(fa)辦案中(zhong)的相關信息告知(zhi)(zhi)(zhi)有關當事人(ren)(ren),如職務(wu)犯(fan)(fan)罪(zui)案件查(cha)封、扣押(ya)、凍結(jie)涉案財物處理結(jie)果,超期羈押(ya)和(he)違法(fa)(fa)或不當減刑、假釋、暫予(yu)監外執(zhi)行的監督糾(jiu)正情況(kuang)等(deng)。
2、規范完善案件流程(cheng)公開查詢機制
依托“陽光(guang)檢務”網(wang)絡平臺,主動公開(kai)訴訟(song)期限、辦案(an)流程、處(chu)理情況等信息,根據訴訟(song)參與人的申請(qing),有(you)針對性公開(kai)其他信息。案(an)件管理部門按(an)照規范性要求,適時將案(an)件流程信息予(yu)以公開(kai),方(fang)便社會公開(kai)查詢。
3、推(tui)進(jin)案(an)件公(gong)開審查、公(gong)開答(da)復機制
根據上(shang)級院推進(jin)案(an)件公開(kai)審查(cha)、公開(kai)答復制(zhi)度(du)的部(bu)署,對符合(he)公開(kai)審查(cha)、公開(kai)答復條件的案(an)件,結(jie)合(he)實際,認真(zhen)組織推進(jin)落(luo)實。
4、探索終結性(xing)法律文書公開機(ji)制
孟建(jian)柱說(shuo)(shuo):“要(yao)大力推進(jin)檢(jian)務公(gong)開。建(jian)立(li)(li)不(bu)立(li)(li)案、不(bu)逮(dai)捕(bu)、不(bu)、不(bu)予提起抗(kang)訴(su)決(jue)定書(shu)(shu)等檢(jian)察(cha)機(ji)關(guan)(guan)終結性(xing)法(fa)(fa)律(lv)(lv)文(wen)(wen)書(shu)(shu)公(gong)開制(zhi)度,增強(qiang)法(fa)(fa)律(lv)(lv)文(wen)(wen)書(shu)(shu)說(shuo)(shuo)理(li)性(xing)”。建(jian)立(li)(li)檢(jian)察(cha)機(ji)關(guan)(guan)終結性(xing)法(fa)(fa)律(lv)(lv)文(wen)(wen)書(shu)(shu)公(gong)開制(zhi)度,是中央(yang)深(shen)化司法(fa)(fa)體(ti)制(zhi)改革的(de)要(yao)求,對(dui)于檢(jian)察(cha)機(ji)關(guan)(guan)依(yi)法(fa)(fa)公(gong)正(zheng)行使自由裁量權、增強(qiang)法(fa)(fa)律(lv)(lv)文(wen)(wen)書(shu)(shu)的(de)說(shuo)(shuo)理(li)性(xing)具有十(shi)分重要(yao)的(de)現實意義。在“陽光檢(jian)務”網絡平臺上開設檢(jian)察(cha)文(wen)(wen)書(shu)(shu)公(gong)開平臺,探索對(dui)法(fa)(fa)院已(yi)作出生效(xiao)判決(jue)案件(jian)的(de)書(shu)(shu),檢(jian)察(cha)機(ji)關(guan)(guan)作出的(de)不(bu)立(li)(li)案、不(bu)逮(dai)捕(bu)、不(bu)決(jue)定書(shu)(shu)、抗(kang)訴(su)請求答復(fu)書(shu)(shu)、刑事申訴(su)復(fu)查通知(zhi)書(shu)(shu),民事行政檢(jian)察(cha)不(bu)支持監(jian)督申請決(jue)定書(shu)(shu)進(jin)行主(zhu)動公(gong)開;對(dui)實名舉報線(xian)索的(de)不(bu)立(li)(li)案決(jue)定書(shu)(shu)依(yi)當事人申請予以公(gong)開。
(五)探索、完善內部監(jian)督制約與外部監(jian)督工作鏈接機制
1、進一步完善案件回訪機制
除了對(dui)本院辦(ban)結的自偵案(an)(an)(an)件(jian)(jian)進行(xing)回訪外(wai),還(huan)對(dui)其它重(zhong)大(da)、復雜案(an)(an)(an)件(jian)(jian),有(you)嚴重(zhong)社(she)會(hui)影(ying)響的刑(xing)事案(an)(an)(an)件(jian)(jian)進行(xing)回訪監督。紀(ji)(ji)檢監察部門(men)通過回訪,征(zheng)求社(she)會(hui)各界、發案(an)(an)(an)單位(wei)或與案(an)(an)(an)件(jian)(jian)當事人有(you)關(guan)人員、抽查案(an)(an)(an)卷等對(dui)辦(ban)案(an)(an)(an)人員嚴格、公正(zheng)、文(wen)明(ming)、廉(lian)潔辦(ban)案(an)(an)(an)及執行(xing)辦(ban)案(an)(an)(an)紀(ji)(ji)律和有(you)關(guan)規定的情況。
2、進一步加強與其它部門的(de)走(zou)訪聯(lian)系
紀檢監察部門和案件管理部門通過明察暗訪,走訪人大、政協(xie)、公安、法院、司法局(律協(xie))等單位,對(dui)主任(ren)檢察官(guan)執法辦案的(de)質(zhi)量和效率(lv)進行監督(du),對(dui)督(du)查(cha)發現(xian)的(de)傾向性問題進行通報、督(du)促整改(gai)。
3、探索執法(fa)辦案(an)評價公(gong)開(kai),以(yi)公(gong)開(kai)促(cu)規(gui)范(fan)
把(ba)人(ren)(ren)(ren)民群眾是否滿意(yi)作為(wei)(wei)檢(jian)驗檢(jian)察(cha)(cha)工作的重要標準,探(tan)索(suo)建(jian)立(li)群眾滿意(yi)度收(shou)(shou)集(ji)(ji)考(kao)評(ping)機制,加強對(dui)檢(jian)察(cha)(cha)人(ren)(ren)(ren)員執(zhi)法(fa)辦(ban)(ban)案(an)(an)活動(dong)的監(jian)督,通過(guo)執(zhi)法(fa)辦(ban)(ban)案(an)(an)評(ping)價公開推進執(zhi)法(fa)規范,深化執(zhi)法(fa)為(wei)(wei)民。分別(bie)在(zai)(zai)一些場所等地設置檢(jian)察(cha)(cha)意(yi)見箱(xiang),在(zai)(zai)官(guan)方(fang)網站建(jian)立(li)意(yi)見收(shou)(shou)集(ji)(ji)專欄,由紀檢(jian)監(jian)察(cha)(cha)部門(men)定時收(shou)(shou)集(ji)(ji)匯(hui)總、調查核實意(yi)見。在(zai)(zai)執(zhi)法(fa)辦(ban)(ban)案(an)(an)重點關(guan)鍵(jian)環節分別(bie)設計并發放《意(yi)見表》,由當事人(ren)(ren)(ren)、辯護(hu)人(ren)(ren)(ren)或訴訟人(ren)(ren)(ren)、來訪人(ren)(ren)(ren)、第三方(fang)社會人(ren)(ren)(ren)士等在(zai)(zai)每(mei)次的訊(詢(xun))問、接待、聽證結束(shu)后(hou),對(dui)辦(ban)(ban)案(an)(an)人(ren)(ren)(ren)員執(zhi)法(fa)行(xing)為(wei)(wei)作風提(ti)出意(yi)見,作出評(ping)價,考(kao)評(ping)結果記(ji)入(ru)主任(ren)檢(jian)察(cha)(cha)官(guan)執(zhi)法(fa)檔案(an)(an)。
